SAN JUAN COUNTY COMMISSION MINUTES JULY 18, 1988

The regular meeting of the San Juan County Commission commenced at 10:00 A.M. at the San Juan County Courthouse, Monticello, Utah.

A motion to approve the minutes of July 5, 1988 as corrected was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

COMMISSIONER MARK MARYBOY'S REPORT

Recreation/Monticello Swimming Pool - Commissioner Maryboy reported that he and Recreation Director Edward Allred met with some Monticello residents who felt that the fees at the Monticello Swimming Pool are too high for the low income families. The issue will be discussed at the next Recreation Board Meeting on August 2.

Montezuma Creek Fire Fighters - Enough volunteer fire fighters have been recruited in Montezuma Creek to receive the necessary training. Administrative Assistant Rick Bailey will set up a training seminar for them in August.

San Juan County Fair Board - Commissioner Maryboy met with the County Fair Board last week and they requested that the parking for rodeo participants be cleaned up. The rodeo will be held August 12th and 13th. Commissioner Bailey will check the Fair Grounds and see what needs to be done.

COMMISSIONER CALVIN BLACK'S REPORT

Long Canyon Road - Commissioner Black has contacted Neldon Holt about the Long Canyon Road and Mr. Holt is supposed to look and see if there is an alternative route around his property. If the road would remain through his property it would require four cattle guards. Commissioner Black will follow through to see what Mr. Holt has decided.

State Land Board - The special session of the Utah legislature took care of a problem with respect to the new land law which by repeal of the old land laws repealed the board. That was changed and the State Land Board is now comprised of 11 members. An amendment appointed part of the board members to a four-year term and the rest to a two year-term so they would have staggered terms. The following were appointed to a four-year term: Calvin Black, Roger Peart, Loryn Ross, Frank Nishiguchi. Two year terms: Willard Gardner, Max Williams, Jim Bowns, Rulon Gill, Reed Christensen, Doug Bates represents the Superintendent of Public Instruction, Jack DeMann will possibly be appointed as the final member.

Fishing Violation Complaints - Commissioner Black reported that he met with Sheriff Lacy last week regarding numerous citations being given to people on Lake Powell for various fishing violations. Many letters are being sent to the County Attorney and the courts regarding the excessive fines and the way the incidents are handled. Mr. Black feels that with all the money spent on attracting visitors to the area we ought to work with them and give them a good impression of Utah rather than take their money and send them home early. He also reported that our law enforcement people should approach violators with the attitude of leaving the people with a good impression of Utah and being as helpful as possible while filling their responsibilities of law enforcement.

Lake Powell Region Resource Development Council - There will be a meeting of the Lake Powell Region Resource Development Council on Lake Powell on the 4th and 5th of August to make an inspection of the area.

National BLM Advisory Council Meeting - Dean Bibles, Arizona State BLM Director, told Commissioner Black that under his direction the State of Arizona has transferred to Arizona all of their in-lieu trust lands. In addition several thousand acres were exchanged administratively. Arizona has really made some headway in land exchanges that everybody is agreeable to, doing it on an administrative basis. At a recent hearing in Salt Lake, former Governor Matheson said that these things could not be done administratively, but Mr. Bibles has proven that it can be done.

Southern Paving - Brenda Stocks of Southern Paving called Commissioner Black and said that their cost without the royalty for crushing gravel would be a maximum of $2.95. If they can get some higher quantities it would be cut down if their actual costs are less than that but it will not be more.

Utah BLM Director Meeting - Conmissioner Black met with Jim Parker, Director of the Utah BLM, two weeks ago to discuss various issues in the County including the San Juan Area Resource Management Plans, policy and administrative matters.

Forest Service/Tree Thinning - The Monticello office of the Forest Service is requesting comments on their tree thinning. The area to be thinned is from the Causeway, the Chippean and the Starvation Point area. The thinning is aimed at providing increased growth and vigor of young ponderosa pine stands. The Commission will send a response in favor of the proposal.

