The San Juan County Commission met in regular session on May 18, 1987 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Black, Chairman

Commissioner Bailey Commissioner Maryboy

Minutes of the May 11, 1987 Commission Meeting were approved with the corrections on the motion of Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

COMMISSIONER CALVIN BLACK'S REPORT

LaSal Mountain Planning Unit - The Division of State Lands will be holding a public hearing for the

proposed LaSal Mountain Planning Unit. There will be time for public comment and Commissioner Black said

he will submit some changes.

Regional Prison Facility - Comnissioner Black said that he will write a letter on behalf of the Commission

thanking and complimenting Lynn Lee, Winn Wescott and Joe Slade for their efforts and expertise in

submitting the proposal for the Regional Prison Facility.

Utah Counties Finance Cooperative - Commissioner Black said the Utah Counties Finance Cooperative has

$114,880,000 for pooled financing. This amount was determined by the capital improvement needs submitted

by the participating counties that was finalized April 29. On August 1, counties with identified needs

will receive an application form for those funds. A remarketing agent for the Cooperative will assist

each county with completing the application. The Commission asked the clerk to submit the application.

Employment Statistics in Utah - The latest employment statistics in the state show that only five of the

nineteen counties south of the "Payson-Dixon" line are below the double digit unemployment rate. San Juan

County is 10.2%.

State School Section - Commissioner Black reported that a state school section received a bonus bid on an

oil and gas lease for $16,000 in T34S, R25E and $27,000 for one in T35S, R22E. These locations are

northeast of the Mustang fields.

COMMISSIONER KENNETH BAILEY'S REPORT

Public Safety Building - Commissioner Bailey reported that the bids were opened on May 14 at 2 p.m. for

the Public Safety Building. Commissioner Bailey proposed that the Commission accept the recommendation of

the architect. Commissioner Bailey made the motion to approve the low base bid for $3,267,000 and

alternates #3,#4,#5 & #9 for a total contract price of $3,304,000 to Valley Buildiers of Gunnison, Utah.

Commissioner Maryboy seconded the motion. UNANIMOUS. Bid awarding and ground breaking will be May 26 at

3 p.m.

Keith Hoggard - Lumber - Commissioner Bailey said that Keith Hoggard was the high bidder of $6000 for the

patrol and he also bid on furnishing lumber to the county. The Commission agree that it's in the best

interest of county to buy the lumber from Mr. Hoggard deducting the cost from the patrol. Commissioner

Bailey said he will have the county attorney prepare an agreement of monthly payments plus interest.

George Urban - Roller - Commissioner Bailey said that George Urban is interested in buying a roller at the

road department. The Commission agreed to sale it to Mr. Urban for $200.00.

Brown's Canyon Road - Commissioner Bailey said he talked to Eugene Guymon about where the quarter corners

are at Brown's Canyon Road and Doug Pehrson, surveyor, will go down tomorrow to try and locate them.

Rio Algom Road - Commissioner Bailey said that Merz Hungentobler, road superintendent, wrote a letter Rio

Algom explaining that the county plans to work on the road as soon as possible.

Paiute Farms Road - Commissioner Bailey said he complimented Doug Pehrson and Stan Hawkins on the

condition and design of the Paiute Farms Road.

Road Department Radio System - The radio system in the road department has been completely out of order

for the last three months. Commissioner Bailey said he will talk to Bill Bayles, communications

engineer, about this matter.

COMMISSIONER MARK MARYBOY'S REPORT

Rodeo - Blanding - Commissioner Maryboy reported that a fairboard member requested that a rodeo be held in

Blanding on August 28 & 29. The rodeo is proposed to include a pow-wow, 4-wheel drive, quarter horse

race, etc. This will be on the agenda for discussion at the next fairboard meeting.

Bluff Post Office - Commissioner Maryboy said they are planning to close the Bluff Post Office and

contract for the service. Commissioner Black said the Development Board discussed this last week and

agreed to write a letter requesting the same level of service. The U.S. Postal Service is eliminating

postmasters in small communities because of the cost and contracting the service.

Recreation Proposals -Commissioner Maryboy said he will be in Window Rock, Arizona tomorrow to follow up

on the proposals that were submitted by the county on recreation and fire trucks.

Montezuna Creek Police Station - UNI is currently using the old Montezuma Creek Elementary school for a

sewing factory and also using the county's leased portion to store equipment. The Commission agreed to

let UNI use the entire building until the Tribe is ready to put in a police station. Commissioner Bailey

said he will follow up with the Tribe and get an agreement prepared.

WEED CONTROL - SUMMER HELP

Jim Heaton, county weed agent, met with the Commission to discuss the hiring of part-time summer help. The Commission approved the hiring of Paul Weber as supervisor of summer weed control and McKay Hungentobler as his assistant.

