MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD

MARCH 1, 1982

Time: 10:00 a.m. in the Commissioner's Room at the Monticello Courthouse.

Members Present: Chairman Calvin Black, Commissioner Kenneth R. Bailey, and Commissioner Robert Low.

Minutes of the previous week were read and approved upon the motion of Commissioner Low and the second of Commissioner Bailey and it carried unanimously.

SCOUT HUT AND COURTHOUSE PARKING SPACE DISCUSSED;

Mr. Larry Bailey, representing the Monticello Stake Presidency of the L.D.S. Church, met with the Commission He discussed the possibility of negotiating a lease for a 105 3/4 ft. by 125 ft. parking space for the County Courthouse on the Churches' property in exchange for an 80ft. by 80ft. piece of County porperty on Monticello City block #23, for a Scout Hut.

The Commission felt that it would be more advantageous to work out a seperate agreement with the L.D.S. Church for Courthouse parking space, and agreed to lease the property on block #23 to the Boy Scouts of America for a moveable Scout hut, for a period of five years, with one year notice of termination.

Mr. Larry Bailey will contact the Boy Scouts of America and the Church Realestate Division in regards to these plans.

STATE WILDERNESS COMMITTEE MEETING REPORT;

Chairman Black reported on his attendance at the State Wilderness Committee meeting. During the next two years the Committee will review, and make recommendations on proposed State wilderness areas. The Committee will also define the limits of "single use" for wilderness areas.

NUCLEAR WASTE REPOSITORY;

The Commission reaffirmed that they are in favor of nuclear waste storage in San Juan County if a favorible site can be found. Chairman Black will write to State Senator, Omar Bunnell, to relay the feelings of the County Commission.

EVERETT JOHNSON MEETS ON FAIR BOARD BUSINESS:

Mr. Everett Johnson, representing the Fair Board, suggested that the costs for printing the premium book for the County Fair could be cut if the County copy machine is used to reproduce the books. The Commission gave the Fair Board permission to us the copy machine as long as they reimburse the County, from their budget, for the paper and use of the machine.

CHAMBER OF COMMERCE AND LIONS CLUB DISCUSS SHEDULING OF FACILITIES FOR PIONEER DAYS:

Mr. Carl Eisemann, representing the Monticello Chamber of Commerce, and Mr. Al Haskins, representing the Monticello Lions Club, met with the Commission to discuss scheduling of facilities for Pioneer Days. In the past, the City of Monticello and the Chamber of Commerce have cooperated in organizing the Pioneer Day Celebrations and the County has only been involved with leasing facilities for some events. The Commission recommended that the Chamber, the City , the Lions Club, and the Recreation Department meet together to discuss and coordinate scheduling of events for this year. The Commission did not feel they should be involved , as it is not a county sponsored event.

MONTEZUMA CREEK FIRE STATION:

Commissioner Bailey reported that he will deliver the check to Frank Montella for the shed for the Montezum

Creek fire station. Mr. Montella will store the shed until the County is ready to assemble it in Montezuma

Creek.

The Commission agreed that funds to purchase the Montezuma Creek fire station will be drawn from the Fire Warden's budget and all expenses for construction and alterations will be drawn from the Road Department budget.

BLUFF TO MONTEZUMA CREEK ROAD:

Commissioner Bailey reported that he will be meeting with the Utah Division of Indian Affairs regarding the Bluff to Montezuma Creek road project. It is the County's goal to have the project ready to bid in two months. It is estimated that the project will cost $3,000,000 and the county will fund its share from the Capital Improvements Roads and "B" Roads budgets.

NAVAJO MOUNTAIN TO OLJATO ROAD PROPOSAL:

Dear Mr. Grayeyes,

We are in receipt of your letters of February 5 and February 8, 1982, also the resolution of the Utah Navajo Development Council of January 21, 1982 and the resolution of the Navajo Mountain Chapter concerning a possible road from Navajo Mountain to Oljato.

The San Juan County Commission has discussed this proposal and asked that I respond as the Road

Commissioner.

The proposal to construct a paved, road from Oljato to Navajo Mountain is by far the most massive, formidable project that has ever been requested of the San Juan County Commission. We have traveled to Navajo Mountain, are aware of this distance and are sympathetic to the need for this road.

The cost of this project will be enormous and the funds will have to be sought from many areas, we propose the following:

We feel that the County Road Department could engineer and construct a preliminary access road

connecting the missing link between Oljato and Navajo Mountain off the Mesa to start this project,

and would propose to do this as soon as possible.