County Employee Appreciation/Lana Herron - A letter has been received from Doug Messerly of the Utah Fish and Wildlife Department extending his thanks and appreciation to Lana Herron, 7th Circuit Court Clerk, for the excellent job she does. Conservation Officer Messerly states: "In dealing with the sometimes irate, sometimes embarrassed, people that had recently received a citation from a conservation officer, Lana always seems to provide the right answer. Lana's common sense and let's-get-it-done attitude are a great asset to county government and are especially important in the difficult job that Lana has."

COMMISSIONER KENNETH BAILEY'S REPORT

Monticello Library - Commissioner Bailey asked Commissioner Maryboy to talk to the Library Board at their meeting tomorrow night about the possibility of keeping the Library open over the 24th weekend to use for display for the Centennial Celebration.

Road Department Employees/Probation - Commissioner Bailey presented a request for probationary raises for Jay Palmer at grade 9 step 2, $7.35 per hour and Eddy Barry at grade 10 step 2, $7.70 per hour. A motion to approve the raises was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Attempted Vandalism - A report was received from the road department crew working on the dike at the Clay Hills Crossing that someone tried to vandalize a County truck.

Loader Vandalism - One of the County loaders had a flat tire and when the crew returned the following morning to fix the tire the tire had been removed and somebody drove the loader all over and ruined the wheel. A calculated estimate of the needed repairs plus time lost while waiting for the wheel to be fixed would run over $619.62. The Commissioners felt that unless the Tribe and others that the work is being done for can provide security for County equipment, the County would be unable to do the work.

Montezuna Creek Police Station - The following letter to Commissioner Bailey was received from Deseret Architects:

Dear Ken:

With regards to our meeting on Friday, July 1, 1988 in Monticello, we are proceeding with the drawings for the Police Station. The following notes are our understanding of the project:

1. A portion of the old Montezuma Creek School Building will be utilized for the jail.

2. A plan has been prepared which shows the intended layout. The plan includes the following:

A. Police office which includes a public area, counter and office.

B. Sleeping area with space for 2 beds.

C. Men's and Women's toilet room to include new fixtures. Room to be planned for handicapped use.

D. Kitchen to include sink, range, refrigerator and storage. No disposal.

E. Training room.

F. Jailer and sergeants office.

G. Two holding cells, approximately 8 hour maximum use. Cells to be ventilated. No plumbing. Doors to be non-security but with heavy

gauge steel construction. (To be verified with applicable codes.)

Cells to be roofed with poured reinforcing concrete. Floor drains in

each cell with hose bib nearby. Poured concrete bench. H. Evidence rooms. I. Janitors closet.

J. Heating and ventilation system. Swamp coolers for cooling. K. Finishes to be jointly determined with Owner. L. Separate electrical meter and wiring.

3. Proposed Architects Services:

A. DAE proposes to develop plans for bidding and construction based on the above program. Bid documents would include floor plan, sections and details as required for adequate description of the project and would be

prepared in accordance with all applicable building, fire, life safety and jails

standard codes.

B. Plan reviews with the Owner.

C. Coordination with State Reviewing Agencies.

D. Review of the bids and assistance to the Owner during the bid period.

E. Assistance to the Owner during construction to include:

(1) Field visits.

(2) Review of shop drawings.

(3) Certifications of Payments to the Contractor.

(4) Project closeout.

Jail design requires the Architect, as well as the Owner to assume certain liabilities regarding the health and welfare with the person jailed. Other liabilities arise concerning security. Though this project is small in scope, we must adhere to the same code restrictions and agency reviews as if it were a major facility.

We would propose an hourly fee of $45.00 per hour to accomplish the above services along with reimbursable expenses for telephone, printing, supplies and travel. Hopefully, travel could be made in conjunction with the Public Safety Building. I would estimate that our fees would not exceed $5,000.00. If you are in accord with the proposed services and fees, please respond with a letter of authorization. We are very appreciative of doing this work for you.

Commissioner Bailey stated he was in agreement with the letter down to the point of 3C but would prefer the County be responsible for the points of 3C, D and E. Administrative Assistant Rick Bailey was asked to respond to the letter and asked the Deseret\DLR Group to write a letter of disclaimer regarding those points.

