The regular meeting of the San Juan County Commission convened at 10:00 A.M. at the San Juan County Courthouse at Monticello, Utah.

COMMISSIONER MARK MARYBOY'S REPORT
Montezuma Creek Meeting - Commissioner Maryboy indicated he would have to leave about 11:00 A.M. this morning to attending a meeting in Montezuma Creek.
Commodities/Aneth Chapter - Aneth Chapter would like to have any available commodities taken to the Aneth senior citizens. Administrative Assistant Rick Bailey indicated that the County's contract with the State does not provide for services on the reservation. Those services would come through the Navajo Tribal offices. Mr. Bailey said that the available commodities are dwindling and there will be Very little if anything available in the near future. Mr. Bailey will asked the State director to write a letter as to the status of the contract locations and available commodities.
Recreation Director - Commissioner Maryboy would like to have Recreation Director Eddie Allred give a statement as to how the $1,000 he received from the school district was utilized. Mr. Allred will be asked to meet with the Commission at the next meeting.
UNDC Proposal/Construction Crewmen - The UNDC is requesting County participation in the amount of $31,194.58 to be used as salary and fringe benefits for five construction crewmen in the Aneth, Mexican Water, Navajo Mountain, Oljato and Red Mesa areas. This will be referred to the County Attorney as there is question as to the legality of such a proposal. Commissioner Black also indicated there would be a problem of budgeting and starting a new program with declining County revenues.
Transportation District/Reservation - A resolution has been received from the Aneth Chapter requesting the creation of a San Juan County Transportation Service District and the disclosure of detailed information regarding the expenditure of revenues collected by the County from gas and oil production on the reservation. The Commissioners felt that misunderstandings about the source of funding for the San Juan County Transportation Service District need to be addressed. The only revenue collected by the County from the production of oil and gas on the reservation is in the form of property tax. There is no direct revenue from the production of oil and gas, just an indirect revenue in the form of property tax from an advalorem assessment of the production of oil and gas. The request indicates that there should be the same amount of money spent in an area that comes from an area. If that were the case, there would be no money spent in the Navajo Mountain area or on most of the reservation where no revenue is generated. In reality, services have to be provided where people live. Commissioner Black will write a letter to the Aneth Chapter explaining all of the factors of taxation and services and what the County provides and where the money comes from and where the money is spent. The County will continue to work with the Navajo people to provide all of the services possible.
Aneth Chapter Multipurpose Building Proposal - Commissioner Maryboy asked Administrative Assistant Rick Bailey to write a letter of commitment to the Navajo Tribal Community Development Block Grant office regarding the County's support of the Aneth Chapter Multipurpose Building proposal. This will contingent on the approval of the proposal.
Appreciation Expressed - Commissioner Maryboy expressed his appreciation to Commissioner Bailey for his service to the County and for all the things he has done over the years.
COMMISSIONER CALVIN BLACK'S REPORT
Ute Tribe Property/Green Belt - An opinion has been received from County Attorney Craig Halls with respect to the request by the White Mesa Ute Council for retroactively giving then consideration on green belt. The White Mesa Ute Council owns quite a bit of land but has never applied for green belt status on those lands as provided by Utah law. Mr. Halls indicated that the request could be granted by the Commission. Commissioner Black said that the Ute Tribe probably could apply for exemption from paying the taxesf but they have not asked for that. Because of that it was Cortmissioner Black's recommendation that the request be approved. A motion to approve the request of the White Mesa Ute Council for green belt status on their property if they will fill out the proper applications retroactively was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.
Peavine Corridor - Bob Weidner from Senator Jake Garn's office called and read a letter they are sending to the Forest Service with respect to the Dark Canyon Wilderness area and the Peavine Corridor. In effect the letter tells the Forest Service that the corridor was left out of the wilderness by an act of Congress and that they should not even consider doing anything differently, administratively or otherwise. A copy of that letter will be sent to the Commission.
Underground Storage Tanks - A notice has been received notifying underground storage tank owners/operators of the new rules on the technical requirements for underground storage tanks which will become effective December 22, 1988. An outreach program on this will be conducted in Monticello for San Juan and Grand County at a later date.
Bluff and Mexican Hat Dump Sites/Purchase - Notification for the sale of the Bluff and Mexican Hat parcels of land for $2,600 has been received from the Bureau of Land Management. The description of the parcels are:
Salt Lake Meridian, Utah
T. 40 S., R. 21 E., Section 27: NE 1/4 NE 1/4 SW 1/4.
T. 42 S., R. 19 E., Section 6: SE 1/4 SE 1/4 SW 1/4.
The described land aggregates 20 acres. The parcels will be used for dump sites in the Bluff and Mexican Hat areas.
