SAN JUAN COUNTY COMMISSION MINUTES AUGUST 22, 1988

The regular meeting of the San Juan County Commission convened at 10:00 A.M. at the San Juan County Courthouse in Monticello, Utah.

A motion to approve the minutes of August 15, 1988 as corrected was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT

Halls Crossing Airport - Barbara Johnson of the FAA indicated that the FAA portion of the EIS has been completed. They have sent fill-in-the-blank pages to the BLM and Park Service for their portion. As soon as they get that back it will be ready for publication. Ms. Johnson stated that they have received the one from the BLM but the Park Service has problems locating site #3. They have been sent a map but they still cannot find the site. They will not complete their part of the EIS until they can visually go out and walk that site. Ms. Johnson suggested that someone from the County contact J.D. Sweat and go over the location with him. The Park Service has promised to have the information back by the 30th of September. In the event they do, the draft stage will be completed by the 30th of October. Ms. Johnson would like to have the County really review the economic and social impacts the EIS will address as she doesn't feel the Park Service will give a fair and adequate response to those areas. Administrative Assistant Rick Bailey will ask someone from the county engineers office to contact Mr. Sweat and go look at site #3.

Monticello Library/Truck Damage - Administrative Assistant Rick Bailey reported that the damage at the Monticello Library caused by a runaway truck would run about $700. The truck hit a tree that may kill it and hit a corner of the retaining wall as it goes down the stairs as well as some damage to the sprinklers. The insurance company of the trucking company has been notified

but has not responded to the claims. A proposal for the repairs has been received and approval given to proceed with the work.

Bureau of Land Management Meeting - State BLM Director James Parker will be in Monticello Thursday, August 25th at 3:00 P.M. and has requested a meeting with the County Commissioners at the BLM office.

CURRENT BUSINESS

Road 415 - Steve Pehrson reported that road #415 by Richard Yanito's is in very bad condition and needs grading. That road will have shale put on it as soon as the pit is approved by the Navajo Tribe. Mr. Pehrson said he had a grader he would be willing to use on the road if the County would furnish the fuel. A proposal was presented to that effect.

Blanding Health Committee - Rayburn Jack and Donna Singer, representing the Blanding Health Committee, met to update the Commission as to concerns of the committee. Their first concern was in regard to the impact the proposed tax initiative would have on health care. The committee is opposed to the initiatives and would like to hold some public meetings to inform people from a health practice standpoint what the tax initiatives would do if they were passed. The second area of concern is the possible formation of a hospital service district and how the funds could solidify the hospital program. If funds are drastically cut by any of the measures currently facing the County a hospital district would help the health care program. The third area the committee is working on is the possibility of giving help to the County in the selection of a management company for the San Juan County Hospital. Mr. Jack felt that possibly he and Steve Palmer were qualified to answer any questions the Hospital Board may have in regard to the various proposals. The fourth area of concern is the possibility of Dr. James Redd returning to practice in the Blanding area. Mr. Jack indicated that Dr. Nichols and Dr. Redd have reached a verbal agreement on all of the procedures that would be required if Dr. Redd were to return to the area. Dr. Redd requested that the committee contact the Commissioners to see if they would consider an up front cost of $10,000 that would include help with the cost of moving and setting up practice in Blanding. Dr. Redd, along with Dr. Nichols, is willing to assume part of the debt that has been accrued with the purchase of Dr. MacNeill's accounts receivable. Chairman Black expressed appreciation for the report and Mr. Jack's willingness to help with the selection of a management company that would meet the hospital's needs. Mr. Black indicated that the Commission does not have the authority to act on areas concerning the San Juan County Health Care Board. The Commission felt it would be very worthwhile to have public meetings to inform the public about the tax initiatives but felt that local business people and others would have a greater influence on the public than the Cortmission would have because many people view public officials as being self-serving. Mr. Black also indicated that Dr. Val Jones has also expressed a desire to practice in the Blanding area but he felt that the area probably could not support three doctors so the residents may have to make a choice between Dr. Redd and Dr. Jones if they are both serious about coming to the area.

San Juan County Hospital - Sue Morrell met with the Commission to give them a breakdown of the applicants for management of the hospital. Hospital Administrator John Fellmeth highlighted those board chairmen he felt the board should contact for further inquiries. Ms. Morrell also asked if the board would be available for a hospital board meeting on August 30th.

