MINUTES OF THE SAN JUAN COUNTY COMMISSION JUNE 24, 1985 MEETING
The San Juan Commission met in regular session Monday, June 24, 1985 at the hour of 10 a.m. in the San Juan County Courthouse at Monticello, Utah.
The following members were present: Commissioner Kenneth R. Bailey
Acting Chairman Commissioner Jerry Holliday
Commissioner Calvin Black was excused from the meeting.
Minutes of the previous June 17, 1985 meeting were approved as corrected on the motion of Commissioner Holliday. The motion was seconded by Commissioner Bailey and carried unanimously.
CIRCUIT COURT ADMINISTRATION, ET AL MEETING
The Commission discussed the Circuit Court administration meeting with the County set for June 25, 1985 at 2 p.m. The Commissioners will invite Judge Harold Muhlestien to attend the meeting. Gail Johnson, County Clerk/Auditor, requested that Lana Herron, County Deputy Clerk of the Circuit Court, also attend the meeting.
REIMBURSABLES SERVICES REQUESTED BY FOREST SERVICE
The following Attachment I to the Joint Operating and Financial Plan with San Juan County and the Forest Service was submitted for the Commissioners' approval and execution. Motion was made by Commissioner Holliday to adopt the agreement regarding reimbursable services as requested by the Forest Service and, also, that Commissioner Bailey sign the agreement as acting chairman. The motion was seconded by Commissioner Bailey and carried unanimously.

October 1, 1984 to September 30, 1985 Joint Operating and Financial Plan
Reimbursable Services Requested by Forest Service
1. The San Juan County Sheriff will furnish personnel with equipment to adequately patrol National Forest Land as follows:
a. A patrol will be made in the Blue Mountain Watershed, North and South Elk Ridge areas, LaSal Creek to laSal Pass, from the junction of LaSal Pass to State Lands, and around LaSal Guard Station three days prior to and during the opening weekend of hunting season.
b. A concentrated patrol will be made in the recreation areas on the Blue Mountain from Foy Lake to Devils Canyon Campground and around the Pack Creek Campground in the LaSal Mountains on holidays, weekends and opening of hunting season.
c. Occasionally other lesser-used roads and recreation areas on the Manti-LaSal National Forest within San Juan County will be patrolled.
2. Cooperator personnel assigned on duty in Item I will be regular employees of the San Juan County Sheriff's Department.
3. The Cooperator shall not have any responsibility in the collection of Forest Service recreation fees.
4. The Cooperator shall furnish the Forest Service with a copy of all uniform Incident/Offense Reports on action taken by law enforcement officers on National Forest administered lands.
Rate Schedule for Reimbursement Service
The Forest Service agrees to reimburse the Cooperator for the service listed in Item 1 and 4 on a monthly or quarterly basis as follows:
Fourteen dollars ($14.00) per hour for a man and vehicle.
Billing for reimbursement will be furnished at the end of each month or quarter to Forest Supervisor, Manti-LaSal National Forest. Maximum funds available for expenditure under this agreement through September 30, 1985 is $3500.00.