Blanding Shop Equipment - Bids were received for a 1BF100 2 ton jack from Gray Automotive for $714.00 and Snap-on Tools for $968.00. A motion to accept the bid from Gray Automotive for $714.00 was made by Commissioner Bailey and seconded by Cortmissioner Maryboy. UNANIMOUS.

ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT

San Juan Mental Health Contract - Administrative Assistant Rick Bailey presented a contract from the San Juan Mental Health authority and the Utah Department of Health for Medicare reimbursement. The contract has to be signed in order to submit to the U.S. Department of Health for reimbursement. Commissioner Bailey made a motion to approve the contracts and authorize Chairman Black to sign them. Commissioner Maryboy seconded the motion. UNANIMOUS.

Loader/Surplus - Mr. Bailey reported that the loader at the government surplus sale had been used for parts and did not have a loader bucket. It would not be advisable to purchase this particular loader.

Public Safety Building - The request for payment #14 was made by Valley Builders, contractors for the Public Safety Building. The payment includes $159,384.00 for Valley Builders, $17,709.00 for retainage, $1,857.51 for Deseret Architects and $2,364.30 for AT&T for a total of $181,314.81. A motion to approve the payment was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Valley Builders Contract Addendum - A motion to approve the addendum to the contract of Valley Builders for the Public Safety Building was made by Catmissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Community Impact Board Contract/Revolving Loan Fund - The contract has been received from the Economic and Development Agency for the Revolving Loan Fund indicating that everything is ready to begin accepting applications for the Revolving Loan Fund money. A packet of information was received from the Deseret Certified Development Company which has the application review and closing recommendations. Deseret Certified Development Company has been hired by the state to review the applications for the money and make recortmendations to the local board as to whether the project should be funded and approved. The local board can then determine whether to make or reject the request. Once the money has been loaned out and repaid to the County, the money will then be cleared of all State regulations.

Hospital Administrator - From the numerous applications received for the position of San Juan County Hospital Administrator the Hospital Board reviewed the applications and several selected to be interviewed for the position. Letters will be sent to the remaining applicants expressing appreciation for their interest.

CURRENT BUSINESS

San Juan County Queen Pageant - Kevin Rhoades, met with the Commission to update them on the San Juan County Queen Pageant. All of the graduating senior girls have been contacted, as well as any eligible single girls in the area. Four girls from Monticello and one from Blanding expressed an interest in

participating in the pageant but four of them have withdrawn, leaving only one girl interested. Mr. Rhoades does not feel that a pageant can be held for only one girl. The Commission expressed appreciation to Mr. Rhoades and his wife for their efforts but said it would not be necessary to hold a pageant at this time if only one girl was interested. Mr. Rhoades indicated that there were a couple of bills that needed to be paid for expenses incurred while trying to organize a pageant that will be paid.

USU Extension Office Secretary - San Juan County Home Economist Holly Tatnall presented the name of Janet Hazelton to be approved as the secretary for the USU Extension office. A motion to approve the hiring of Mrs. Hazelton at grade 2 step 1, $927 per month, effective August l, 1988 was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

San Juan County Fair Grounds - Mrs. Tatnall asked if the road department could level a couple of areas at the fair grounds and dig a trench so that the Jr. Livestock club could bury a water pipe. Commissioner Bailey said he would have the projects completed.

San Juan County Tax Notices - County Treasurer Marian Bayles presented a sample tax notice to the Commissioners for their review. The notice is very similar to previous notices but will show the total market value along with the taxable value to eliminate confusion. Ms. Bayles indicated only one notice is sent to the property owner and the taxes would be paid from that notice. Any appeals would be made at least ten days after the notice has been sent. Property owners are those individuals whose property is recorded in the San Juan County Recorders office. If the Treasurer's office is notified that another individual is purchasing the property they are listed on the tax notice as the agent. The Commissioners discussed the possibility of making up a form for the signature of the deeded owner stating that the individual purchasing the property is to receive the tax notice. This might help alleviate the problem of delinquent taxes for the deeded owner if the individual purchasing the property does not pay the taxes. According to the law the notice should be mailed to the recorded owner. It is the responsibility of the individuals to see that the property is recorded when it is sold. The Commissioners expressed appreciation to Ms. Bayles for adding the total market value to the notice as they feel it will eliminate the confusion between the market value and the taxable value.

