SAN JUAN COUNTY COMMISSION MINUTES SEPTEMBER 26, 1988

The regular meeting of the San Juan County Commission convened at 10:00 A.M. in the San Juan County Courthouse at Monticello, Utah.

A motion to approve the minutes of September 19, 1988 was made by Commissioner Mark Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

COMMISSIONER CALVIN BLACK'S REPORT

Executive Session - Commissioner Bailey made a motion to suspend the regular session of the San Juan County Commission and go into an executive session to discuss personnel matters and issues pertinent to the public meeting to be held in Bluff on Wednesday evening. Commissioner Maryboy seconded the motion. UNANIMOUS.

A motion to return to the regular session of the San Juan County Commission was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

County Roads - Commissioner Black reported on several roads that need attention in the Blanding area. The road at the Energy Fuels plant has some large pot holes. The road from Red Mesa to Todahaidekani needs to have work done on the wash board conditions as does the road to TeecNosPos from Red Mesa. The road from Hovenweep by Black Steer Canyon has had some damage and needs work done on part of it. The race track road also needs to have crushed gravel put on it and the wash board conditions fixed. Commissioner Black would like to have a report made at next weeks monthly road department meeting with the Commission of the road projects completed this year, the ones approved and not as yet completed and recommendations for road projects for the next year or two.

Translator Site Fees - Commissioner Black reported previously regarding a resolution passed by the Utah Association of Counties opposing the communication site fees by the Forest Service. The Forest Service has now revised their proposal to allow for public entities to have a waiver from those fees. The resolution opposes the proposed policy on electronic site fees and supports a proposal to provide that such sites must be exempt from any charges for state and local governmental entities. The County provides services to the Forest Service for access to manage County lands and the Commission doesn't believe that charge should be made for providing public services that also are services to the Forest Service. Mr. Black proposed that San Juan County adopt a similar resolution in support of the UAC resolution. Commissioner Bailey made a motion to adopt the resolution and Commissioner Maryboy seconded the motion. UNANIMOUS.

Tax Initiatives - Commissioner Black reported on a Utah Foundation report with respect to the tax initiatives and the impact it would have. The report shows a reduction in San Juan County of over a million dollars, San Juan School District 1.675 million, cities and towns - $63,000, special districts-$109,771, B & C road funds $475,190 for a total impact of 3.3 million dollars.

COMMISSIONER KENNETH BAILEY'S REPORT

Guyman Lane - Commissioner Bailey reported that the pit run being put on Guyman Lane will be finished today and the road department will be griding that the rest of the week. The trucks that have been hauling the pit run will be sent to help on the gravel project being done by Timber Products in the LaSal area. Priorities for the use of the trucks will be discussed at the monthly road meeting next week.

Harts Draw Road/Gravel Crushing - Holliday Construction has moved to the gravel pit in the Harts Draw area and will be crushing gravel there this week. If the pit run needs to be moved an agreement will be made with Mr. Holliday to have his crew move it.

Blanding Road District/Stolen Pickup - Commissioner Bailey reported on the theft of a County road department truck from the County road shed yard at Blanding. The person climbed over the fence, discovered the keys in the glove compartment, and drove the vehicle through the gate. The truck was found later the next day in the White Mesa area. A written report will be requested from the Sheriffs Department.

County Road Foreman - Commissioner Bailey contacted Anthony Brandt regarding the position of County Road Foreman. Mr. Brandt agreed to sell his truck that he has been using to haul materials for the County to avoid a conflict of interest. He will also relocate and move to the Monticello area. A motion to hire Mr. Brandt as County Road Foreman at Grade 20 Step 2, $2,019 per month was made by Commissioner Bailey and seconded by Comnissioner Maryboy. UNANIMOUS.

At the end of ninety days Mr. Brandt will undergo an evaluation and if his work is acceptable, he will be given a one step increase. The Commission discussed and approved some changes to be implemented in the job description of the road foreman.

Green Thumb Employee - Mel Eardley has been working 20 hours per week as a temporary part-time employee for the Green Thumb program with the road department. Bernal Bradford, road foreman for district No. 2, has requested permission to use Mr. Eardley to help with the overlay at Oljato. Commissioner Bailey recommended that, if Mr. Eardley is used, he be paid $3.75 per hour. A motion to approve the request was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

COMMISSIONER MARK MARYBOY'S REPORT

SEUCAP Board Member - Commissioner Maryboy recommended that Edward Topaha be appointed to fill the position that Marsha Keele, a member of the Southeast Utah Community Action Program board, has vacated as she has moved from the area. The matter will be placed on next week's agenda for further discussion.

