SAN JUAN COUNTY COMMISSION MEETING MINUTES NOVEMBER 18, 1985
The San Juan County Commission met in regular session on November 18, 1985 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.
The following members were present: Commissioner Calvin Black, Chairman
Commissioner Kenneth Bailey Commissioner Jerry Holliday
Minutes of the November 12, 1985 meeting were approved on the motion of Commissioner Holliday. The motion was seconded by Commissioner Bailey. UNANIMOUS
ELECTED OFFICIALS MONTHLY MEETING
The following elected officials met with the Commissioners for their monthly meeting.

The motion was made to approve the hire of Oliva Blake in the Recorder's Office at a Grade 1, Step 3 for permanent part time, with no benefits or a probationary raise.
Rigby Wright, Sheriff, asked the Commissioners to sign and approve a Deputization Agreement between San Juan County and Glen Canyon National Recreation Area. It was signed and approved. Also, Mr. Wright requested permission to receive bids for two new cars. Commissioner Bailey made the motion to approve the bids for two cars. The motion was seconded. UNANIMOUS
MELVIN DALTON BAR MK RANCHES
Melvin Dalton, Bar MK Ranches, gave the commissioners a copy of a letter that Steven Boos, Attorney for DNA-People's Legal Services, Inc. had written to Mr. Dalton's attorney concerning Mr. Dalton trailing his cattle through Cottonwood Canyon. DNA is asking for $100,000 in penalties for not having a grazing lease on Ute Allotments and contends that the road is not a county road. Mr. Dalton asked the Commis-sioners if the county had any road maps of this area from 1900. The road in question is designated county B road # 227. Commissioner Black told Mr. Dalton to meet with Doug Pehrson, County Surveyor to see if he could help.
4-H SAVINGS ACCOUNT
Sharon Riley, Tauna DeGraw, and Linda Kilgrow, members of 4-H council, met with the Commissioners with an agreement for the Commissioners to sign, stating that the monies in the 4-H council savings account will stay in a separate account from the Extension 4-H account and not be transferred into the County General Fund. Gail Johnson, Clerk, said she feels that this money should be kept with the county records and could be put in a revolving trust account. Extension office and 4-H program are supported by county money, however, the indication was that this account was raised privately and contains no county money. Commis-sioner Black said that the way the agreement is stated the Commissioners can not sign it and will ask Bruce Halliday, Attorney to review it.
EXTENSION AGENT
Rick Bailey, Administrative Assistant, reported that he met with Ralph Home, District Supervisor for the Extension Service, to discuss the possibility of Utah State hiring someone with a B.A. for the job of Extension Agent. Mr. Home said that all applicants will be interviewed and adjustments would be made so that a person hired with a B.A. could work on their M.A. degree. Mr.Home wanted to assure the Commission that they will be included on the final decision.
LIABILITY INSURANCE
Rick Bailey, Administrative Assistant requested permission to advertise for proposals for liability insurance for the county, which will expire the end of April, 1986. Commissioner Bailey said that the dead line for the proposals should be February 28, 1986. Commissioner Bailey made the motion and Commissioner Holliday seconded it. UNANIMOUS.
JAIL REIMBURSEMENT
Rick Bailey, Administrative Assistant, reported that he sent in for a reimbursement of $68,000 for part of the property that was bought for the county jail sight.
BLUE-CROSS BLUE SHIELD AGREEMENT
A motion to approve an agreement with Blue Cross-Blue Shield on terms, benefits, etc. was made by Commis-sioner Bailey. The motion was seconded by Commissioner Holliday. UNANIMOUS. The agreement is retro-active May 1, 1985 and is filed in the clerk's office.
BOOKMOBILE ROLAND FRANCOM
Roland Francom, employee with the Bookmobile, met with the Commissioners about the possibility of the county discontinuing the Bookmobile. Mr. Francom pointed out that his biggest customers are Montezuma Creek and Monument Valley Elementary schools, and the teachers as well as the children depend upon the Bookmobile for books. Commissioner Black said that the Commissioners received many letters from the children of these schools saying how much they like the Bookmobile, and if this is the case then the school district and UNDC should help pay for the expense. Mr. Francom agreed with this and said he would meet with the school board and UNDC to discuss the possibility of than sharing the expense.

Considering the controversy and intense discussions surrounding the 1985 Beef Basin anterless deer hunt, it appears prudent to schedule a board of Big Game Control public hearing in Monticello in 1986. That
way, the views of San Juan County interests—as well as others in the southeastern corner of the state---
can more easily be heard prior to the Board's final executive meeting where decisions on hunts are made.
In addition, the Division of Wildlife Resources' game management personnel will offer a field tour of Beef Basin to the San Juan County Commissioners next spring prior to any Board public hearings. In that way, forage conditions can be viewed on the ground with professionals, who can interpret these conditions and their implications on deer herd management. I will advise you later on the best dates for field review, but we will endeavor to also accommodate the schedules of the county commissioners.
The Commission may also attend other Board public hearings in other cities if they so desire, and they may at any time submit further comments to either the division or the Board prior to the 1986 Board executive meeting on deer harvest regulations.
I feel that these measures will offer considerable opportunities for the San Juan County Commission to have their concerns heard and fairly considered in light of other pertinent information.

