The San Juan County Commission met in regular session on April 20, 1987 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.
The following members were present: Commissioner Black, Chairman
Commissioner Bailey Commissioner Maryboy
Minutes of the April 13, 1987 Commission Meeting were approved with the corrections on the motion of Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.
COMMSSIONER CALVIN BLACK'S REPORT
Western Region of Counties - Commissioner Black reported that he will be in Sacramento, California next
week attending the Western Interstate Region of Counties.
COMMISSIONER KENNETH BAILEY'S REPORT
Gravel Crushing - Commissioner Bailey reported that the gravel crushing at Bluff has been contracted for
35,000 yards instead of the 50,000 yard bid and after the chips are crushed he authorized Skeleton to move
off and come back in the fall to crush the balance of the gravel in the fall.
White Mesa Gravel Pit - Commissioner Bailey said that the gravel pit permit at White Mesa needs to be
expanded. Doug Pehrson, engineer, is working with the BIA on this matter.
Transient Care - Commissioner Bailey said he is concerned about the transient care that is being provided
by the county. The county used to let people spend the night in the jail and also provide a meal if
needed. The Commission agreed to talk to the county sheriff about this matter.
Hospital Board - The hospital board will meet this Wednesday at 6 p.m.
COMMISSIONER MARK MARYBOY'S REPORT
Fire Truck at Montezuma Creek - Commissioner Maryboy said that the Navajo Tribe will pay half the cost of
two new or used fire trucks for Montezuma Creek and Mexican Hat. Comnissioner Maryboy asked Rick Bailey,
Administrative Assistance, to write a proposal to the Tribe for this.
Baseball Field for Red Mesa, Aneth and Mexican Water - Commissioner Maryboy said the Navajo Tribe is
asking the Red Mesa, Aneth and Mexican Water Chapters to submit a proposal for baseball fields. They will
be funded 100% by the Tribe provided that the county recreation personnel work with the communities on a
recreation program. Commissioner Maryboy said he assigned Eddie Allred, county recreation director, to
prepare the designs and estimated cost of these projects.
Recreation Board Meeting - Commissioner Maryboy reported that he met with the Recreation Board. A request
was made to move the Blanding golf course south of town.
Bluff Mission - Aneth Resolution - Commissioner Maryboy said a resolution was passed by the Aneth Chapter
regarding the accretion land at the Bluff Mission. According to the people they believe its part of the
reservation but the BLM and the BIA disagree. The resolution asks for this matter to be resolved.
UDOT - Dyke LeFevre - Commissioner Maryboy reported that he met with Dyke LeFevre, UDOT, in Montezuma
Creek last week and reviewed the state roads on the reservation. They also looked at the Montezuma Creek
Elementary School where the curb and gutter is to be built. The state will install a flashing yellow
light and a cross walk at the school this summer when school is out.
Commissioner Maryboy said that Mr. LeFevre said a wider space will be provided at the Bluff school bus
route for a turn around and Jamie Laws, state road employee, was assigned to go over the roads on the
reservation to see if they have been maintained properly and to check the guard rails to see if they have
all been installed.
Meetings - Commissioner Maryboy reported that he and Claude Lacy, Sheriff, will meet with the Mexican Hat
residents tonight at 7 p.m. Tomorrow at 10 a.m. Commissioner Maryboy, the BLM and some Navajo families
will meet regarding grazing on BLM property. And on Thursday and Friday he will be in Window Rock,
Arizona meeting with the Navajo National Education Director, Director of Safety Patrol, Land
Administration, Police and Fire Department Personnel and the Navajo Tribe Chairman's assistant.
UDIA - The UDIA will meet this Wednesday. The UNDC board met last week to discuss the budget cut and
decided to request a 10% cut in their budget instead of a 40% cut to the UDIA board.
ELECTED OFFICIALS MONTHLY MEETING
Recorder's Office - Vault Space - Louise Jones, Recorder, told the Commission she will need additional
vault space within one or two years. Commissioner Bailey said that when the new public safety building is
built the offices in the courthouse will be reviewed.
May Tax Sale - Gail Johnson, Clerk, said the county tax sale of delinquent property will be May 27. The
Commission will have to determine whether to sale the property at market value or for the taxes and
penalty interest owed. The Commission asked Mrs. Johnson and the County Attorney to recommend what
property to sell for market value.
Refund of Property Taxes - Gail Johnson, Clerk, reported that the claims for property tax refunds on motor
vehicles are still coming in but said she has stopped payment on them. Mrs. Johnson said a signed
stipulation was never filed by the attorneys in the lawsuit and until an agreement is signed she will not
pay any more claims.
Re-appraisals - Barbara Montella, Assessor, said that the re-appraisals are being done on the older homes
in the county and the taxes on these homes will be going up which was expected.
