SAN JUAN COUNTY COMMISSION MINUTES MARCH 24, 1986

The San Juan County Commission met in regular session on March 24, 1986 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Black, Chairman

Commissioner Bailey

Commissioner Holliday

Minutes of the previous meeting were approved with the corrections on the motion of Commissioner Bailey Commissioner Holliday seconded it. UNANIMOUS.

CREAMER & NOBLE - HALLS CROSSING AIRPORT

Rick Bailey, Administrative Assistant, said he received a letter from Creamer & Noble, Inc. with their request for a 25% advancement reimbursement of the contract on the Halls Crossing Airport master plan. It will be payment #1 to the Federal Aviation Administration for $9,094. Commissioner Holliday made the motion to approve this and authorize Commissioner Black to sign the papers. Commissioner Bailey seconded it. UNANIMOUS.

LOPEZ ARCH

Hardy Redd and Robert Nieves, President of SOCIO, met with the Commissioners to ask for their cooperation in requesting road signs for the Lopez Arch that is on US-191 (eight miles south of La Sal Junction). Mr. Nieves said the Lopez Arch was dedicated August 25, 1976, and he has written letters to UDOT requesting road signs identifying the arch. Mr. Nieves said the arch is hard to see from the road and there needs to be a place where traffic can pull off the road. Mr. Hardy Redd said the land is owned by Paul Redd and the BLM. Commissioner Black said they need talk to Sam Taylor, UDOT, and get some state help. Mr. Nieves will write a letter to Sam Taylor. Doug Pehrson, county surveyor, will look for a possible turn out.

SAN JUAN GOLF COURSE

Grant Leavitt, golf course, met with Commissioners to get approval to turn in paybacks for Golf Course. Mr. Leavitt said this year is the earliest spring and has been collecting fees for the golf course since February. Grant Leavitt will go on salary as of March 1, 1986.

SOCIAL SERVICES CONTRACT - #2 86-0361

A motion was made to approve the Social Services Contract for Aging Services for $71,879.00 by Conmissioner Bailey and authorized Commissioner Black to sign then. Commissioner Holliday seconded it UNANIMOUS.

COUNTY PURCHASE POLICY

Commissioner Bailey made a motion to adopt a procurement policy for capital purchases for all county departments. Commissioner Holliday seconded it. UNANIMOUS.

FROM: COUNTY COMMISSION Capital Items

Capital Items: Machinery, equipment, vehicles, tools (other than hand tools), or any other non-consumable item to be purchased by the County.

Effective April 1, 1986, any capital item purchases will follow the outlined policy:

1. Any capital item between the price of $100 and $500 must have two quotations, either verbal, written or advertised.

All quotations must be placed on the attached Procurement Policy and Bid-Quotation Form forwarded to the County Commission by way of the County Clerk for approval before any purchase may be made.

After Commission approval, the Procurement Policy and Bid-Quotation Form will be attached to the invoice for payment.

2. Any capital item between the price of $500 and $5,000 must have two quotations, either written or advertised.

The written quotations or the advertised bids must be forwarded to the County Commission by way of the County Clerk for approval before any purchase may be made. Copies of the advertised notice and bids shall be attached to the invoice for payment.

Any capital purchase not following the policy will not be paid by the County and will be the personal responsibility of the person ordering the item(s).

PERSONNEL POLICY - COUNTY EQUIPMENT

Commissioner Holliday made the motion to approve the following addition to the county personnel policy. Commiissioner Bailey seconded it. UNANIMOUS.

Amendments

Effective immediately, the following additions to the County Personnel Policy will be followed:

COUNTY EQUIPMENT

When equipment such as pagers or radios must be furnished to employees, or volunteers for taking

call for San Juan County, it is responsibility of San Juan County to purchase and maintain that

equipment.

If it is determined that the equipment has been abused or intentionally damaged, the individual to whan the equipment was issued will be responsible for repairs.

If the equipment is lost, or not surrendered upon request, the individual will be required to reimburse the County for the cost of said equipment.

USE OF COUNTY FACILITY FOR PERSONAL GAIN

A San Juan County employee may not enter into any arrangement, agreement, or contract for personal gain for services provided by a County employee at a County facility or while using County equipment without express permission from the County Commissioners.