ELECTED OFFICIALS MONTHLY MEETING

The county elected officials met with the Commission.

Queen Pageant - Gail Johnson, clerk, said that Becky Young still has the county queen pageant funds and

since she has resigned the funds need to be returned to the county account. The Commission will write a

letter to Mrs. Young asking for the account to be closed and the funds returned to the county.

Tax Sale - Gail Johnson, clerk, said the Commission needs to determine whether to sell the delinquent tax

property for market value or for the taxes owed plus interest. The Commission asked for a list of the

property that is for sale on May 27 with the market value figures.

Recorder's Office - Louise Jones, recorder, told the Commission that everything was going fine in the

recorder's office.

Older Homes Tax Increase - Barbara Montella, Assessor, told the Commission that the taxes will going up on

the older homes to meet market value and the newer homes may see a decrease.

Treasurer's Office - Marian Bayles, Treasurer, said that everything was fine in her office.

Legislative Special Session - May 20 - The Legislature will hold a special session on May 20.

EXECUTIVE SESSION

Claude Lacy, sheriff, and Craig Halls, attorney, asked that the Commission meeting be called into an executive session to discuss personnel matters. Commissioner Bailey made the motion for the Commission to go into executive session and Commissioner Maryboy seconded the motion. UNANIMOUS.

Robert L. Furlow, director of SEUHD, met with the Commission to discuss the State funds that were lost to several County administered agencies as a result of the recent "trade-off" 1987 legislation. The State Health Department is cutting the general health block grant by about $17,000 because of the SB91 "trade-off" of the County Medical Indigent program for Agingf Public, Mental Health and Drug and Alcohol. Mr. Furlow said the State cut all urban and rural departments by 10.43%. The Regional Health District Meeting will discuss this tomorrow night at their monthly meeting. Commissioner Black said the county is going to take a strong position that each county should pay their fair share according to the agreed formula based on population and assesed valuation. The Conmission said that the State should deal with services to people on an equalization formula.

MONTICELLO AIRPORT - ARMSTRONG CONSULTANTS, INC.

Keith Koler, Armstrong Consultants, and Ron Theobald, UDOA, met with the Commission to review their study of soils, base and asphalt at the Monticello Airport. The reports states that the existing asphalt is in extremely poor condition and outlines four methods of rehabilitation. Commissioner Bailey made the motion to proceed on this project and authorized Armstrong to finish the plans and let the bids as soon as possible in hopes to get more competitive bids. Commissioner Maryboy seconded the motion.

Commissioner Bailey said if this work is not done with the extra money the State has available, it will not be done in the future because there will be less funds. This maintenance is well worth it to the county and with a 90-10 cost match is one of the best investments the county can make. It will also be beneficial to the Industrial Development and Tourism.

Commissioner Black said the county's assessed valuation is falling and the Monticello Airport cannot be increased in length because it's limited by the altitude. The County is going to have to cut back on expenses and there is the duplication of the airport in Blanding. There are arguments that the airport is already in the county there and therefore should be maintained. The airport currently has very little use. Commissioner Black said there is controversy in the county right now concerning the health care which he is not supporting and therefore he can not vote in favor to support a second airport that is short on justification. Commissioner Bailey said he supports it whole heartily. The voting was as follows: Commissioner Bailey - Aye Commissioner Maryboy - Aye Commissioner Black - Nay

Mr. Theobald and Mr. Koler said they will prepare the bids and get back with the Commission.

PERSONNEL - PART-TIME EMPLOYMENT

Gail Johnson, clerk, informed the Commission that she's had a high school student working in her office about four hours a week on a school program. Mrs. Johnson said she would like to hire her part-time for the summer months and pay a minimum wage. The Commission approved Mrs. Johnson's request to hire without advertising because she has already been trained.

UNDC REPORT - TULLY LAMEMAN

Herb Clah Resign from UNDO - Tully Lameman, UNDC, reported to the Commission that Herb Clah, executive

director of UNDC, submitted his resignation. The UNDC board is meeting next Tuesday to discuss budgets

and will appoint an acting director.

UDIA Board - The UDIA board did not meet last Thursday as planned.

Chapters Members - UNDC will be meeting with the chapters to discuss replacing the board members whose

terms have expired.

UNI Operations - The UNDC board discussed the structuring of the UNI operations. UNI is planning to

relocate Dineh Lumber and Metro Printing Shop to the reservation to enable them to get contracting with

the Navajo Tribe. UNI appointed Everett Kenneth of Albuquerque to president of UNI and appointed Dick

Netsosie to president of the Henry Hillson Company.

