SAN JUAN COUNTY COMMISSION MINUTES MAY 23, 1988
The regular meeting of the San Juan County Commission commenced at 10:00 A.M. at the San Juan County Courthouse in Monticello, Utah.

A motion to approve the minutes of May 16, 1988 as corrected was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.
COMMISSIONER CALVIN BLACK'S REPORT
Mental Health Funding - Commissioner Black wrote a letter to Sherril Burge, Chairman of the State Mental
Health Board requesting a re-evaluation of the funding approved for San Juan County for the coming year.
Lake Powell Land Exchange - A letter was drafted by Commissioner Black to send to the Congressional
Delegation's offices giving the legal description of the lands and information to draft legislation for
the Lake Powell land exchange.
Blue Ribbon News - Commissioner Black recommended that the Commission subscribe to the Blue Ribbon News as
it appears to be a worthwhile organization. The fee is $100.00 and an organizational list can be sent for
those to receive the paper.
Halls Crossing Dump - Bill Duckett called about the Halls Crossing Dump. The deed has not been received
from the Bureau of Land Management yet. The BLM has already surveyed and marked the area. A map will be
given to Mr. Duckett so he can locate the dump. As soon as the deed is received the County will put in
the road and take equipment down to dig the pits. An agreement will be drawn up as soon as Mr. Duckett
finds out what the National Park Service is paying at the Bullfrog dump.
Bluff Gravel Pit - Jerry Holliday had taken pit run gravel from the Bluff pit as he was under the
impression that a survey point was the boundary line. The Commissioners determined that the matter be
considered closed.
Hammond Canyon Property/40 Acres - A letter has been drafted to Senator Garn, Senator Hatch and
Congressman Nielsen regarding 40 acres of land near the mouth of Hammond Canyon. It was designated as a
school site in 1924 and The White Mesa Ute Tribe is requesting the 40 acres.
Hole-in-the-Rock Jamboree - A letter from Mark Smith gave an accounting of the Hole-in-the-Rock Jeep
Jamboree held in April. The comments from participants were favorable and Mr. Smith felt that subsequent
tours would be worth while projects. The over-all income was $9,095 and their total costs were
$11,703.71.
COMMISSIONER KENNETH BAILEY'S REPORT
Montezuma Creek Police Station - Commissioner Bailey reported that they have all the measurements and necessary specifications to draw up a bid proposal on the Montezuma Creek Police Station remodeling. Red Mesa Chapter Meeting - Commissioner Bailey and Administrative Assistant Rick Bailey attended the Red Mesa Chapter Meeting to discuss the BLM San Juan Area Resource Management Plan and the Hovenweep expansion. The Red Mesa residents are concerned about the restrictions placed on the wood gathering which is essential to their way of life and would prefer the management remain as it now exists. The residents indicated that they would write letters to the Commission and/or the BLM regarding their concerns. Cat/Dozer - Shop Foreman Victor Nebeker reported in the road department meeting that he estimated that the 1976 Fiat Allis FD30 cat/dozer would require $21,000 in the next eighteen months for repairs and maintenance. A used 1983 Fiat Allis would be $88,000 if purchased for cash or $90,000, less. $17,000 trade-in, if not purchased for cash. The road department recommends that the new one be purchased. The Commission indicated that it would be purchased from the bonds issued by the Utah Counties Finance Cooperative. Commissioner Bailey made a motion to approve the purchase of the cat/dozer from Cate Equipment. Commissioner Black seconded the motion. UNANIMOUS.
Road Department Employee - Michael Holyoak worked for the road department last year as a mower operator and patch crew. He reapplied for 6-month employment this year and was recommended as a good employee. Commissioner Bailey made a motion to hire Michael Holyoak at grade 5 step 1, $6.02 per hour, as a 6-month employee with the road department. Commissioner Black seconded the motion. UNANIMOUS.