Sheriff - Sheriff Claude Lacy said that the county jail administrator was in Boulder, Colorado last week
to a training session.
Attorney - Craig Halls, attorney, said he received a bill from Devon Burtenshaw for wrecking services for
towing a trailer that was used for a road block requested by the sheriff's department. The Commission
told Mr. Halls to discuss the bill with Mr. Burtenshaw.
OIL COMPANIES LAWSUIT
Lyle Anderson, attorney, said that the attorney who is representing Texaco Oil Company on the lawsuit filed against San Juan County, San Juan School District and the State of Utah will be in the county tomorrow to look at records of the county and the school district.
PUBLIC DEFENDER
The Commission received one bid for the Public Defender contract. The bid proposed $35,000 per annum for basic representation plus additional expenses. The Commission discussed the proposal and decided to advertise the contract for $1000 a month plus health insurance.
MOSQUITO PROBLEM IN BLUFF - RALPH HORNE
Ralph Horne, USU Extension Coordinator, met with the Commission to discuss the mosquito problem in Bluff. Mr. Horne said many of the mosquitos are coming from the swamp areas but other places are also contributing to the problem. Mr. Horne said that in his opinion it would be a waste of money to spray the chemicals by air because the areas to be sprayed are covered by grass and the chemicals won't ever hit the ground. The best way to spray is to have someone go around with a dipper to test for any lava present and then follow up with the spraying procedure. The County will furnish the chemicals and the public will do the spraying.
UTAH WILDLIFE FISH & GAME - RECAPTURE LAKE, DEER HERDS, ELK TRANSPLANT
Doug Messerly, Fish & Game, met with the Commission to discuss various topics.
Recapture Lake - Mr. Messerly said there is a fish growth problem at Recapture Lake because of a lack of
food and nutrients in the lake. Mr. Messerly said they are considering putting moldy hay in the lake that
would add nutrients to the lake and asked the Commission how they felt about this. The Commission said it
would be a good idea. Mr. Messerly said he will check with Norman Nielson, San Juan Water Conservancy
District, and the Board of Health before proceeding with this project.
Deer Herds - Mr. Messerly said they did their annual spring classification on the deer herds and there was
a good production last year with 80 to 90 fawns per 100 does.
Beef Basin - The Fish and Game made their annual trip into Beef Basin last week.' Mr. Messerly said the
sage brush looks real bad.
Elk Transplant - There were 26 appeals on the Forest Service's proposed Elk Transplant.
Anterless Deer Hunt East of Monticello - There was a public meeting in Eastland and the Game manager
proposed a hunt for anterless deer as an alternative of paying for damages. The land owners agreed to
open their land to let the doe hunters in.
EMPLOYEE PERSONNEL - BACK PAY - PAUL FOREMAN'S PETITION
Last week the Commission received a petition from Paul Foreman, a former county employee, stating that he was promised a $.50 raise per hour to become effective October 1, 1981. The Commission told Mr. Foreman to submit any additional documentation by today. Mr. Foreman came before the Commission today stating that a raise was verbally promised by Dick Traister, former county road superintendent, by creation of a new job of sign painting Mr. Foreman said that after Mr. Traister's termination it was brought before Bernal Bradford, superintendent, and it was denied.
Commissioner Bailey said that he had discussed this with Dick Traister and told him that no raise was to be given to Mr. Foreman. The Commission told Mr. Foreman that Mr. Traister, nor any other foreman, has the authority to give any employee a raise but can recommend it to the Commission. Commissioner Black said this was never brought to the Commission.
Commissioner Bailey made the motion denying the claim of Mr. Foreman. Commissioner Maryboy seconded the motion stating that the petition would be reconsidered if Mr. Foreman could provide any documented evidence. The decision was UNANIMOUS.
BLM 120 ACRE LAND SALE TO NAVAJO TRIBE
Ed Sherick and Bob Turri, BLM, met with the Commission to discuss the BLM 120 acre land sale to the Navajo Tribe. Craig Halls, county attorney, said that once the land is sold it comes under the definition of "Indian lands" and no one but the Tribe has jurisdiction. Mr. Halls said that an agreement needs to be signed defining all areas or jurisdiction, law enforcement, taxes, etc. before the land is sold. Commissioner Maryboy said that he is meeting with the Navajo Tribe Chairman's assistant on Thursday at 10 a.m. at Window Rock, Arizona regarding this issue and asked Mr. Halls if he would attend. Mr. Halls said he will attend.
MONTEZUMA CREEK ROAD SHED - STIPULATION
A motion was made by Commissioner Bailey approving an Acceptance of Notice of Stipulation on the Montezuma Creek Road Shed with the BLM and authorized Commissioner Black to sign the Notice. Commissioner Maryboy seconded the motion. UNANIMOUS.
