MINUTES OF THE SAN JUAN COUNTY COMMISSION MEETING OCTOBER 22, 1984

The San Juan County Commission met in regular session on Monday, October 22, 1984, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah.

The following members were present: Commissioner Calvin Blackf Chairman

Commissioner Kenneth R. Bailey Commissioner Robert Low

Minutes of the previous meeting were approved with the specified corrections on the motion of Commis-sioner Bailey. The motion was seconded by Commissioner Low and carried unanimously.

REPRESENTATIVE HOWARD NIELSON MEETS

Representative Howard Nielson, Reed Ivans and Sam Klemm met with the Commission to review some of the concerns the Commission has.

1. Intergral vista - A discussion regarding the interagral vista statement. The Commission requested Representative Nielson look into this matter. Commissioner Black stated that Salt Lake City is within site of a National Monument so the intergral vista aspect should also apply to them and not just to the proposed repository site near Canyonlands National Park.

2. Proposed repository site - Commissioner Black reported that at the hearings in Salt Lake City the statement was made that the proposed repository site is in a flood plane. Commissioner Black further reported that the proposed site is not in a flood plane. It was further reported that in the Salt Lake City area all of the buildings are built in a lake bed which is rising and flooding yearly. The Commission also stated that they felt that the media coverage of the hearing in Salt Lake was not an objective view. Commissioner Black stated that he felt the D.O.E. did a very good job at the hearing of explaining the facts and how they should proceed.

3. Island in the Sky Road - The Commission explained that their opposition to the Island in the Sky Road is based on the fact that the Needles Area was suppose to be the first and primarily developed area in Canyonlands National Park and nothing has been done for 10 years. The Commission stated that they will continue to oppose the road until they receive a commitment regarding the Needles Area. The Commission reviewed all the efforts that have been made to have the Park Development Plan changed back to the original plan. The Commission stated that they want Representative Neilsonf the Senators, and our friends in Moab to recognize that we are not opposed to that road but we want the commitment on Needles kept and we want them to put pressure on Pete Parry and the Park Service to see that this is done. "We are not stopping that road, Pete Parry and Lorraine Mintzmeyer are stopping the road." Commissioner Black reviewed the language of the law regarding the development of roads in Canyonlands National Park. Commissioner Black stated that the Park Service has now decided to keep Canyonlands an undevelped park except for the Island in the Sky area. Further stated was that the majority of the Park is located in San Juan County not Grand County and we feel that Grand County should support us in this issue. The Commission further reported that we may have jurisdiction over all roads in Canyonlands National Park that were previously County Roads and the Commission feels that the County has the right to stop the Island in the Sky Road in Court.

4. Navajo Mountain Road - Commissioner Bailey reviewed the attempts he has made with the BIA for funding appropriations for this road.

5. Trail of the Ancients - The Commission stated that they are supportive of the Trail of the Ancients project.

6. Memorandum of Understanding between the Park Service and the BLM - A discussion of the wording of the bill concerning multiple use in the Glen Canyon Recreation Area was held. Commissioner Black stated that the wording of the bill says "shall be a multiple use area" instead of "may be a multiple use area". Grazing in this area was placed under the management of the BLM under the same criteria that they manage grazing on adjacent BLM lands. Commissioner Black reviewed a copy of a memorandun of understanding that was signed between the BLM and the Park Service in September 1984 it basically gives the Park Service the final authority in grazing management in the Glen Canyon Area and is contrary to the law in his opinion.

7. Tar Sands Development - The law pretaining to the development of tar sands was reviewed.

ELECTED OFFICIALS MONTHLY MEETING

Marian Bayles, County Treasurer, met with the Commission to discuss the intrest rates we are receiving on the Trust Fund.

Gail Johnson, County Clerk, met to discuss the appointment of the following election judges and interpreters:

1985 BUDGETS DISCUSSED

The Commission informed the elected officials to figure a 1-step raise into their budgets for their employees. The Commission further stated that the raise is not definite but will be considered.

