MINUTES OF THE BOARD OF COUNTY COMMISSIONERS' MEETING HELD IN MONTICELLO, UTAH, ON AUGUST 24, 1959 at 10 A. M.
The Board of County Commissioners of San Juan County, State of Utah, met in regular public session on the 24th day of August, 1959, at the hour of 10 o'clock A. M., at the regular meeting place of said Board in the County Court House in Monticello, Utah.
On roll call the following members were determined present:
William C. Walton, Chairman Marion H. Hazleton, Commissioner Leonard J. Bartell, Commissioner
also present, Ada Palmer, Clerk
Absent: None
At the hour of 10:30 A. M. the Chairman announced that one purpose of the meeting was to receive sealed bids for the purchase of $155,000 Recreational Facilities Bonds of San Juan County, Utah. The County Clerk presented to the Board of County Commissioners the sealed bids which had been received for the purchase of said bonds, and upon opening and tabulating said bids the board found them to be as follows:

Thereupon, it was determined that the bid of Thornton D. Morris & Company of Salt Lake City, Utah, for the purchase of said bonds was the lowest and best bid received, and the following ordinance was intro-duced in written form by Marion H. Hazleton, was read in full and pursuant to motion made by Leonard J. Bartell and seconded by William C. Walton was adopted by the vote set out in the endorsement appearing thereon.
The ordinance was then signed by the Chairman of the Board of County Commissioners and attested by the Clerk and the seal of San Juan County was impressed thereon. The ordinance is as follows:

An Ordinance confirming the sale and authorizing the issuance of $155,000 Recreational Facilities Bonds of San Juan County, Utah; providing for the payment of such bonds and levying taxes therefor.
WHEREAS an election was duly called and held in San Juan County, Utah, on May 29, 1959, and at said elect-
tion the following proposition was carried by a vote of 271 of the qualified voters of San Juan County
who paid a property tax therein in the year preceding said election voting for said proposition and 89 of such voters voting against such proposition:
Shall San Juan County, Utah, incur debt and issue bonds to the amount of $155,000 to run for a period of not more than 10 years from the date thereof and to bear interest at the rate or rates not in excess of 4 1/2% per annum for the purpose of acquiring through purchase and construction and improving county recrea-ational facilities, including land, buildings and equipment?
; and
WHEREAS said bonds have heretofore been offered to the Utah State Commission has waived its right to purchase said bonds; and
WHEREAS pursuant to notice of sale duly brought to the attention of potential purchasers of said bonds, this Board of County Commissioners has received sealed bids for the purchase of said bonds, and has de-termined to sell said bonds to the bidder submitting the lowest and best bid, namely, Thornton D. Morris & Company, whose bid reads in full as follows:
We will pay you par value a premium of $756.50 for $155,000.00 of San Juan County, Utah, General Obligation Recreational Facilities Bonds- Series September 1, 1959-- as described in your official notice of sale, and bearing interest at the rate of 3.25% per annum.
Enclosed is a cashiers' check payable to San Juan County in the amount of $7800.00; such check to be held by you as evidence of our good faith if we are successful bidders and to be credited against the purchase price of the bonds. If we are not successful bidders this check is to be returned to us immediately.
We shall appreciate your early advise as to the result of the bidding.

NOW, THEREFORE, the Board of County Commissioners of the County of San Juan ordains as follows:
Section 1. That for the purpose of acquiring through purchase and construction and improving county recreational facilities, including land, buildings and equipment, and for the purpose of paying all legal, engineering and fiscal expenses reasonably incurred in connection therewith and in connection with the authorization and issuance of the bonds herein authorized, there shall be issued the bonds of San Juan County in the sum of $155,000.
Section 2 That said bonds shall be designated "Recreational Facilities Bonds", shall be in the total principal amount of $155,000, shall be dated September 1, 1959, shall be in the denomination of $1,000, shall bear interest from date until paid at the rate or rates hereinafter set out, payable March 1, 1960, and semiannually thereafter on the first days of March and September of each year. The bonds shall be payable as to both principal and interest in lawful money of the United States of America at First Se-curity Bank of Utah, N. A., in the City of Monticello, Utah, and shall mature serially in numerical order without option of prior redemption on September 1 of each of the years and shall be numbered and bear interest as follows:

