SAN JUAN COUNTY COMMISSION MINUTES JUNE 20, 1988
The regular meeting of the San Juan County Commission commenced at 10:00 A.M. at the San Juan County Courthouse in Monticello, Utah.

Commissioner Maryboy was attending meetings in Salt Lake City, Utah. A motion to approve the minutes of June 13th as corrected was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.
COMMISSIONER KENNETH BAILEY'S REPORT
Spring Creek Turn-off - A letter to the Utah Department of Transportation verifies an agreement for the
County to furnish 300 tons of 3/4" gravel for a turnoff to be constructed at the Spring Creek turnoff on
Highway 191.
Public Safety Building - A motion to approve the payment of $8,755 for testing at the Public Safety
Building by Delta Geotechnical was made by Commissioner Bailey and seconded by Commissioner Black.

Equipment Request - Bids for an ST-63 14 ga. over lip all-weather-sliding drawers spring lock latch tool
box for a fire truck was received from Tesco-Williams for $268.00 and Hafer's for $215.66. Cormiissioner
Bailey made a motion to accept the low bid from Hafer's for $215.66. Commissioner Black seconded the
motion. UNANIMOUS.
Surveyor's Helper - A motion to hire Scott Boyle as a part-time surveyor's helper at grade 7 step 1 for
$6.51 per hour effective May 30, 1988 was made by Commissioner Bailey and seconded by Commissioner Black.
UNANIMOUS.
Hart's Draw Road - The bid on the Hart's Draw road will probably be in the paper next week. The bid will
call for a per yard bid on the soil removal and stacking.
Guymon Lane Power Poles - There are one or two power poles that need to be moved on the Guymon Lane. Utah
Power and Light will be contacted to see if the poles can be moved at their expense.
COMMISSIONER CALVIN BLACK'S REPORT
Utah State Tax Commission Meeting - There will be a meeting with the Utah State Tax Commission on June 29th in Green River to which all commissioners, assessors, and other elected officials are invited. The Commissioners will plan to attend this meeting.
Cahone Mesa Road - Coitmissioner Black asked if the right-of-way has been clear on the road by the Hatch Trading Post to the top of Cahone Mesa. Commissioner Bailey indicated that it was not cleared and that they want to make the road wider. If that section were finished and oiled on through it would make a nice road. Mr. Black also reported a lot of pot holes in the oiled section of the Hatch road and the noxious weeds between Hovenweep and the state line.
Edge of the Cedars - Comnissioner Black stated that the County, working with the National Park Service, ought to make an effort to prepare a grant proposal to the Impact Board to expand the Edge of the Cedars so it can be used by the BLM and other groups as a repository for their archaeological resources studies. Small Cities Grants - The Small Cities Grants were discussed at the AOG meeting held last week. About $19,000 is available now with more funds available soon. The grants are designed specifically to help promote projects like the tannery being sought by Monticello City. Bill Howell, executive director of the AOG will be contacted to get an application.
Oil & Gas Wells - Commissioner Black reported that there will be three oil and gas wells drilled in the near future out on Cedar Mesa and Cyclone Flat. Administrative Assistant Rick Bailey also reported the drilling of two additional wells north of Monticello this sumner.
State Lands for Sale - There is a proposal to put some State lands up for sale out around the old LaSal area. There is also a piece of land down the river from Moab in San Juan County that has been approved by the State Land Board for sale. The environmentalists are opposing that sale so Commissioner Black will follow through with Pat Spurgin on that.
Halls Crossing Dump - Commissioner Bailey indicated the road has been pushed through the Halls Crossing Dump but still needs to have shale put on it. Bill Duckett would like to have an agreement drafted. Coitmissioner Black felt the following points should be included in the agreement: Dell Webb would manage the facility, they would build and maintain the fence and keep it moved in lieu of a fee, any other users would pay to the County $5.72 a yard on a monthly basis. The County would agree to provide the land, which has already been purchased, and periodically dig and cover the pits and build and maintain the road into the dump. In the event any equipment, surplus or otherwise, becomes available the County will try to furnish a piece of equipment that Dell Webb would operate. In that event Dell Webb would agree to maintain and operate the equipment. County Attorney Craig Halls will be asked to draft the agreement. Hospital Districts - Comnissioner Black asked Administrative Assistant Rick Bailey to get a summary of what Hospital Districts can do, what is required and when it would have to be completed in order for it to be able to have a tax rate next year. The Hospital Board would like to discuss the issue further at the Hospital Board meeting tomorrow night.
ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT
CDBG Contract - Administrative Assistant Rick Bailey presented a contract agreement from Southeastern Utah Association of Local Governments to the County for ten percent of the community development block grant which is for their administrative work in the amount of $8,091.00. A motion to approve the contract was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.
Monticello Senior Citizens Center Director - Four applicants for the Monticello Senior Citizens Center Director were interviewed by a six panel board. All of the applicants were very qualified and on a vote of 6 to 5 Malva Ransdell was selected to be the director replacing Mary Ann Brown who has moved. A motion to approve the hiring of Malva Ransdell at Grade 2 Step 1 for $5.33 per hour effective June 20, 1988 was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.
