MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD OCTOBER 25, 1982

The Board of County Commissioners met in regular session on Monday, the 25th day of October at the hour of 10:00 a.m. in the Courthouse at Monticello, Utah.

On roll call, the following members were present: Commissioner Calvin Black, Chairman

Commissioner Robert Low Commissioner Kenneth R. Bailey

Minutes of the previous week were read and approved with the specified corrections upon the motion of Commissioner Low and the second of Commissioner Bailey and it carried unanimously.

GRADER BLADES;

Commissioner Bailey reported that upon further investigation into the fair market price of a worn grader blade, he has found that they are selling for between $5.00 and $6.00. Upon his recommendation the Commission authorized the sale of worn grader blades from the Road Department at $5.25 each.

CONSTITUTIONAL AMENDMENT - PROPOSITION 1 DISCUSSED;

Chairman Black explained to the Commission what the probable affects would be if proposition 1 were either defeated or passed in the November General election. Chairman Black explained that whether the proposition is passed or defeated, taxes on homes and commercial property will increase in 1983. If the proposition does not pass, property taxes will double or more. The examples below are all assuming an addition of the 20% rollback, 40% factor and 8% annual inflation increase since 1978, all of which are likely by court decisions or legislative action:

Chairman Black reported that over the last twelve, years there has been a shift of the tax burden from large corporations in the State of Utah to homeowners because these corporations are assessed by a different formula than that applied to homes.

Because the Commissioners feel strongly about the passage of proposition 1 to keep property taxes from doubling, they agreed, as private individuals, to sponsor an advertisement in the San Juan Record to be paid for with their personal funds. No county funds will be used to support proposition 1 in any way.

SOIL CONSERVATION DISTRICT REQUESTS FUNDS:

Mr. Tyrcn Lewis, chairman of the Board for the San Juan Soil Conservation District, met with the

Commission to explain the Conservation District's program and request funds from the county to help

support the coining years activities. The Commission agreed to take the request under advisement.

Mr. Lewis clarified for the Commissioners that the Soil Conservation District and Soil Conservation

Service are seperate units and it is the Board's responsibility to direct the activities of the Service

BLUFF - MONTEZUMA CREEK ROAD PROJECT BID REPORT:

County Engineer, Doug Pehrson, reported that because of an error in the extension of a quantity price,

the bid from Summit, Inc. will be $200.00 higher.

Mr. Pehrscn reported that his office needs another man to help with the slope staking and cross-sectioning on the Bluff-Montezuma Creek project. Mr. Pehrson was authorized by the Commission to hire an additional man on the basis of need, and if he has to be let go at a later date, he will have first priority to be rehired.

Commissioner Bailey said the total sum of the following expenditures relating to the Bluff-Montezuma Creek project will bring the estimated costs for the project to just under $3,000,000.00:

Summit, Inc.'s Bid, State engineering fees, County engineering costs, previous engineering expenditures, archaeological clearance and abatement costs, State engineer's fee on redesigning, and all the other expenses of the County Engineer's office up to this date.

The Commission agreed to let the bid for the Bluf f-Montezuma Creek project on November 1, 1982 and requested that Doug Pehrson and Hugh Kirkham meet with Summit, Inc. to find out when and where they anticipate starting work on the project.

The Commission also requested that Mr. Pehrson write to George Thompson and request, in writing, advance construction authority to use "B" and "C" Road Collector funds on the Bluff-Montezuma Creek project, so that the County may be able to replace these funds in future years.

PACK CREEK ROAD;

Commissioner Bailey reported that the Pack Creek Road has been overlaid and chip sealed and the Road

Superintendent feels the crew has done an excellent job.

UCOLO ROAD:

Commissioner Bailey reported that a foot of new base has been put on the Ucolo Road and the Road

Department has it scheduled for oiling this coming summer.