Red Mesa Chapter - The Red Mesa Chapter is renovating their Senior Citizen building. They are using local

labor instead of contracting any services.

Outstanding Navajo Seniors - UNDC selected three outstanding Navajo Seniors who are Chris Singer from San

Juan High School, Jim Dandy, Jr. of Monument Valley High School and Marlin Willow of Whitehorse High

School. They will receive $100 award and $400 scholarship and will also receive a plaque from UNDC. Mr.

Lameman said this program has been very productive.

The Commission thanked Mr. Lameman for his report.

BLUFF VOLUNTEER FIRE DEPARTMENT

Bill Davis and Bette Davis, Bluff residents, presented the Commission a petition signed by 123 people. The petition reads "We, the undersigned citizens of Bluff, Utah sincerely request that the San Juan County Commissioners provide a fire truck that will pump at least 500 gallons per minute to protect our homes and surrounding areas. The community of Bluff has adequate fire hydrants, and state-trained volunteer fire fighters. However, our current equipment is dangerously inadequate for fighting any type of structural fire. The citizens of Bluff therefore request that the San Juan County Commissioners allocate and reserve in the upcoming 1988 county budget funds necessary for obtaining an up to standard fire truck.

The Commission said that the county can not afford to buy a truck for every community. Commissioner Maryboy said this has always been a concern and the county has submitted a proposal to the Navajo Tribe to purchase two fire trucks. Commissioner Maryboy said he will be going to Window Rock tomorrow and will receive a definite answer to the proposal. The Commission said they are aware of the need for a fire truck in the Bluff area and said that do have a very dependable volunteer fire department. The Comnission thanked them for coming in and said they will follow up on their request.

SHERIFF'S OFFICE SALARY INCREASE

Claude Lacy, Sheriff, met with the Commission and presented than a salary analysis of the sheriff's office personnel. Mr. Lacy said he would like to make adjustments for the county deputy sheriffs. The Commission said that even with these recommended increases the San Juan County deputies and jailers are still substantially paid less than comparable people with the same experience as in Blanding and Monticello and other cities and counties in the area. Commissioner Bailey made the motion to approve the following salary increases and Commissioner Maryboy seconded the motion. UNANIMOUS.

PUBLIC DEFENDER AGREEMENT

Commissioner Maryboy made the motion approving the Public Defender Agreement between San Juan County and Keith Chiara. Commissioner Bailey seconded the motion. UNANIMOUS.

PUBLIC DEFENDER AGREEMENT

This Agreement made this 14th day of May , 1987, by and between San Juan County, a body corporate and politic, of the State of Utah, hereinafter referred to as COUNTY, and Keith H. Chiara, 350 Blake Street Helper, Utah, 84526, hereinafter LEGAL DEFENDER,

RECITALS

WHEREAS, the COUNTY is obligated to provide legal representation to indigent defendants charged with criminal offenses, and

WHEREAS, the most efficient and expeditious way of providing such service is by contracting with a LEGAL DEFENDER, and

WHEREAS, the above named LEGAL DEFENDER is familiar with constitutional and statutory duties of the County to provide such service and is wiling, able and qualified to render such service to qualified indigent defendants as an independent contractor and not as a employee of COUNTY, thereby assuring Defendant complete independence in representing his clients, and

WHEREAS, the parties hereto have reached an understanding as hereinafter set forth,

NOW THEREFORE, in consideration of the duties to be performed by each party hereunder and other adequate consideration, the receipt and sufficiency of which is hereby acknowledged, the parties do here by agree as follows:

1. Service to be rendered, the LEGAL DEFENDER shall represent all persons qualifying as indigent, pursuant to determination to be made by the Justice of the Peace Court, Juvenile, Circuit and District Court, in all 2nd and 3rd Degree Felonies, Misdeamors.

2. 1st Degree Felonies, Capitol Felonies and Appeals shall be handled at an additional rate as set forth.

3. Compensation: COUNTY shall pay LEGAL DEFENDER One Thousand Dollars, ($1000.00) per month for basic legal defender services in handling all Justice of the Peace, Juvenile, Circuit and District Court appointments for 2nd and 3rd Degree felonies, Misdeamors.

a. COUNTY shall pay the LEGAL DEFENDER $40.00 per hour in addition to the monthly rate for all 1st degree Felony and Capitol cases.

b. COUNTY shall pay the LEGAL DEFENDER $40.00 per hour for all matters taken on Appeal to the Appeal Court or the Utah Supreme Court,

c. COUNTY shall pay the LEGAL DEFENDER 10 cents per mile for round trip mileage to and from Helper, Utah, and shall reimburse all long distance telephone calls,

d. COUNTY shall provide medical insurance benefits for the LEGAL DEFENDER.

