MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD

SEPTEMBER 20, 1982

The Board of County Commissioners met in regular session on Monday, the 20th day of September at the hour of 10:00 a.m. in the Courthouse at Monticello, Utah.

On roll call, the following members were present: Chairman Calvin Black

Commissioner Robert Low Commissioner Kenneth R. Bailey

Minutes of the previous week were read and approved with the stipulated corrections upon the motion of Commissioner Low and the second of Commissioner Bailey and it carried unanimously.

MEXICAN HAT ASSOCIATION MEETS CONCERNING LAW ENFORCEMENT AND FIRE PROTECTION;

The following members of the Mexican Hat Association met with the Commission to discuss their concerns regarding law enforcement and fire protection in their community: Howard Valle, Mark Sword, Oscar Eneboe, Constance J. Eneboe, Luther Risenhoover, Robert E. Linenberger and Jerold Baum.

Sheriff Rigby Wright was invited to attend the meeting to hear comments and answer questions. The association expressed that the people of the community feel isolated from the rest of the county and would like to have increased law enforcement. They asked if it would be possible to have a resident officer in their area. Sheriff Wright explained that with the present tax base, the county cannot afford to hire another deputy as it costs approximately $30,0000 a year to fund a deputy. A one-man resident deputy would have to transport arrested persons to Monticello, which would take him away from the area , and it would be difficult for him to take any days off. The Sheriff's Department will patrol the area as best they can with the present staff and also continue the present road block program. Sheriff Wright told the group that they may call the Sheriff's office collect on emergency cases and they may also call him at home if they feel that they are not getting adequate response from his department. He will also councel his deputies to make personal contact with someone in the community of Mexican Hat when responding to their calls. The problem of law enforcement on the reservation was also discussed.

President of the Mexican Hat Association, Mark Sword, reported to the Commission that a new volunteer fire department has been organized with the following members who have said they are willing to attend the monthly meetings and do what is necessary to have an active fire department: Howard Valle, Oscar Eneboe, Robert Linenberger, T.J. Knight, Mark Sword, Jerold Baum, Donna Valle, Julie Sword, Lee Dillon Luther Risenhoover, Gail Ammerman, and Howard West.

Fire Warden, John Baker was invited to the meeting to hear comments and answer any questions. Mr. Baker explained that the fire station will only require a 30 AMP electrical circuit and that the local electrical companies have hooked up the power to the other county fire stations. Because Mexican Hat Association is the owner of the electricity for their community, the association agreed to also install power to the fire station meter base. Mr. Baker reported that the county has purchased the plywood material necessary to finish the inside of the fire station and the Mexican Hat fire depty agreed to provide

the labor to install it. The association reported that the community would like to use the fire station as a meeting hall and they requested that a black top floor be installed in the fire station. If the County will provide the cold mix and equipment, the association will provide the necessary labor to finish the floor. Commissioner Bailey and Bernal Bradford will cheek into the availability of cold mix and equipment for this project.

The association reported that they support the budget proposal for the Mexican Hat ambulance which will be presented, at a latter date, by Lee Dillon, The Commission then approved the release of Mr. T.J. Knight from responsibility for any ambulance equipment he has signed for and returned.

The association reported that the new power booster has not improved T.V. reception to their area. Chairman Black will report this to Jim Allred, the County communications engineer.

The Commission discussed briefly the initiative petition concerning the sale of beer. Chairman Black apoligized, on behalf of the Commission, to Mr. Howard Valle for not having resolved the issue con-cerning limiting the beer licenses in the county. Chairman Black also personally thanked Mr. Valle for his gentlemanly and patient manner in this matter.

STATE FAIR AWARD FOR COUNTY EXHIBIT;

Commissioner Low presented the plaque and red ribbon the County received as the second place award

for the San Juan County exhibit at the 1982 State Fair.

BIG INDIAN ROAD:

Commissioner Low stated that he has received reports that the Big Indian Road is deteriorating. Commissioner Bailey reported that the Road Department will perform maintenance on the Big Indian Road when work on the Ucolo Road is completed.

MQNTICELLO URANIUM MILL UPDATE:

Commissioner Low reported that the Harry Randall home and the Ward's Store Building have been placed on the National priority list for decontamination from uranium mill tailings. It would cost approximately $150,000 to remove tailing material from both these buildings.

HEALTH CARE SERVICES BOARD WILL ALSO SERVE AS MENTAL HEALTH BOARD:

Upon the recommendation of the San Juan County Health Care Services Board that its members meet the criteria to constitute a Mental Health Board and they are all willing to serve on the Mental Health Board, Commissioner Low moved to appoint the membership of the San Juan County Health Care Services Board to serve on the Mental Health Board. The motion was seconded by Commissioner Bailey and it carried unanimously.

HEALTH CARE SERVICES BOARD BY-LAWS AMENDED;

Upon the recommendations of the Health Care Services Board, Commissioner Low moved to amend the By-Laws of the Governing Board of the San Juan County Health Care Services as follows: Article III

Membership

Section 2-Number

The Governing Board shall consist of 8 voting members including the head of the medical staff. A designated member of the County Commissioners shall automatically be considered as an ex-officio member of this body.

