MINUTES OF THE BOARD OF COUNTY COMMISSIONERS' MEETING HELD ON OCTOBER 19, 1959 at 10 A. M.

The Board of County Commissioners met in Regular Session this 19th day of October, all Commissioners being present and Wm. C. Walton conducting, Clerk also present.

COUNTY EXHIBIT BOOTH AT STATE FAIR TO BE RENOVATED AND MURALS REPAINTED

A motion was made by Commissioner Hazleton, seconded by Commissioner Bartell and unanimously carried, that Raymond Mc Alister be advanced the sum of $120 for expenses while repainting the murals in the County booth at the State Fair Grounds and upon completion of the work to be paid an additional $500 as compen-sation for such services.

COUNTY TO HAVE USED X-RAY MACHINE HELD FOR BLANDING CLINIC

The Clerk was directed to write to Mr. F. T. Hanlon, Westinghouse Electric Corporation, 235 West South Temple, Salt Lake City, Utah, to have the company hold a used X-Ray machine for installation in the Bland-ing Clinic . The machine will be held at no cost to the County until installation.The original bid price will be $4,350.00 which is within the budget previously submitted to the Board of County Commissioners.

CHECK RECEIVED FOR COUNTY'S SHARE OF FEDERAL MINING LEASING

A check was received in the amount of $35,109.19 for the County's share of the Federal Mining Leasing, t he amount to be deposited to the County Road Fund.

BIDS OPENED FOR CONSTRUCTION OF THE BLANDING CLINIC

This being the hour of 2 P. M. which has been advertised as the time for the opening of bids for the con-struction of a Clinic Building in Blanding. The following bids were received by the people as listed:

F. Bennion Redd, County Attorney was called in for an opinion in regards to the legality of the Blanding Cabinet Shop Bid without an accompanying bond. His opinion was that a bond should accompany the bid and as there was no bond the bid should not be considered as it was disqualified.

A motion was made by Commissioner Hazleton, seconded by Commissioner Bartell, and carried, that the Harvey Builders Supply bid be approved in the amount of $49,991.00 and that the construction of the Clinic Building at Blanding be awarded to the Harvey Builders Supply Co.

SAN JUAN COUNTY TO ENTER INTO AND EXECUTE THE RATIFICATION AND JOINDER TO THE ROLLING MESA UNIT AGREEMENT

The following Resolution was introduced by Commissioner Walton, seconded by Commissioner Hazleton, and carried:

RESOLUTION

Whereas, San Juan County, a county of the State of Utah is the owner of certain oil and gas interests in and under (1) the streets and thoroughfares falling within the Bluff Townsite Survey in the E1/2NW1/4 and NE1/4 of Section 25, Township 40 South, Range 21 East, SLM and (2) Lots 1, 2, 3 and NW%SW% of Section 25, Township 40 South, Range 21 East, SLM, all in San Juan County, Utah;

and

Whereas, The above described oil and gas interests are now leased to The Carter Oil Company under those certain oil and gas leases, dated May 1, 1956 and September 18, 1953, and respectively recorded in Book 134, Page 173-174 and Book 26, Page 314 of the San Juan County, Utah records;

and

Whereas, The Carter Oil Company has this date presented a proposal inviting San Juan County to unite with other parties in interest collectively adopting, and committing their oil and gas interests to, a feder-ally approved unit plan of development or operation as set forth in the attached Rolling Mesa Unit Agree-.

ment of August 1, 1959, covering, among other lands in T. 40 S, R. 21 E, SLM, the above described lands wherein San Juan County owns oil and gas interests now under lease to the Carter Oil Company;

and

Whereas, the Board of County Commissioners of San Juan County, Utah has discussed the above proposal and now deems it to be in the best interest of San Juan County to commit its oil and gas interests, as above described, to the above federal unit plan for the Rolling Mesa area;

and

Whereas, San Juan County may commit its oil and gas interests in the Rolling Mesa Unit area by its execution of the attached Ratification and Joinder to the Rolling Mesa Unit Agreement to the same extent and effect as if it had executed the original of said Unit Agreement;

Now, Therefore, Be It Resolved, that the Board of County Commissioners, for and behalf of the County of San Juan, State of Utah, enter into and execute the Ratification and Joinder to the Rolling Mesa Unit Agreement for the purpose of Committing to such agreement its oil and gas interests under lease to the Carter Oil Company in and under the following described lands:

Township 40 South, Range 21 East, S.L.M.

Section 25: Lots 1,2,3, NW1/4SW1/4 and the

Streets and thorofares fall-ing within the Bluff Townsite Survey in E1/2NW1/4 and NE1/4.

RATIFICATION AND JOINDER

IN THE ROLLING MESA UNIT AGREEMENT

COUNTY OF SAN JUAN

STATE OF UTAH Dated August 1, 1959

For the consideration stated in the above described Unit Agreement, the undersigned hereby ratifies, con-firms, and joins in the execution of said Unit Agreement, which is hereby incorporated herein and made a part hereof, to the same extent and effect as if the undersigned had executed the original of said Unit Agreement. ( Unit Agreement on file in Office of San Juan County Clerk)

The undersigned acknowledges that no representations not incorporated herein or in said Unit Agreement h ave been made to the undersigned, and that this instrument has been signed and delivered unconditionally.