4. LEGAL DEFENDER shall be an independent contractor and this agreement is not an employment contract, but at all time hereunder, LEGAL DEFENDER shall have the status of independent contractor and in no way shall be an employee, agent, or officer of San Juan County, nor shall LEGAL DEFENDER be subject to the control of COUNTY in any manner in his representing indigent defendants.

5. This agreement shall be for all cases in the Justice of the Peace Court, Juvenile Court, Circuit Court and District Court, if LEGAL DEFENDER has no conflict of interest in any case assigned, he shall thereupon give experienced, competent and zealous representation to every such indigent person unable to employ counsel, who faces the possibility of deprivation of their liberty or other serious sanction by courts established pursuant to the State of Utah and within the boundaries of San Juan County, Utah.

6. LEGAL DEFENDER will keep a record of all cases on which he is appointed and will upon request provide the same to the County Attorney's Office naming the Indigent, the Court from which appointment came, the Offense charged, the time spent on the case and its disposition. Such report shall be sent to the County Attorney's Office, at least on a yearly basis and shall be available upon reasonable notice at any other time upon request.

7. If the LEGAL DEFENDER recognizes that any case on which he receives an appointment will require special consideration, or if the case is a Capitol Felony or 1st Degree Felony, justifying additional compensation because of the special or unusual circumstances, LEGAL DEFENDER shall make a claim to the County Commissioners prior to the trial or detailed representation of the case and request additional compensation. Any additional compensation in any of the case of Appeals, 1st Degree Felonies, Capitol, or unusual or unique cases shall be cleared with the County Commissioners as soon as possible after the unique character of the case is determined.

8. This agreement shall be in force and effect for one year following the signing of this contract. Any work hereunder may be terminated by either party with or without cause upon said party giving written notice of the termination 30 days prior to the date of termination.

a. All cases which the LEGAL DEFENDER has accepted appointment on at the time of his notice of termination shall be handled to a logical conclusion, either by conviction, plea bargain, dismissal or by court approved withdrawal by the LEGAL DEFENDER. Unless special provision are made for special payment, the LEGAL DEFENDER shall handle such case for the compensation received upon the final payment under the contract.

9. LEGAL DEFENDER shall have sole control over the method of providing the legal services for the person for whom he is appointed at to act as counsel, subject to the ethical and legal obligation of attorney's under the code of professional responsibility and shall be independent and under no control of San Juan County and/or it's elected officials or employees.

10. This agreement shall be effective upon its execution by the San Juan County Commissioners.

PUBLIC SERVICE COMMISSION - CONTINENTAL TRAILWAYS - BUS SERVICE

Rick Bailey, Administrative Assistant, reported that he talked to Lowell Elmer of UDOT and Mr. Elmer said he talked to the Public Service Commission after the Continental Trailways hearings and understood that Continental Trailways was still serving this area. Mr. Bailey said that Mr. Elmer will talk Bill Habel, Manager of Business Regulation, said he will call Trailways in Dallas to set up a meeting between them and the Public Service Commission. The Commission said they want Trailways to continue services in the Four Corners area.

AOG MEETING

Rick Bailey, Administrative Assistant, reported that he attended the AOG meeting last Friday in Price.

Dee Hansen, Executive Director of Natural Resources, and Milow Barney were present at the meeting in

which the following items were discussed:

Land Exchange - The land exchange issue was discussed and if approved it will be handled on a county by

county basis. It is proposed to start in Washington County immediately and then proceed to the

southeastern counties. They will involve county and cities officials and situations may vary by each

county. Bill Howell, director of AOG, will be involved and Mr. Hansen indicated it would be handled on a

administrative basis. Mr. Bailey said there is the problem of pilt payments because they don't transfer

to federal lands. Commissioner Black said that if some of the land is sold it will solve the pilt

payments because then it's on the tax roles.

Economic Development - There is a company that is interested in developing "Kitty Litter" because the

soils in the area are adaptable for this product. There is a big market for this.

Air Quality and Integral Vista - Mr. Bailey said they discussed the regulations that have been put on air

quality and integral vistas. The AOG agreed to request a change and that they go the other way.

STATE LIBRARIAN VISITS NAVAJO MOUNTAIN - RUSSEL DAVIS

Russel Davis, state librarian, met with the Commission on his way to visit Navajo Mountain. Mr. Davis said he had 100 books with him to distribute and help start a library in Navajo Mountain.

COUNTY ATTORNEY REQUESTS SALARY RAISE

Craig Halls, county attorney, presented the Commission a documentation of his hourly time he's worked for the county since January 1987. Mr. Halls explained that he works an average of 30 hours per week but is only getting paid for 20. The Commission said that with this documentation they agree to hold a public hearing on June 23 at 7:30 p.m..
