SAN JUAN COUNTY COMMISSION JANUARY 20, 1987
The San Juan County Commission met in regular session on January 20, 1987 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.
The following members were present: Commissioner Black, Chairman
Commissioner Bailey Commissioner Maryboy
Minutes of the January 12, 1987 Commission meeting were approved on the motion of Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.
COMMISSIONER CALVIN BLACK'S REPORT
Inauguration of Peter McDonald - Commissioner Black reported that he and Commissioner Maryboy attended the
Inauguration of Peter McDonald, Tribal Chairman, in Window Rock last Tuesday. Commissioner Black said he
was impressed with Mr. McDonald's remarks of the need for jobs and economic development and for his
enthusiasm in what he plans to do.
AOG Meeting - Commissioner Black reported that he attended the AOG board meeting last Friday in Price.
They discussed the state funding formulas and Bill Howell, Ex. Director, will follow up on these. If the
proposed legislation process is passed it will affect the rural areas in Utah. Commissioner Black said
they also discussed the bus service situation (Trailways discontinuing service in Utah) and asked Mr.
Howell and Les Prall to pursue the possibilities for a feasibility study and funding of alternate service.
The board heard a report on the new safe drinking water act and money that will be available. This will
primarily effect the cities to help improve the culinary water delivery systems in making drinking water
safer. Also discussed was a proposal within the AOG Block Grant Funding Formulas and the recommendations
approved were that all money be allocated and contracted between the counties and AOG.
UAC - District Court - Commissioner Black reported that he attended a meeting with representatives of the
UAC to discuss the proposed District Court legislation. UAC is opposed to this legislation stating that
it's not an improvement to the district court services that are already being provided.
Governor's Mansion Breakfast Friday - Commissioner Black reported that he was invited to a breakfast this
Friday at the Governor's Mansion.
New Commissioner's Workshop - The New Commissioner's Workshop will be March 5 & 6. Commissioner Maryboy
said he plans to attend this workshop.
Legislative Session - Commissioner Black said he plans to attend some of the Legislative Sessions. There
is a legislative committee meetings every Thursday at noon in the capital cafeteria where representatives
of the counties meet to discuss the current status of all legislative matters that will be following.
Multi-County Appraisal Trust is meeting on February 6.
Governor's Economic Development Conference will be held on February 5 & 6.
Mined Land Reclamation - Commissioner Black said the efforts made by the county and Jimmie Walker, Grand
County Commissioner, were successful in getting the Division of State, Oil, Gas & Mining to propose
legislative changes in the bill with respect to mining. Commissioner Black said he would also like a
provision that prohibits the state from duplicating federal regulations.
UMETCO Will Open Mines in LaSal - Commissioner Black reported that UMETCO is planning to open some mines
in the LaSal area in the next few weeks. There will be about 200,000 tons of vanadium uranium ore that
UMETCO plans to mill, which will keep the mill in Blanding open for another year.
Employment in San Juan County - Commissioner Black read a report that the unemployment rate in San Juan
County is 8%. San Juan County has the highest percentage of government employment than any other county
in the state which is 35% of all non-agriculture jobs.
COMMISSIONER KENNETH BAILEY'S REPORT
Road Department - Graders - Commissioner Bailey recommended that the county purchase five graders for the road department. Bids were received from Century Equipment Company and Wheeler Machinery Company for motor graders. Commissioner Bailey made the motion to approve the purchase of three new champion 720A motor graders from Century Equipment Co. for $78,646 each less a 2% discount and two new Caterpillar 140 motor graders from Wheeler Machinery Co. for $100,000 each. Commissioner Maryboy seconded the motion. UNANIMOUS.
Commissioner Bailey explained that there are many positive factors in favor of each machine. The bids are not cat against cat and champion against champion, the champion is a lower initial cost. All components, engines, etc. are assembled by champion. The additional cost of the cat is justified by oil disk brakes over $6,000 additional cost, 5 circle pads instead of 3, motor driven circle instead of pistols driven, planetary drivers in the final drive, sealed and heavier front wheels bearings etc. Both are excellent machines.
