MINUTES OF THE SAN JUAN COUNTY COMMISSION MEETING AUGUST 20, 1984

The San Juan County Commission met in regular session on Monday, August 13, 1984, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah.

The following members were present: Commissioner Calvin Black, Chairman

Commissioner Robert Low

Commissioner Kenneth R. Bailey is attending a subcommittee meeting of the Joint Roads Committee.

Minutes of the previous meeting were approved with the specified corrections on the notion of Commissioner Low. The motion was seconded by Commissioner Black and carried unanimously.

MEETING WITH ELECTED OFFICIALS

The following elected officials met with the Commission for their first regular meeting:

Rigby Wright, County Sheriff

Gail Dalton-Johnson, County Clerk/Auditor

Mary Lou Mosher, County Recorder, asked the Commission if any decision has been made regarding the implementation of an option for a dental program for County employees. The Commission reported that as soon as the cost information is received a memo will be sent out to the employees so that they can make their decisions.

Bruce K. Halliday, County Attorney, reported that he is very pleased with the idea of the monthly meetings. Also discussed was the opinion survey drafted for the primary election regarding the election of County Commissioners by districts.

Marian Bayles, County Treasurer, reported that the County is receiving an 11 1/2% interest rate on invested money.

Sheriff Rigby Wright reported that there are no complaints on file either in the Sheriff's Office or with the Blanding City Police regarding the vandalism at the Walter C. Lyman Park in Blanding. Sheriff Wright further reported that there will be increased patrols of the area by both the San Juan County Sheriff's Department and the Blanding City Police Department.

Sheriff Wright also pointed out that his department is on a different retirement system than the rest of the County employees and wanted to know if his department would also be entitled to an option for dental insurance or additional retirement.

The Commission reported that the Sheriff's Department and the Health Care Services retirement programs have not had a reduction therefore they will not qualify for the options.

Gail Dalton-Johnson, County Clerk/Auditor, and John Fellmeth, Chief Deputy Auditor, reported that the insurance companies contacted for proposals regarding the dental option do not want to submit proposals for an optional insurance program. One possibility would be for the County to provide single coverage for those choosing the dental option and the employee to pay any additional fee for family coverage.

UNI SEWING FACTORY AT THE MONTEZUMA CREEK ELEMENTARY SCHOOL DISCUSSED

Francis Lyman representing U.N.I, met with the Commission to report on the progress of the remodeling at the old Montezuma Creek Elementary School. U.N.I, is planning to operate an apparel sewing factory in a portion of this building.

RIO ALGOM CHECK RECEIVED FOR JULY

Gail Dalton-Johnson, County Clerk/Auditor, met with the Commission to report that the royalty check from Rio Algom in the amount of $2,993. for the month of July has been received.

MONTICELLO REPRESENTATIVES MEET TO DISCUSS AIRPORT AGREEMENT

Rick Terry, Monticello City Administrator, and Bill Christensen, Monticello City Councilman, met with the Commission to discuss the operating agreement between the City of Monticello and San Juan County. The City objected to the portion of the agreement which stated that a new terminal building will be paid 50% by each party. The Commission reported that this is the County's policy for airport terminal buildings.

COUNTY ROADS DISCUSSED

Commissioner Low reported that he has received sane complaints regarding the condition of the Eastland Road.

COMMISSIONER DISTRICTING DISCUSSED

Commissioner Black reported that he received a letter from Willie Greyeyes,U.N.D.C. Chairman, regarding the opinion survey. Mr. Greyeyes expressed his objections to the survey and asked several questions. Commissioner Black drafted a letter of response to Mr. Greyeyes answering his questions and inviting him to meet with the Commission to discuss this matter.

