MINUTES OF THE BOARD OF COUNTY COMMISSIONERS MEETING HELD DECEMBER 24, 1979.
TIME: 10:00 A.M.
PRESENT: COMMISSIONER CHAIRMAN E.S. BOYLE, COMMISSIONERS BILL DUNOW AND CALVIN BLACK. ALSO PRESENT AL HASKINS AND DEPUTY CLERK PEGGY JORGENSEN.
Minutes of the previous weeks meeting were read and approved, this being done upon a motion made by Commissioner Dunow and seconded by Commissioner Black to carry the motion.
COMMISSIONER BOYLE REPORTS:
Commissioner Boyle reported that the Hospital Board will meet January 9, 1980 with a representative of the American Hospital Service.
Commissioner Boyle also reported that a Law-Suit has been filed in the Seventh Judicial District Court against the Southeastern Health District et al., and inquired of the Commissioners which County's attorney should represent the District. They will check with the County Attorney Bruce Halliday on this matter.
Commissioner Boyle also presented a letter he had received from U.N.D.C. inviting the Commission to have a luncheon meeting with representatives from U.N.D.C. to discuss and consider their road program. The secretary will write a letter accepting the invitation.
Commissioner Boyle brought to the attention of the Commission the Budget and the need for the Commission to let the Deputy Auditor know what accounts payable are comming out of. In the future a memo will be sent to Mr. Francom to help stop the confusion on these matters.
The Commission also had a discussion on the pay scale. TRAVEL COUNCIL:
Ms. Vivian Sande of the Travel Council met with the Commission to relay to them that the Travel Council has approved a 5% increase, 1 step raise for both she and her secretary. The Commission also advised Ms. Sande that other than a step raise after the three month trial period, no step raises will be given, but that Grade raises will be given if justified, and increases will only be given if the person is qualified and meets the job requirements. They suggested that the recommendations of the board be submitted and that this be in the form of a letter stating that this is the end of the probationary period.
LETTER FROM CITY OF OREM:
The Commission received a letter from the City of Orem requesting the County's support in defeating House Bill 303 this next Legislative session. The Commission will sign a Resolution in support of this effort and mail copies of it to Senator Omar Bunnell, Hardy Redd, and Governor Scott Matheson. The Resolution will be copied in the Minutes of this meeting. Commissioner Black made the Motion that the Commission adopt and a apply this resolution, Commissioner Dunow seconded for a unanimous decision. Commissioner Black explained to the Commission the essence of House Bill 303, and extent of its effects of the Bill on local governments. The Commission discussed this Bill at length.
COMMISSIONER DUNOW REPORTS:
Commissioner Bill Dunow reported that he had gone to the airport to check out the situation there of the gravel being too high near the doors of the hangers. He stated that a crew had gone out Friday to correct the problem and that there will not be problem with drainage now.
Commissioner Dunow also reported that there has been an outbreak of people writing foul language on the sandstone walls near the swinging bridge and other destructive things happening in that area. He will meet with Ed Scherick of the B.L.M. to discuss these things and also with the Sheriff's Office to see about a patrol being set up there.
AL HASKINS:
Al Haskins reported to the Commission that the Human Services Board of CAP-Title 20 has elected deal Bradford to be the Blanding Representative for this board.
He also reported that he had spoken with S. E. Boberg regarding the completion of the Montezuma Creek Swimming Pool.
CORRESPONDANCE:
The Commission received correspondance from the following: Bill Dinehart on State Lands ( In file) HUD
Bruce K. Halliday re: Splitting the Clerk-Auditor's Office (Copy of letter sent to Emery Co.) NACo. UNDC___Annual report.
WORK SCHEDUAL:
The Commission called all office heads to the Commission meeting to discuss with them the work schedual and the problems that are being experienced trying to arrange a pay scale for a 37 1/2 hour work week. After due discussion it is the decision of the Commission and the Department Heads that the office hours of the San Juan County Courthouse will be the same, from 8:30 A.M. to 5:00 P.M. with employees taking one-half hour for lunch, entitleing them to a full pay for a forty hour week. A memo and new pay scale will be given to all departments and this action will come into effect January, 1, 1980.
BEER LICENSE APPROVED:
The Commission received from the County Clerk an application for Beer Licence for the TOP OF THE HAT LOUNGE in Mexican Hat. The Sheriff had investigated the applicant and found everything in order. The

