MINUTES OF THE BOARD OF COUNTY COMMISSIONERS MEETING HELD AT MONTICELLO, UTAH ON OCTOBER 26, 1959 at 10 A. M.

Meeting opened at 10 A. M. with all Commissioners present, Wm. C. Walton in the chair, Clerk also present. COUNTY TO REPAIR FENCE ON WAYNE RASMUSSEN RANCH IN EAST CANYON OR TORB REGION

Wayne Rasmussen was present to ask the County to repair the damage done to his fence adjoining the county road on his ranch in the East Canyon or Torb region of San Juan County. He stated that while burning brush in the area the road men also burned several fence posts so that stray stock are able to get through the fence and onto his land. He stated that he is willing to have the fence moved back even with the high-line thereby giving the county a wider right-of-way and it will also keep the posts from being knocked over when work is done along the road.

It was unanimously agreed that the County will repair the fence as soon as possible. COUNTY TO ADVERTISE IN DESERET NEWS AND TRIBUNE IN THE YEAR 1960

A motion was made by Commissioner Bartell, seconded by Commissioner Hazleton, and unanimously carried, the San Juan County advertise again this year as it has done in the past in the Christmas News of the Des-eret News, and in the Empire Edition and Scenic Edition of the Salt Lake Tribune, the rates to be the same as in the year 1959. The Clerk was directed to write Qwen B. Saunders of the Feature Advertising Department of the two papers giving the Commissioners approval to such advertising.

MITCHELL MELICH AND HOWARD BALSLEY PRESENT TO DISCUSS COMPROMISING OF TAXES DUE ON MINING PROPERTY

Little Beaver Mitchell Melich and Howard Balsley were present to discuss compromising on taxes due on mining properties.

Mining Company Mr. Melich stated that the Little Beaver was mined by Homestake Mining Company and the taxes were paid

up to and including the year 1957. It was mined out at that time and Homestake refuses to make any further payment of taxes. The State has agreed to make no assessment for production for the year 1959, but an opinion of the Attorney General's office is that mines must be assessed for 2 years after being mined out. Mr. Melich further dtated that the Little Beaver Mining Company is willing to make a settlement of $15000 on delinquent taxes now due in excess of $39,000. The mine occupation tax has been paid.

, Plateau Mining Mr. Melich stated that he and Mr. Balsley both have an interest in the Plateau Mining Company and that the Company Company is willing to make a settlement on back taxes and are willing to pay $1750 , the amount of back

taxes being $3463.80. They will pay the taxes for 1959 in full and the mine occupation tax has been paid.

Snowflake and Mr. Balsley stated that he is willing to pay the 1959 taxes on the Snowflake and Sunset claims in full Sunset and is willing to pay 50% of the back taxes that are due.

F. Bennion Redd was called in to participate in the discussion and will contact the State Tax Commission to ascertain the County Commissioners right to make such settlements.

It was unanimously agreed that the County Commissioners will favor such settlements if it is in accord with the State Tax Commission.

First Security Bank of Utah Fiscal Services, Recreational Facilities Bonding $1,705.00

Minutes of the last meeting were read and approved.

Meeting adjourned.until Friday the 30th day of October, 1959 at 10 A. M. at which time the Tentative Budget will be considered.