Monticello Golf Course - Recreation Director Edward Allred and Monticello Golf Course Manager Grant Leavitt met with the Commission regarding the charging of trail fees for private golf carts. A comparison of fees was made with the Moab Golf Course. A complaint had been received from an individual with regards to the charging of tourists $1 more per 9 holes or $2 for 18 holes and rider fees on private carts. Mr. Leavitt indicated that tourists were charged the regular fee but that those individuals belonging to the Utah Golf Association were getting the reduced rate of $1 for 9 holes or $2 for 18 holes. Mr. Leavitt also felt if individuals were allowed to ride free with the owner of a private cart that it would cut into his business of renting carts for use on the golf course. The Contnissioners felt that it would be well to see how much is actually collected by the rider fees. As the season is nearly half over, the Commissioners asked that the rider fee be eliminated and for Mr. Leavitt to keep track of any problems that may develop. Then consideration could be given to either raising the season pass for golf carts or to implement a rider fee for the coming year.

Oljato Residents - Commissioner Bailey reported that he had attended the Oljato Chapter meeting and said the residents would like to schedule the Mexican Hat Elementary school or Monument Valley High School for activities. The school district has agreed to let the schools be used for supervised scheduled events. Mr. Bailey indicated that the grass at Mexican Hat is new and not mature enough to allow use at the present time. However the Monument Valley football field would be available for soccer games, etc. Commissioner Bailey asked Mr. Allred to contact Jim Dandy and Francis Shorty to work out some programs for the residents of the area.

Montezuma Creek Lighting Wire - Mr. Allred presented a bid for 2400 feet of 1/0 aluminum underground wire for the lighting system at the Montezuma Creek softball field. Gray Bar bid $948 per 1,000', Amfac of Salt Lake bid $945 per 1,000' and Northern Electric bid $770 per 1,000'. A motion to accept the bid from Northern Electric for $770 per 1,000' was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

Utah Cooperative Finance - County Clerk Gail Johnson requested that a requisition from Utah Cooperative Finance for $530 be signed to pay for the printing of the bonds. Zion's Bank will pay the amount.

Unicol Pipeline Company/Appeal - Notice has been received from Unicol Pipeline Company stating that they have appealed their property valuation because of a formula variation. As this is a state assessment the County would have no recourse in the issue.

Harts Draw Road/Crushed Gravel Bid - County Engineer Doug Pehrson discussed the bid that was received from Holliday Construction Company in regards to crushing gravel for the Harts Draw road. The bid was for $3.00 per yard for 6,000 yards. Other companies had been contacted but did not submit bids. The amount to be crushed would be sufficient to cover approximately three miles of road. Mr. Pehrson said the total road would be seven or eight miles which would require about 15,000 yards of gravel plus chips, etc. The company doing the crushing would be required to remove the overburden and clean up the material. Conmissioner Black felt that the total amount of gravel needed to complete the road plus the chips should be calculated and then contact the Holliday Construction Company to see if the bid would be revised.

Harts Draw Road Construction Bid - Two bids were received for the construction of 1.4 miles on the Harts Draw road. Holliday Construction Company bid $241,646.68 and Crowley Construction Company bid $217,124.56. Mr. Pehrson recommended that the bid of $217,124.56 from Crowley Construction Company be accepted. A motion to accept that bid was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Lero's Draw Mulch - Commissioner Bailey reported that the County is running out of mulch in Lem's Draw and there will not be enough 3/4 inch mulch for the Guymon Lane project. The 3/4 inch could be mixed with sane 1/2 inch or the 3/4 inch could be laid and then put some 1/2 inch over the top of it or armor coat it. Mr. Pehrson was asked to look and the road and decide what needed to be done to complete the project.