HOVENWEEP NATIONAL MONUMENT PROPOSED EXPANSION
The commissioners instructed Mr. Rick Bailey, Administrative Assistant to the Commissioners, to write a letter to the BLM opposing any expansion of the Hovenweep National Monument area.
COUNTY PADDYWAGON
Rigby Wright, County Sheriff, reported vandalism on the county paddywagon in Blanding. The Commis-sioners suggested a $500 reward be posted leading to arrest and conviction of persons involved in destruction of the property of the county paddywagon.
COUNTY UNEMPLOYMENT COMPENSATION - GIBBONS COMPANY
The Commissioners discussed the County's contract with Gibbons Company with Bruce Halliday, County Attorney, to determine the possibility of terminating this contract. Mr. Halliday said he would go over the contract with Mr. Rick Bailey, Administrative Assistant to the Commissioners. Mr. Halliday said he would also review the working presently being used on employee termination slips and possibly restructure this wording.
4-CORNERS ORGANIZATION
Mrs. Sue Halliday, representative of the 4-Corners Organization, met with the Commission to discuss the purpose of the organization and request the support of the Commission. She stated that the purpose of the organization is to provide political clout to help in funding. The organization should be made up of the following groups:
County Commissioners from area counties and states
Navajo Chapter's Councilmen
Ute Tribe
Mrs. Halliday asked the Commissioners to host a meeting comprised of the above individuals to be held August 22, 23, and 24 in Bluff for the purpose of input and support. Mrs. Halliday will provide the Commissioners with more information and they will prepare and send out invitations for this meeting.
DISTRICT FIRE WARDEN MEETS
John Baker, District Fire Warden, reported that there were no major fires during the last week.
COUNTY PERSONNEL POLICY
Gail Johnson, County Clerk/Auditor, presented the final copy of the County Personnel Policy to the Commissioners. Motion was made by Commissioner Holliday that the effective date of the County Personnel Policy be July 1, 1985. The motion was seconded by Commissioner Bailey and carried unanimously.
ASSESSING AND COLLECTING
The Commissioners requested that a copy of the Commission Minutes and letter be sent to the taxing districts notifying them of the Commissioners' decision of phasing in the costs of collection as authorized by House Bill 160.
EMPLOYEE PROBATIONARY PERIOD
Gail Johnson, County Clerk/Auditor, informed the Commissioners that Lana Herron had completed her employment probationary period. Mrs. Johnson recommended a grade and one-step salary increase for Ms. Herron. Mrs. Johnson told the Commission that Ms. Herron is particularly adapt for circuit court work and has demonstrated ability to merit the increase. Motion was made by Commissioner Jerry Holliday for the recommended salary increase for Mrs. Herron. The motion was seconded by Commissioner Bailey and carried unanimously.
Mr. Rick Bailey, Administrative Assistant to the Commissioners, informed the Commissioners that he has completed his employment probationary period. Motion was made by Commissioner Jerry Holliday for a one-step salary increase for Mr. Rick Bailey. The motion was seconded by Commissioner Bailey and carried unanimously.
Gail Johnson, County Clerk/Auditor, met with the Commissioners to discuss a salary increase for Judge Harold Muhlestein based on the proposed increase in workload. The Commissioners felt this request is premature and said they would consider the proposal when and if the changes are made.
STATE AGING DEPARTMENT - COUNTY BUDGET
Mr. Rick Bailey, Administrative Assistant to the Commissioners, reported that he met with the State Aging Department. The State Aging Department cut the County's budget $4,500. However, Mr. Rick Bailey reported that they are willing to set up a meeting with the State of Utah, the Denver Office, the Navajo Tribe, and San Juan County representative to discuss why the County has to serve a portion of the reservation without reimbursement. Mr. Rick Bailey reported they gave him positive indication the County would get back a portion of these monies. The meeting will be set up for approximately three weeks.
COMMUNITY BLACK GRANT - SAN JUAN COUNTY JAIL PROPOSAL
The Commission authorized Rick Bailey, Administrative Assistant to the Commission, to send out certified letters to property owners on the Community Development Black Grant as required in the grant applica-tion. Mr. Rick Bailey reported he is sending in the environmental assessment today.

DOE HUNT ON ELK RIDGE-BEEF BASIN

Enclosed please find a copy of a letter to the Editor of the San Juan Record. It generally responds to the letter by Mr. Sandberg of June 5 relative to the proposed slaughter of 150 does in Beef Basin.
Probably none of the BLM or Wildlife Resource people that are here now, were here in the 1950's and 1960's when we supposedly had too many deer. Many of us were here and although there may have been "too many deer" in the early and mid 50's, by the end of the 60's they were being depleted to such a low herd that they have not returned to numbers that can be carried in most of San Juan County. This was finally recognized by the Wildlife Resources and we thought the BLM and Forest Service after the last "doe slaughter" in Beef Basin.
Exactly the same arguments were used then as are being used now. It was a mistake then and it will be a disastrous mistake again if the slaughter is allowed to happen this year.
It is ironic that the BLM is concerned about the sagebrush. If the deer keep the sagebrush down, more grass will grow.
Where there aren't enough deer to keep the sagebrush down, (most of the County) the state and federal agencies and private land owners have to spend tax payers and private money to kill the sagebrush.
I used to hunt extensively in Beef Basin, Dark Canyon, Deer Flat, Red Canyon, Cedar Mesa, and Bears Ears, among other places, and there still are no deer in most of these areas compared to what there were in the 50's and 60's, and not nearly as many as the range will carry.
A friend of mine spent several days just recently in Dark Canyon and said he saw all of two deer tracks.
Let's let our deer herds replenish!