Public Safety Building - Soil Report - Commissioner Bailey said he received the soil reports from where the public safety building is going to be built and will be reviewing them in detail. Commissioner Bailey said they are contemplating installing Honeywell heat controls in the new building because the schools in the county have them. Honeywell will send a written proposal on what they would charge for combined service trips for the school district and county. Commissioner Bailey read a letter from John Peterson, architect, stating information on double bunking.
Library Monticello Gas Leak - Commissioner Bailey said there is a gas leak in the Monticello library. The Commission will go look at it after this meeting.
Vacuum Cleaner Bid - Monticello Library - Two bids were received for a upright vacuum cleaner for the Monticello Library; B.J. Mansden - $199.87, and Monticello Merc $179.95. Commissioner Maryboy made the motion to purchase the vacuum from Monticello Merc because of best price. Commissioner Bailey seconded the motion. UNANIMOUS.
Road Projects - Shale - Commissioner Bailey asked Commissioner Maryboy to talk to Herb Clah about the list of road projects on the reservation and also pre-approval for the shale from the White Mesa pit. Commissioner Maryboy said he has spoken to Mr. Clah and has it on the agenda for the next UNDC board meeting.
Brown's Canyon road right-of way - Commissioner Bailey said the county has been working on widening the Brown's Canyon road (south of Blanding) for the last three years. Commissioner Bailey said that Doug Pehrson, surveyor, said most of the section corners have been destroyed and will have a difficult time doing the survey. It was suggested that Mr. Pehrson talk to the State Roads to see if they know where some section corners are. Commissioner Bailey said they will proceed with the survey and get the right-of-way documents prepared.
Roads Blanding - Commissioner Bailey said the city of Blanding is requesting work on the road to the college. This will be discussed at the monthly road meeting will all Commissioners. The city also agreed a few years ago to install curb & gutter by the stake center if the county built the road and this has not been completed yet.
Policy on Hiring Trucks - Commissioner Bailey gave the Commission his and the road foreman's recommendations on the policy for hiring trucks.
COMMISSIONER MARK MARYBOY'S REPORT
Montezuma Creek - Jail - Commissioner Maryboy reported that he meet with the Chairman's Assistant to discuss the proposal to build a jail and court in Montezuma Creek and tribal staff members will be assigned to work on this project.

Mexican Water Chapter Meeting - Commissioner Maryboy reported that he attended the Mexican Water Chapter
Meeting last week to discuss concerns relating to law enforcement in Bluff. Commissioner Maryboy said he
told them to document their concerns and the Chapter Manager will submit a list. Another complaint is the
wrecking yard in Bluff, they say it's unfair for the owner to take vehicles without permission of owner.
Commissioner Maryboy said he will discuss these with Sheriff Lacy.
Aneth - Robert Whitehorse - Contnissioner Maryboy said he met with Robert Whitehorse and discussed the
construction in the Aneth area. Mr. Whitehorse is working on a proposal to the county to do some fill-in
work on the reservation. Commissioner Bailey said the county has not contracted any maintenance but have
bid contracts in the past.
Repeater Black Mesa - Commissioner Maryboy reported that he met with Russ Stevenson to discuss the
repeater on top of Black Mesa south of Montezuma Creek Clinic. There is a need for communication between
the Shiprock Hospital and the Clinic to maintain the ambulance calls. The Commission told him to talk to
Bill Bayles the communication engineer.
Southeastern Utah Health District Board - Commissioner Maryboy recommended the appointment of Edward
Tapaha of Montezuma Creek to serve on the Southeastern Utah Health District Board. Commissioner Maryboy
made the motion for this appointment and Commissioner Bailey seconded the motion. UNANIMOUS.
Bluff Meeting - Commissioner Maryboy said he will be meeting with residents in Bluff tonight to discuss
various concerns.
HOSPITAL EMPLOYEE
Belinda Nielsonf hospital employee, met with the Commission concerning a personnel complaint of her employment at the hospital. The Commission told Mrs. Nielson this should be discussed at the health care board meeting tomorrow night.