Reservation Road Report - Commissioner Maryboy met with the Navajo Director of Transportation Charles Henderson while in Window Rock. A report has been prepared on the reservation roads and other

information. The Tribe is also concerned about toxic waste being hauled across the reservation from Blanding. Commissioner Black stated that San Juan County does more for reservation road maintenance and construction than any other county and any other state. He further stated that he was not aware of any waste being hauled from Blanding. Commissioner Bailey will contact Mr. Henderson concerning the report as the Commission feels there are several discrepancies. San Juan County has had a contract with the BIA for road maintenance on the Navajo Reservation within the boundaries of the County. There is also an intergovernmental agreement called the Memorandum of Understanding which was signed by the BIA, Navajo Tribal Chairman, Utah Department of Transportation and San Juan County which provides authority for San Juan County to build and maintain roads on the Navajo Reservation. During the past twenty years San Juan County has spent millions of dollars in construction and maintenance of roads on the reservation for the use and benefit of the Navajo people.

ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT

Montezuma Creek Police Station - A letter has been received from Tri-Hurst Construction Company regarding the Montezuma Creek Police Station remodeling. Tri-Hurst had been awarded the bid for the remodeling but had not had access to the addendum information to formulate their bid. After reviewing the addendums they revised their bid by $600.00. Administrative Assistant Rick Bailey recommended that County Attorney Craig Halls be authorized to draft the contract so that the work can proceed on the remodeling. A motion to approve the recommendation was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Hazardous Materials Plan - After a meeting of the local committee of the hazardous materials plan, the draft of the local participation plan has been sent to the State for their review. The state will check the plan for liability problems and return it for the approval of the Commission.

Health Care Service District - The Commission reviewed the requirements for the establishment of the special service district for health care services prior to the public hearing scheduled for this afternoon. There will be an additional fifteen day period to accept comments. On October 12th a special Commission meeting will be held to either establish or abandon the plan. At that time, if the district is approved, the appointment of the board members will need to be made. However, the issue will still need to be placed on the ballot for the electorate to approve the taxing authority.

Tax Limitation Initiative - A copy of a Deseret News editorial was given to the Commission which opposed the tax limitation initiatives.

Senior Citizens Personnel - Robert Matthews had previously been hired to work approximately 30 hours a week to drive the senior citizens bus and do other related work throughout the County. He has taken another part-time job and will not be available except for driving the bus part of the time. Sylvan Johnson had previously been a bus driver but had resigned to fill an LDS mission. However, his wife's health has not permitted the acceptance of the mission call. Therefore Administrative Assistant Rick Bailey recommended that Mr. Johnson be hired to take total responsibility for the senior citizens vehicles and to do some of the other responsibilities with the Aging Department. A motion to hire Sylvan Johnson at Grade 1 Step 1, $5.12 per hourf was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Administrative Assistant Rick Bailey also reported that Malva Ransdell has completed three months employment with the Aging Department as director of the Monticello Senior Citizens. Since her employment the meal count has doubled and she has done an outstanding job. Mr. Bailey recommended that Mrs. Ransdell be given a probationary raise from $5.33 to $5.55 per hour. A motion to approve the recommendation was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Public Safety Building/Furniture - A letter from Deseret Architects & Engineering recommends that the low bid for the furniture for the Public Safety Building be set aside as their bid reflects substitution of nearly every item on the list. Some of substitutions were approved previously but others were not. When Administrative Assistant Rick Bailey was in Salt Lake City he looked at similar furniture placed at other businesses by the low bidding company as there were no samples available to check. Mr. Bailey also checked on the office furniture specified and bid by Mid-West Office Supply and was very impressed with the quality of the furniture. It is Mr. Bailey's suggestion that the Commission accept the recommendation of Deseret Architects of spending the extra $3,500 to purchased the furniture specified because of the quality of the furniture and the numerous substitutions by the low bidder. A motion to accept the recommendation of Mr. Bailey and Deseret Architects was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

CURRENT BUSINESS

Monticello City Fire Truck - Monticello City Councilman Joe Slade met with the Commission to request support and possible help with funding for the purchase of a new fire truck for Monticello City. The City feels that the present vehicle is inadequate and needs to be replaced before a serious problem is encountered. The present truck, a 1960 Chevrolet, has been repaired several times and the pump has frozen up a couple of times. Contact with the Community Impact Board has indicated the steps necessary to receive funding through that source. The purchase of a new truck would cost approximately $80,000. The City is able to -come up with about $3,000 toward the purchase and is asking for support and some funding from the County as the fire department also responds to needs outside of the city limits. Commissioner Black stated that the County would be glad to give their support but did not know if the funding could be arranged at this time. If such funding were available for Monticello, similar funding would probably be requested from Blanding City also. The Commissioners will consider the request at the time of the County budget hearing in December.