Commission approved this beer license, this being done upon a motion made by Commissioner Dunow
and seconded by Commissioner Black to carry the motion. The license will be issued to J. D. Mueller.
THE FOLLOWING IS A RESOLUTION PASSED BY THE SAN JUAN COUNTY COMMISSION DECEMBER 24, 1979.
RESOLUTION
WHEREAS, the most representative form of democracy in the United States today is that type of government closest to the people: cities, counties, special districts and school districts; and
WHEREAS, local governments in the state of Utah are subject to daily scrutiny by their constituency and must account for their activities on a more regular basis than any other level of government; and
WHEREAS, local government representatives are in the best position to determine whether or not tax limitation mandates are necessary within their respective jusisdic-tion; and
WHEREAS, attempts by higher levels of government to regulate the affairs of local governments have typically resulted in increased costs and decreased self-destiny determination, many times to the detriment of local tax payers; and
WHEREAS, since 1964 the budget of the state of Utah grew at an appreciably higher rates than budgets of local units of government; and
WHEREAS, the Legislature of the state of Utah has adopted a revenue limitation bill that is restrictive, inefficient and unworkable in its application to local government; and
WHEREAS, the Revenue and Appropriations Limitation
Law imposes upon the will of the people in local government
jurisdictions applications that could be adverse to
the will of the people.
NOW THEREFORE, BE IT RESOLVED that the State Legislature in its 1980 budget session amend the Revenue and Appropria-tions Limitation Law to exempt local units of government from the limitation provisions set forth;
BE IT FURTHER RESOLVED that the State Legislature endorse the right within general policy reasoning of local governments to determine their own destinies;
BE IT FURTHER RESOLVED that the Legislature of the State of Utah henceforth consider all possible future legislation in light of the philosophy that government closest to the people is that government most responsive to the people.

Dear Mr. Mitchell:
As a member of the Southeastern Utah General Health District Board from Grand County, I am requesting that the State Social Services Department immediately initiate an audit of this health unit prior to the retirement of the present Director of the Health District.
We are under the impression that there is a surplus of anywhere from $50,000 to $100,000 and we would like to know exactly the amount of the surplus. The Grand County Commission have instructed our auditor not to transfer any more county funds until we have an audit of the health district and the surplus balance is reduced to zero.
The audit at the present time is in order to protect both the retiring Director as well as the new Director. As over-seers of the tax money of Grand County, we see no reason at all for any department to have a large surplus.

Dear Commissioner Boyle:
As you are aware, the State Legislature during its last session enacted a Revenue Limitation Law known as House Bill 303. There has been much controversy surrounding the effects of that law as they pertain to the ability of local units of government in servicing their citizens. Many studies have been conducted all pointing to the restrictive nature of the law and the loss of flexability at the most local level of government. We believe this bill is morally wrong.
We have heard so many times, not only from ourselves but also from officers in State govern-ment, the cry of undue hardships being imposed by the Federal government. In my judgment, this bill is no different. Although not necessarily by design, nonetheless the State Legis-lature has done the same thing that many federal regulatory agencies do each day - erode the ability of local governments to be independent and the most representative form of decocracy in this country.
I am convinced the elected legislators are responsive to the voices of their constituents. I further believe that no one is closer to representing the needs and expressing concerns of the people than those of us who are elected to serve on City Councils, County Commissions, or School Boards. We are in the best position to advocate to our elected representatives in State government the feelings and decisions of their constituents, not special interest lobby groups from Salt Lake City and other areas.
It is time to make our wishes known. This City will send the attached resolution to our legislators. I urge you to seriously consider adopting a similar resolution and forwarding your feelings on to your elected State representatives and Senators.