PUBLIC SAFETY BUILDING - CORPORATION ACCOUNT - BOETTCHER & COMPANY
Rick Bailey, Administrative Assistant, presented the Commission the Corporation Account with Boettcher & Company for the purchase of the bonds for the Public Safety Building. Commissioner Bailey made the motion to approve and authorize Commissioner Black to sign the contract. Commissioner Maryboy seconded the motion. UNANIMOUS. The Commission also authorized Commissioner Black to sign the following:
1. Escrow Agreement
2. Construction Fund Agreement
3. General Certificate
4. Signature Indemnification & Non-litigation Certificate
5. Attorney's Opinion
6. Receipt
MONTHLY ELECTED OFFICIALS MEETING

Sheriff Lacy was absent because he was attending a sheriff's workshop in Salt Lake.
Implementation of Due Bill System - Gail Johnson, Clerk - Mrs. Johnson explained to the Commission she would like the county to adopt the Implementation of the Due Bill System. The county auditor is required by statute to issue a certificate of amounts due the county to the county treasurer. The auditor would examine all accounts indebted to the county or holding money payable to county treasury and certify the amount. The treasurer is required to receive money only when accompanied by certificate. Mrs. Johnson said she has talked this over with Ms. Bayles, Treasurer, and both agree this would be beneficial. The Commission told Mrs. Johnson to have this on the agenda next week for final action.
Copy Machine Money - Mrs. Jones said her office spends a lot of time taking copies for the public. The Commission discussed raising the copy price to 25 cents for the first copy and 10 cents thereafter. Worker's Compensation & Occupational Disease Contract - Utah Local Governments Insurance Trust - Mrs. Johnson asked Commissioner Black to sign the contract for worker's comp. which was previously approved and became effective January 1, 1987.
Telephone System Courthouse - Mae Systems - Mrs. Johnson said that Mae Systems has not been abiding by their agreement to fix the telephone system and provide training to employees in the county courthouse. Commissioner Bailey said written complaints should be sent to Contel because the county purchased the system from them and they installed it. The system has never worked the way it was represented to work and was not installed satisfactory.
District Courts - Commissioner Black reported that he attended an AOG meeting Friday to discuss the state's proposal to take over the district courts. The AOG board is recommending that the UAC board to oppose this legislation. Mrs. Johnson said she does not want to contract with the state because they would take all the revenue and reimburse the county for salary and there would still be a two boss system which causes other problems.
Taxation on Non-Profit Hospitals & Nursing Homes - Barbara Montella - Assessor
Mrs. Montella will be attending the UAC meeting on January 29 to review the criteria under which non-profit hospitals are to be treated as tax exempt. The Commission said that personnel from the Monument Valley hospital should also attend be invited to attend this meeting.
Marian Bayles - Treasurer's Office more room - Ms. Bayles informed the Commission that she needs more room in her office. The custodian told her the floor is sinking and she also needs more space for file cabinets. The Commission said they will look into this.
Merrill Lynch Investments - The Commission asked Ms. Bayles about the Merrill Lynch Investments. Ms. Bayles said they are approved by the state and are in a Federal Security's Trust. The Commission asked Ms. Bayles to check if the invested funds are guaranteed by federal insurance or bonds.
Public Defender - Attorney Halls discussed the public defender position which will be open the first of February. The Commission said they would like to advertise for proposals.
COURTHOUSE CUSTODIAN - HEATERS
Dell Hunter, custodian, told the Commission the he needed two hot water-heaters for the courthouse basement. The Commission told Mr. Hunter to go ahead and install the heaters.
HUMAN SERVICES FUNDING SUBCOMITTEE - RECOMMEDATIONS
Bruce Shumway, Social Services, met with the Commission to discuss the Human Services Funding Subcommittee's recommendations. The programs with recommended changes are Aging & Adult Services, Alcoholism & Drugs, Mental Health and Department of Health. The subcommittee is also recommending that the county's medical indigent program be set up as a statewide program, totally funded and administered by the state and recommending options for juvenile detention and county jail reimbursement. Commissioner Black said the county needs to review these proposed changes. Mr. Shumway said the rural districts are especially concerned with what this will do. Mr. Shumway said he will work with Rick Bailey, Aging Director, on alternative programs.