COMMISSIONER KENNETH BAILEY'S REPORT
Utah State Fair - Commissioner Bailey received a picture of the San Juan County booth at the Utah State Fair and a letter of appreciation from the Fair Board.
"Without the cooperation of the people from your county, we would not have a STATE FAIR. Since the FAIR is for sharing, we hope you will always LOVE-A-FAIR. We look forward to your involvement next year."
Road Department Procurements - A bid was received from Custom Flooring for vinyl flooring and carpeting for the computer room at $763.70. This was the only bid received because Custom Flooring is the only flooring business in the County.
Bids for a 20" bar chain saw were received from The Truck Stop for $460.00, Motor Parts for $350.00 and Caun Company for $349.99. The recommendation is to accept the bid from The Truck Stop for $460 as it is a better quality saw and the parts and service would be more accessible.
Bids for an electric rotary vane vacuum pump were received from Tool Center in Salt Lake City for $357.00 and Low's Auto Parts for $355.00. The bid from Low's Auto Parts was recommended as being more economical with direct delivery.
Bids for a 2" Mud Pump was received from Motor Parts, a 3/4 hp pump for $635.00 and a 5 hp pump for $710.00 and Caun Company , a 3/4 hp pump for $543.74 and a 5 hp pump for $1,031.24. The bid from Motor
Parts was recommended for the best price.
Bids were received from Snap-on Tools for a GA191 Torque Mult. 11.4-1 ratio for $1,185.00 and from Wheeler Machinery for a 6V6080 Torque Mult. 18.5 ratio. The bid from Wheeler Machinery was recommended because of the higher maximum and lower price.
A motion to approve the recommendations for the bids was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.
Montezuma Creek Road Shed - Commissioner Bailey reported that Jim Benally has been stationed at the Montezuma Creek Road Shed and Jimmy Grant will be stationed there by the first of the year.
Monticello Spa - Commissioner Bailey met with JoAnn Crittenden regarding the parking area at the Monticello Spa. Ms. Crittenden said that if the County would put some top soil over the gravel in the spring they would be able to plant grass or put sod down.
Dr. Steve Warren's Clinic - There is a problem that has been caused on Dr. Warren's clinic property by dumping chips, etc. on his property by the construction of the New Public Safety Building. Also where a wall was installed will need to have some repair work done in the spring.
Library Board/Harold Allen - A letter has been received from Harold R. Allen submitting his resignation from the San Juan County Library Board, effective February 1, 1989. A letter of appreciation for the many years of dedicated service to the library system was drafted to Mr. Allen from the Commissioners.
Equipment School - Wheeler Machinery sponsors an equipment school in Salt Lake City during the off season year. A motion to approve Tierre Patterson, Max Halls and Max Ksiazkiewicz to attend the school was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.
Appreciation Expressed - Commissioner Bailey said this would be his final Commission meeting and expressed that, "It has been an honor for me to serve in this position and I will miss the association and the working relationship here. I want to wish you all the best in the coming years, not just next year, but from now on because I think you'll need the prayers of everyone."
ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT
San Juan County Transportation Board Member - Eugene Foushee called Administrative Assistant Rick Bailey regarding the San Juan County Transportation Service District. Mr. Foushee has been out of the country and had just returned and received notification of his appointment to the board. He indicated he would like to serve on the board but there would be periods of time when he would be out of the area especially during the winter months. If it would cause a concern for the Commissioners, Mr. Foushee said he would decline the position. The Commissioners felt that because there is no set schedule of meetings for the board they could work with Mr. Foushee when he is in the area.
Congressman Howard Nielson - Congressman Nielson's office called to indicate that the Congressman would be in the County on Monday, January 16th. A tentative schedule calls for him to visit the Whitehorse High School and meet with the students, a town meeting at either Aneth or Red Mesa, a town meeting at Bluff and Blanding, dinner with the Commissioners and a town meeting in Monticello. More definite plans will be given as soon as the arrangements are made.
A later call indicated Congressman Nielson would meet with the Commissioners for dinner from 5 to 6 p.m. in Blanding, a town meeting in Blanding at the Library at 6 p.m. and a town meeting in Monticello at 7:30 p.m. at the Courtroom.