WEED & RODENT BUDGET DISCUSSED

Bob Thompson and Jim Heaton met with the Commission to discuss the budget and accounting methods for the Weed and Rodent budgets. Commissioner Bailey reported that this matter will be discussed further at the next Weed Board meeting.

PROPERTY TAX RE: VEHICLES ON THE RESERVATION

Bruce K. Hallidayf County Attorney, and Barbara Montella, County Assessor, met with the Commission to discuss the issue of charging propety tax for vehicles on the reservation. The Commission instructed Mrs. Montella to continue collecting the tax until an official decision is made. The Commission also requested a written opinion from Mr. Halliday by the November 12th Commission Meeting.

COUNTY TRAVEL POLICY DISCUSSED

Rayburn Jack and Gail Johnson met with the Commission to discuss the proposed changes in the County Travel Policy. Commissioner Low made a motion to adopt the changes in the County Travel Policy. The motion was seconded by Commissioner Bailey. A copy of the travel policy will be distributed to all Department Heads.

PHYSICIANS GROUP DISCUSSED

Rayburn Jack, Executive Director for Health Care Services, met with the Commission to discuss the current cash flow deficit for the Phusicians Group. Mr. Jack reported that the deficeit is approximately $31,449. current outstanding bills at the present time. Commissioner Low made a motion to transfer $20,000 to the Physicians Group to cover outstanding bills. The motion was seconded by Commissioner Bailey and carried unanimously.

OIL AND GAS LEASE

Leon Abadie representing TXP Operating Co. met with the Ccxnmission to present a lease for the following property consisting of a small tract and the roadway:

TOWNSHIP 29 SOUTH, RANGE 24 EAST, SLM

Section 10: A 0.184 acre tract, more or less, being more particularly described in that certain Deed from Alden Stevens and Inez Stevens, his wife, to San Juan County dated October 29, 1957, recorded in Volume 202, Page 276 of the Deed Records of San Juan County, Utah and being more particularly described as follows to wit: beginning at a point South 0 16' West 298 feet and East 61 feet of the NW corner of Section 10, thence South 89 44' East 100 feet, thence South 0 16' West 80 feet; thence North 89 44' West 100 feet, thence North 0 16' East to the point of beginning.

TOWNSHIP 29 SOUTH, RANGE 24 EAST, SLPM

Section 10: 1.953 acres, more or less, out of NW/4 of said Section 10, described as follows, to wit:

Beginning at a point onthe West line of said Section 10 which point bears South 0 31' 22" West, 398 feet from the NW corner of Section 10, T29S, R24E, SLPM, San Juan County, Utah; THENCE North 89°44' 47" East, 988 feet to a point; THENCE South 0 311 22" West, 50 feet to a point; THENCE South89 44' 47" West, 958 feet to a point; THENCE South 0 31' 22" West, 365 feet to a point; THENCE North 89 441 47" East, 958 feet to a point; THENCE South 0 31' 22" West, 25 feet to a point; THENCE South 89° 44' 47" West, 988 feet to a point on the West line of said Section 10; THENCE, along the West boundary line of said Section 10, North 0 31' 22" East, 440 feet to the place of beginning, containing 1.953 acres, more or less.

Commissioner Low made a motion to approve the leases and authorizing Commissioner Black to sign. The motion was seconded by Commissioner Bailey and carried unanimously.

AIRPORT HANGAR LEASES APPROVED

Commissioner Bailey made a motion to approve the following airport hangar leases. The motion was seconded by Commissioner Low and carried unanimously.

HARTS DRAW ROAD DISCUSSED

Ron Dickmore from the Forest Service met with the Commission to report that the Forest Service has granted permission for the survey on the 4.7 miles of Harts Draw Road. A copy of the assessment was reviewed. Mr. Dickmore also reported that the road design will need to be approved by the Forest Service before any construction work can begin.
