The San Juan County Commission met in regular session on February 24, 1986 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.
The following members were present: Commissioner Black, Chairman
Commissioner Bailey
Commissioner Holliday
Minutes of the February 18, 1986 meeting were approved on the motion of Commissioner Holliday. The motion was seconded by Commissioner Bailey. UNANIMOUS.
PUBLIC MEETINGS FOR COUNTY MEDICAL FACILITIES
The Commission is going to hold two public meetings to address the future of the county's medical facilities. On Monday March 10, 1986 in Blanding at the San Juan High School Auditorium from 6 p.m. to 8 p.m. and on Tuesday March 11, 1986 in Monticello at the High School Auditorium from 7 p.m. to 9 p.m. The Commission will meet with the Blue Ribbon Committee on Monday before the public meeting at 5 p.m. Ted Stagg, CPA developer, will be present for both meetings.
WESTERN CARE CONSTRUCTION - PARKDALE NURSING HOME - PRICE
The Commission is invited to attend an open house of the Parkdale Care Center in Price on February 28, March 1, and March 2. Parkdale Center is owned by Western Care Construction and operated by Ruel McPhee. Commissioner Bailey said he plans on attending the open house. The Commission will encourage the Blue Ribbon Committee members to attend the open house and the county will reimburse their mileage.
PROPOSED COUNTY JAIL - Application Community Impact Fund Board
Commissioner Black said he has heard negative feed back from local people concerning the county proposing to build a new county jail. Commissioner Black said it would be a good idea to meet with both city councils again to express the importance of this issue. Commissioner Bailey suggested that the Commission hold community meetings to provide more information to the public on the reasons why the county needs to build a new jail. The county is presently being sued on a case of a prisoner (which is a city prisoner). It is important to both the cities and county that a new jail be built that meets the federal standards.

Dear Alice:
Please accept this letter as San Juan County's intent to submit to the Permanent Community Impact Fund Board an application in the very new future to fund the proposed construction of a public safety building in Monticello. As you are aware, we have been served with several lawsuits resulting from the present condition of the jail, and will continue to receive such lawsuits until we are able to build a new facility. This problem, along with declining price of oil and gas, a non-existing uranium industry, and many other severe economic factors within the county have made it impossible to secure any other type of funding or bonding. The estimate for the facility and the amount that the application will be for is $3,000,000.00.
We are in the process of finishing up the application in the coming week and anticipate to have it in the mail by the first week in March. Both Cities are aware of the importance of this project not only to the County but to the Cities also and have pledged their support.

A letter was also sent to both cities requesting that each city approve a resolution in support of the county's application and construction of the building. And also asked that the city's mayor, manager and council members write letters of support.
LIGHT - COUNTY PARKING LOT COURTHOUSE
Rick Bailey, Administrative Assistant, reported that Sheriff Rigby Wright requested that the county install a light for the parking lot on the east side of the county courthouse. Mr. Wright told Mr. Bailey that the deputies and secretaries on the night shift have a hard time seeing. Commissioner Bailey said that it would better to have the light on the pole that is there rather than the courthouse. Empire Electric will be contacted for installation.
FLAGPOLE - COURTHOUSE
Rick Bailey, Administrative Assistant, said that Young's Machine is working on the flag pole for the courthouse. The cost will be about $600. Mr. Bailey said that Young's will install the pole soon.
TELECOMMUNICATION USER AGREEMENT - ABAJO PEAK
Bill Bayles, Communications Engineer, met with the Commissioners with a proposed agreement for the Abajo Peak users. The Abajo Peak agreement consists of several agencies. Bruce Halliday, county attorney, reviewed the draft agreement and thought it was okay for final.
Mr. Bayles said Channel 20 will be off the air for awhile because of complications with the mountain transmitter.
SAN JUAN COUNTY-WIDE RECREATION CONTRACT
Bruce Halliday, county attorney, said that Eddie Allred, County-Wide Recreation Director, met with him concerning a recreation contract for the cities and the county. Commissioner Black suggested that Mr. Halliday draft a new contract/agreement to include the School District, City of Monticello, City of Blanding, UNDC, CEU, and White Mesa. Mr. Allred will get a list of all county recreation facilities and set up a program with the board. Each participant would pay so much percentage of the budget. Mr. Halliday will draft something according to this.