Section 3 That said bonds shall be signed by the Chairman of the Board of County Commissioners, attested by the County Clerk and shall have impressed thereon the official seal of San Juan County. Interest fall-ing due on said bonds on and prior to maturity shall be evidenced by appropriate coupons to be thereto attached, which coupons shall be signed by said officials by their facsimile signatures, and said offic-ials, by the execution of said bonds, shall adopt as and for their own proper signatures their respective facsimile signatures appearing on said coupons.
Section 4 That the bonds and the coupons to be thereto attached and the endorsement to appear on the back of each of said bonds shall be in substantially the following form:

KNOW ALL MEN BY THESE PRESENTS, that San Juan County, Utah, hereby acknowledges itself to be indebted and for value received hereby promises to pay to the bearer hereof the sum of One Thousand
Dollars ($1,000) on the first day of September, 19____, with interest thereon at the rate of
______________ per cent (______%) per annum from date until paid, payable March 1, 1960, and semi-
annually thereafter on the first days of March and September of each year, interest falling due on and prior to maturity being payable upon presentation and surrender of the attached interest cpu-pons as they severally become due. Both principal of and interest on this bond are payable in law-ful money of the United States of America at First Security Bank of Utah, N. A., in the City of Monticello, Utah.
This bond is one af an issue of $155,000 bonds, numbered 1 to 155, inclusive, all of like date, tenor and effect, except as to maturity (and interest rate), issued by San Juan County under the provisions of Title 17 of the Utah Code, 1953, for the purpose of acquiring through purchase and construction and improving county recreational facilities, including land, buildings and equip-ment, and for the purpose of paying all legal, engineering and fiscal expenses reasonably incurred in connection therewith and in connection with the authorization and issuance of the bonds of the issue this is one, and is issued pursuant to an ordinance adopted by the Board of Commissioners of said county on August 24, 1959, after having been duly authorized at an election held on May 29, 1959, by the qualified voters of said county who paid a property tax therein in the year preceding said election.
The Board of County Commissioners of San Juan County hereby covenants and is by law required to levy annually a sufficient tax to pay the interest on this bond as it falls due and also to constitute a sinking fund for the payment of the principal hereof when due.
It is hereby certified, recited and declared that all acts, conditions and things essential to the validity of this bond have happened and have bean done in regular and due time, form and manner and that every requirement of law affecting the issue hereof has been duly complied with and that this bond is within every debt and other limit prescribed by the Constitution and Laws of the State of Utah and that the full faith, credit and resources of San Juan County are hereby irrevocably pledged to the punctual payment of principal of and interest on this bond according to its terms.
IN WITNESS WHEREOF San Juan County, Utah, acting through its Board of County Commissioners, has caused this bond to be signed by the Chairman and attested by the Clerk of said county and has caused the corporate seal of said county to be hereto affixed and the annexed interest coupons to be signed with the facsimile signatures of said Chairman and Clerk, which officials, by the execu-ion hereof, do adopt as and for their own proper signatures their facsimile signatures appearing on each of said coupons, all as of the first day of September, 1959.