Hovenweep Draft Plan - The BLM has indicated that they are not in favor of the proposed Hovenweep Plan of the National Park Service nor the attacks on the BLM's lack of management in the area. The proposal calls for expansion of the Hovenweep Monument area and the oversite. When Administrative Assistant Rick Bailey called the Park Service they indicated there wasn't a draft plan out when in actuality there was. Mr. Bailey has sent a copy to Bob Weidner, Ron Crittenden, Jim Peacock and the Governor's office.
CURRENT BUSINESS
Presentation/Bill Howell - Executive Director Bill Howell, in behalf of the AOG Board, presented Commissioner Calvin Black with a plaque in appreciation for service rendered as past chairman of the AOG board. Lee Simpkin a former chairman, and Jimmy Walker, as current chairman, were also honored at the last AOG meeting. The plaque reads:
The Southeastern Association of Governments to Commissioner Calvin Black, who was chairman between 1984 and 1987, expressing our deep gratitude for your leadership, your scholarship and your friendship. Your hard work for the people of Southeast Utah has brought stature and dignity to the institution of local government and to the concept of intergovernmental cooperation.

District Court Contract - County Clerk Gail Johnson presented the District Court Contract which is basically an amendment to the Circuit Court contract from January to July 1989 for the operations of the court. When the courts are moved into the new building in the spring, a new lease will have to be negotiated for District Court space. The cover letter indicates the State Court Administrator's office has asked the legislature to budget about $23,000 at $7.25 per square foot, however this figure is not binding to the County.
A motion to approve the contract and authorize Chairman Black to sign it was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.
457 Deferred Compensation Plan - County Clerk Gail Johnson and Deputy John Fellmeth met with the Commission to present the 457 Deferred Compensation plan to go along with the 401K plan as an employee option. The NACo deferred compensation plan was also considered. If the County adopts this plan, it would allow the employees to make a choice as to whether or not they wanted to join. The County is not obligated to contribute to the plan. Mr. Fellmeth indicated he preferred the State Retirement plan because the NACo plan is very similar to the 457 already established through John Black, and that is the deferred sales charge on any contributions. Everything other than life insurance options for the first twelve years, if there's a distribution out of the plan, they deduct 4% as a deferred sales charge. From the 12th to the 15th year there is a reduced sales charge and after the 15th year there is no deferred charge. All of them charge fees, some of which are up front and some on the tail end. The State Retirement funds are managed under Beneficial Life and they report all their returns after the fees whereas the NACo plans report the returns before the fees. One of the advantages to the deferred sales charge, assuming that it would not be any greater, is that you are making money on all of your money rather than paying some of it for management fees. The NACo plans charge an additional management fee in addition to the deferred sales charge. One of the advantages to the 457 compared to the 401K, which quite a few employees are participating in, is that with a 401K or any other qualified plan, if you take a premature distribution, there is an IRS penalty of 10%. On the 457, the individual has to report it as income on the year they take the distribution, but there is no penalty. The drawback of the 457 is that if you take a lump sum distribution you can't roll it over into your IRA. The only roll-over that's available for a 457 plan is into another 457 plan that accepts roll-overs. Neither company has a set number of employees that would have to sign up; it would be acceptable to them if the plan was just available for the employees.
A motion to approve and authorize a 457 plan, either the State Retirement plan or the NACo plan, as an option for the County employees was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.
County Computers - John Fellmeth reported that the changeover to the new 36 computers should be completed within a month. Mr. Fellmeth has contacted sane used computer brokers to determine what the old computers would be worth. They indicated they would pay between $300 and $400 if the computers are delivered to them. Mr. Fellmeth indicated it would cost more than that to deliver them. He said he would be interested in making an offer to purchase the computers and asked the Commissioners if they would want to have an independent person determine an acceptable price. The Commissioners felt that the local media, the counties and the League of Cities and Towns could be contacted to advertise the computers to see if anyone within the state would be interested in purchasing the computers. The bid opening will be scheduled for February 6th.
Alkali Crossing - County Engineer Doug Pehrson reported that the road crews are ready to move to the Alkali Crossing bridge project but there is a Navajo lady that is not allowing them to work as she says it is on her property. Mr. Pehrson said that the property has nothing to do with her but she insists that it is and will not allow the survey crew to drive the required stakes. Commissioner Maryboy said that Aneth Chapter has tried to work with the lady but has not had any success in contacting her. A second option would be to contact the Navajo Tribe to provide security for the crew while they complete the project. The Commissioners are not in favor of doing the work if they cannot get the cooperation of the Navajo lady. A resolution has been received from the Chapter authorizing the work but the Aneth Chapter will try again today to contact her and get an okay to proceed with the project.