Gravel Pit/BLM Property - A good gravel pit has been located on BLM property just beyond the Don Brown property. Mr. Brown will allow the County to build a temporary road across his property to the pit if the County will build the road and the turnaround to his property. The Commission felt that if the pit was a good one and it would save money for hauling gravel to roads in the area, it would be worth building the road Mr. Brown wants. Mr. Pehrson said an agreement would need to be drawn up allowing the County to use the pit in the future as well as on this particular road.

Forest Service - Raymon Carling and Tom Bandolin from the Moab Forest Service office met with the Commission regarding the closing of roads in the LaSal Mountain area during the month of October for the big game hunting season. The sportsmens groups feel that a plan needs to be implemented to increase the buck herd as well as the size of the animals either by restricted access, a four-point or bigger hunt, or a limited number of permits. In reviewing the problem with interagency people a proposal was drawn up to close a number of roads in the area which would prohibit vehicles and insure a more quality hunt with bigger bucks and the people wouldn't have to compete with motorized vehicles. Commissioner Black indicated that there are much larger areas than the one designated that have no roads into them and did not feel it was necessary to close already existing roads and that it would just cause more problems. Mr. Carling said there are many roads on the mountain that are not shown on the map but they had selected a few that could be easily closed that leads to a basin or a larger area to hunt. The Commission went on

record as opposing the closure of any road even for just the hunting season. History has shown that it would lead to permanent closure and more stringent regulations.

Watershed Road Closure/LaSal Creek Area - Mr. Carling indicated there is an old road near the LaSal Creek that the Forest Service is proposing to close for watershed reasons. The old road has been replaced and hasn't been used for years and is eroded and carries water like a ditch. The Forest Service is proposing to go in and waterbar and seed it to put it back into production to stop the erosion. They are not proposing to legally close it but rather just waterbar the road. The Commiission felt that if the Forest Service should just waterbar the road then four-wheel drive vehicles could still use the road and wouldn't just go around it.

Spanish Valley Roads/Dead Horse Point - The Commissioners of San Juan and Grand Counties will be meeting tonight to try and reach an agreement on road maintenance in the Spanish Valley area, under Dead Horse Point and up Pack Creek. Some of the roads extend into the Forest and would need an easement deed in order to be put on the B Road System. San Juan County would make the application for an easement deed and get the roads put on the B Road System then give the money from the B Road System to Grand County in return for the maintenance of the roads.

LaSal Road/Southern Paving - It was determined that the road in the LaSal area to be upgraded for timber use is on the Schedule A system with the Forest Service under cooperative agreement. Mr. Carling indicated that the road is being considered as one to be turned over to the County by easement deed so that it can be put on the B Road System.

Sheriff's Department - Sheriff Lacy discussed the hiring of Jerrold Perkins as a Correctional Deputy Sheriff. A motion to approving the hiring of Mr. Perkins at grade 8 step I, $1,177 per month effective August 1st was made by Catmissioner Bailey and seconded by Catmissioner Maryboy. UNANIMOUS.

Vehicle Registration - Sheriff Lacy reported there are still several individuals working in the County that have not registered their vehicles in Utah. The Commission stated that if the individuals are working in the County they should have their vehicles registered in Utah. The individuals should be given an opportunity to voluntarily obtain the registration before the Sheriff's department issues citations for those vehicles that do not comply.

Lake Powell Fishing - A meeting was held with the Sheriff's Department, County Attorney, Circuit Court Judge and Utah State Fish and Wildlife representatives regarding complaints received on fishing tickets given at Lake Powell. Sheriff Lacy reported that he felt there would be better cooperation with the State Division of Wildlife Resources and that the amount of bail has been reduced.

Monticello Airport Insurance - Monticello City Manager Rick Terry met with the Commission to discuss what coverage was needed for the Monticello Airport. Utah Local Government Trust no longer carries airport coverage so they are working with the Aviation Office of America for insurance.

