SAN JUAN COUNTY COMMISSION MEETING SEPTEMBER 19, 1988

The regular meeting of the San Juan County Commission convened at 10:00 A.M. in the San Juan County Commission Chambers at Monticello, Utah.

A motion to approve the minutes of September 12, 1988 as corrected was made by Comnissi oner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

CURRENT BUSINESS

Courthouse Telephone System - County Clerk Gail Johnson met with the Commission to discuss the telephone system in the County Courthouse. Several problems are still being experienced and Contel cannot seem to find the solution to the problems. They have suggested that one person be designated to answer the console and that the supersets not be used as the primary phone. In the present situation, it is not possible for one person to staff the console. When the new public safety building is finished there will only be three people in the Clerks office where the console is located. Mrs. Johnson suggested that separate phones be installed in each office so that the clerk's office is not responsible for answering and transferring all of the incoming calls. A separate phone will have to be installed in the road department as they are open longer than the rest of the courthouse. Commissioner Black said that a meeting should be held with Contel people and a solution worked out. Mrs. Johnson will set up a meeting as soon as possible.

Sue Cook/Congressman Howard Nielson - Sue Cook, representative of Congressman Howard Nielsen's office, met with the Commission to discuss County concerns. Commissioner Black stated that Joel Janetski, BYU Archaeologist, is encouraging the study by the National Park Service of the area around the Nancy Patterson ruins so that it might be designated as a National Monument in the future. Mr. Janetski would like to set aside the stipulations of the County in order to get the study completed. Mrs. Cook indicated that she felt Congressman Nielson would continue to support the County's stipulations.

Oljato to Navajo Mountain Engineering Request - Commissioner Bailey reported that the request for funding of the engineering on the Oljato to Navajo Mountain road was not approved in this session of the Congress but Congressman Nielson was willing to try to get approval in the next session.

Halls Crossing Airport - Administrative Assistant Rick Bailey expressed appreciation for the help Congressman Nielson's office gave toward the Halls Crossing Airport. Mr. Bailey reported that the EIS should be completed by the first of October.

Uranium Revitalization Bill - Mrs. Cook reported that the Uranium Revitalization Bill is still in process. Commissioner Black stated that he had read an article that stated that Congressman Udall was opposed to the bill.

Graduate Nurse Salary - John Fellmeth introduced the interim hospital administrator, Norm Campeau, to the Commissioners. Mr. Fellmeth asked that Mr. Campeau respond to the question regarding the salary of graduate nurses. Mr. Campeau stated that within the LHS Management system they have a pay scale for the graduate nurse which is somewhat less than the full R.N. but more than that of an LPN, from 50 cents to a dollar less than a entry level R.N. The policy will be determined at the next Hospital Board Meeting.

Canvas of Primary Election Votes - The Commissioners canvassed the primary election votes as stipulated by law. Three absentee ballots had been received after the day of election but the postmark was prior to the election so they are eligible to be counted. The Commissioners checked the disposition of the ballots to see that the judged have accounted for all the ballots used in the election. The tally lists were also checked to make sure the tally count was accurate. One tally correction was noted and the absentee ballots added to the total. After canvassing the tally lists the following results were posted: District 1 County Commissioner; Ty Lewis received 506 votes and Kenneth Bailey received 443 votes. U.S. Representative; Craig Oliver received 259 votes and Robert Stringham received 136 votes. A copy of the voting by precinct can be found at the end of these minutes.

Crowley Construction Payment - A motion to approve the payment of $15,832.80 to Crowley Construction for work on the Harts Draw Road was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

COMMISSIONER CALVIN BLACK'S REPORT

Recapture Reservoir and Lloyd's Lake - Commissioner Black reviewed the problems and opportunities available with Recapture Reservoir and Lloyd's Lake. The Monticello Chamber of Commerce has shown some interest in the improvement of Lloyd's Lake and Blanding City has accepted some responsibility toward Recapture Reservoir. Both facilities are owned by the San Juan Water Conservancy District but their primary interest is in the water for agricultural, commercial and industrial use. Commissioner Black recommended that two meetings be set up with the cities, the Water Conservancy District and the County Commission to discuss the possibility of the three entities entering into an interlocal governmental agreement for the management and operation of those facilities whereby each entity would fund one-third of the budget. The budget would have to be approved each year by each of the entities. Some type of an authority could be appointed to manage the facilities. Both areas are in need maintenance and policing. Various types of funding could also be applied for if the areas are organized. Commissioner Black was authorized to proceed with the meetings.