HALL'S CROSSING CABLE TV
The following letter was reviewed by the Commissioners.

Dear Mr. Black:
The Hall's Crossing Employee Association is requesting a franchise to operate a cable TV operation in the Hall's Crossing Marina area. We are requesting this for the purpose of obtaining the rights to broadcast Showtime and,or,the Movie Channel plus 4 to 6 other satellite stations.
The franchise should be put in the name of the Hall's Crossing Employee Association which is in the process of applying to became a non-profit organization.
Any money charges for the system will be used to pay off the loan through the Del Webb Credit Union and the programing for the stations. Any money left over will be used for service and maintenance of the system. No money will be paid to the Association officers or members.

Commissioners Black says that by issuing Hall's Crossing Employee Association a franchise, they are not asking for the county to provide the service. The County has the authority to issue a franchise and the Commissioners will ask Bruce Halliday, county attorney, to prepare a franchise for Hall's Crossing Employee Association. Commissioner Bailey made the motion to approve the franchise. Commissioner Holliday seconded it. UNANIMOUS.
BLANDING CITY COUNCIL MEETING-NURSING HOME
Rayburn Jack, Health Care Director, reported to the Commission that he attended the Blanding City Council meeting last week in which the city of Blanding was to give the county a deed to the land where the Nursing Home is located. Mr. Jack said that the council reviewed the previous minutes from the city council where the city had offered to deed the two acres north of the nursing home but Mayor Bradford stated that the council never agreed to deed the land to the county where the nursing home is located. Mr. Jack said that he read in the minutes that the council did agreed to deed the land to the county and a motion was made and approved. Mr. Jack said that the council reviewed the current lease of the Nursing Home and rather than make a decision now, decided to wait until the next city council meeting.
Commissioner Black reported that Kay Johnson, elect member of Blanding City Council, called him and asked what his knowledge of this situation was, so Commissioner Black went over the minutes that Mayor Bradford gave the Commissioners a couple of weeks ago. Commissioner Black said that in the minutes it states very clear that the Blanding City Council, where Mayor Bradford acted as mayor and chairman of the health service board, passed a resolution to deed the land to the county. Subsequently Mayor Bradford did not follow through with his responsibilities and carry out what was legally his duty. Commissioner Black asked Mr. Jack to draft a letter to present to the Mayor and Mayor-elect of Blanding along with the minutes presenting these facts.

EMPIRE ELECTRIC APPLICATION SECURITY LIGHT
The Commissioners reviewed an application from Empire Electric for a security light to be installed at county road shed. The motion to approve this application was made by Commissioner Bailey. The motion was seconded by Commissioner Holliday. UNANIMOUS
PROPOSALS OPEN ON MEDICAL FACILITIES
The bids were opened at 2:00 p.m. for sale the county medical facilities. Castle County Care Center of Price made a proposal for a management contract exclusive of the hospital. Southwest Health Management Co. of Cotton, California, proposed a management contract or a lease/purchase plan. Bonneville Health Care of Salt Lake City proposed negotiating an agreement and San Juan Health Care Service, a local corporation, proposed a purchase or lease of the facilities.Rick Bailey, Administrative Assistant, will meet with Ted Stagg,CPA developer, with the proposals that were received, so that Mr. Stagg can evaluate and prepare the data for the Commissioners. Commissioner Bailey also wants Mr. Stagg to analyze the medical facilities so that recommendations can be given on a price, etc. before a public meeting is held.
NATIONAL BLM ADVISORY COUNCIL MEETING
Commissioner Black reported that he attended the National BLM Advisory Council Meeting in Washington D.C. last week.
MICHAEL ALLISON UNDC
Commissioner Bailey reported that Michael Allison, UNDC, had called him and said he agrees with the Commissioners about the importance of putting a Tribal Police station in Montezuma Creek. Erica Todakoni-nonzie is working on getting the lease to the county and will have it soon.
CITY AND COUNTY ROADS
Commissioner Bailey asked Bruce Halliday, county attorney, if the county can enforce encroachment permits on the county roads in the cities. Monticello and Blanding cities have the attitude that they don't have to protect the county road within city limits.
OMEN PHELPS PROPERTY
Commissioner Bailey said that the problem on the Omen property is that there are 15 acres being sub-irri-gated from a reservoir. Doug Pehrson, Surveyor, said the county never raised the pipes but will replace the pipes and place them a foot lower. Commissioner Bailey will write Mr. Phelps a letter stating that the county is doing this.
BLANDING CLINIC HEATING SYSTEM
Commissioner Bailey said that heating system in the Blanding Clinic does not work. Don Smith who in-stalled the heating system says that it was misdesigned by the engineer. Commissioner Bailey said that this needs to be followed up on with the architect, Keith Stephan.
BLUE RIBBON BOARD
Bruce Halliday, county attorney, suggested that the Commissioners form a Blue Ribbon committee consisting of county residents, to sit on a board with the Commissioners to evaluate the proposals and alternatives of San Juan County's medical facilities. Commissioner Black thought this would be a good idea and will follow up on this.