Search and Rescue - Rick Bailey was approached by a few of the EMT's both in Monticello and Blanding who want to be involved with search and rescue and some rope training, etc. Mr. Bailey met with Sheriff Lacy and Deputy Steve Stovall in the Sheriff's department as both have a role in the search and rescue and emergency management. It is their recommendation that a small group of ten to fifteen volunteers, from EMT and firefighter groups, be organized to help in search and rescue under the direction of the Sheriffs office. They would be covered by Workmen's Comp insurance and they would also help in EMT and fire fighting needs. Mr. Bailey recommended that some of the funding be run through the EMT program because the grants are available through the EMS State program for search and rescue. There are some funds available in the ambulance fund that could be used in the training of the volunteers.
CURRENT BUSINESS
District Court Contract - Mike Allphin of the Stake Court Administrators office met with the Commission to briefly explain the District Court Act and answer any questions the Commissioners may have. The
Legislature passed a bill that the UAC felt they could live with. The Bill mandates the four Wasatch front counties into the system and the other 25 counties had the option of joining. Out of those 25 counties, there are nine primary locations and 16 secondary locations. The primary locations will be totally taken over by the state and funded and administered by the state. The secondary locations will be funded by the state and administered by local government, through the county clerk. A letter received from Bill Vickery, State Court Administrator, gives an estimate of what that contract would be based on the figures that were supplied through the UAC. It represents $12,250 a half a year, so it would be approximately $25,000 with a lease payment of approximately $9,700 begining July 1, 1989. They arrived at that lease payment by taking what they are currently paying for circuit court and multiplying it by whatever the square footage is. It will be a full-service lease. Mr. Allphin indicated that with a new facility, the County ought to be paid at least in the $8 range. The majority of the counties seen to be in favor of going with the state system. The warrant fee of $85 will be effective as of January 1, 1989. Bailiff services will also be paid for but are not reflected in the contract. The Sheriff's department will be reimbursed for actual cost for bailiff services through a contract between the sheriff and Court Administrators office. A motion to approve the County's Declaration of Intent to participate in the State District Court System was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS. County Clerk Gail Johnson stated that she would like to see the state take over the funding of the sanity hearings before the person commits a crime. Mr. Allphin indicated that issue may be brought before a special session of the legislature this summer. However, if they are civil cases, it is doubtful that the state would ever fund those.
Bluff Mosquito Problem - Bluff residents Charley DeLoren, Eugene Foushee, Gary Sosa met with the Commission to express their concerns over the apparent breeding grounds propagated by two individuals from the use of their irrigation water. County Health Officer Greg Adams investigated the situation and stated there is some areas by the San Juan River and the old swimming hole, as well as the Guymon and Jones property that are potential health hazards to the area residents. However, the Health Department can only get involved if there is a disease problem. The Soil Conservation Service has indicated that they would be glad to help the farmers learn how to put the irrigation water on at the proper rate. It was suggested that in order to relieve the problem a mosquito abatement district may have to be established. Meetings have been held with the individuals asking for their cooperation with the problem but nothing seems to have been done to alleviate the situation. The Commissioners suggested that letters be written requesting the help of the landowners in clearing up the problem with the idea that if nothing is done the county attorney can be contacted for other solutions.
Budget Hearing - County Clerk Gail Johnson reported to the Commissioners that to raise the mill levy 1/2 mill to the original 16 mills would only increase the general fund by $64,000, which would not be sufficient to cover the funds needed by the hospital. The 1/2 mill does not represent an increase in the tax structure as the certified tax rate is 16 mills. When the budget was formulated it was estimated conservatively therefore, the 1/2 mill increase will just bring it back to the 16 mill levy. Any other hospital deficit will have to come out of the accumulated surplus.
Ken's Lake Ordinance - After meeting with the Grand County Commission, it was decided to hold a public hearing on adopting the ordinance. There will be a hearing after a Commission meeting in Monticello and an evening hearing in Moab. County Clerk Gail Johnson* was asked to contact Grand County as to the earliest possible date to hold the hearings. The ordinance would not go into effect for 30 days after the ordinance has been approved.
Clay Hill Crossing - Concern has been expressed about the road from Clay Hill Pass to Clay Hill Crossing. Commissioner Black indicated that the Park Service is planning to close the access at Clay Hill Crossing. Bernal Bradford has looked at the situation and said it would be very expensive to construct a road in that area because when the water rises it would cover the present road. A suggestion was made to relocate the road. Commissioner Black, Eugene Foushee and others will go look at the area on Thursday, June 23rd.
Utility Box - Communications Truck - A bid has been received from Tesco-Williams for a utility box for the communications truck for $3,067. Other companies were contacted but unable to provide a similar box. A motion to approve the bid from Tesco-Williams was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.
Alcohol and Drug Contract - Social Service Director Mark Lyman presented the Alcohol and Drug Contract to be approved in the amount of $10,000. A motion to approve the contract and authorize Chairman Black's signature was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.
Mental Health Contract - Commissioner Black indicated the Mental Health contract should be signed and County Attorney Craig Halls draft a letter reserving the County's rights to challenge or contest the contract. Mr. Lyman stated that the Utah Alliance for the Mentally ill is considering a law suit against the state for the overall cuts statewide. There is a possibility the County will cooperate in that lawsuit rather than initiating a separate action.