Section 5
That there shall be and is hereby levied in each year while any of said bonds is outstanding and unpaid, in addition to all Other taxes authorized by the Constitution and Laws of the State of Utah, an unlimited tax on all taxable property in San Juan County fully sufficient to pay the interest on said bonds as the same shall become due and to pay the principal of said bonds falling due in each year. Beginning with the year 1959 the appropriate officials of San Juan County, Utah, shall, without further instructions or di-ections from this Board of County Combissioners, extend and collect the aforesaid tax, which shall be de-voted and applied solely to the payment of interest on and to the creation of a sinking fund for the pay-ment of the currently maturing principal of the bonds herein authorized as they fall due in each and every year until all of the said bonds are retired. Principal or interest falling due at any time when the pro-ceeds of said tax levy may be available shall be paid from other funds of the county and such funds shall be reimbursed from the proceeds of said taxes whenever said taxes shall have become available.
Section 6.
Thatthe sale of the bonds herein authorized to Thornton D. Morris & Company of Salt Lake City, Utah, as recited in the preamble hereto, at the price of par and accrued interest to the date of delivery plus a premium of $756.50, is hereby in all respects ratified and confirmed. Said bonds shall be printed and executed as soon as may be and thereupon shall be delivered to said purchaser upon receipt by the Treasurer of San Juan County of the purchase price for said bonds.
Section 7
That this ordinance, together with the names of those voting for and against it, shall be published immediately after its adoption in the San Juan Record, a newspaper published and of general circulation in San Juan County, and shall take effect immediately upon the expiration of fifteen days from the date hereof.
Section 8
That all ordinances, resolutions and orders or parts thereof in conflict herewith are to the extent of such conflict hereby repealed.

This meeting immediately followed the above meeting and matters not concerned with the Sale Of Bonds were considered. All Commissioners and Clerk were present.
CIVIL DEFENSE DIRECTOR CONFERS WITH BOARD
A. J. Redd met with the Board to present the Summary of Duties and Reference Books for the various de-partments of Civil Defense to be delegated by the County Commissioners to the following departments:
Education: Zenos L. Black, Superintendant of Schools Engineering: George H. Newell, County Engineer Welfare: Harold Blanck, Welfare Department Fire Service: Sheriff's Department, Raymond McAlister Health: Marion H. Hazleton, County Commissioner in charge of Health
The Clerk was directed to send notice to the various departments of Civil Defense that a special meeting will be held in the Commissioners' Room on August 31st at 10 A. M. for presenting such instructions.
LABOR DAY TO BE OBSERVED BY COUNTY EMPLOYEES
It was unanimously agreed that Labor Day will be observed by all County Employees. There will be no Commissioners' Meeting on that day but will be continued until Tuesday, the 8th day of September.
REQUEST MADE TO KEEP ROADS OPEN TO BM RANCH
Mrs. William Junge and family were present to request that the County Commissioners consider keeping the road to the BM Ranch open during the winter months. The ranch is situated on the forest reserve south-west of Monticello.
After due consideration Mrs. Junge was promised that the County Attorney would be requested to give an opinion as to the responsibility of the County in regards to County and private roads, and she would then be given an answer.
EASTERN UTAH CATTLE GROWERS REQUEST COUNTY TO BE DESIGNATED AS DROUTH STRIKEN AREA
A letter has been received from the Eastern Utah Cattle Growers Association asking that the Commissioners petition Governor Clyde to have San Juan County designated as a drouth striken area. After due consider-ation, it was requested that the County Clerk direct the letter to Clem Washburn of the San Juan Cattle Growers' Association for their consideration. The Commissioners feel that all such requests should come from local people.
HEALTH PROGRAM OF COUNTY DISCUSSED
Mrs. Fern Peterson, Health Supervisor from Price, Utah, and Mrs. Oakes, Nurse from Blanding, Utah, were present to discuss the Health Program of the County. The contract to be made with the State was discussed and a preference was made for Provision A under the contract. The contract was signed by Wm. C. Walton in behalf of the County and to be sent to the State for approval.
Mrs. Oakes will be hired by the County as a Public Health Nurse in the County and arrangements are under way for the hiring of another nurse. Salary, sick leave, and vacations were discussed and it was unan-imously agreed that the Nurse is responsible to the County Commissioners.
The Clerk was directed to write to the State Board of Health asking that San Juan County be given use of the State Nurse's car that has previously been used in the County.