Beer License/Silver Dollar Bar - County Clerk Gail Johnson reported that Bill Jenkins, owner of the Silver Dollar Bar, died last spring but the bar has continued to operate on his beer license. Mrs. Johnson has talked with County Attorney Craig Halls about the propriety of allowing the bar to operate as the license does not transfer to another individual. Mr. Jenkins1 son, Bill Jenkins Jr, has been appointed personal representative for the estate. Mr. Halls recommended that the County should wait until the matter is resolved in the Probate Court. Bill Jenkins Jr. also met with the Commission and requested permission to keep the bar open until September 7th when the matter will come before the court. At that time the family will decide whether or not to keep the bar open. If they decide to keep the bar open they will apply for a new license. The Commission approved the request.

Primary Election Workers - County Clerk Gail Johnson recommended that the following people be approved as workers for the Primary Election:

A motion to approve the recommendation of County Clerk Gail Johnson was made by Commissioner Maryboy and seconded by Commissioner Kenneth Bailey. UNANIMOUS.

Mrs. Johnson indicated that she is looking to use either the optical scanner or punch card voting machines in the 1990 election.

Area Aging Program - Don Gallegos of the State Agency for Aging met with the commission to talk about some of the areas of administration, etc. of the elderly people of the County. Mr. Gallegos reviewed some national statistics for the elderly but indicated that the State of Utah follows very similarly to the national statistics. Sane additional information was given to the Commission for their perusal. Mr. Gallegos also reviewed how the programs are administered. The U.S. Congress provided for the states to have state units on aging. The money comes from the federal government to the state and then divided down into the twelve area agencies of aging within the state for services to be provided to the individuals. Mr. Gallegos indicated that the federal government pays for about 44% of the programs administered in the state with approximately 28% of the programs are paid by the counties and 20% being paid by the individuals themselves. He felt that many of the areas of service that will provided in the future for the aging will be of the home service nature.

San Juan County Audit Report - Ted Stagg of Stagg & Associates and Kay Anderson of Anderson & Peterson & Co. P.C. met with the Cortmission to report on the 1987 audits made on both the San Juan County Health Care funds and all of the financial affairs of the County. Mr. Stagg presented, the report for the Health Care funds. The funds of the hospital and other health care entities, the ambulance fund, have been properly recorded and properly accounted for. The books and records were in order and an unqualified opinion was issued on the health care funds of the County. The Medicare cost report was filed prior to the end of May with an additional amount of $60,000 worth of reimbursement requested from the Medicare program. Mr. Stagg indicated that a management letter has been given to Hospital Administrator John Fellmeth with some suggestions in terms of better management of the accounts receivable in the hospital. Mr. Stagg felt that there was an unusually high number of bad debts as there was $734,000 worth of unpaid medical bills owed to the hospital as of January 1, 1988 which is approximately half of the work that was done at the hospital last year. The difficulties encountered in the San Juan County Hospital are the same as any other rural hospital with the decrease of the patient load. As the patient load goes down in a hospital, the cost per patient day increases. Mr. Stagg stated that he was convinced that the hospital could operate at a break-even level if (1) sufficient charges are made to cover the cost of the services and (2) to participate in the swing bed program and caring for some long-term nursing care type patients at the hospital.

Mr. Anderson reported on the audit of the County and the opinion on the financial statements they rendered is an unqualified opinion, indicating that the financial statements of the County do present the results of operation and the financial condition of the County for the year ended 1987. Mr. Anderson reviewed the management letter with the Commissioners. The letter contained recommendations for things which they felt could be improved upon in the record keeping process and management of the County. 1. Monthly financial statements including financial reports comparing budgeted and actual expenditures which would allow for more effective management of the affairs of the County. 2. Revenues and expenditures of each federal or state program be identified separately in the accounts of the County. Matching funds should also be specifically identified by program. 3. San Juan County take the steps necessary to increase the level of technical accounting knowledge needed within the accounting system. 4. The County Cortmissioners have management and policy responsibility for the County. The Commission should review and approve investments made or being considered by the county treasurer. Such review could be done with the review of monthly financial statements. Adding this level of review of County investments will better safeguard county funds. The Cortmission informed Mr. Anderson that we had been previously advised by previous county attornies that the treasurer had the sole authority and responsibility for making investments.