Rural Conmunity Fire Protection - JOHN BAKER
John Baker met with the Commissioners to report that the Rural Community Fire Protection Program (a federal program) is still in effect this year. The county has participated in this program the last 10 years and the county has received about $80,000 equipment on a 50/50 match basis. Mr. Baker said that he can get fire extinguishers, first aid kits, an air pack, etc. for the county for $2,000. The Commissioners told Mr. Baker to submit this request for them to review.
COUNTY FIRE WARDEN
John Baker presented the Commission with a draft position for a County Fire Coordinator (Fire Marshall). Commissioner Black asked Mr. Baker if the duties listed on the draft are duplicate duties of the State Fire Warden. Mr. Baker said that the State Fire Warden could provide these duties. The Comnissioners said that this position will still have to be discussed.
UNDC - TOLLY LAMEMAN AND CHUCK HARRISON
Tully Lameman and Chuck Harrison, UNDC employees, met with the Commissioners. Mr. Harrison met with the Commission earlier concerning the vocational education training program that UNDC is providing and asked if the county could help train people on heavy equipment. Conmissioner Holliday said the county has a gravel pit at Lems Draw, north of Blanding, that needs to be cleaned off this week. This can provide three to four weeks of training for the UNDC applicants that are interested. Commissioner Holliday said the county would provide the equipment and training and UNDC will have to handle the insurance and payments of the trainees. Commissioner Black suggested that Job Service in Blanding be contacted and see if anyone is interested.
WILDERNESS STUDY EFFECT ON RESERVATION
Commissioner Black informed Tully Lameman and Chuck Harrison, employees of UNDC, about the Wilderness Study Areas proposed by the BLM. There is approximately 200,000 acres on Cedar Mesa and Mule Canyon that is in the WSA. Commissioner Black explained that when an area is declared Wilderness all roads are closed. Contnissioner Black said that these are main wood supply areas and no wood can be touched if declared Wilderness. One of the strongest points that can be made by the Indian people is that above the canyon rims be left open for wood gatherers. The WSA proposal volume is in the EIS and the public has 120 days to respond. The seven volume study can be picked up at the BLM office. Mr. Lameman and Mr. Harrison expressed concern on this issue and agreed to respond to the EIS.
COUNTY PERSONNEL POLICY - SICK LEAVE
Gail Johnson, county clerk, met with the Commissioners to discuss the county policy on shared sick leave. Mrs. Johnson said that a county employee wants to use her long-term sick leave to take care of her husband who has recently had a heart-attack. The policy reads that an employee who is forced to leave work due to an illness in the immediate family may have sick leave contributed by fellow employees. It does not point out that this person can use their own sick leave. The Commissioners said that an employee has to be sick to use their sick leave. The Comnissioners will put this on the agenda for March 17 to clarify the county policy on sick leave.
HEALTH CARE EMPLOYEES - COMPENSATION
Joyce Martin, Publisher of the San Juan Record, met with the Commissioners concerning health care administrative employees who may have been paid overly compensated. Before publishing an article Ms. Martin wants accurate information. The Commission said that the public has the right of access to all the county meetings. Commissioner Bailey said this was discussed at the Health Care Board Meeting last week and the information should be in those minutes. The Commissioners said they will not make a decision on the matter until they have all the information and a hearing is planned for next week.
UTAH STATE UNIVERSITY - RALPH HORNE - MOSQUITOS BLUFF
Ralph Home, USU Extension Area Supervisor, and two managers of the Mosquito Department Program, met with the Commissioners about the mosquito problem in Bluff. Mr. Home said in order for anyone to handle any chemicals that person has to be certified. Commissioner Holliday said there are five to six people in Bluff who are interested in getting certified. Mr. Home said they will survey the Bluff area and
determine what chemicals will be needed. Mr. Home will also hand out some materials for study. On March 12, 1986, USU is holding a three-hour pesticide certification workshop at the Blanding City Library at 1 p.m. Mr. Home said this workshop and the study materials should be very helpful to anyone taking the certification test.
COUNTY AGRICULTURAL AGENT - JIM KEYES
Ralph Horne, USU, informed the Commission that the University has hired Jim Keyes for County Agricultural agent. Mr. Horne said that Mr. Keyes has a strong background in cattle and sheep. Mr. Keyes also speaks Navajo and enjoys working with the Navajo people and is very enthused with the 4-H program. Mr. Keyes will officially start April 1.