Oljato/Navajo Mountain Road - Navajo Tribe Representative Rich Raszweig called to report that he has met with Senator Jake Garn and Congressman Howard Nielsen's staff on applying for a special appropriation to fund the engineering on the Oljato to Navajo Mountain road. Senator Garn is ready to present the proposal to the Appropriation's Committee. It will be earmarked as additional funds to the Bureau of Indian Affairs. The $950,000 will need to be broken down and a map of the designated route mailed to Senator Garn for the presentation. Commissioner Bailey and County Surveyor Doug Pehrson will compile the information and mail it to Senator Garn.
Independent Truckers Agreement - Commissioner Black signed the Independent Truckers Agreement with Dennis Cosby.
COMMISSIONER MARK MARYBOY'S REPORT
Red Mesa Chapter Meeting - Commissioner Maryboy reported that there was a very good turnout at the Red Mesa Chapter meeting held last Friday. A resolution opposing the BLM San Juan Area Resource Management Plan was passed, specifically the Cedar Mesa area. They will forward the resolution to the Commission within the next week.
Cemetery - Red Mesa Chapter officials would like to designate an area on the reservation or in Bluff on one of the UNDC properties as a cemetery.
Trash Dump - Land was approved to set up a trash dump in the Red Mesa area. The Bureau of Indian Affairs and the Indian Health Service will be approached to establish the dump and have the County dig the trenches. The Commission indicated that as soon as the land was acquired and fenced the County will provide the same services as in other County dumps.
Fire Truck - Red Mesa Chapter Officials would like to have the old Montezuma Creek fire truck placed in the Red Mesa area. Administrative Assistant Rick Bailey stated that the truck is owned by the State and they have no authority for fire control on the reservation. The State will be asked if the truck can be put in that area.
ADMINISTRATIVE ASSISTANT RICK BAILEY
Senior Citizens Bus Driver - Administrative Assistant Rick Bailey reported that the recently hired bus driver, William D. Brown, has accepted employment elsewhere. Consequently Mr. Bailey recommended that Robert Matthews be hired at grade 2 step 1, $5.33 per hour, to replace Mr. Brown. Commissioner Bailey made a motion to approve the recommendation and Commissioner Black seconded the motion. UNANIMOUS. Mary Ann Brown has also been serving as Director of the Senior Center in Monticello and as she will be moving with her husband, Mr. Bailey will advertise for a person to fill that vacancy.
COUNTY CLERK GAIL JOHNSON
May Tax Sale - County Clerk Gail Johnson met with the Commission to discuss the various pieces of property to be auctioned at the Tax Sale on Wednesday, May 25. Each piece of property was reviewed to determine whether it should be sold at market value or just for the taxes owed on the property. Registration Agents - A motion to appoint the following as registration agents was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Mrs. Johnson still needs to obtain registration agents in Bluff, Montezuma Creek and Mexican Hat. Mail-in registration forms have been placed in post office facilities and in some chapter houses to expedite the registration of qualified voters. The registration agents will have registration forms available in their homes on September 6,7, and 8, prior to the Primary Election, and November 1,2 and 3, prior to the General Election. Registration forms can be obtained from the County Clerks office until August 23rd for the Primary Election and October 18th for the General Election.
Circuit Court Contract - The contract for the use of the Circuit Court will be the same terms as negotiated last year. The State had determined that the case load of the Circuit Court was down and had indicated that the costs would be determined on a 3/4 time. However the work load has remained constant therefore County Clerk Gail Johnson requested that the full-time equivalent be restored. The State concurred therefore Mrs. Johnson recommended that the contract be approved. The total of the contract will be $20,328. A motion to approve the contract was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.
State Retirement Information - County Clerk Gail Johnson reported that the non-contributory retirement has gone from 7% up to 7.54% effective July 1st. The County employees who are on the non-contributory should have their 401K reduced by 2.81% to keep it at the 13% total in retirement benefits.
San Juan County Assessed Value - The State Assessed Rolls were delivered to the County last Thursday. The assessed value went up from $556,749,835 last year to $572,820,274 this year. Mrs. Johnson hasn't had an opportunity to review the recap sheets to find where it went up but will report back to the Commission when she reviews it.