Sealed Bids/Group Health Insurance - A sealed bid from John Black, representing Blue Cross/Blue Shield of Utah, and the renewal rates quote from Utah Local Governments Insurance Trust for the San Juan County group health insurance were compared for consideration by the Commission. The Blue Cross/Blue Shield proposal is: Single - $119.74, Double - $240.74, Family - $306.09. This includes an addition for life insurance, $100 deductible, 3 deductibles per family, 80% coverage to $2,500 and 100% thereafter. The life insurance is $20,000 for the employee with $2,000 for the spouse and $2,000 for the dependents. The Utah Local Governments Insurance Trust proposal is: Single - $120.65, Double - $251.22. Family - $321.42. The coverage is the same as the Blue Cross/Blue Shield proposal. Mr. Black indicated there would be no pre-authorization nor second opinion required with Blue Cross/Blue Shield for emergencies.
Commissioner Bailey made a motion to approve the proposal from Blue Cross/Blue Shield for the County's group health insurance. Commissioner Maryboy seconded the motion. UNANIMOUS.
Sheriff's Department - Administrative Assistant Rick Bailey checked on a 4-wheel drive Mitsubishi as a possible vehicle for the Sheriff's department. Mr. Bailey said it was about a foot and a half taller than a Jeep Cherokee and about a foot and a half narrower than a Cherokee. The sticker price on the vehicle was over $19,900 and the vehicle he checked did not have the off-road package on it. The parts availability would also be a question. It would be Mr. Bailey's recommendation that the Mitsubishi would not be suitable for the sheriff's department. Commissioner Black felt that the Commission needs to look at the number of vehicles in the sheriff's department and make a determination on how many actual vehicles are needed in the sheriff's department and who should be using them. Sheriff Lacy said that they had 10 vehicles still shown in the sheriff's department but some of them have been kept at the road department. Commissioner Black asked that the vehicles be listed and their condition noted so that a decision can be made as to their disposition. Bids have previously been received for the purchase of two Jeep Cherokee vehicles and the Commission authorized Sheriff Lacy to proceed with the purchase.
Shell Loader - Sheriff Lacy reported that the cost of a new shell loader similar to the one already in the department would be $969.00. The company will convert the present loader to a 9mm for $199.00. Other loaders, not in the same category, would cost $276 and $283. Sheriff Lacy recommended that the present loader be reconditioned for $199.00. A motion to approve the recommendation was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.
Independent Auditor - County Attorney Craig Halls reported that Kay Anderson gave
Rick Bailey some additional itemized information that was not included in the analysis of the Merrill-Lynch investments. Mr. Anderson felt that his out-of-pocket expenses, his secretary time, copies, etc. and the time spent doing legal research and preparation for meeting was not included in his initial billing and should be considered by the Commission. Mr. Halls said that in his original billing Mr. Anderson had listed about 5 hours for meetings. On the additional information there is some additional preparation time prior to the meetings listed. There is 14 hours that is being attributed directly to the meetings held with Mr. Halls and Merrill-Lynch. Mr. Halls said that he did not have any knowledge on the other items. Commissioner Black stated that he felt the out-of-pocket expenses had been included in the original billing as they would be a necessary part of creating the reports. Mr. Black said that Mr. Anderson should be notified that the amount of $9,450.00 agreed upon earlier is fair. County Clerk Gail Johnson will have the check drawn and a release typed on the back stating that it will be accepted as full payment for the services rendered.
Edge of Cedars Museum - A letter has been received from Timothy Rose, President of the Utah Museums Association, in support of the grant application for expansion of the Edge of the Cedars expansion to meet federal standards for archeological repositories so that artifacts excavated in southeastern Utah can be kept in Utah.
Forest Service Translator Site Fees - A copy of a letter to the Utah Congressional Delegation has been received from Stephen H. Hess, Chairman of the Utah State Telecommunications Board, requesting support of HR-5285 which would prohibit the Agriculture and Interior Departments from increasing rental fees that were in effect January 1, 1988. Mr. Hess listed three areas of major concern that have not been resolved: a blanket waiver from the fee payment of all state and county-owned radios and translators, they have not been able to discuss their concerns with top level people, and the market study was unfairly conducted and does not reflect the fair market value. Mr. Hess states that the commercial entities will discontinue their service to rural communities which will bring about significant repercussions from the rural citizens if these fees are charged.