Commissioner Black stated that there has been a lot of criticism by the U.N.D.C. and the Navajo Tribe regarding the issue of Commissioner Districting, stating that the Commission has no right to put the questions regarding this on the ballot. The Commission believes that they have every right to put questions on the ballot and get further input and opinions from citizens regardless of what it is and that the Commission has the responsibility to listen to all of the input whether it is from the Tribe, the U.N.D.C., the general public or any other individual or group. The Commission will continue to solicit information from all of these groups. Commissioner Black further stated, "That the Commission has previously requested numerous times a preferred alternative on districting each from the Navajo Tribe and the U.N.D.C. and that the Commission waited until we could wait no longer and they failed to respond to this request. Therefore the Commission put a composite of

the proposals, in effect covering the spectrum of what had been discussed to try to get further public opinion. After the vote tomorrow, the Commission will still review not only that but all other input from any group or individual".

HEALTH CARE SERVICES

Commissioner Low reported that the physicians contract will be on the agenda for the Health Care Services Board meeting tonight. Commissioner Low also reported that the County Attorney is reviewing the proposed contract. Commissioner Black stated that he feels that the Board should review the proposals and give the Commission a written report and recommendation to the Commission before a final decision is made.

AOG BOARD MEETING ATTENDED

Commissioner Black reported that he attended an A.O.G. Board meeting in Price last Friday.

COMMISSIONER BLACK APPOINTTED TO NACo STEERING COMMITTEE

Commissioner Black reported that he has been appointted to the National Energy and Environment Steering Committee of NACo.

NUCLEAR WASTE POLICY GROUP DISCUSSED

Commissioner Low reported that he has not been receiving notice of the Nuclear Waste Policy Group meeting in time to make arrangements to attend them. Notice was received of the meeting scheduled for Tuesday on Friday.

LAMP OWNERSHIP COMPARISON REVIEWED

The Commission reviewed a land comparison chart that shows the amount of acres and percentage per county of federal acres, state acres and private acres. San Juan County has the 7th highest percentage of federal acres in the state with 85.9%. There is 5.99% of state acres in the County. Private acres in the County amount to 8.1%.

PROJECT BOLD DISCUSSED

Commissioner Black received a letter from Governor Matheson regarding Project Bold. The letter was in response to a letter from Commissioner Black on June 25th.

BLUFF TO MONTEZUMA CREEK ROAD

Gail Dal ton-Johnson/ County Clerk/ met with the Commission to report that Commissioner Bailey had telephoned to report that the D.O.T. is ready to make the first payment to W.W. Clyde Construction on the Bluff to Montezuma Creek Road. The payment will be in the amount of $250/000.

JAIL ARCHITECT

Sheriff Rigby Wright and Mr. Markham from Markham & Markham Architects and Engineers met with the Commission to discuss some proposals for a new jail should the County decide to build one. Plans were reviewed for a jail and for a jail and new courthouse complex. Cost estimates for a 45 prisioner capacity would be approximately $1.5 million and for the jail and courthouse approximately $3 million.

INSURANCE FOR MONTEZUMA CREEK ELEMENTARY SCHOOL DISCUSSED

Doug Boyle, representing Boyle Insurance met with the Commission to review the type of coverage needed on the old elementary school at Montezuma Creek. The Commission instruced Mr. Boyle to insure the whole building and the County will bill U.N.I, on a pro-rated basis for the portion of the building they will be using.

ISLAND IN THE SKY ROAD

The Commission drafted a letter to the Superintendent of Canyonlands National Park responding to the Environment Assessment with respect to the proposals to rebuild 13.5 miles of road to and within the Island-in-the-Sky District of Canyonlands National Park. The letter stated that it is the position of the Commission that this project requires a complete Environmental Impact Statement and that an E.A. is inadequate and does not fully comply with the National Environ-mental Policy Act. Some of the reasons cited were air standards, diesel smoke plumes, noise. The Commission further stated that it would appear to be inconsistent to allow an activity within the Park to occur while opposing an activity with less impact outside the park. The Commission also stated that it is their feeling that additional information must be gathered, public hearings must be held with respect to the actual construction, and a complete Environmental Impact Study approved before this project can legally proceed.