Low-Level Military Flights - A County resident inquired about the flight routes of the low-level military flights being conducted for national security. Since the inception of the fighter planes training on the same routes the noise has increased considerable. The residents of the area are writing to the Utah Congressional Delegation, the Governor and the Pentagon requesting a change of routes. They have been putting up with the flights for over two years and feel someone else should be given that opportunity too.

Courthouse Space - Administrative Assistant Rick Bailey was asked to review the space in the courthouse in view of the fact that when the new Public Safety Building is finished a number of staff and offices will be moving to that building. Requests have already been received from the treasurers office and the recorders office for additional needed space. After consulting with elected officials, Mr. Bailey presented several ideas for discussion. Copies will be made of the suggestions and given to the various offices in the courthouse for their review and recommendations before a final decision is made.

Permits for Burning/Citations - Sheriff Claude Lacy reported that a county resident had called to get a permit to burn on his property. Those individuals responsible for issuing the permits were not available at the time. The individual went ahead and set the fire anyway and it got out of hand requiring assistance from the Monticello fire department and the County fire truck. Sheriff Lacy asked the Commissioners to decide if citations should be issued in such instances. The Commissioners instructed the sheriff to issue citations when the proper permit has not been obtained.

Flag Pole Vandalism/Monticello Library - An individual climbed the flag pole at the Monticello Library and bent it . so that it extends over the roof. It will cost approximately $150 to repair. The Commission authorized Administrative Assistant Rick Bailey to have the flag pole repaired.

County Computer Specialist/John Fellmeth - John Fellmeth met with the Commission to discuss his salary. He has continued to be paid the salary of Hospital Administrator even though LHS has taken over the management of the San Juan County Hospital. Mr. Fellmeth has continued to serve as the financial officer at the hospital to this date but there has been no definite time set as to when LHS will make any changes. After considerable discussion, a motion to approve the request of Grade 22 Step 4, $2,395 effective September 26, 1988, was made by Commissioner Bailey and seconded by Commissioner Maryboy. Because Mr. Fellmeth has previously filled this position and with the approval of an increase based on his skills as well as consideration for a raise given other employees, there will be no probationary raise. The motion passed by a unanimous vote.

Health Service District Public Hearing - Commissioner Black convened the public hearing that had been called for the consideration of creating a Health Care Service District in San Juan County. Those present were the San Juan County Commissioners, County Clerk Gail Johnson, Administrative Assistant Rick Bailey, Deputy Clerk Merna Johnson, Sandra Skousen and Neil Joslin from the media, John Fellmeth, Rayburn Jack, Kathleen Lyman and Russ Stevenson.

Rayburn Jack stated that he felt the creation of a Health Service District would provide an opportunity for stability for health care. It would specify money from the County that would go directly to health care where other revenues raised by the County may or may not be authorized to be used in health care.

County Clerk Gail Johnson expressed concern with the independence of the board directing the district. It was stated that there are definite controls as the Commissioners appoint the board members and there will be a set amount allocated for the use of the health service district. Any funds beyond the set tax rate would have to be approved by the public in an election. If the taxing authority is not approved by the electorate then the health care still has to be funded out of the general fund of the county.

There was some concern by the residents in Monument Valley about being included in the district where they already have a hospital in the area. Because there is very little taxes generated on the reservation it would not affect that area.

Another question raised was whether there could be a reduced cost for people within the district as opposed to tourists or others outside the district. The Commission felt that would not be a consideration as current hospital costs are such that it is already being subsidized by tax revenues. The possibility of a sliding scale for costs based on private income and not eligible for any other reimbursement scheme will be checked into.

In response to a question concerning the authority of the health service board the Commission stated that the health service district board would act as the hospital board which is currently held by the County Commissioners.

All those who were in attendance at the public hearing expressed support of the creation of the San Juan County Health Care Service District. Commissioner Black expressed appreciation for the interest expressed and advised those in attendance of an additional fifteen day comment period. On October 12th at 9:00 A.M. in the San Juan County Courthouse a special commission meeting will be held to either approve or abandon the creation of the health care service district. If the district is approved, it will be placed on the November ballot for the approval or disapproval of the electorate for the taxing authority.