Human Services Board - Glenna Webb, representing the San Juan County Human Services Board, reported that the Board met twice over the past two weeks and heard the proposal by Worthy Glover on the UNDC Project Team. After discussing the proposal the board recommended an allocation of $5,000 to Project Team. Mrs. Webb presented the Commission a breakdown of the discretionary funding for fiscal year 1988 and 1989. The projected funding for the programs will be cut approximately $30,000 by the year 1991 which will result in reduced funding to the programs.

Quit Claim Deed/Canary Lode - A quit claim deed was presented for approval to complete a tax sale in 1981 where only a partial deed was issued. A motion to approve the deed was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Procurement Bids - There has been some concern over repairs and carpeting work done at the Blanding and Monticello Libraries without obtaining bids. Commissioner Maryboy indicated the problem is on the agenda for the Library Board meeting tomorrow night. Other departments also need to be aware of the County policy of obtaining at least two bids on items costing over $100.00.

Courthouse Sidewalks - A bid was presented from Sonderegger Construction for $1.89 per sq. foot or $1.95 per foot with wire and clean up for sidewalks at the courthouse. Other contractors were contacted but did not submit a bid. A motion to accept the bid from Sondereggers was made by Conmissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

LaSal Fire Department - Inspection of the LaSal Fire truck indicated that they had no ladder. A 24' expandable ladder is reconmended as equipment on the truck. Bids have been received from Monticello Merc for $146.99 and Sears for $259.99. A motion to approve the bids from Monticello Merc for $146.99 was made by Catmissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Revolving Loan Fund Guidelines - The Commission reviewed and discussed the guidelines for the San Juan Revolving Loan Fund. The Commissioners felt that in any situation where the County has the opportunity to choose between two competing and otherwise comparable developments or loans that priority would be given to San Juan County residents or tax payers. It was decided to have a 6 member Loan Administration Board consisting of two elected officials, two business people , one financial officer and one accountant. Individuals were suggested to serve on the LAB board. A motion to approve the guidelines with the changes on the board members and to add the item of priority given to San Juan County residents was made by Catmissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

The following names were suggested as possible LAB board members: Ron Johnson as the financial officer, Kenneth Bailey and Mark Maryboy as elected officials, Dale Black and Keith Black as businessmen and Phil Acton as the accountant. A motion to appoint the suggested people to act as the LAB board pending their acceptance was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Ambulance Service Supplies - Commissioner Bailey made a motion to approve the purchase of the following items for the ambulance service: Head immoblizers/spine board for $1,167.00, Adult CPR Training Manikin for $1,365.00, Child CPR Training Manikin for $401.20, Slides and Training Tape for $1,000, for a total of $3,933.20. Catmissioner Maryboy seconded the motion. UNANIMOUS.

Ken's Lake Ordinance/Public Hearing - A public hearing was convened at 3:00 for the purpose of making comments on the proposed ordinance governing the activities at Ken's Lake. There were no comments forthcoming. No action will be taken at this time as another hearing is scheduled to be held in Moab at 7 p.m. tonight. The issue will be placed on the agenda for next week for final action.

Amended Beer Ordinance/Sunday Sales - A public hearing was convened at 3:30 for the purpose of considering

an ordinance to repeal section 3(1) of County ordinance 1983-1 (amended 1988) to allow for the sale or

consumption of an alcoholic beverage on Sunday.

Section 3(1) prohibits the sale or consumption of alcoholic beverages within the unincorporated areas

of San Juan County on Sundays. The proposed change will allow for Sunday Sales and will read as follows:

(1) Sale or Distribution of Beer Between Certain Hours, Unlawful. It is unlawful for any licensee, operator, or any employee thereof to sell, dispose of, give away, or deliver any beer or to permit the consumption of any alcoholic beverage on the licensed premises between the hours of 1:00 o'clock a.m. and 8 o'clock a.m. on any day, except that, during the calendar period of May 1 through October 31st of any year, both dates inclusive, the

hours of unlawful operation shall be between the hours of 2:00 o'clock a.m. and 8:00 o'clock a.m. of said day.

The comment was made that the sale of alcoholic beverages on Sunday would be advantageous for tourists to be able to get an alcoholic beverage with a meal or to continue with the enjoyment of their vacation.
