MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD
JANUARY 23, 1984
The San Juan County Commission met in regular session on Monday, January 23, 1984, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah.
The following members were present: Commissioner Calvin Black, Chairman
Commissioner Robert Low Commissioner Kenneth R. Bailey was absent.
Minutes of the previous meeting were approved on the motion of Commissioner Low. The motion was seconded by Commissioner Black and carried unanimously.

GRANT LEAVITT MEETS
Grant Leavitt met with the Commission to discuss a location for the Golf Course Pro Shop because the lease on the present location expires March 1, 1984. Mr. Leavitt and the Commission also discussed the proposed land transfer between the City of Monticello and San Juan County. The Commission will meet with Mr. Leavitt, Mayor Redd, Doug Pehrson and Bruce K. Hallidya on February 6, 1984, to discuss this further.
APPLICATIONS FOR ENERGY IMPACT MONEY DISCUSSED
Al Haskins met with the Commission and reported on applications he is submitting for Energy Imapct Money for the Nursing Home. The Commission also requested Mr. Haskins submit an application for Energy Impact Money for the proposed justice facility in Montezuma Creek.
POLICE SERVICE ON THE RESERVATION DISCUSSED
Commissioner Low reported that Commissioner Bailey has met with some of the Tribal Police Chiefs and they were enthusiastic about the proposed joint "facility between San Juan County and the Navajo Tribe in Montezuma Creek.
HEALTH CARE SERVICES DISCUSSED
Commissioner Low reported on the Health Care Services Board meeting* It was reported that December's census at the hospital was the lowest in years and the length of stays are shorter. Commissioner Low also reported that approximately 167 babies were born at San Juan County Hospital in 1983.
Commissioner Low also repoted that the Helath Care Services Board accepted the recommendation of the medical staff to review abortion cases on an individual case basis.
Commissioner Low also reported that there are twenty~four (24) people on the waiting list for the nursing home.
Commissione Low also reported that a contract has been agreed upon by the Health Care Services Board and Dove Creek, Colorado, for physician's services one (1) day a week with a guarantee of $300.00 per week.
Commissioner Low also reported that the detoxification unit at the hospital has been used eighteen (18) days since it has been built,
COMMISSIONER LOW'S REPORT
Commissioner Low reported that he has spoken to Van Wagner about getting the County gas pumps rekeyed and it would cost approximately $3,500.00 to do all of the pumps. Commissioner Low also reported that the ambulance service has been having problems with their gas pumps, too.
JOINT ROADS COMMITTEE MEETING REPORTED ON
Commissioner Black reported that he attended the UAC Emergency Joint Roads Committee Meeting to discuss the proposed change in the funding formula for B & C roads by the League of Cities. Commissioner Black reported that a motion was made by the Committee to reject the proposed change in the formula. Commissioner Black also reported that the matter will be further discussed at the March Joint Roads Committee Meeting.
COUNTY AGENT MEETS
Bob Thompson, County Agent, met with the Commission to discuss the 1984 Agreement for Extension-Education in the amount of $23,000.00. The Commission approved the agreement and reported that the amount had been approved in the 1984 budget.
TAX ANTICIPATION BONDS (Resolution 1984-B)
Gail Dalton, County Clerk, met with the Commission to discuss the 1984 Tax Anticipation Bonds. Commissioner Low made a motion to adopt a resolution to authorize $2,000,000.00 in Tax Anticipation Notes at 6.9% interest rate. The motion was seconded by Commissioner Black and carried unanimously.

The minutes of the previous meeting were read and approved, and other business was conducted. Thereafter, Commissioner Calvin Black introduced the following resolution in writing and moved its adoption:
RESOLUTION:
WHEREAS, there is an immediate and pressing need for raising funds to the amount of $2,000,000.00 for the year 1984 until the payment of taxes for the year 1984, and
WHEREAS, the sum of Two Million Dollars ($2,000,000.00) required to be raised is not in excess of seventy-five per cent (75%) of sid revenue for the year 1984, and
NOW, THEREFORE, BE IT RESOLVED that San Juan County, for the prupose of meeting the current ex-penses of sid County for the year 1984, shall borrow the sum of Two Million Dollars ($2,000,000.00) and for that purpose as evidence of such indebtedness shall issue twenty (20) notes, numbered one (1) to twenty (20), both inclusive, in the denomination of $100,00.00 each, bearing interest at the rate of six and ninety hundredths per cnet (6.90%) per annum from date until paid. Said notes shall