TANK STAND - ROAD SHED
Commissioner Bailey said that George Barry asked him if the county was interested in selling the old tank stand that is at the east county road shed. Merz Hugentobler is going to look into the value of it.
OLJATO BRIDGE - DOT MEETING
Commissioner Bailey reported on the DOT meeting of last week. One of the things discussed was getting the old bridge at Oljato on the bridge replacement program. Commissioner Bailey said they are drawing some plans of the old bridge that were there and taking pictures of the bank sites. Commissioner Bailey feels that it will go.
SAN JUAN HEALTH CONSORTIUM BOARD
Commissioner Holliday said that a director needs to be appointed to the San Juan Health Consortium Board. The Commission asked Commissioner Holliday if he would be interested in serving on this board. Commissioner Holliday will be recommended by the Commissioners at the next meeting.
HOUSE BILL 308 - TRUST FUND
Commissioner Black reported that Representative Dave Adams called him last week and said that House Bill 308 was on the agenda for Thursday. Commissioner Black said he flew to Salt Lake and worked with Jack 01 sen on making some wording changes on the bill of the trust fund. The bill was changed to read the total amount of the trust fund (of any county) will be set on it's highest assessed value year. The bill came out of committee with only two negative votes and with favorable recommendation. The bill still has to go through the house and senate. Commissioner Black said that if it doesn't pass there is still enough time to do it next year.
WILDERNESS COMMITTEE MEETING - COUNTIES
Commissioner Black said there is a Wilderness Sub-Committee Meeting of the counties in Price on March 4, 1986. It was set up by the Governors' Advisory council. Commissioner Holliday will attend this meeting.
FEDERAL REGULATION ON MINING
Commissioner Black said he received a copy of the Federal Regulation on mining claims from the BLM. Commissioner Black he is going to write a letter to the Governor about House Bill 71.
AOG BOARD MEETING IN PRICE
Bill Howell, AOG, called Commissioner Black to report on the AOG Board meeting that was last Friday in Price, Utah. The AOG Board voted Bill Howell to direct all of his time until June 15 on the proposed BLM Wilderness Study Issue and to respond to the Environmental Impact Study. Mr. Howell said the four counties will work together on this project. It was approved that Harvey Merrell, a consulting geologist in Moab, will be hired and work under the direction of Bill Howell. The four counties are asked to contribute a total $6,000 for this effort. Commissioner Bailey made a motion for the county to contribute $1500 in cooperation with the other three counties. The motion was seconded by Commissioner Holliday. UNANIMOUS.
HOUSE BILL 71 - REGULATING SMALL MINES
The Commission received a copy of a letter that Grand County Commission wrote to the Governor requesting that he veto House Bill 71 (that would put small mines under regulation of the state.) Grand County's position was that this bill is an unnecessary expenditure of the tax payers' money because it's a duplication of what the federal government already does. The Commission authorized Commissioner Black to write a letter to the Governor about this and send a copy of the BLM Federal Regulations.
BLM/FOREST SERVICE
Commissioner Black reported that the proposed BLM / Forest Service land exchange has been completed by the EIS and will soon be before Congress.
NACO LEGISLATIVE CONFERENCE
Commissioner Black said that he will be in Washington D.C. this Friday to a NACO Legislative Conference. He will also attend a BLM Moab district advisory council meeting on March 6.
COUNTY POLICY FOR CAPITAL PURCHASING
Commissioner Black said that it has come to his attention that some county departments have been making capital purchases without approval. The Commission decided this will be put on the agenda for March 17. The Commission will adopt a county policy for capital purchases. A limit will be set on the amount of money each department can spend prior to Commission approval.
BLANDING AIRPORT OPERATING AGREEMENT
Commissioner Holliday reported that he received the Airport Operating Agreement with Blanding City. The Agreement is on file in the clerk's office.
UTAH DEPARTMENT OF TRANSPORTATION
Scott E. Nay, Road Inventory Supervisor of UDOT, will meet with the Commission March 3, 1986, at 11 a.m. to go over the Class "B" roads in the county. UDOT cooperates with the Federal Highway Administration. The mileage on these maps determines how much money the county gets from the Class "B" Fund allocation.
