SAN JUAN COUNTY COMMISSION SEPTEMBER 22, 1986
The San Juan County Commission met in regular session on September 22, 1986 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.
The following members were present: Commissioner Black, Chairman

Minutes of the September 15, 1986 Commission Meeting were approved on the motion of Commissioner Holliday and seconded by Commissioner Bailey. UNANIMOUS.
FIRE CONTROL - COUNTY
George Kensley, standby fire warden, met with the Commission to report briefly on last weeks fires. Seven fires were reported in which five were private fires without burning permits, a haystack burned down in Bluff and a fire on Mustang Flats. The Commission recommended that it be advertised that burning permits are required until the end of October. Mr. Kensley said the Department is promoting a Statewide Home Fire Drill "Plan to Get Out Alive" which is planned for Thursday, October 9th at 6:30 p.m. Commissioner Holliday made the motion to adopt the following Proclamation and Commissioner Black seconded the motion. UNANIMOUS.

WHEREAS; Home fires kill thousands of people every year:
AND WHEREAS; Many such deaths could be avoided if family members were properly trained in how to escape from a burning house:
AND WHEREAS; The San Juan County Fire Department, The Fire Marshals Office, and many other organizations throughout the state are sponsoring a statewide Home Fire Drill called "Plan to get out alive":
AND WHEREAS; This plan calls for information to be distributed whereby families can plan together how to escape from burning home:
AND WHEREAS; Such a plan may well result in the saving of many lives in San Juan County, and throughout the entire state:
AND WHEREAS; October 9, 1986 at 6:30 p.m. has been designated as the time when families in San Juan County and throughout the state are encouraged to execute their fire drill plans in the home:

SUBJECT: NOTIFICATION OF BOARD ACTION
On September 4, 1986, the Permanent Community Impact Fund Board voted to award San Juan County a $1,900,000 grant and a $1,800,000 interest-free loan repayable in 30 years to construct a new public safety building.
A contract for review and signature will be prepared upon receiving a copy of a proposed bond that will be issued to secure the loan portion of the award. Upon acceptance of the proposed bond by the Attorney General's Office, the Board will deliver the proceeds of the loan in exchange for a definitive, fully executed bond.

The Commission will discuss this with Bruce Halliday, county attorney, and will contact a bond attorney to see what needs to be done.
COMMUNICATIONS - TV IN MONTICELLO - BUILDING ON ABAJO PEAK
Commissioner Holliday reported that Bill Bayles, communication engineer, called him and said that the new building on Abajo Peak is blocking the signal for Channel 2 and 4 to Monticello. Mr. Bayles said it will be fixed in about two weeks.

URANIUM REVITALIZATION AND TAILINGS RECLAMATION ACT
Commissioner Black reported that he received a copy of a news release dated September 12, 1986, whereby the Senate Energy and Natural Resources Committee voted 14-2 on Senate Bill 1004 (the Uranium Revitalization and Tailings Reclamation Act). This will clear the way for the Senate to vote on it and if passed, it will restrict the use of foreign uranium in the United States and will establish a $900 million fund to reclaim uranium tailings. The Federal Government would then be required to purchase only domestic uranium in the future and nuclear power utilities would be required to purchase at least 50%. Commissioner Black said if this passes it may help bring back the uranium industry.
200TH ANNIVERSARY OF SIGNING OF U.S. CONSTITUTION
The Commission received a letter from Lt. Governor Olsen stating that on September 17, 1987 the United States will celebrate the 200th anniversary of the signing of the U.S. Constitution. The letter asks for support from San Juan County by forming a local Bicentennial Commission to supervise Constitution-related activities in the community. The Commission will follow up on this in the near future.
UDOT - STOP SIGNS
The Commission received a memo from the Utah Department of Transportation stating that there was a discussion of whose responsibility it is to replace fallen or missing stop signs. Because of several differences DOT requested an informal opinion from the Attorney General's office. In their opinion the County or City has the statutory duty to maintain stop signs which regulate traffic entering a State highway from a County or a City road. A standard agreement will be prepared and will be available for aid in installing fallen or damaged stop signs.
DIVISION OF WILDLIFE RESOURCES
Guy Wallace, Division of Wildlife, met with the Commission to bring them up to date on various topics. The latest on the elk transplant is that sane local farmers want them transplanted on their private land. Mr. Wallace said they had a meeting and discussed making a posted hunting unit where all land owners would cooperate together and make a big unit and lease it out to hunters. The Forest Service's plan is still at the printers and as soon as they get it back and signed they will start an EA study which will take a month. Mr. Wallace said he hoped it would be completed by this winter because Deseret Land and Livestock has 400 head of elk ready to be transplanted. Wildlife will be transplanting 150 head of antelope on Hatch Point this winter and will also be transplanting turkeys, and chukars. There were 930 applicants for the Elk Ridge hunt for 400 permits and 40 non-resident permits. And there were about 100 out of 300 permits sold for the Beef Basin doe hunt. Mr. Wallace said the Range Crew has been in the area doing range studies on Elk Ridge and Blue Mountain. The applications were down by about 10,000 and so were the licenses mainly because of the price and Mr. Wallace said the state is already talking about cut backs in the division because of this. The Commission thanked Mr. Wallace for this information.
ROADS - BLANDING CITY/COOPERATION AGREEMENT WITH COUNTY
Norman Johnson, Blanding City Manager, met with the Commission to discuss the cooperative road agreement between the city and the county. Mr. Johnson asked what the status was on laying of mulch in the city and how many roads have to be ready before asking the county for help. Commissioner Holliday said that Bernal Bradford will start on the project tomorrow. Mr. Johnson said he needs to know what roads in the city are county's roads. The city is doing curb and gutter projects and need to work with the county on this project and will coordinate with Doug Pehrson, county engineer. The intersections are real bad and Mr. Johnson asked if it would be proper to dig the roads up in these areas and pour a new base of mulch. The Commission said the drainage problem needs to be solved first before any road repairs are done or they won't do any good. Mr. Johnson said the city is going to apply for assistance in a matching type grant for a complete drainage study of the city. The Commissioners and Mr. Johnson agreed that the cities need to prepare and submit a road program to the county and all meet together the first of the year and schedule what needs to be done. They also need to discuss who is responsible for supervising the county crews while working on city roads.

