The San Juan County Commission met in regular session on May 5, 1986, at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.
The following members were present: Commissioner Black, Chairman

FIRE WARDEN - DISTRICT POSITION
George Kensley met with the Commission concerning the Utah State Lands & Forestry hiring a District Fire Warden to work in the county area. His opinion was that this was done without proper advertisement and someone who is not a resident. Mr. Kensley said this position is only a five-month job and if someone locally was hired this position could be a year-round job. Mr. Kensley said he applied for this job and feels he is qualified. The State prefers a BS degree in Range Management for this position. Rick Bailey, Administrative Assistant, said the State went through Job Service and have hired Bruce Sillitoe. Mr. Sillitoe will begin work on June 2 and meet with the county June 6.
UPHOLSTERY MACHINE - Extension office
Phyllis Heaton met with the Commission concerning the upholstery machine that is in the Extension office. Mrs. Heaton said that a group of women that took the upholstery class own the machine but would like to leave it in the extension office and have then be responsible for it's use. The Commissioners agreed with this decision. The upholstery machine is not county property.

The following elected officials met with the Commission for their monthly meeting.

Mary Lou Mosher requested that the Commission approve Olivia Blake to a full time position. Mrs. Mosher
said the workload in her office has increased and she needs full time help. The Commission told Mrs.
Mosher they would like to wait before making a decision on this until Jack Tanner, UAC, presents his
evaluation of the county's employees and suggested authorizing more hours if needed.
Cemetery districts Mrs. Mosher asked the Commission who is responsible for the cemeteries in the county.
Commissioner Black said there are cemetery districts for the Blanding and Monticello cemeteries and the
county may be responsible for the others. Mrs. Mosher said the Utah Code reads that all plats of cemetery
districts must be recorded twice yearly. The people administering the districts are required to file a
transcript, certificate of sale, and evidence of burial rights. Mrs. Mosher said the recorder's office
has nothing of this on record. The Commission told Mrs. Mosher to write a letter to the administrators of
the districts and follow up on this.
Barbara Montella was asked by the Commission if the county was ordered by the state re-factor this year.
Mrs. Montella said that next year is a re-factor year. Mrs. Montella said she is going to put the sales
ratio on the tax form this year with the new computer she will be getting.
Marian Bayles said the interest rates are about the same and the county is still invested with Merrill
Lynch which is a Federal Security Trust.
Rigby Wright said one of his secretaries resigned as of today and he has hired a temporary secretary at an
hourly rate. Mr. Wright said he has advertised for a matron and jailer and will have the Commission
approve them before hiring. Mr. Wright said on July 14, 1986, there will be a Correction Academy which is
a seven week course and he would like to have some of his people attend this.
BEER LICENSE - Orin Story - Fry Canyon
Commission Bailey made the motion to approve a renewal beer license for Orin Story in Fry Canyon. Commissioner Holliday seconded it. UNANIMOUS.
CITY OF MONTICELLO - Airport - Loyd's Lake
Rick Terry, Monticello City manager, met with the Commission to ask where the city stands with the water
hauling at the airport. Commissioner Bailey said the road department is building a tank trailer for the
city to use. Mr. Terry said Mitch McCann used the water in the tank in a two-week period and feels this
is a lot. Mr. Terry said a low level control was never installed on the tank. Commissioner Holliday said
he will see that one is installed.
Commissioner Black asked how much gas was being sold at the airport. Mr. Terry said about 600 gallon a
month.
Mr. Terry said the city is going to provide Loyd's Lake with recreation and camping areas. Mr. Terry
asked the county if they would level and gravel out two areas at the lake while the county is working up
there so the city can develop the area. The city will be responsible for the upkeep and maintaining of
the lake's parks and such.
WIIDERNESS SUB-COMMITTEE
Commission Black reported that the State Wilderness Sub-Committee will be in Blanding tonight. Commissioner Black said he going to take them to Cedar Mesa Area, White Canyon, Fish Creek and other areas.

Commissioner Bailey made the motion to approve these assistants and agents on the recommendation of the county clerk and Commissioner Holliday seconded it. UNANIMOUS. Mrs. Johnson said she will be having a workshop for the assistants in June.
RESOLUTION 1986-4 - HALL'S CROSSING AIRPORT CAPITAL PROJECT FUND
John Fellmeth, deputy auditor, reported that the county needs to establish a capital project fund for Hall's Crossing Airport. The following resolution was approved and passed:
RESOLUTION 1986-4 HALLS CROSSING AIRPORT CAPITAL PROJECT FUND
WHEREAS, the Board of County Commissioners of San Juan County, Utah, desires upon its own motion, pursuant to Section 17-36-16(3),Utah Code, Annotated 1953, as amended, to initiate said proceedings and to give notice of its intention to establish a capital project fund, hereafter known as HALLS CROSSING AIRPORT PROJECT FUND; and
WHEREAS, San Juan County is receiving money from the Federal Aviation Administration and Utah Department Transportation of Aeronautics for the construction of the Halls Crossing Airport; and
NOW THEREFORE BE IT RESOLVED, the Board of County Commissioners of San Juan County, Utah deem it necessary to establish a capital project fund.
Effective this 19th day of May , 1986.