SOUTHEASTERN UTAH ECONOMIC DEVELOPMENT DISTRICT IN MONTICELLO
The Southeastern Utah Economic Development District meeting will be held in Monticello on January 27 at 6 p.m. at the county courthouse. This meeting will be spent going over the Southeastern Utah Overall Economic Development Program documentation.
SAFETY MEETING - UTAH LOCAL GOVERNMENTS INSURANCE TRUST
Rick Bailey, Administrative Assistant, informed the Commission that the Utah Local Governments Insurance Trust is holding a safety meeting. This is a regional safety seminar focusing on loss prevention through safety awareness. The Commission agreed that all road department employees should attend but will request the seminar to be held in this area. Mr. Bailey said he will see if they will hold a seminar down here.
SOUTHEASTERN UTAH ASSOCIATION OF LOCAL GOVERNMENTS - AMENDMENT TO AGREEMENT
Commissioner Black signed an amendment to the agreement in which Southeastern Utah Association of Local Governments agrees to reimburse San Juan County a maximum of $18,439.79 for term of the contract for the provision of service activities previously agreed upon. This is a Community Service Block Grant increase.
COMMUNICATION - RADIOS IN SHERIFF'S OFFICE
Bill Bayles, communications engineer, met with the Commission to discuss the radio programmers in the sheriff's office. He would like to buy the General Electric system to stay with the State Highway Patrol radios and specialize in this one area. Only one bid was required as this programmer is the only one that will work with mobile radios already purchased. Commissioner Bailey made the motion to purchase #2310 electronic programmer for GE Mobile Radio for $2035, two prong adaptor kits at $173 each, and two cable pigtail kits at $121.00 each. Commissioner Maryboy seconded the motion. UNANIMOUS.
COURTHOUSE EMPLOYEES - GRADE INCREASES APPROVED
Marian Bayles, Treasurer, presented the Commission a request for a grade increase to Netta McDonald. Ms.
Bayles said that Mrs. McDonald has taken over some of the computer responsibilities and has done a good
job. Commissioner Maryboy made the motion to approve a grade increase for Netta McDonald from Grade 1 to
Grade 2 Step 6. Commissioner Bailey seconded the motion. UNANIMOUS.
Barbara Montella, Assessor, presented the Commission a request for a grade increase to Mary Lou Hoggard.
Mrs. Montella said Mrs. Hoggard has the full responsibility of the motor vehicle office which includes
doing all the reports. Commissioner Bailey made the motion to approve a grade increase for Mary Lou
Hoggard to a Grade 2 Step 6. Commissioner Maryboy seconded the motion. UNANIMOUS.
Mrs. Montella told the Commission that Roma Young has been working for three months and has done an
outstanding job and recommended a probationary raise. Commissioner Maryboy made the motion to approve a
probationary raise for Mrs. Young to Grade 1 Step 2. Commissioner Bailey seconded the motion. UNANIMOUS.
PERSONNEL POLICY - PERMANENT PART-TIME EMPLOYEE - LEAVE TIME
Gail Johnson, clerk, asked the Commission how to figure a permanent part-time employee's leave time. It is stated in the personnel policy book that a permanent part-time employee (30 hours or more) is entitled to pro-rated sick leave and pro-rated vacation.
CONSORTIUM BOARD
John Fellmeth, hospital administrator, informed the Commission that the Consortium Board is meeting tomorrow at 1 p.m. at the UNDC building. Commissioner Maryboy said he will attend this meeting. Mr. Fellmeth said the board will be discussing a new plan to get Consortium funding. (There is $140,000 available.) Mr. Fellmeth said the county would like to buy a scope instrument that's in Dr. Warren's office but is owned by the Federal Government.