Edge of the Cedars Museum - There have been rumors circulating that the BLM wants to send all of the artifacts from San Juan County and possibly all of the artifacts of Southern Utah to the Anasazi Heritage Center in the Dolores area. The Commission is strongly opposed to that and feels that the Edge of the Cedars Museum should be enlarged to house and store those artifacts. To that end, Commissioner Black has been talking to individuals about working with the State Parks and Recreation and Governor to get a line item in the budget next year and go after an impact grant for matching money to expand the Edge of the Cedars museum at Blanding. A motion to approve and authorize Commissioner Black to follow through with this project was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Long Canyon Road - Commissioner Bailey will check with County Engineer Doug Pehrson to see if an agreement has been reached on the Long Canyon road. As the deer season is approaching, the Commissioners will need to answer questions about the area.

National & State Parks, Monuments and Recreation Areas - Administrative Assistant Rick Bailey was asked to call the National & State Parks, Monuments and Recreation areas within the area to get the visitor count for 1987.

Tannery - Carl Cratz, Vocational Rehabilitation, JTPA and Sheril Burge from Mental Health Price office and CEU have offered their support and help with the proposed tannery for the Monticello area.

Southeastern Utah Health District - Commissioner Black will attend a Southeastern Utah Health District board meeting on Tuesday night at Green River.

Scenic By-Ways - Commissioner Black reported that there has been some talk of making a three-state promotion on designating all of US 191 as a Scenic By-Way as it connects several recreational areas and there has been a marked increase of traffic on that highway.

Southeastern Utah 4-Lane Highway - Rudy Higgins has proposed a four-lane highway from Spanish Fork on through Southeastern Utah. Commissioner Black would like to obtain a copy of the proposal as he feels that they may have taken the project east to the Colorado border from Monticello. Mr. Black felt that the Commission should support the project going through Blanding, Bluff, Mexican Water and on to Window Rock and Gallup as it would put a main artery through that area that would enhance transportation and have a better impact on economic development, tourism and other projects. Commissioner Maryboy was asked to contact the Chapter officials to get their feelings on the project.

Drug Free Youth - A communication has been received from the Utah Federation for Drug Free Youth. They are requesting the support of a proclamation on the National Red Ribbon Campaign from October 23-30 in the interest of working toward a drug-free society. The motion to adopt the proclamation was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

COMMISSIONER KENNETH BAILEY'S REPORT

Montezuma Creek Police Station/Deseret Architects - A motion to approve the payment of $5,000 to Deseret Architects for the work they did on the Montezuma Creek Police Station was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Library Custodians Increase - Commissioner Bailey reported that he had contacted the Library Board and they supported the requested increase for the custodians at the Blanding and Monticello Library. Other county employees have been given two or three increases that have not affected the custodians salaries. A motion to approve the increase of $50 per month for Rufina Romero and Gaylen Schaugaard and $100 per month for Gary Martineau was made by Commissioner Maryboy and seconded by Commissioner Bailey.

Alkali Crossing - The County had been asked to upgrade the Alkali crossing. When the worked was

begun a resident stated that it was part of her grazing permit and they had not received permission to do the work and would not let the work crew proceed. Commissioner Maryboy was asked to talk to the party to see if he can get the clearance to proceed with the work. Commissioner Bailey said that Stanley Hawkins would be willing to go with Mr. Maryboy.

Crowley Trucks - Crowley Construction provided two trucks for the County to haul oil mix. In return the County will hire two trucks to help haul gravel on the Harts Draw Road that Crowley Construction is working on.

Montezuma Creek Road Shed - Conmissioner Bailey reported that the road shed in Montezuma Creek has been completed with the exception of the concrete apron in front. The fence is being installed at the present time. A decision will be made at the monthly road meeting as to who will be in charge of the second patrol to be stationed at the road shed.

Oljato Bridge Archaeology - The Oljato Bridge archaeological clearance has been approved by the Navajo Tribe. The next step will be to proceed with the application for the right of way.

Brown's Canyon Gravel Pit - County Engineer Doug Pehrson tested the Brown's Canyon gravel pit and reported that there is some very good gravel at the east end of the pit but the west end was not as good as anticipated. Claude Lacy has released his mining claims and the BLM said they will approve the permit for the pit today.

Tax Initiatives - The affect of the proposed tax initiatives on the County roads was discussed as Commissioner Bailey was asked to present the information to a public meeting on Wednesday night so that the public will be able to make an informed decision when they vote on the issues. Commissioner Black stated that the items that needed to be stressed were: how much it will reduce revenue to the local district, the uniform school fund, the County and the City if the measures are approved by the electors.

San Juan County Road Policy - The San Juan County Road policies were discussed by the commission and will be discussed further with the Road Department foreman before further amendments are made. Commissioner Bailey made a motion that the policies that had been previously adopted and amended at various times be approved. Commissioner Maryboy seconded the motion. UNANIMOUS.

Road Oil/Heating -Commissioner Bailey presented a plan for heating the oil to be used on the roads utilizing the boiler used to heat the road shop. Insulated pipes would be run underground to the oil heating tank and the hot water circulated to heat the oil. A valve would be installed to be able to heat it only when needed. The commissioners felt this would be an efficient operation.