NURSING HOME ACCOUNTS RECEIVABLE
John Fellmeth, deputy auditor, reported to the Commission that the residents' accounts of the nursing home are in deficit and Kamar Management requests that the county submit a check to them covering the deficit for $427.00. Mr. Fellmeth says the county should get a full return of this money. Also, the county's accounts receivable at the nursing home were analyzed and $110,000 is probable, with $75,000 of this less than sixty days old, $26,000 is sixty to one hundred days old, and $9,000 is over four months old (Mr. Fellmeth said this will be difficult to collect).
COMPUTERS IN THE COURTHOUSE
John Fellmeth, deputy auditor, told the Commission he would like to transfer the computer in the Assessor's office into the Clerk's office, and the computer in the Clerk's office be transferred to Julie Wood's office (Attorney). The Attorney's office will have to buy a printer and Mr. Fellmeth will buy a bigger computer for the Assessor's office. The Commission approved Mr. Fellmeth to go ahead with this.
QUIT CLAIM DEED
The following quit-claim deed was issued by the Commission on the request of Clem Washburn. Mr. Washburn said this piece of land was deeded to the county earlier for a right of way and has never been used by the county.

COUNTY ROAD
Clem Washburn met with the Commission to discuss the road east from Peter Springs. Mr. Washburn said the county had agreed some time ago to rock this road but it has never been followed up on. Commissioner Bailey said he would look into this.
MONTICELLO CEMETERY - DICK & ANNIE BRODERICK
The Commission met with the Monticello City Cemetery District to present a complimentary plaque to Dick and Annie Broderick for the beautiful work they have done on the cemetery.
REQUEST REFUMD OF TAXES PAID ON EXEMPT PROPERTY
The Commission received a request from Mr. Podpechan's attorney for a refund of taxes paid on exempt property that is on the Navajo reservation. The Commission referred this to Bruce Holliday, county attorney.
COMMUNITY NURSING SERVICES - HOME HEALTH - JAN TREML
The Commission received a letter from Jan Treml, director of Community Nursing Service, stating that CNS would like an opportunity to re-submit a formal proposal for purchase lease of the county's fixed assets. CNS would like to arrange a lease on the 1981 Blazer. Ms. Treml said her assistant will be in Blanding the end of May to assess the fixed assets and then she will submit a formal proposal for the purchase lease.
COMMUNITY IMPACT BOARD - JUNE 5
The County will be on the agenda of the Community Impact Board hearing on June 5, 1986, for the public safety building. The cities of Blanding and Monticello are encouraged to attend.
WILDERNESS TASK FORCE
Rick Bailey, Administrative Assistant, said he and Robert Anderson discussed forming a Wilderness Task Force. The Task Force would consist of one representative from each entity group and work together in submitting a proposal on the wilderness. Mr. Anderson feels the Task Force should work closely with the local education association. They feel the education association should contact other associations in the state and make a strong presentation to the UEA and the State School Board. Mr. Bailey will work with Mr. Anderson to form the Task Force. It is very vital that the school association present a strong opposition on the wilderness. The Commission approved the formation of the Wilderness Task Force.
NURSING HOME AND HOME HEALTH EMPLOYEES PAY-OFF
The Commission will approve the cash settlements to the nursing home and home health employees at the Health Care Board meeting this Wednesday.
RECREATION - COUNTY-WIDE
Commissioner Bailey said that Eddie Allred, county-wide recreation director, is not following up on his budget recommendations to the cities and school district. The Commission said Mr. Allred is doing a good job in organizing the activities but needs to attend city council and school board meetings to review and update them on the program and present his budget for 1987.
ROAD SCHOOL - ST. GEORGE
Commissioner Bailey reported on the road school he attended in St. George last week. Congress is considering about combining all the federal road funding. A House bill passed could designate Congress to say where the money is going to be spent. DOT will have total responsibility under the Administration Bill to set up new accommodations which appear to be about the same as they are now but with stricter guidelines. One would be that the counties are required to have a Professional Engineer. The State of Utah has selected Wilbur Smith Associates for the needs study. Smith and Assoc. will schedule a time with the county to visit and evaluate the roads.
RESOLUTION OF MEXICAN WATER CHAPTER #MWC-Rll0-86
Supporting the Mexican Water Head Start Program LPPC's resolution requesting San Juan County Road Department to improve and install culverts on the bus route on BIA road #121 in the Utah portion of Mexican Water Chapter.
WHEREAS:
1. The Mexican Water is officially recognized and certified chapter of the Navajo Nation; and
2. The Chapter officials and community people have discussed and recognised the need to improve the bus route, BIA route #121; and
3. The wash board road has caused wear and tear on the Pre-School bus and other community liaison vehicles.
NOW THEREFORE BE IT RESOLVED THAT:

1. The Mexican Water Chapter is requesting to approve the Local Parent Policy
Committee's resolution to improve and install culverts on bus route, BIA Road #121.

