MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD
MARCH 26, 1984
The San Juan County Commission met in regular session on Monday, March 26, 1984, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah.
The following members were present: Commissioner Calvin Black, Chairman
Commissioner Robert Low Commissioner Kenneth R. Baiely was absent.
Minutes of the previous meeting were approved with the specified corrections on the motion of Commissioner Low. The motion was seconded by Commissioner Black and carried unanimously.
EASTLAND ROAD DISCUSSED
Commissioner Low reported that the Eastland road is being damaged due to heavy truck traffic and that he has been in touch with a representative from Transco about the possibility of using alternate routes whenever possible.
AGREEMENT WITH TRANSCO DISCUSSED
Bruce K. Halliday, County Attorney, met with the Commission to report that an agreement has been reached with Transco stating that they agree to the following points with San Juan County:
1. That TXPO shall utilize the County roads designated as County roads No. 312, 351, and 339, and agrees to reconstruct the roads to the same condition as they now are in or to make paument to the same condition as they now are in or to make payment to San Juan County for the cost of said reconstruction for any damages caused by TXPO.
2. That County shall retain the right at any time, should damage become obvious and severe, to close all of the foregoing roads to access in accordance with County ordinances regardless of this agreement.
3. TXPO hereby assumes all risk of loss to its equipment and any and all liability for damages caused by its use of said road.
Commissioner Low made a motion to approve the agreement and to authorize Commissioner Black to sign it. The motion was seconded by Commissioner Low and carried unanimously.
Mr. Halliday also recommended the Commission adopt a resolution or an ordinance regarding the use of County roads by truck traffic. The Commission authorized Mr. Halliday to draft an ordinance for review at the April 2nd Commission meeting.
OLD CLINIC BUILDING IN BLANDING
The Commission reviewed a letter from the San Juan School District reaffirming their interest for the use of the old clinic building in Blanding as a training center for handicapped children and adults. The Commission deferred action until the April 2nd Commission meeting so that they could further study the matter.
PUBLIC HEALTH MEETING ATTENDED
Commissioner Low reported that he attended a public health meeting in Green River last week.
NACQ MEETINGS ATTENDED
Commissioner Black reported that he attended NACO meetings in Washington, D.C. Among the topics discussed were PILT and proposed legislation for acid raing. Commissioner Black further reported that the proposed legislation for acid rain will be opposed by the western states because of the proposed 1 mill per kilowatt hour for all coal and hydroelectric power. Most of the hydroelectric power produced in the U.S. is in the West. Also, most of the coal burned is low sulpher. Commissioner Black also stated that the western states do not want to share the cost for a problem that is in the eastern states.
PROJECT BOLD DISCUSSED
Commissioner Black also met with most of the Congressional Delegation while in Washington, D. C. and discussed Project Bold. Commissioner Black reported that Senator Garn and Senator Hatch will co-