UDOT Annual Visit to Counties - A letter confirming the Utah Department of Transportation annual visit to counties was received. Topics of discussion at each meeting will be the Federal Aid Secondary, Bridge Replacement Programs and other Federal programs of interest. San Juan County has been scheduled for February 9th at 11:00 A.M. at the San Juan County Courthouse.
San Juan County Health Care Request - A payment of $80,000 to the San Juan County Hospital has been requested. Commissioner Bailey made a motion to approve the advance on the basis that the money be reimbursed out of the hospital accounts receivable. Commissioner Black seconded the motion. UNANIMOUS. Letter of Appreciation/Marylou Stanley - The following letter was received from Marylou Stanley:
To all of you who were so generous in your support.
I am Marylou Stanley, widow of Roylee Stanley, the Navajo Police officer who was killed last December.
I want to thank you on behalf of myself and my two baby boys for your wonderful support during the past year. Your attendance at the funeral and the memorial service; your gifts of flowers and your contributions of money, firewood, coal and food have helped immensely, not only materially, but because of your friendship and generosity.
I couldn't have made it without your help, your prayers and your words of encouragement have meant more to me than I can say.
As the Christmas Season approaches, I want to express my gratitude and to wish each and everyone of you joy and happiness now and in the New Year.

San Juan County Budget - The 1989 budget for San Juan County was discussed by the Commissioners, County Clerk Gail Johnson and Administrative Assistant Rick Bailey. It was suggested that the Commissioners budget be increased to $95,000 as there will be a deficit with the present budget. Commissioner Black felt that part of the Tourist and Promotion budget should be designated for promotions. Administrative Assistant Rick Bailey stated that the transient roan tax should bring in more revenue than was projected as it was a very good year.
The Interagency Recreation Project will be doubled to $20,000 as the Commissioners had previously approved $10,000 each for the Recapture and Lloyds Lake projects. That budget will be contingent upon the San Juan Water Conservancy District and the cities each budgeting matching funds.
Commissioner Bailey said that the Weed and Rodent budget should remain at $35,000, the same as last year with $5,000 earmarked for the Bluff mosquito spraying with the residents matching the $5,000. The additional request was for additional chemicals which the commission said they already have a good supply. It was noted that there needs to be better controls on the mosquito spraying.
The recreation budget was approved with stipulation of $3,000 each going to Montezuma Creek and Monument Valley areas for activities. They weren't afforded the same programs as in the Blanding and Monticello and they have as many people in those areas that need those advantages.
It was noted that the Blanding Airport budget showed a deficit because of the fencing and signing that had not been budgeted but was approved. The expected expenses should show a decrease in the next year.
Commissioner Bailey requested that the Bookmobile budget be increased by $2,000 to buy books for the Navajo Mountain area. That area is not covered by bookmobile services and they rarely request any help from the County so it was felt that would be appreciated by the residents.
Also Mr. Bailey felt that the Historical Preservation budget should be increased by $4,000, $2,000 to take care of microfilming and preservation of old County records and $2,000 toward the Blue Mountain Shadows project.
Administrative Assistant Rick Bailey noted that the capital improvement request from the Monticello Golf Course was $6,408 rather than the $18,908 as shown on the budget worksheet.
The Unclassified budget of $20,000 as shown on the worksheet will be designated as $10,000 each for the Aneth Multipurpose Building and the LaSal Gym to be matched by local funds on both projects.
The $45,300 capital request of the County and State Fair includes $24,500 to be used to install a livestock scales and upgrade the Monticello Fair Grounds, $20,000 to upgrade the rodeo grounds at Blanding and $800 for a printer. Conmissioner Bailey recommended that the request be approved with $10,000 being earmarked for a scale at Monticello and another scale to be placed in the southern area of the County and that the other entities match those funds. The County will charge for the use of the scales for the maintenance of the units. The commissioners felt that good used scales can be obtained rather than purchasing new ones.
It was noted that the Dry Wash Campground project budget of $5,000 is to be matched with funding from Blanding City and the Forest Service.
The Television and Communications budget includes money to take down the cable from the poles at Bluff.
A motion to approve the budget as amended was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS. A copy of the approved budget can be found at the end of these minutes.