RIO ALGOM MINING CORP.
The Commission received a letter from Rio Algom Mining Corp. asking the county to work on Highway 113 this sunnier. Rio suggests the county start work at the north end of Highway 46 intersection around Lisbon Valley to Church Rock area.
GRAVEL BIDS - FULLER CONSTRUCTION - Skelton Inc.
Commissioner Bailey reported that Lane Fuller of Fuller Construction called this morning and said he is not able to make arrangements to crush the gravel they bid on earlier. The Commission then awarded the low bid to Skelton, Inc. at $377,950.00. Commissioner Bailey made the motion to award the bid to Skelton. Commissioner Holliday seconded it. UNANIMOUS. Bruce Halliday, County attorney, will write a letter to Lane Fuller giving the Commission's decision to allow him to withdraw his bid and release him from any and all further obligations under the terms of bidding. Also, the letter will make it a complete and mutual release. A new memorandum of agreement will be signed by Skelton Inc.
ALKALI POINT AND PERKINS RANCH - ARCHAEOLOGICAL CLEARANCE - county road #204
Commissioner Bailey said Bill Davis, archaeologist, is ready to work on the road from Alkali Point to Perkins Ranch. This road is an oil hauling route and is requested by the BLM. Bill Davis will scout out the archaeological sites, re-align the road and mark the ruins. Mr. Davis will also work with Doug Pehrson, county engineer, on designing the road. Commissioner Holliday made the motion for the county to enter into a 15 month agreement with Bill Davis for $2500 to $3000 to provide all archaeological clearance from Alkali Point to Perkins Ranch. Commissioner Bailey seconded it. UNANIMOUS.
CONSORTIUM BOARD
Commissioner Holliday met with the Consortium Board last Tuesday night. The Board is drawing up some guidelines so that the county could hire a therapist for the area. The county has $92,000 left over from last year's grant and the Board says they can't justify the county asking for $200,00 this year. The Board said Dr. Warren is buying Dr. Goon's private practice the first of June. The Commission said the county could rent the office. The Commission is still looking at selling or selling the hospital and will try to work this out.
BIG GAME HUNT MEETIMG
Commissioner Holliday reported on the Big Game Hunt Meeting that was held in Monticello. Commissioner Holliday said there was a good turn out but the majority of the people were for the Doe Hunt on Beef Basin.
SPANISH VALLEY WANTS ANNEXATION INTO GRAND COUNTY
Commissioner Black said Dutch Zimmerman called him last week and said there is a move to annex Spanish Valley (San Juan County) into Grand County.
BLM ADVISORY COUNCIL MEETING
Commissioner Black reported he attended the BLM Advisory Council Meeting last week. In the meeting they discussed FLPMA that was passed in 1976, which requires that during the planning process, areas must be considered for nomination as Areas of Critical Environmental Concern (ACEC). This puts special management provision on these areas. Commissioner Black said the following resolutions were adopted; one, a resolution opposing any state blocking of lands unless all right of ways have been cleared by users before; two, another resolution was passed recommending the Secretary of Interior develop regulatory relief on marginal oil and gas wells; three, adopted resolution opposing Senator Cranston's bill to create more national parks and wilderness areas in California; four, a resolution called for studies of reasonable compensation for private land owners who provide wildlife habitat; five, a resolution recommending the Secretary of Interior to develop an information program to point out and communicate the benefits to the public the use of federal lands for grazing, mineral, energy production. The American Outdoors is also developing another proposal of locking up lands.
HANGAR LEASE MONTICELLO AIRPORT - Mike Young
Rick Bailey, Administrative Assistant, reported that Mike Young has a hangar lease at the Monticello airport and wants to know if the county would let him lease his hangar to someone else until October. The Commission approved Mike Young renting the hangar on his own terms since it was paid in full for the year 1986.
BOOKMOBILE UNDC
The Commission received the UNDC Board meeting minutes of January 7, 1986 that indicated the board would not consider funding the bookmobile for $4000. On February 14, the Board minutes read that the Navajo Tribe had been allocated funds of $97,000 for Bookmobile services. Their bookmobile will start in April and run only once per month.
EMERGENCY MEDICAL SERVICES - Department of Health - GRANTS
The Department of Health is unable to implement the FY 1985-86 Emergency Medical Services per capita grants and is extending the termination date of these grants from July 31, 1986, to December 31, 1986. Commissioner Bailey made the motion to approve the extension and authorized Commissioner Black to sign the Amendment to Contract Agreement. Commissioner Holliday seconded it. UNANIMOUS.