UAC - JACK TANNER

Rick Bailey, Administrative Assistant, reported that Jack Tanner, executive director of UAC, is going to meet with the Commission on April 14, 1986 to help evaluate the county employees' job descriptions and grades.

COMMUNITY IMPACT BOARD - Public Safety Building

The Community Impact Board Hearing will not be able to schedule the county's application on April 3, 1986, for the public safety building. The Commissioners hope that it will be scheduled for May.

CAMPAIGNING BY COUNTY EMPLOYEES

Gail Johnson, Clerk, asked the Commissioners what their feelings were on county employees campaigning. Commissioner Black said that there is no limitation as far as he knows, so long as they don't campaign on county time or expense.

HUMAN SERVICES BOARD - Block Grant

Bruce Shumway, Human Services Board, met with the Commissioners to discuss the Social Services Block Grant funding. Mr. Shumway said that with a carry over from last year, Social Services will have $97,500 for 1986-87. Mr. Shumway said Block Grants are being cut and next year (1987-88) the base is set at $79,900. There was seven requests to the Human Services Board for a total of $134,500 and the board's recommendations cut it to $97,500. The Commissioners feel that there should not be any new programs started such as the UNDC outreach. The Commissioners made the following cuts to the recommendations:

Commissioner Holliday made the motion to approve $87,500 for the Social Services Block Grant Funding. Commissioner Bailey seconded it. UNANIMOUS.

Commissioner Bailey had asked for a previous report from CEU of number of people served and hours spent in direct one on one counseling and has never received it.

EMPLOYEE HEALTH CARE COVERAGE

The Commissioners tabled their decision on the County Employee Health Care Coverage until a decision is made on the county medical facilities.

BOOKMOBILE - Roland Francon-UNDC

Roland Francom, bookmobile employee, met with the Commissioners to report on the funding of the Bookmobile. Earlier in the year UNDC said they would match the School District's contribution with $4,000 and this was approved by the board. Mr. Francom said that now UNDC says the tribe is going to furnish their own bookmobile and rescinded their earlier action. The Commissioners feel that since UNDC had approved this they should abide by their action. Mr. Francom said he will write a letter to Herb Clah explaining the situation.

SHERIFF RIGBY WRIGHT - MARTHA MCCANN

The Commissioners received a letter from Martha McCann, employee in the sheriff's office, stating that her job was not available when she returned from maternity leave in of June 1984. Mrs. McCann requests a hearing and pay backs from June to present. Rick Bailey, Administrative Assistant, was asked to meet with Mrs. McCann to help her follow the personnel policy procedures.

GENERATOR (Nursing Home) - Keith Ivins

Commissioner Holliday received a phone call from Keith Ivins asking if he could use the old generator (from the nursing home) to pump a well. The Commissioners agreed to let Mr. Ivins use the generator for

550 and Commissioner Holliday will see if Mr. Ivins is interested in purchasing the generator. The generator is at the Monticello road shed and this will be handled by the road department.

JOHN BAKER - COUNTY FIRE MARSHALL POSITION

John Baker met with the Commissioners to discuss the position of county fire marshall. The Commissioners told Mr. Baker that with a drop in revenue the county can't afford to create any new position. Commissioner Bailey said this position would be a duplication of service in the area. No motion was made for a county fire marshall.

JOINT ROAD COMMITTEE

Conmissioner Bailey reported on the Joint Road Committee meeting he attended in St. George last week where they discussed the State Transportation Funds. Commissioner Bailey said $350,000 is being appropriated by the Legislature for highway study and a committee has been selected to direct the contractors who will make the study. Commissioner Bailey said that the Legislature, in their last day of session, took $10 million from the DOT road funds to balance the general fund budget.

KAMAR MEDICAL MANAGEMENT COMPANY - Ruel McPhie

Ruel McPhie, Kamar, Co., met with the Commissioners to present his feelings on today's health care. Mr. McPhie said there is a growing crisis in today's health care and the changes are going to be great. Commissioner Black said the Commission has become aware of this crisis in the last year. Mr. McPhie presented his proposal to buy the county nursing home for $1.5 million with $200,00 down payment. The Commissioners told Mr. McPhie they are leaning toward selling the nursing home to his company, Kamar. The Commissioners would want a stipulation that the county gets first right of refusal if the facility is shut down or sold. The Commissioners would like to discuss this with the Blue Ribbon Committee before making a final decision; and if the Committee agrees the Commission would prefer to enter into an agreement whereby Mr. McPhie can begin operation of the nursing home May 1, 1986. The Commissioners will meet with the Blue Ribbon Committee Wednesday at 6 p.m. in the courthouse.

