SAN JUAN COUNTY COMMISSION SEPTEMBER 21, 1987
The San Juan County Commission met in regular session September 21, 1987 at the hour of 10:00 a.m. at the San Juan County Courthouse, Monticello, Utah.

A motion to approve the minutes of September 14, 1987 as amended was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.
ELECTED OFFICIALS MEETING;
Sheriff Claude Lacy reported a theft at Broderick Tire Sunday, Sept. 20, 1987. The Sheriff's department gave chase to a suspect and apprehended him.
The Sheriff's Department needs to acquire the services of an airplane in connection with the Bartley-Rockwell deal, to find where additional evidence has been hidden in order to obtain a search warrant. Commissioner Black suggested they contact Jim Black, manager of Scenic Aviation in Blanding, to obtain the needed airplane.
Recorder, Louise Jones reported they have been short of storage space in their vault for several years and inquired as to the possibility of enlarging their vault. Mrs. Jones also needs a plat cabinet to store the recorded platts. Presently they are being rolled up and placed in a fire-proof file where she feels they are being damaged. The suggestion was put forth by the Commission that when the Sheriff's Department moves into their new offices in the Public Safety Building, in approximately a year, the Recorder's Office could use the vault currently used by the Sheriff's Dept. Mrs. Jones was advised to purchase a plat cabinate that would be suitable to fit in that vault.
Assessor, Barbara Montella, reported that there were no problems in her department. She is prepared for the Board of Equalization hearing this afternoon. To assist the Commissioners in their responsibility as Board of Equalization the pertinent figures on the tax form were discussed. The tax valuation number does not represent the current market value of the property. A formula of 1.67 for residential and 1.25 for farm land and commercial property would have to be multiplied to the tax valuation number to determine market value. The tax notice also representes a 11.5% increase as prescribed by the State Tax Commission through a factoring order. Commissioner Black indicated that if people believe they are over-assessed, they need to come in with some evidence to substantiate that belief. That evidence could be a recent appraisal, recent sale of that or similar property, or a listing where they are trying to sell it or any evidence that would substantiate a lower value. With that evidence the Board of Equalization could lower the valuation and consequently lower the taxes. A good cross-section of the people indicating that their tax valuation is over-assessed would give the Board cause to cut back other peoples valuations. There will be a Board of Equalization hearing this afternoon from 1 to 5 p.m. in the Commissioners Room and one next Monday afternoon during the same hours for people to express their concerns.
COMMISSIONER CALVIN BLACK'S REPORT
Report on AOG Meeting in Price - Commissioner Black attended an AOG meeting held Friday, September 19, 1987 in Price. At the meeting a report was given on the Integral Vista hearings. The Department of Health extended the time for comments until September 24th. Commissioner Black will write a letter in behalf of the County in regard to that issue.
Pioneer Estates Road - Commissioner Black indicated that a decision on the Pioneer Estates road needs to be made. The Commissioners will consider the cost estimates during the week and make a recommendation at the Conmission Meeting next week.
Conmissioner's Workshop - Commissioner Black will represent the San Juan County Commission at the Workshop to be held September 23-25th in Vernal.
Mental Health - Private Practice - The Commission received a letter from Bruce Shumway dated April 28, 1987, a copy of a memorandum from Mark Lyman to Bruce Shumway dated April 8, 1987, a letter from Garth Skouson dated March 17, 1987, and a letter of recommendation from County Attorney, Craig C. Halls, requesting the San Juan County Social Service department to allow private practice by the the approval of the private practice of the Mental Health Staff. Pursuant to those letter and the recommendation of the County Attorney, a motion was put forward by Commissioner Bailey and seconded by Commissioner Black approving the request. UNANIMOUS. The Commissioners will ask the Mental Health Staff to formalize their procedure and practices into a form and send it to the Commission.
Enterprise Zone Proposal - The Enterprise Zone Proposal is a legislative proposal that may be introduced in the Legislature next year that would give tax incentives for businesses to locate in rural areas. The AOG has approved the proposal and the Development Board has received a briefing on it. Commissioner Bailey made a motion, seconded by Commissioner Black, to endorse this proposal. UNANIMOUS.