bear date as of the 5th day of Jnauary, 1984, shall be known as "San Juan County Tax Anticipation Notes, Series of January 5, 1984" and shall be due and payable December 31, 1984, both principal and interest being payable at maturity in lawful money of the Untied States of America at the First Security Bank of Utah, N.A., Monticello, Utah, said notes and each of them, except as to consectuive numbers, to be in substantially the following form to wit:
TELEPHONE IN THE COMPUTER ROOM DISCUSSED
Gail Dalton, County Clerk, met with the Commission to discuss putting a telephone in the computer room. The Commissison approved a wall phone with call restrictions for the computer room.
BOND ELECTION DISCUSSED
Gail Dalton, County Clerk, met with the Commission to report on the progress of the taped items being played on the radio due to the Justice Department Lawsuit.
POLL OFFICIALS AND INTERPRETERS FOR BOND ELECTION APPOINTED
Commissioner Low made a motion ot adopt the resolution to appoint the poll officials and interperters for the February 7, 1984, bond election. The motion was seconded by Commissioner Black and car-ried unanimously. The resolution is as follows:
The Board of County Commissioners of San Juan County, State of Utah, met in regular public session on the 23rd day of January, 1984, at the hour of 10:00 o'clock a.m. at the regular meeting place of said board in the County Courthouse, in Monticello, Utah. The meeting was called to order and on roll call the following members were determined present:

After the minutes of the preceding meeting had been read and approved, the County Clerk presented to the board an affidavit evidencing the giving of not less than twenty-four (24) hours public notice of the agenda, date, time and place of the January 23, 1984, meeting of the board in compliance with the requirements of Section 52-4-6(2), Utah Code Annotated 1953, as amended, by (1) posting written notice of the meeting at the principal office of the board in the County Courthosue, (2) providing notice ot at least one newspaper of general circulation within the giographic jurisdiction of San Juan County, or to a local media correspondent and (3) providing notice to radio stations KNDN, located in Farmington, New Mexico and to KRTZ, located in Cortez, Colorado. The affidavit was ordered recorded in the minutes of the meeting and is as follows:

After the conduct of other business, the following resolution was introduced in written form by Commissioner Low, was read in full, and after discussion, pursuant to moiton made by Commissioner Black and seconded by Commissioner Low, was adopted by the following vote:

The resolution was thereupon was thereupon signed by the Chairman of the Board of County Commissioners and attested by the Clerk and is as follows:
A RESOLUTION appointing judges of election and alternate judges of election, interpreters and alternate interpreters to conduct and otherwise provide bilingual assistance in the English language and the Navajo American Indian language at a special bond election to be held in San Juan county, Utah, on February 7, 1984, to determine the issuance of $1,800,000 General Obligation Hospital and Nursing Home Bonds.
WHEREAS pursuant to a resolution duly adppted on Januray 9, 1984 (the "Resolution"), a special bond election was called by this Board of County Commissioners of San Juan County, Utah (the "Board") to be held on February 7, 1984, for the purpose of submitting to the qualified registered electors of the County the bond proposition set out in the Resolution; and
WHEREAS a need exists for bilingual assistance in the English language and in the Navajo American Indian language at siad special bond election; and
WHEREAS said special bond election will be held in compliance with Section 203(c) of the Voting Rights Act of 1965, as amended, by the providing of oral minority language assistance in thenavajo American Indian language at all stages of the electoral process with respect to said special bond election; and
WHEREAS pursuant to the Resolution, judges of election and alternate judges of election (collectively, the "Election Officials"), interpreters and alternate interpreters must be appointed by the Board to conduct and to provide said bilingual assistance at such special bond election; and
WHEREAS said resolution sets forth qualifications for such Election Officials, interpreters and alternate interpreters;
NOW THEREFORE, be it resolved by the Board of County Commissioners of San Juan County, Utah, as follows:
SECTION 1. The following persons are herby appointed to act as Election Officials for the purpose of conducting the special bond election, those Election Officials whose names are marked with an asterisk being bilingual in the English language and in the Navajo American Indian language, and to act as interpreters and alternate interpreters for the purpose of rendering oral minority language assistance at such election, at the polling place indicated below, all in accordance with Section 203(c) of the Voting Rights Act of 1965, as amended, the Resolution, and all appliclcable laws and applicable court orders. Such polling places represent all of the polling places for each voting district that is situated in whole or in part in that protion of the Navajo Indian Reservation which is located in San Juan County, Utah:

COUNTY CLERK MEETS
Gail Dalton, County Clerk, met with the Commission to discuss an IBM PC Word Processor for the Clerk's office and an IBM PC to be used as a remote for the Nursing Home. The Commission approved these purchases.
CORRESPONDENCE
The Commission received a letter from the City of Monticello requesting a 10,000 or 12,000 gallon fuel storage tank be ordered and installed at the San Juan County Airport,
A letter was drafted to Mr. Kenneth Winn of the Utah Liquor Control Commission requesting they proceed with a public hearing in the Bluff area before the Commision gives Bill Jenkins a letter of local consent as he requested for his application to the Utah Liquor Control Commission
The Commission reviewed a letter and position statement concerning Project Bold from Don Chase. Commisisoner Balck drafted a letter of response.
POSITION ON ADDITIONAL LAND FOR NEWSPAPER ROCK STATE PARK DISCUSSED
The Commission reviewed a Salt Lake Tribune article claiming that between 500 and 2,000 archeological sites could be disturbed by construction of a new transportation corridor between Moab and the proposed Nuclear Waste site near Cnayonlands Stae Park. The Commission feel they shoudl reconsider the position they reached at the November 28, 1983, Commission meeting. Commissoner Bleak recommended the item of reconsidering the postiion of extra land to Newspaper Rock State Park be reviewed and discussed at the February 6, 1984, Commission meeting. Commisisoner Black drafted a memo to Mr. Max Jensen informing him of this meeting and copies will be sent to interested parties.
JAIL STUDY COMMITTEE MEETS
The following people met with the commisison to discuss progress made by the Jail Study Committee: Haze Locke, Evan Reed, Art Hobbs, Bruce Shumway, Sheriff Rigby Wright, and Cleal Bradford
It was reported that it will be three (3) years before the State of Utah would be able to consider proposing any additional joint jail facilities but reported that there is a possibility of the State contracting with the County for bed space in the County's facility. The Committee will proceed with their study and see what is needed by the County and then make recommendations. The possibility of obtaining impact money was also discussed.
COMMUNICATIONS DISCUSSED
Jim Allred met with the Commission and reported that someone broke into the television storage building in Montezuma Creek and stole a television set.
Mr. Allred also reported that he and Commissioner Black will be meeting in Castle Dale with the Emery County Commissioners to discuss a joint program for television reception. Mr. Allred and Bruce Shumway met with the Commission to discuss a proposal to get matching funds for Social Service to obtain eight (8) radios for the workers to use that will have the ability to be monitored by the Sheriff's Departments radio system. The Commission authorized Al Haskins to work on this matter.

SOCIAL SERVICE CONTRACT DISCUSSED
Bruce Shumway met with the Commission to discuss a contract for Adult Home Care between San Juan
County and San Juan Health Care Services. Commissioner Low made a motion to approve the contract
and authorize Commissioner Black to sign it. The motion was seconded by Commissioner Black and carried unanimously.
GAS SEVERANCE TAX DISCUSSED
Commissioner Black reported that he feels that the proposed gas severance tax will cost the oil companies an additional 4% of the gross revenue and will have to be paid whether a particular oil well makes money or not; and as the oil and gas wells decline in productivity, their decline will progress more rapidly.
JUSTICE DEPARTMENT LAWSUIT RE: DISTRICTING COUNTY COMMISSIONERS DISCUSSED
Bruce K. Halliday, County Attorney, met with the Commission to discuss the lawsuit against the County by the United States Justice Department on the method of electing County Commissioners. The Commission will have a resolution drafted for action at the County Commissioners meeting February 6, 1984, and all of the Commission will be present.