COMMUNITY RECREATION PROGRAMS
Terra Gresh met with the Commission to register the following complaint against North Recreation for the discrimination against her son and other non-LDS children. Ms. Gresh told the Commissioners that her son has not been allowed to participate in the county swimming program nor has he been allowed to play an active part in the community baseball league. Ms. Gresh told the Commission her son as well as a few others are being discriminated against, and she will write a formal letter of complaint with the Commission.
Commissioner Bailey said he would follow up on Terra Gresh's complaints and suggestions.
CONTRACT FOR AGING PROGRAM
Mr. Bruce Shumway, Director of Social Services, met with the Commission requesting the execution of a contract for aging program in the amount of $23,990. Motion was made by Commissioner Holliday for Commissioner Bailey to sign the contract as Acting Chairman. Motion was seconded by Commissioner Bailey and carried unanimously.
YOUTH EMPLOYMENT COUNSELING PROGRAM
Mr. Bruce Shumway, Director of Social Services, met with the Commission requesting the execution of a contract for youth employment counseling program for the budgeted amount of $24,200. Motion was made by Commissioner Holliday for Commissioner Bailey to sign the contract as Acting Chairman. Motion was seconded by Commissioner Bailey and carried unanimously.
UACC ESTABLISHED and FLOOD MITIGATION LOCAL MATCH - RESOLUTION NO. 1985-5
The following memorandum was received by the Commission:

Commissioner Stewart has asked that I inform you of the actions taken in the specially called meeting of County Commissioners on June 7, 1985 in Provo.
A motion was made, seconded and unanimously passed that:
(1) A Utah Association of County Commissioners (UACC) be established within the Utah Association of Counties, (2) that the Association (UACC) meet formally at least once a year apart from other UAC meetings and at other times as may be necessary, (3) that the Organization be chaired by the Commissioner's representative on the UAC Board of Directors. The Chairman of the UACC is therefore D. Michael Stewart, Salt Lake County Commissioner.
Other issues discussed in the meeting were:
1. Jail cost reimbursement by cities.
2. Annexation issues forthcoming in legislative discussion.
3. A recommendation for UAC action on Utah hosting the winter

Olympics in either 1992 or 1996.
Also enclosed is a resolution passed by the Board of Direc-tors regarding the flood money currently being held by the legislature. The UAC Board urges each county commission to pass this resolution and send it to both the Governor and the Legislative Leaders. Their addresses are as follows:

UTAH ASSOCIATION OF COUNTIES REGARDING FLOOD MITIGATION LOCAL MATCH
WHEREAS, the Legislature and the Governor and the State of Utah have approved the State funding package for flood control mitigation,
WHEREAS, part of the State flood funding package includes a transfer of 1/8 cent sales tax to the State which was originally to be distributed to local governments, but which local governments agreed to allow the State use as the local match for flood mitigation,
WHEREAS, the State Legislature is now considering using funding earmarked for flood control activities, to help balance the State Budget,
WHEREAS, local governments are becoming increasingly strapped financially because of a loss of traditional funding sources, such as General Revenue Sharing, Block Grants, Categorical Grants, Economic Development Grants, and limitations imposed on tax revenues available to local governments.
NOW THEREFORE BE IT RESOLVED that the San Juan County calls upon the Legislature before any appropriation of such funds occurs for other than flood related purposes to return to local government all revenues to be used in the local flood match including the 1/8 cent sales tax.