Increased Fees - Communications Sites - Commissioner Black indicated that the charges for the Federal Communication Sites are extremely serious. The Commission needs to do everything they can to get Congress to, in effect, recind what the Federal Agencies are proposing. If the proposal goes into effect it will cost rural areas in the West a great deal of money. Commissioner Bailey made the motion to put San Juan County on record as opposing the steep increases proposed by the BLM and Forest Service for communication sites for commercial or private purposes for the West. The Commission is opposed to any charges for Communication Sites for local government and public purposes. Commissioner Black seconded the motion. UNANIMOUS.
COMMISSIONER KENNETH BAILEY'S REPORT
Joint Road Committee Meeting in Midway - Commissioner Bailey attended the Joint Road Committee Meeting in Midway last week. After a great deal of discussion the Committee could not come to an agreement as to the proposal that needed to be submitted to the Legislature for a formula on the gas tax. A motion was made to form a smaller committee to try and arrive at an agreement.
Road Dept. - Culvert, Oil & Gas Bids - Black Oil was determined to be the low bidder on the petroleum products. Pacific Corrugated Steel was the low bidder on the culverts and bands. Contech Construction Prod, was low bidder on the end sections. Commissioner Bailey made a motion to award those bids as stated. Commissioner Maryboy seconded the motion. UNANIMOUS.

Mineral Lease Allocation for Roads - The proposal for the $100,000 mineral lease money has been typed and mailed to the Department of Transportation in Price by County Clerk, Gail Johnson.
HONOR - COMMISSIOMER MARK MARYBOY - Commissioner Bailey and Commissioner Black extended congratulations to Commissioner Mark Maryboy on his recent selection as an Outstanding Young Man of America.
Personnel Promotions - raises; Road Department: Commissioner Bailey presented background information on the following Road Department employees pursuant to a motion for approval of work responsibilities and salary increases: Tierre Patterson took over the responsibilities of Oley Black when he died. Mr Patterson was told he would be given a raise retroactive to the first of the year because of the added responsibilities. Victor Nebeker has been acting as assistant shop foreman since Tierre Patterson was made head mechanic. Robert Laws has been a seasonal employee for six months and it has been determined that he is a very good employee. His service as a full-time employee is needed because other employees have resigned. Ambrose Yanito has qualified himself to advance from a laborer to a light equipment operator. Commissioner Bailey made the motion that Tierre Patterson's present salary be made retroactive back to the first of the year; Victor Nebeker's salary be raised to a Grade 11, Step 9 because of the change of his responsibilities; Robert Laws be hired full time at a Grade 8, Step 1 salary; and Ambrose Yanito's grade and step be changed to Grade 8, Step 5. Commiissioner Maryboy seconded the motion. UNANIMOUS.
COMMISSIONER MARK MARYBOY'S REPORT
Resolution - Red Mesa Chapter - Road Requests - The following resolution was received from the Red Mesa Chapter of the Navajo Nation, Utah:
RESOLUTION OF RED MESA CHAPTER REQUESTING SAN JUAN COUNTY ROAD DEPARTMENT TO REVIEW THE PROCEDURE OF RESURFACING THE BLACKTOP ROADS WITHIN SAN JUAN COUNTY AND UTAH NAVAJO RESERVATION.
WHEREAS:
1. Red Mesa Chapter which is being recognized to represent it's communities in resolving and to allocate certain issues or matter that is affecting
the chapter residents and;
2. Red Mesa Chapter is aware that there is a great need in road improvement within the chapter communities and;
3. Red Mesa Chapter received several complaints regarding resurfacing N35 road with gravel, that looks like big pebbles and this has caused some local residents, who own vehicles, that their windshields have been broken and;
4. Red Mesa Chapter request San Juan County Road Department to apply fine gravel to road surface instead of hard gravel which is being applied at present, and;
5. Red Mesa Chapter also request San Juan County Road Department to establish more signs on: Livestock, Bus stops, and other regulatory signs on N35 road.
NOW THEREFORE IT BE RESOLVED THAT:
1. San Juan County Road Department will make whatever necessary in applying fine gravel to N35 roads instead of hard gravels.
2. San Juan County Road Department shall place signs where needed for and such signs would be: Bus Stop; Livestocks; Stop Signs; and other related signs which are important for public safety.