We would propose the following funding:

Navajo Mountain Chapter from general revenue sharing or other sources------------------$ 50,000

Oljato Chapter from general revenue sharing or other sources---------------------------$ 50,000

Bureau of Indian Affairs---------------------------------------------------------------$100,000

Utah Division of Indian Affairs--------------------------------------------------------$100,000

ROAD DEPARTMENT RESPONDS TO MONTEZUMA CREEK ROAD SPRAYING COMPLAINT:

Dear Sirs:

Montezuma Creek residents recently filed a complaint with San Juan County Commissioners saying that they are losing livestock due to saltwater and petroleum being sprayed on roads.

Citizens reported that livestock drink accumulated water on uneven roadways.

In the future, we would appreciate that petroleum is omitted from saltwater that is sprayed onto roads and light application of saltwater be sprayed on roadway so as not to accumulate into ponds.

TIRES FOR SHERIFF'S DEPARTMENT DISCUSSED:

Commissioner Bailey reported that the Road department would like to stock tires for the County Sheriff's department. The Commission gave its approval on the conditions that they stock the tires recommended by the vehicle manufactures and the Sheriff's department use the the tires that are in stock at the Road department before other tires are ordered.

BLANDING LIBRARY TO HAVE C.E.U. TEXTS AVAILABLE;

Commissioner Bailey reported that the Library Board is agreeable to a request from the College of Eastern Utah to place their course text books in the Blanding Library. The books will be checked out by the librar-ian.

DANCE PERMIT FEE SET;

Upon the motion of Commissioner Low and the second of Commissioner Bailey it was unanimously agreed to

set the County dance permit fee at $25.00.

SOUTHWEST MANUFACTURING CONTRACTS TERMINATED;

Commissioner Low reported that the County Attorney has informed Southwest Manufacturing Corporation of Dove Creek, Colorado, that it is the Commission's decision to terminate the hospital contract dated October 3, 1981, and the LaSal and Mexican Hat fire station contract dated October 2, 1981, on the basis of the defaults previously outlined by the Commission and the Health Care Services Board.

AIRPORT HANGAR RENT DISCUSSED;

The Commission agreed that airport hangar rent may be paid throughout the year at the yearly rate, or the

rent may be prorated to October 1st, whichever is most convenient for the renter.

SAN JUAN SPECIAL SERVICE DISTRICT # 1 SEWER PROJECT ACCEPTED:

Upon the motion of Commissioner Low and the second of Commissioner Bailey it was unanimously approved to accept by resolution the sewer project for San Juan Special Service District #1, and to authorize Chairman Black to sign the Grantees Release and Assignment of the Federal Share of Refunds Rebates and Credits.

The sewer system was accepted as complete January 28, 1982, by the Special Service District #1 Board and concerned Government Agencies. In addition the following resolutions were adopted by the Board:

1. Required 60 day hookup time limit to begin 1 February 1982.

2. Hookup fees should be paid by 1 March 1982 to facilitate the loan payment which is due.

3. The sewer service rates have been established as follows:

A. Commercial $20.00 Residence $ 5.00 Additional Business $ 5.00

B. Residence $10.00

C. Units (sinks, toilets, etc.) $ .51 per unit

4. The first bill is due and payable 1 April 1982.

5. Bills not paid by the 20th day of each month, a 10 day notice will be given and a 5% penalty added. Noncompliance within 30 days of delinquency will result in termination of service and a reinstatement charge of $25.00 plus labor will be assessed.

MARIAN BALYES DISCUSSES 1979 TAXES TO BE REFUNDED FOR OVER ASSESSMENT;

Treasurer, Marian Bayles, met with the Commission to discuss problems related to the 1979 tax refund. Since tax credit cannot be given to those who will not be tax payers in 1982, it was agreed that their rebates should be held out and they may be obtained upon request to the Treasurers office.

COUNTY AUDIT TO BE BID;

The Commission discussed the annual County audit with Clytie Barber and Bill Francom from the Clerk/Auditors office. It was agreed to bid the County's annual audit on April 5, 1982. A completion date of June 30, 1982 was specified. The Clerk's office was asked to have a Public Notice published,in The San Juan Record, of the County's intention to bid the audit, and to also notify accountants in the area regarding bid specifications and date of the bid.

HOSPITAL INSURANCE POLICY DELIVERED;

Central Utah Insurance Agent, John Fogg, delivered the insurance policy for the San Juan Hospital. The

policy will expire April 1, 1983.

Upon the recommendation of Mr. Fogg, the Commission approved a 5% increase in coverage for County buildings to keep in line with construction costs.

CIRCLE PARK ELECTRIC LINE EASEMENT APPROVED:

The Commission approved a request from Empire Electric for a power line right-of-way easement at Circle

Park near the Monticello Golf Course.

The Commission also discussed the possibility of eventually donating Circle Park to the City of Monticello.