The motion was seconded by Commissioner Bailey it carried with two votes for and one vote against the motion.

BOB THOMPSON MEETS WITH THE COMMISSION:

County Agent Bob Thompson, met briefly with the commission to request information on a building leased by B.Y.U. in Blanding. Mr. Thompson also asked if one of the Commissioners would be able to speak at the Voter Awareness Program to be held September 30th in the San Juan High School. Commissioner Bailey agreed to represent the County Commission at the program.

BLUFF TO MONTEZUMA CREEK ROAD BID DATE SET;

County Engineer, Doug Pehrson, reported that the plans for the Bluff to Montezuma Creek road project have been completed and will be delivered to the State Department of Transportation in Price by September 23rd. The Commission requested that Mr. Pehrson place the necessary Public Notice and advertisements for the County to hold a bid opening for the project on October 18, 1982 at 2:00 p.m. in the Commissioner's room at the Monticello Courthouse.

GRAVEL PITS OPERATED BY THE COUNTY FOR PUBLIC PURPOSES ONLY;

The Commissionses reconfirmed that is in not lawful for the County to sell or donate gravel to a

private individual as the County gravel pits are dedicated to public purposes only.

ROAD DEPARTMENT INDIVIDUAL RAISES APPROVED:

Upon the recommendations of the Road Department Superintendent, Bernal Bradford, Commissioner Bailey

moved to approve the following step and grade increases for county employees:

Larry Begay from 26.1 raise to 26.2 Merz Hugentobler from 14.5 raise to 14.6

Norman Begay from 26.1 raise to 26.2 Dan Mclnnes from 29.2 raise to 29.3

Raymond Bond from 26.4 raise to 29.2 Leona Markosek from 06.1 raise to 06.2

Richard Francom from 26.1 raise to 26.2 John Richardson from 23.2 raise to 26.2

Dale Fuller from 29.3 raise to 29.4 Howard Rogers from 26.1 raise to 26.2

Bryan Hawkins from 23.2 raise to 26.2 David Yonito from 29.1 raise to 29.2

The motion was seconded by Commissioner Low and it carried unanimously.

It was approved by the Commission to hire T.R. Patterson at a reasonable step and grade in accordance with his qualifications, and that he be hired without a probationary period, no probationary raise is to be given).

SHERIFF'S DEPARTMENT VEHICLES APPROVED:

Upon the request and recommendation of Sheriff Rigby Wright, Commissioner Low moved to approve the purchase of two new vehicles for the Sheriff's Department. The motion was seconded by Commissioner Bailey and it carried unanimously.

EQUALIZATION DAY:

After the noon recess for lunch, the Commission reconvened their meeting in the County Assessor's office, at which time they received requests for property tax adjustments. The following requests were reviewed and acted upon by the Commission:

1. U.N.D.C.

Several requests were made for tax exemptions. The County Attorney reviewed the tax laws concern-ing charitable organizations and the Commission requested a letter from the U.N.D.C. certifying that U.N.D.C. is a charitable organization and that U.N.D.C. prepare a list of the property and corresponding portion that U.N.D.C. feelsshould be tax exempt. The Commission will act upon the request after the letter is received.

2. Carl Eisemann Valuation # M-I18-2

Due to an error in the recorded length of his mobile home, Mr. Eisemann's assessed value for this property will be reduced from 4400 to 3590.

3. San Juan Community Church (Represented by John Baker) Valuation # M-71

Mr, Baker requested that the parsonage receive tax exempt status as it is owned and supported by the Church for religious purposes. No decision was made, pending research by the County Attorney on this matter and the precedents set under the State tax laws.

4. Curtis Jones Valuation #2090

It was felt that the property was not over assessed, and the request was denied.

5. Delores Bench Limited (a State Assessed Property)

After considerable research into the matter, the commission was satisfied that there had been an over payment of taxes in 1978. (The Company had used the price of yellow cake and not the actual price of the uranium ore.) Commissioner Low moved to refund to Delores Bench Limited $34,759.46 which is equal to the amount of taxes they over paid in 1978. The motion was seconded by Commiss. Bailey and it carried unanimously.

6. Frank Pendleton Valuation #938-2-1

Due to an error in the recorded length of his mobile home, Mr. Pendleton's assessed value will be reduced from 3830 to 3190 : .

7. Valuation #932-1 for William Hoyt Hoagland (there was an error in assessment as of January 1, 1982; Assessed value of 3670 reduced to 2400.

8. Valuation #165-6-2 for First Western Bank (the mobile home was removed) Assessed value of 4320 removed from the tax roll.

9. Valuation #1817 for Max Dalton (this is an older home and was reduced because of obsolescence) Assessed value of 2365 reduced to 1390.

10. Valuation for Fillerup,Inc.(the buildings were torn down and removed&are to be fully removed from

the tax rolls by next year)B-284&104 reduced 50%;B-80 reduced 25%; B-88 assessed value reduced from BILLS PRESENTED FOR PAYMENT AND APPROVAL;