sponsor the Project Bold bill in the Senate. Representative Nielson and Representative Marriott have decided not to co-sponsor the bill but will hold some public hearings to discuss the propsoal.
Commissioner Black also discussed the Wilderness Bill with the Congressional Delegation present. MEETING ATTENDED TO DISCUSS PROPERTY TAX
Commissioner Black reported that he attended a meeting in Salt Lake last week to discuss the property tax problem.
Commissioner Black went through some hypothetical mathematical computations to see how the proposed new tax formula would affect various counties based upon the porportion of state and locally assessed properties.
COUNTY CLERK MEETS
Gail Dalton, County Clerk, met with the Commission to discuss the possibility of changing the County letterhead. Terry Connors has been adked to make some sketches for the Commission to review.
Miss Dalton also reviewed some figures from AT&T for a new phone system. The hospital phone lease-purchase agreement with Contel was also discussed.
U.D.I.A. FUNDS FOR THE BLUFF TO MONTEZUMA CREEK ROAD DISCUSSED
Commissioner Black reported that when he requested the $450,000 from the U.D.I.A. they had received a letter from the U.N.D.C. opposing the granting of these funds and stating that the Aneth chapter was opposed to this also. Commissioner Black has obtained a copy of the January 22nd Aneth Chapter meeting showing the vote on this matter was 52 in favor and 0 opposed, contrary to what was represented in the letter.
A copy of a letter to Mr. Bruce Parry of the U.D.I.A. from the U.N.D.C. was received by the Commission. The letter stated that the U.N.D.C. has taken the position that since a toatal of $1,200,000 from the Navajo Fund is being contributed to the Bluff to Montezuam Creek road project that Navajo employment preference be strongly emphasized. The U.N.D.C. Board requests that the U.D.I.A. Board, as a trustee and administrator of the Navajo Fund, share their concern and share the position taken by the U.N.D.C. Board.
R.C.F.P. FUNDS REPORTED ON
John Baker, District Fire Warden, met with the Commission to report on the R.C.F.P. funds approved. Mr. Baker stated that the following funds were approved:
$1,875.00 in matching funds for San Juan County $ 365.00 for Blanding
15 full grant training spaces have also been approved LETTER RECEIVED FROM THE ATTORNEY FOR THE INDIGENTS
The Commission received a letter from Eric Swenson reporting that in the case of the State vs Gresham it might be a costly case to defend. Mr. Gresham has been charged with a wildlife violation. The Commission requested the County Atttorney research and clarify the County's obligation in the defense of a wildlife citation.
LIQUOR LAW ENFORCEMENT DISCUSSED
The Commission reviewed the suggestions made at the March 12th Commission meeting discussing liquor law enforcement. The County Attorney will check the ordinance about the hours of the establishments as sug-gested by Sgt. Rudy Cook. The County Attorney will work on drafting the suggested proclamations. The Commission scheduled a meeting for April 9th at 4:00 p.m. in the Courtroom for all of the beer and alcohol vendors in the County and interested law enforcement officials to discuss some of the problems of liquor law enforcement.
DIVISION OF MENTAL HEALTH MEETS
The Commission met with the local and State representatives from the Division of Mental Health as part of the States annual on-site review.
LETTER TO THE BLM SUPPORTING LAND FOR WASTE DISPOSAL PONDS
A letter to the B.L.M. supporting land being made available in Montezuma Creek and other areas of the County for the construction and maintenance of salt water and other wastes from the exploration for and the production of oil and gas was drafted by the Commission.
LETTER RECEIVED FROM THE NATIONAL PARK SERVICE RE: ISLAND IN THE SKY ROAD
The following letter was rec3ived by the Commission from Mr. Pete Perry fo the National Park Service in response to theCommission's request for an E.I.S. on the proposed paving of the Island in the Sky Road in Canyonlands National Park. The letter is as follows:

The concept of paving the Island in theSky Road in Canyonlands National Park was covered in the assessment of alternatives (approved 5/24/77) in the General Management Plan (final 5/78). That assessment covered the San Juan and Grand County approach road as well as the sections within the park boundaries. As a result of that clearance which was accomplished through NEPA procedures including full public review,

it is only necessary to prepare updated environmental assessments at this point.
A meeting was held on March 9 between Canyonlands National Park and the Grand Resource Area of BLM to determine agency responsibilities for preparation of the needed assessments. TWo assessments will be
prepared, one of which will cover the road and one of which will cover a related borrow pit and batch
plant. These documents will be available for public review upon completion and we will be glad to forward copies to your as soon as they are ready.

COMMISSIONER BLACK REPORTS
Commissioner Black reported that Senate Bill 39, passed by the 1984 legislature, includes a provision allowing elected and certain appointed officials to exclude themselves from retirement coverage in the Utah State Retirement System as of July 1, 1984.
MOTION FROM THE MARCH 5TH COMMISSION MEETING
At the March 5th Commission meeting a motion was approved and the Deputy Clerk failed to put it in the official minutes, so here it is:
Gail Dalton, County Clerk met with the Commission to discuss the possibility of getting a mural painted on the new wall by the Sheriff's office. Commissioner Low made a motion to put Commissioner Bailey in charge of getting Paul Foremen to paint this and to assist him. Commissioner Black passed the chair to Commissioner Bailey and seconded the motion. Commissioner Bailey abstained.