Rick Bailey, Administrative Assistant to the Commissioners, reported the county equipment auction brought approximately $102,000 for the sale of county surplus equipment.
BLUE CROSS BLUE SHIELD HEALTH INSURANCE

Mr. Lee Nielson, pharmacist of the San Juan County Pharmacy, met with the Commissioners to discuss the advantages and disadvantages of the PCS cards. Mr. Nielson told the Commissioners that it would mean considerable more paper work for him and a possible loss of income. The 50 percent savings was discus-sed as was outlined by Mr. Al Price in a previous meeting. Mr. Nielson said he was not aware of any such savings or discounts and would like to know more. Mr.
Rick Bailey, Administrative Assistant to the Commissioners, said he would get more information regarding this 50 percent discount.
MILT PIPKIN - SAN JUAN COUNTY NURSING HOME
Mr. Rayburn Jack, San Juan County Hospital Administrator, met with the Commission to report the findings of the automobile accident involving Milt Pipkin, employee of the San Juan County Nursing Home on June 21, 1985 at 4:30 p.m. Apparently while transporting a patient of the Nursing Home, Mr. Pipkin reached down to remove a pop can that had rolled under his feet and had a head-on with an oncoming vehicle. All were released with only minor or no injuries. Mr. Jack told the Commissioners that he was going to suspend Mr. Pipkin from driving duties for a period of time. He also expressed concern for the fact that Mr. Pipkin was not using seat belts.
DR, STEVE WARREN - SOUTHERN UTAH HEALTH CONSORTIUM
The Commission authorized Mr. Rayburn Jack, San Juan County Hospital Administrator, to go ahead with the purchase of equipment necessary for the consortium. Mr. Jack reported that Dr. Steve Warren will be ready to resume practice at the consortium on scheduled date of July 15, 1985.
SAN JUAN COUNTY NURSING HOME ADDITION
The following copy of letter and Certificate of Release was received by the Commissioners:

If any of the subcontractors neglect or refuse to return the release by the latter part of next week, we would propose to furnish as part of the package a copy of the construction contract and copies of the checks paying the amount in lieu of the signed release. This is almost certain to be the case with Elias Morris since we understand they are no longer doing business.

SAN JUAN HEALTH CARE SERVICES - LETTER TO SENATOR ORRIN HATCH REGARDING DISTRIBUTION OP HEALTH CARE DOLLARS
Mr. Rayburn E. Jack, Executive Director of San Juan Health Care Services, presented a copy of the following letter to the Commissioners:

Dear Senator Hatch:
According to date from the American Hospital Association, the "hospital industry in 1984 showed its healthiest bottom line in more than 20 years." Based on the hospital industry's margin, the gauge of financial viability increased 6.2%, the highest figure during the 22 years AHA kept tract of the statistic. The margin data is available in the March 16 issue of AHAxs National Hospital Panel Survey Report.
Doug Lefton's article mentions that "Only the smallest hospitals showed a decline in margin. Hospitals with fewer than 25 beds suffered the greatest decline, to a -8.9%.
Joe Martin, director of the AHA's economic studies and hospital data center, explains that the smaller hospitals cannot cut personnel as easily as larger facilities.
My concern, Senator, is the impact on communities in the Southwestern United States where small hospitals play such a vital role in the health delivery system. Of the 29 hospitals in Utah, 19 have fewer than 50 beds, 9 have fewer than 25 beds. If the financial picture doesn't improve, Utah could conceivably lose all hospitals south of Price, except the Dixie Medical Center in St. George.
I understand the importance of incentives in curtailing health care costs. I am concerned with the distribution of the health care dollars so that small hospitals have no chance for survival. I would appreciate your review of current reimbursement practices, with an eye toward helping to preserve the small hospital.

RECAPTURE RESERVOIR
Commissioner Ken Bailey, reported that the BLM has agreed to install three cattleguards at Recapture Reservoir. After inspection by Mr. Edward Scherick of the BLM, the BLM decided to install a cattleguard from the east approach, old Hwy. 191, instead of a fence.