HOWARD C. NIELSON VISITS THE COMMISSION:

Mr. Howard Nielson, Republican candidate for U.S. Representative for District #3, met with the Commission at 1:30 p.m. Mr. Nielson asked about the good working relations between the County and the Reservation. Chairman Black explained that the county has tried to provide equal services to the Reservation; and the County, Ute and Navajo leaders, and local School District have worked closely together to solve many of the problems. On other matters, Mr. Nielson said he felt the local people should have the most to say about issues concerning their area.

FIRE STATIONS FOR BLANDING AND MONTICELLO TO RECIEVE COUNTY FUNDING:

Mr. Bud Nielson and Mayor Cleal Bradford met with the Commission to request $10,000.00 from the County toward funding the new fire station for the Blanding area. They reported that Blanding is ready to go ahead with the project, which they estimate will cost $78,300.00. Upon the motion of Commissioner Bailey and the second of Commissioner Low, it was unanimously voted to provide funds in the amount of $10,000.00 for the new Blanding fire station, and $10,000.00 for the new Monticello fire station, subject to budgeted funds available. The commission then requested that Fire Warden, John Baker, budget this expenditure in his Capital Improvements budget for 1983.

MONTEZUMA CREEK SWIMMING POOL:

Commissioner Bailey reported to Chairman Black that in order to winterize the Montezuma Creek

swimming pool, the solar collectors need to be drained and the pool cover put in place.

SANITARY LANDFILL APPLICATIONS DISCUSSED:

The Commissioners stated that it was their understanding from meetings with the cities of Blanding and Monticello, and the BLM Office, that the county would apply to the BLM for the needed sanitary landfill areas in the county's unincorporated areas, while the cities agreed to make the necessary applications for their own needs.

Commissioner Low reported that he and Ed Scherick have looked over the sanitary landfill property for LaSal and recorded the proper discription for the application to the BLM. Commissioner Low also reported that it will require approximately 100 yards of road, off the main road, to get to the new landfill sit at LaSal.

ROAD DEPARTMENT POLICY ON PAST DUE INVOICES;

The Commission authorized Commissioner Bailey and the Road Department to establish a policy to require the net payment on items sold to private individuals to be paid within 30 days of the invoice date, after which, the Department is authorized to charge 18% interest per year on all unpaid bills. The Road Department should send out notices to this affect and remind the customers that unpaid bills will be truned over to the County Attorney for collection.

BLANDING MEDICAL CLINIC REPORT:

Commissioner Low reported that Dr. Redd has signed the lease agreement for the new medical clinic which is to be built in Blanding. Commissioner Low moved, that subject to the review and approval by the County Attorney of the lease agreement, and when the certificate of need arrives along with all other requirements having been met, and the design has been approved by the Health Care Service Board, the County Commission authorizes the Health Care Service Board to proceed with the project to build the Blanding medical clinic. The motion was seconded by Commissioner Bailey and it carried unanimously.

PERSONNEL POLICY TO REQUIRE ANNUAL DRIVING TESTS FOR HIRED DRIVERS:

Commissioner Low reported that State Dirvers License Examiner, Doug Bohn, has agreed to develop and administer a yearly test for all persons who are hired by the county as drivers for the various county programs. Commissioner Low moved to require all county employees driving for hire and haul-ing passangers, Except other county employees, on a regular or irregular basis, be required to successfully pass an annual test administered by State Drivers License Examiner. The motion was seconded by Commissioner Bailey and it carried unanimously.

INITIATIVE PETITION ON THE BANNING OF BEER-INFORMATION REPORTED;

Chairman Black reported that Representative Hardy Redd has received information that it would be constitutional to designate specific unincorporated areas of the county as "dry" without affecting the entire county. The division could be done by voting districts. Rep. Redd is presently work-ing on a bill to submit to the State Legislature regarding this particular issue.

CORRESPONDENCE:

A letter was received from Betty Pehrson of the Blanding PTA complimenting Sheriff's Deputy, Dennis Gutke, on his educational presentations for the grade school and on his example as a law enforcement officer for the community.