BUDGET HEARING - REFUND of PERSONAL PROPERTY TAXES
The Commission will hold a Budget Hearing on October 14, 1986 at 2 p.m. to re-open the budget to set up a fund for refunds of personal property taxes.

SOCIAL SERVICES - AGING, MENTAL HEALTH, ALCOHOL AND DRUG PROGRAMS
Rick Bailey, Administrative Assistant, talked to the Commission about the State of Utah Social Services aging, mental health and alcohol and drug programs. Mr. Bailey said the states opinion on the aging program is to leave it on a state service level but to reduce the staff by 3% so that more funds can be distributed. The mental health, alcohol and drug programs is proposed to be combined into one division with smaller staffing and block granting it and to have the county be the administrator. Mr. Bailey said he questions the total liability being placed on the county and requiring them to administrate these programs. The Commission feel that this should be left on the state level and recommend that the county be responsible for the aging program and the state be totally responsible for mental health, alcohol and drug programs. Mr. Bailey will prepare a statement on this.
BLM MANAGEMENT PLAN
Rick Bailey, Administrative Assistant, told the Commission he is ready to prepare a position paper on the BLM Management Plan and needs their input. Commissioner Black said he is totally opposed to the BLM's preferred alternative and can see them-creating wilderness areas through management decisions. . Mr. Bailey will contact Bill Howell, AOG, to ask him to review and respond to it.
UTAH STATE SOCIAL SERVICES DIVISION OF AGING AND ADULT SERVICES
Commissioner Holliday made the motion to approve Amendment #1 to the 1987 Utah State Department Social Services Division Aging and Adult Services contract and authorized Comnissioner Black to sign it. The contract is the six month contract but an increase to $38,226 for the county. Commissioner Black seconded the motion. UNANIMOUS.

UTAH LOCAL GOVERNMENTS INSURANCE TRUST
Sherron Tuttle and Susan Koring, representatives of Utah Local Governments Insurance Trust, met with the Commission to discuss the county's insurance. The county is on their self-funded medical plan as of April 1986 and on the liability program since February. Mrs. Tuttle said the Trust's liability program is going extremely well and after completing the first full year the loss was only 5% for the whole pool. There will be no increase in the liability program fees at renewing time. Mrs. Tuttle said the Trust is not an insurance company; it is a unit of government set up by inter-local agreements. Mrs. Koring said the Trust now handles private car insurance to employees of local governments and there can be payroll deductions on a monthly basis and also the Trust's workmans compensation program is very good. COBRA was discussed in that as of January 1, 1987 all Federal Government Employers may be liable for any employee and their spouse for up to three years after termination if they pay the premium. Commissioner Black said the county will calculate the self-funded full premium and look at investing the extra in a reserve account and let it earn interest and make the payments from this account. Mrs. Tuttle said that the county can change from being self-funded to the pool (a regular premium payment basis) any time. The Commission told Mrs. Tuttle and Mrs. Koring that their service has been very good and thanked them for their help and information.
BIDS - COMMUNICATIONS
Two bids were received for a 6db gain omnidirectional antenna for the sheriff's office. Selwave $364.50 and Aurora Marketing $356.25. The Commission approved the purchase from Aurora Sinclair.
BLM EVALUATION TEAM
The BLM Evaluation Team met with the Commission to ask how the local BLM employees worked with the county. The Commission told them that the BLM people were very cooperative to work with and are pleased with the way they do things.