Commissioner Bailey indicated that the road chips being used are the best quality available and being made in Montezuma Creek for that purpose. However, signs need to be posted warning drivers to drive slowly to avoid broken windshiedls from loose chips. Commissioner Bailey will also take the resolution to the Road Department for consideration of the needed signs for livestock, bus stops, stop signs and other related signs.
Aging Service Meeting - Window Rock - Commissioner Maryboy will be going to Window Rock this week to meet with the Aging Service people. The Service People need some more statistics for their justification.
Commissioner Maryboy will follow up on the surplus fire truck proposal for Montezuma Creek.
Bill Todachinnie, School Board Member, will meet with Commissioner Maryboy for a few minutes today concerning the microwave deal down at McCracken Mesa.
Commissioner Maryboy will also meet with the Land Administration on the 120 acres, Sec. 32, exchange of State Land.
The white shale permit south of Bluff was approved by the Navajo Tribe. Commissioner Bailey will report this approval to the Road Department.
ADMINISTRATIVE ASSISTANT - RICK BAILEY'S REPORT
Integral Vista Hearing - Rick Bailey, Administrative Assistant, represented the San Juan County Commission at the Integral Vista Hearing in Moab conducted by the State Department of Health. There were 25 to 30 people in attendance with six participants expressing concerns against the regulations. One participant
indicated that industry could comply effectively with the regulations. The others in attendance chose not to voice their comments. There were some complaints registered following the meeting that the Department of Health hadn't given enough notice or time for the people to adequately respond to the issue.
OTHER BUSINESS
Reta Bartell Presentation - "Scrapbook of School Happenings - Reta Bartell made a presentation of bound scrapbooks that she had compiled during 1959-1971 while she was a supervisor with the San Juan County Schools. With the development of minerals in the county and the subsequent additional funds available to the school system, numerous changes were taking place within the County that received National and local recognition. Mrs. Bartell began clipping these items and putting them in scrapbooks. Whne Mrs. Bartell retired she offered the books to the School Board. The School Board felt they didn't have storage room for the books and suggested she present them to the Library. The Library put them on the shelves for public use and they soon began to deteriorate from misuse. Once again Mrs. Bartell took them home and searched for better methods of preserving them. She took them to Blanding and had than laminated then to Mesa Verde Press in Cortez to have them bound before presentation to the Commissioners. The Commissioners felt that they were of such historic value that another copy should be made so that it would not be lost or destroyed. Commissioner Black accepted the 13 volumes in behalf of the Library Board. Commissioner Maryboy will work with the Library Board to see that the books will be copied and made available to the various Libraries in the County. The Commission commended Mrs. Bartell on this extremely valuable gift to the people and future genertions of the County.
Dean Johnson - Utah Local Government Trust - Health and Medical Benefits
Dean Johnson presented a health and medical program in the interest of the County employees. Mr. Johnson indicated they had two types of programs. The simplest and least expensive to operate and run is the Premium only program. The expanded program would allow employees to fund for a dental, vision, or other medical benefits plan which is a cost reimbursement plan. A motion was made by Commissioner Maryboy to have Mr. Johnson, representing ULGT, set up the program and give the County the information needed to implement the program. Commissioner Bailey seconded the motion. UNANIMOUS.

As I conclude my work for the State I would like to take this opportunity to thank you for the fine support you have given me through the years. I feel you have dealt with and are dealing with some very difficult matters and have, and are doing an excellent job.
I appreciate the opportunity I have had in working with you on many projects and programs. I feel many good things have been accomplished and many efficiencies in government have been realized by working cooperatively with each other.
I wish you continued success in your important responsibilities. You will continue to have my support.
One matter of business that needs to be taken care of with my retirement from the State is for you to appoint a replacement for representation on the Alcohol and Drug Provider Association. This organization represents the agencies throughout the State who are responsible for the Alcohol and Drug prevention and treatment programs. They meet monthly in Salt Lake and Provo. The meetings are usually coordinated to be at the same time as the meetings of the Mental Health Directors. I would suggest Mark Lyman be appointed since he will be knowledgeable of the programs in San Juan.
A letter to Harold Morrell, President of the Alcohol and Drugs Provider Association, which states you have appointed Mark or whomever you choose to represent San Juan County, is all that is needed. The letter can be hand carried to the next meeting.