Chairman Black expressed appreciation for the reports and the candid comments in the management letters.

Sheriff's Department - Sheriff Claude Lacy reported there is one more dispatcher ready to be hired for the Sheriff's Department. She will not be needed until a couple of months prior to moving in the new jail facility which is anticipated the first of 1989. Chairman Black stated that until the tax initiative issue is resolved, it would be better to wait on hiring any new employees.

Weight Variance/Ralph Dunn - Ralph Dunn is hauling ore for Rio Algom and had been granted a weight variance on a County road from the DOT for that purpose. When his permit ran out he received a ticket from the Highway Patrol for overweight. Chairman Black indicated that he had written a letter to the DOT requesting an extension on the time and felt that the ticket should be dismissed.

COMMSSIONER CALVIN BLACK'S REPORT

AOG Meeting - Conniissioner Black attended an AOG meeting Friday where commissioners from rural southern counties were invited to talk about extra resources to help review and comment on government management plans and other public lands issues. The group was responsive to that; however, it was discussed that the Utah Association of Counties is already being paid for those services. When Mark Walsh was hired as a public lands specialist in 1977, all of the counties that were getting PILT payments agreed to pay to the Utah Association of Counties an additional amount over their regular dues of three quarters of 1% of the equivalent amount of money received in PILT payments. Two of the commissioners, namely, Jerry Lewis from Washington County and Jimmy Reidhead from Uintah County were going to look into that and advise UAC and the board that the rural counties either wanted a full-time public lands specialists to work on these issues or take the option of hiring another person for that. Commissioner Merlin Ashman from Sevier County and Conmissioner Lewis are going to talk to recently retired BLM district managers who have been strong multiple use proponents to see if they would have an interest in working on these issues on a consulting or part time basis.

Moab BLM District Advisory Council - Conmissioner Black made the recommendation that Ralph Coates,

provided that he is eligible, Sue Halliday, Keel Johnson and Scott Truman be reappointed to the Moab BLM District Advisory Council. A motion to approve the recommendation was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Recapture Lodge - A letter has been received from Recapture Lodge and Pioneer House thanking the Commissioners for the fogger and the access at Clay Hills.

Aneth Chapter Resolution - A resolution has been received from the Aneth Chapter

requesting that the County upgrade roads 404, beginning at the Texaco turnoff and extending on to the Cahone Mesa and portions of 407, 461 and 460, beginning north of the BIA Day School and ending near the Colorado state line. Commissioner Bailey will follow through with the request.

Utah Advisory Council on Intergovernmental Relations - A notice has been received from Michael Christensen on the first annual Fiscal Summit Conference which the Utah Advisory Council on Intergovernmental Relations is sponsoring on Friday, August 26 from 9:00 - 4:00.

Recreation Department - A letter has been received from a number of Monticello residents registering a complaint against the Recreational Department who is in charge of the Monticello Swimming Pool. They have all purchased a season pass but cannot use it as the water is too cold. They are requesting the help of the Commissioners as they would like to be able to use the pool until it closes.

Comnissioner Bailey said because of the clouds and rain lately the solar system has not been able to heat the water and the glazing is in need of repair to make it more efficient. Commissioner Black suggested that a solar blanket would help keep the heat in the water over night and the pool ought to be maintained so that the public can use the pool.

COMMISSIONER KENNETH BAILEY'S REPORT

W.W. Clyde Construction/Gravel - W.W. Clyde Construction has been upgrading the road north of Monticello and has some rejects and 1/2 inch gravel left over they would like disposed of as they are about to move their batch plant out. They said they would haul the 1/2 inch gravel from Blanding and mix it with road oil and stockpile it for the County for $10 a ton. Commissioner Bailey was concerned about the possibility of an area on the state right-of-way where they could stockpile the material. The area where the plant is has been leased until the first of September. Commissioner Black will talk to Curtis Jones to see if an extension can be obtained to stockpile the material at the site. County Engineer Doug Pehrson said it would be worth it if it can be done for under $20 a ton and the County can use up to 3,000 tons. Carmissioner Bailey will call W.W. Clyde Construction to have than go ahead and haul the gravel from Blanding and mix it with road oil.