Executive Session- Commissioner Bailey made a motion to go into executive session to discuss road

personnel matters. Commissioner Maryboy seconded the motion. UNANIMOUS. A motion to return to the

regular session of the Commission was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS

COMMISSIONER MARK MARYBOY' S REPORT

Bluff Cemetery District - The following letter was received from Steven Boos to Commissioner Maryboy: Re: Bluff Cemetery Maintenance District Dear Commissioner Maryboy:

At the hearing held by the Commission on June 6, 1988, in regard to the formation of a cemetery maintenance district for Bluff, no objections to the formation of the district were received from "...any taxpayer within the proposed boundaries of [the] proposed district..." To my knowledge, no subsequent objections have been made. According to U.C.A. section 8-1-4 all preliminary

steps necessary to the formation of the district have been completed and the Commission is now compelled to "...make an order thereon either denying such petition or granting the same..." If the petition is granted, an election under section 8-1-5 must then be held.

I would be grateful if you could raise this matter at the next Commission meeting and have the petition put to a vote as required. It is my hope that this matter can be pushed out of limbo and finally resolved. I do hope the Conmission can grant the petition, as I feel the creation of the district would be an important step toward local government in Bluff.

Even though there were no other Bluff residents at the public hearing opposed to the creation of the maintenance district, there were others that expressed concern because of family members buried in the cemetery. It was their understanding that those who wanted the district wanted to maintain the cemetery in its natural state. The other people did not recognize the aesthetic value of certain "wild flowers" and wanted them removed from their family gravesites. The Commissioners also felt that the present area of the cemetery is not conducive to planting grass, etc. and that the residents may want to consider an alternate site for a cemetery. Opinion was expressed that many residents and native Indians are being buried in Blanding because of the maintenance factor. After discussing the matter the Conmission decided to hold a community meeting in Bluff to get the opinion of the residents. Commissioner Maryboy will to arrange a meeting on September 28th at 7:00 p.m. at the Bluff Elementary School to discuss the creation of a Bluff Cemetery Maintenance District and other pertinent issues. County Attorney Craig Halls stated that the Commission would need to make a decision and get a notice into the paper for three weeks prior to the issue being placed on the ballot for the approval of the residents within the designated district.

Mental Health Meeting - Commissioner Maryboy inquired about a Mental Health meeting being held. Conmissioner Black reported that he had been invited to attend a Mental Health workshop but he had declined because the state had cut the funding and refused to reconsider the County's requests. Commissioner Black asked Administrative Assistant Rick Bailey to check with County Attorney Craig Halls to see if he has proceeded with the requested lawsuit against the State Mental Health.

CIB - Hatch Preschool Building - Commissioner Maryboy would like to submit a proposal to the Community Impact Board for funding for the Hatch Preschool Building. The Conmission stated they would support the proposal but felt that it would be an uphill battle to receive approval for the project. It would also require matching funds from the Navajo Tribe. Mr. Maryboy indicated that the Tribe has been putting the water and power to the site and felt this could be used as the required matching funds. The land for the building has already been withdrawn from the Tribe and the archaeological clearance and environmental study completed by the BIA. Commissioner Bailey thought that the proposal might be more attractive to the board if the school could also be used as a community building. If the County were to be the applicant the County would have to be the owners of the land.

ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT

Blue Cross Blue Shield - Cafeteria Plan Insurance - Administrative Assistant Rick Bailey met with David Dunsford regarding the insurance cafeteria plan. Mr. Bailey would like to meet with John Black who has proposed another cafeteria plan and discuss other options, then make a recommendation to the Commission next week.

Enterprise Zone - Some further information has been received from other counties on the Enterprise Zone application for consideration. After discussion the Commission decided to apply for tax credit commitments in the single parent head of household and long-term unemployed individual areas. If another category is desired later the application could be amended. A motion to approve the Enterprise Zone application as corrected was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Special Service Districts/Board Members - Administrative Assistant Rick Bailey reported that at the time the Commission adopts the resolutions supporting the special service districts the number of board members as well as the chairman of the board has to be appointed. Mr. Bailey felt that the Commissioners should come up with the names of possible board members so that they can be contacted as to their willingness to serve on the board.

Dr. Paul Mayberry - It was reported that Dr. Paul Mayberry had passed away over the weekend. As he had served as a surgeon at the San Juan County Hospital the Commissioners felt that as the Hospital Board they would like to send some flowers and a card to the family.

Montezuma Creek Ambulance - Administrative Assistant Rick Bailey reported that the Montezuma Creek ambulance broke down on a run to Shiprock, New Mexico. The County Road Shop rebuilt an engine that had been installed a couple of months ago but the engine went out again. Another rebuilt engine has been ordered and will be installed as soon as possible to get the ambulance back into service. BILLS APPROVED FOR PAYMENT