NAVAJO MOUNTAIN CHAPTER MEETING

Commissioner Bailey reported on the Navajo Mountain Chapter Meeting in which he, Commissioner Holliday, Doug Pehrson, Bernal Bradford, Willie Grayeyes, Tom Atene, Harold Drake, Jim Dandy, Dick Netsosie, Herb Clah, Kenneth Miles and other members of the Navajo Mountain Chapter were present. Commissioner Bailey said they went to Piute Creek and re-engineered the bridge. The other span bridge will be replaced with two new ones and will furnish the material to install guard rails on the sides. Doug Pehrson will design an extension on top of their pillars. The road department will supply the bridges and parts and the chapter and the BIA will provide the labor.

BLANDING - RECREATION

Eddie Allred, county-wide recreation director, reported to the Commissioners on the meeting with Blanding city concerning the electric bills. Mr. Allred said he agreed that the county should pay the electric bill on the swimming pool for last year. The city said they will take over the maintenance of the park south of town and the third reservoir park. It was agreed the city will provide the water, sewer and garbage for the swimming pool and the county will pay the electric bill.

ROAD DEPARTMENT - HIRE LEAD MEN

Commissioner Bailey reported that he needs to hire two lead men to work for the road department one in Monticello and one in Blanding. Commissioner Bailey said he will advertise these positions in the paper.

COLORADO SPRINGS SALE

Commissioner Holliday will attend a sale on April 8 in Colorado Springs. The Commissioners authorized Commissioner Holliday to buy a "lo boy" if found at a good price.

SAN JUAN SPECIAL SERVICE DISTRICT - Mexican Hat

Bruce Halliday, county attorney, met with the Commissioners to discuss a request from the Special Service District in Mexican Hat. Mr. Halliday said Jerold Baum, district board, called him saying that the district was applying for Community Impact Money to update the Mexican Hat sewer and asked if the Commissioners would write a letter of support. The Commissioners said they had already talked to Mr. Baum and asked him to wait on their application until the county had submitted theirs for the public safety building.

OFF-ROUTE FREIGHT CHARGES

Commissioner Black said he contacted Ted Stewart, Public Service Commission, concerning the freight charges that are still being charged on "off-routes". Commissioner Black said he hasn't received a report yet but will follow up on it.

WILDERNESS AREAS IN COUNTY

Commissioner Black reported that about one-fourth of San Juan County, less the Navajo Reservation, is tied up in parks, recreation, national monuments, and wilderness and the BLM is proposing to lock up another 360,000 acres. Commissioner Black said this will hurt the county and it is felt that the biggest fight against the EIS is the connection between revenue and jobs, tax revenue and funding for schools. Commissioner Black said that the educators in Utah should be opposed to more wilderness because this will affect school funding.

LAND BOARD MEETING

Commissioner Black said that at the recent State Land Board meeting he reported there is a State Wilderness committee; a member of the Utah Land Board attends their meetings every week and they are in the process of preparing a position for the state of Utah. Commissioner Black said the Land Board has never received a report on these meetings. Don Chase, chairman of the board, organized a Land Board wilderness sub-committee in which Commissioner Black is a member and they will meet in Salt Lake city on March 25 at 1:30 p.m. Commissioner Black will also meet with Diane Nielson, director of Division of Oil, Gas and Mining and their board on Thursday.

The Land Board Meeting will be held in Blanding on April 9,10 & 11. On the agenda will be a field trip to

Cedar Mesa, wilderness areas and state school sections.

JOHN ATLANTIC BURR FERRY CONTEST

Commissioner Black said he asked Peggy Humphreys, San Juan travel council, to ask the high school art

classes if they would like to participate in a poster design contest for the John Atlantic Burr Ferry. The posters would be used to put in businesses in the county for tourist information.

EMPIRE ELECTRIC ASSOCIATION - Security light courthouse

An application for a security light to be installed at the county courthouse for $7.16 per month was

approved by a motion of Commissioner Bailey and authorized Commissioner Black to sign it. Commissioner Holliday seconded it. UNANIMOUS.