CURRENT BUSINESS
Tannery Operation - The Mayor and Monticello City Council met with the Commission to get support for a tannery operation that is interested in locating their operation in Monticello. The Council indicated to the Commission that the Impact Board was meeting on June 12th and that the application for this project was on the agenda for that meeting. Commissioner Black stated that it would be very difficult to assemble a completed proposal on such short notice, but with the help of Rick Bailey and Bill Howell it may be possible. The Council stated the needed information should be available this week to complete the proposal for presentation to the CDBG board at their June meeting. Commissioner Black stated that it would be important to get the proposal to all the board members prior to the meeting for their review. Otherwise they will be unable to act on the request before their August meeting. Commissioner Bailey also stated that he felt that the cooperation and resources of the County were absolutely necessary to get the funding for this project and the County will do all they can to help the city be successful.
Montezuma Creek Road - Harold and Erma Ransdell met with the Commission to discuss the sharp curve at the bottom of the hill on the Montezuma Creek road. Howard Ransdell will be moving down there with his family and will need to move in a trailer to live in. The present turn will not allow a large trailer to be maneuvered down there. Mr. Ransdell requested that the road be widened at that corner to allow more safety at that section of the road.
Recreation Department Seasonal Employees - Recreation Director Edward Allred requested a pay increase for the summer employees of the Recreation Department. After discussing the positions the Commission determined that first year employees should begin at the set minimum wage with additional consideration being given to those employees who have previous work experience or the necessary skills to warrant a pay increase. A request for a salary increase for Mr. Allred was taken under advisement by the Commission.
BLM San Juan Area Resource Management Plan - Jean Melton discussed the ramifications of the BLM San Juan Area Resource Management Plan with the Commission for an article she is writing.
San Juan County Development Board Matter - A letter from the San Juan County Economic Development Board recommended that Dianne Nielson be appointed to the Board. Commissioner Bailey made a motion to approve the recommendation. Commissioner Maryboy seconded the motion. UNANIMOUS.
Ken's Lake Ordinance - The Ken's Lake ordinance was returned from the Grand County Commission with the recommendation that camping be allowed. The ordinance was drawn up to try and curtail the beer parties that have been occurring in the area. The ordinance had recommended a curfew at 11:00 p.m. each night but if camping were allowed the curfew could not be enforced. A meeting with the law enforcement agencies and the Grand County Commission will be arranged to resolve the issue.
Bluff Property - County Attorney Craig Halls discussed his findings pertaining to the dedicated right of way on the Bluff property owned by Rosalie Goldman and subsequently deeded to Mary Fountain. A dedicated right of way is basically the same as a free title or deeded right of way. The Commissioners instructed Mr. Halls to give Ms. Fountain a quit claim deed for the right of way to clear the title.
Dry Valley Road - Dale Lyman made a request that the road department blade the Dry Valley road leading to the Slush mine. Some shale had been put on the road at one time but subsequent blading had pushed most of the shale off. It has been several years since the road has been maintained and is in need of some work as the mine is going to be reopened in the near future. County Engineer Doug Pehrson will be asked to inspect the road to determine what needs to be done.
Montezuma Creek Road Shed - Sealed bids for the erection and insulation of a metal building were received from:

Commissioner Bailey made a motion to accept the low bid from Young Builders for $13,347.00 for the building and Option #2B from Superior Fencing for $12,283.00. Commissioner Black seconded the motion. UNANIMOUS.
Computer Requests/County - John Fellmeth explained the various departmental computer needs and requested approval to purchase three computers, one for the road department, one for the surveyor's office and one for his office; and two call accounting systems, one for the courthouse and one for the hospital at a cost of $995 each. Commissioner Bailey made a motion to approve the purchase of three computers, miscellaneous peripheral devices and software, including the call accounting systems that were discussed. Commissioner Black seconded the motion. UNANIMOUS.
Hospital Administrator Position - Hospital Administrator John Fellmeth reported that the applications for a new hospital administrator will be accepted until the end of May. Mr. Fellmeth and Administrative Assistant Rick Bailey have reviewed the applications received and selected four or five they feel would be the most effective.