Hart's Draw Road - A motion to approve the payment of $45,360.90 to Crowley Construction for work completed on the Hart's Draw road was made by Carmissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS. County Engineer Doug Pehrson reported that Crowley Construction is doing an excellent job with the road and is very conscientious. Another project of approximately two miles is being planned for next year. The engineering has been completed on a portion of that area. Commissioner Bailey felt that the completion of that road would be very advantageous for the Monticello area.

Tannery Proposal - Carmissioner Bailey reported that Monticello has sent the proposal for the tannery to the Community Impact Board and will be meeting with the board on September 1st.

Monticello Cemetery Road - The DOE has been hauling overload materials on the Monticello Cemetery road resulting in considerable damage. However the road wasn't in very good shape prior to their using the road. The Commission felt it was County responsibility to set weight limits on roads that are going to be used for hauling heavy loads but if that hasn't been done the County would be responsible for the repairs.

Blanding Senior Citizens Building - Commissioner Bailey will give Administrative Assistant Rick Bailey the information on electric powered vehicles for use in the Blanding Senior Citizens Building. An estimate of $25,000 was given for the installation of an elevator.

Road Department Party - All of the road department employees have been asked to furnish various types of food for the party to be held on August 27th. They have requested that the Commissioners furnish the meat. Chairman Black indicated he would be willing to help.

Trucks for Hauling - Commissioner Bailey reported the road department is having a difficult time getting enough trucks to haul gravel for County road projects. An ad will be run in the paper asking for additional trucks that anyone may have.

San Juan County Road Foreman - Doug Garner wrote a letter asking to be considered for the position of road foreman. He did not find out about the opening early enough and is requesting additional time to prepare an application. The Commission felt that as the screening process has not begun it would be okay to accept additional applications.

Hart's Draw Road/Gravel Crushing - The following agreement was presented for the crushing of gravel for the Hart's Draw road:

AGREEMENT

THIS AGREEMENT made and entered into this 16th day of August, 1988, by and between SAN JUAN COUNTY, a body corporate and politic, hereafter known as COUNTY, and JERRY HOLIDAY CONSTRUCTION, P.O. Box 502, Blanding, Utah, hereafter HOLIDAY CONSTRUCTION.

COUNTY and HOLIDAY CONSTRUCTION mutually agree as follows:

1. Parties shall comply with all special provisions contained in Specification for Crushing Gravel, Hart Draw Gravel Pit, attached hereto and by this reference made a part hereof.

2. HOLIDAY CONSTRUCTION agrees to furnish to COUNTY and COUNTY agrees to pay for said crushing and delivery pursuant to the below mentioned specifications not less than 15,000 cubic yards at the price of $4.50 per cubic yard.

3. HOLIDAY CONSTRUCTION shall remove the overburden and stockpile it to the satisfaction of the San Juan County Engineer.

4. COUNTY shall pay for 90% of the gravel crushed upon completion of the project. At that time, upon acceptance COUNTY will pay HOLIDAY CONSTRUCTION the remaining 10%. Payments to all subcontractors and employees shall be paid by HOLIDAY CONSTRUCTION before the 10% is paid by COUNTY.

5. COUNTY will perform gradation tests and keep HOLIDAY CONSTRUCTION informed of the results. The COUNTY will reject any material not meeting these gradation requirements.

6. COUNTY will pay HOLIDAY CONSTRUCTION based on the material measured in the Stockpile by County Engineer.

7. COUNTY will rehabilitate the pit at a later date.

8. Crushing will be completed 30 working days being from the 29th day of August, 1988.

9. No bond, either Bid or Performance is required. SIGNED and AGREED to the date first above setforth.

COMMISSIONER MARK MARYBOY' S REPORT

Payroll Increases/Library Employees - A request has been received for salary increases of $50 per month for Rufina Romero and Gaylen Schaugaard, custodians at the Monticello Library, and $100 for Gary Martineau, custodian of the Blanding Library. Administrative Assistant Rick Bailey was asked to review the requests to see if they are equitable with recent increases given all county employees.

Road Meeting/Utah Chapter Presidents - Commissioner Maryboy reported that on September 6, most of the chapter presidents on the Utah portion of the Navajo Reservation will be attending the monthly road meeting to review the maintenance of the roads on the reservation.