HOSPITAL EMPLOYEE - COMPLAINT TO INDUSTRIAL COMMISSION
Craig Halls, county attorney, said the county received a notice from the Industrial Commission of Utah concerning a complaint filed by an employee, Belinda Nielson, who is a housekeeper at the hospital. During her pregnancy leave, her full-time job was cut to a part-time job because it was decided that this position was no longer needed. Mr. Halls said the Commission needs to respond to the complaint in which she wants her full-time job back plus back pay. The Commission told Mr. Halls to answer denying the claim.
MONTICELLO AIRPORT - UPGRADING BIDS
The Commission received two proposals for the engineering project at the Monticello airport. These have been reviewed by the Commission and Ron Theobald, UDOT Division of Aeronautics, and based on the scope of the work and proposals Armstrong Consultants, Inc. is the low bidder. Commissioner Bailey made the motion to award the bid to Armstrong Consultants, Inc. and authorized them to proceed with the first phase of the contract and also authorized Commissioner Black to sign the contract. Commissioner Maryboy seconded the motion. UNANIMOUS.
A contract was signed for task 1 - Geotechinical Investigation - During this phase of the work the Engineer will sample, test and analyze the subbase soils, base gravel and asphalt surfacing. Following this analysis the Engineer shall develop a specific method of rehabilitating the runway and apron and shall develop an estimate of cost for the project. Fixed Fee for this task is $4,500 and no other part of the work will be performed until authorized in writing by Owner.
CRUDE OIL PRICKS - COUNTY
Rick Bailey, Administrative Assistant, presented the Commission a report from Chevron U.S.A., Inc. listing the crude oil prices for the Eastern Region for April 7, 1987. The Four Corners area is $16.50 per barrel which is about the lowest price. Mr. Bailey said that the county will be added to their mailing list to receive future bulletins.
INTEGRAL VISTAS
Rick Bailey, Administrative Assistant, gave the Commission a memorandum from Bill Howell, Ex. Dir of SEUAOG, stating that there will be scheduled hearings to discuss the Citizens Committee recommendations relative to integral vistas designation and protection. The Utah Air Conservation Committee and the Utah Department of Health will conduct a series of public meetings around the state to receive "comment and hear discussion on recommendations made by the Citizens Advisory Committee on Visibility Protection Around the National Parks in Utah.
SOCIAL SERVICES CONTRACT
Commissioner Bailey made the motion approving the Social Services Contract #86-3835 Amendment # Two for the purpose to increase federal funding and decrease state funding and adjust cost centers and authorized Commissioner Black to sign the contracts. Commissioner Maryboy seconded the motion. UNANIMOUS.
FIRE CONTROL POLICIES
Rick Bailey, Administrative Assistant, presented to the Commission the following memorandum and it was adopted on the motion of Commissioner Bailey and seconded on the motion of Commissioner Maryboy. UNANIMOUS.

RE: ADOPTION OF FIRE CONTROL POLICIES
In order to assure proper control and management of the County's fire control system in connection with County personnel policies, the following is recommended to the Commission for adoption as policy regarding the San Juan County Fire Control.
1. The Fire Control Warden position is only seasonal and is not usually aware or made aware of policies and procedures adopted within the County. It should then be reasonable in order to assure that such management be in place, that Fire Control be placed under the Emergency Services Department.
2. That all vouchers for payment of fire control personnel, that are the responsibility of San Juan County for payment, be present to the Director of Emergency Services by the Friday before the third Monday of each month for approval to be submitted to the County Clerk and County Commission for final approval on the third Monday of each Month. Payments for services will be made only once per month.
3. That only meals required by fire control personnel in the field be provided and paid by San Juan County. If such personnel are required to miss a meal in the field, one may be purchased after the fire, per County per diem policy.
4. That as was approved with Michael Grosjean, Regional Manager for State Lands and Forestry, that any time the County would become responsible for payment for heavy equipment on a private land fire, prior approval from either a County Commissioner or Director of Emergency Services shall be obtained prior to the order for such equipment.
5. That when and if additional personnel are required for personnel relief of the district fire warden as required by the State Contract, that such person or persons should be hired per County Personnel Policies and approved by the County Commission.
6. That the County Fire Control work with other law enforcement agencies including the County Sheriff's Department, when fires are reported, especially during the off-season, that these agencies give assistance in determining the type of fire and if additional equipment or personnel are needed.
7. That the County Fire Control work closely with the Sheriff's department in training dispatchers to locate positions of reported fires and call the appropriate agency to respond, i.e., if location of a fire indicates that the fire to be on Bureau of Land Management land that his agency be called to respond.
CONTRACT FIRE WARDEN - SAN JUAN COUNTY
The Commission received a copy of letter from Mike Grosjean, Regional Manager of State Lands & Forestry, stating that the seasonal appointment of contract fire warden for San Juan County is George Kensley. The period of hire will be from June 1, 1987 to October 30, 1987.
