MINUTES OF THE BOARD OF COUNTY COMMISSIONERS MEETING HELD

JANUARY 18, 1982

Time: 10:00 a.m. in the Commissioner room of the San Juan County Courthouse.

Members Present: Chairman Calvin Black, Commissioner Robert Low, and Commissioner Kenneth Bailey.

Minutes of the previous week were read and approved upon the motion of Commissioner Low and the second of Commissioner Bailey and it carried unanimously.

MONTICELLO URANIUM MILL TAILINGS REMEDIAL ACTION PROJECT;

The following representatives met, by appointment, with the Commission to explain the U.S. Department of Energy Surplus Facilities Management Program, Monticello Remedial Action Project: Mr. Alvin E. Rickers, Director, State Division of Environmental Health Mr. William Lund, Utah Geological & Mineral Survey Mr. Larry Anderson, State Division of Environmental Health

Mr. Wayne Gisler, Project Manager, Bendix Field Engineering Corporation, DOE Contractor Mr. Robert L. Furlow, Director, Southeastern Utah District Health Department Mr. John G. Themelis, Director, Engineering & Safety Division, U.S. DOE, Grand Junction, Colorado

Mr. Themelis explained that environmental and engineering studies will be conducted during 1982 to identify and evaluate remedial action options for the inactive mill tailings piles at Monticello, and to determine the most appropriate remedial action, whether it be stabilizing the tailings where they are presently located or moving them to a new disposal location in the area. There are approximately 72 acres containing 2 million tons of tailings material, and 40 to 50 properties to be evaluated in the vacinity of the mill-site. It is estimated that project costs could run as high as $30,000,000 over the next 10 years if the tailings must be relocated.

Mr. Lund described the rock formations of the Monticello area and explained that the tailings are presently deposited in the Mancos Shale formation.

Chairman Black asked if there had been any studies done on the amount of radon in the San Juan County area, and if there was any evidence that radon, by itself, is a health hazard. In response, Mr. Rickers and Mr. Anderson indicated that no studies had been conducted in this area, nor were there studies conducted with radon, in particular, because the levels of radiation are small. They stated that while there are no documented injuries or deaths due to such small amounts of radiation as would be associated with radon and its daughter products, the Utah Department of Energy feels it is prudent to reduce further exposure to the public.

The Commission was in agreement with the need for more thorough studies being carried out in the coming year, but they expressed concern regarding possible further contamination if the tailings were dug up and relocated, along with the possibility of industrial accidents associated with relocation operations. The vast amounts of time and money involved in any relocation project was disturbing to the Commission, as they felt the funds would be better utilized in other endeavors.

Also present to participate in the discussion were Monticello City Mayor, Keith Redd, and Public Health Sanitarian, Wayne Ball.

BUILDING PERMIT PROCEDURE DISCUSSED:

The Commission assured Mr. Wayne Ball and Mr. Robert Furlow that with the recent signing of the new Building Permit Agreement between the County and Southeastern Utah District Health Department, that it was not the Commission's intention to change any of the previous policy procedures. The Clerk's Office will continue doing the bookkeeping and reports associated with the issuing of building permits.

PHONE SYSTEM FOR HEALTH OFFICES DISCUSSED:

Mr. Robert Furlow, of the Southeastern Utah District Health Department, discussed the possibility of obtaining a separate phone system for the Public Health, Mental Health, and Social Service Departments located in the Courthouse. It was felt that the present phone system was not meeting their needs and he would be willing to ask the other departments involved if they would help absorb the costs of installation and maintenance of a more adequate system.

B.I.A. MEMORANDUM OF AGREEMENT FOR ROAD MAINTENANCE SERVICES SIGNED:

Commissioner Bailey make a motiom to approve the Memorandum of Agreements between San Juan County and the Bureau of Indian Affairs, Navajo Office, for participating in road maintenance on the Reservation and authorize Chairman Black to sign the agreements. The motion was seconded by Commissioner Low and it carried unanimously.

OFFICE OF RECOVERY SERVICES CONTRACT AMENDMENT APPROVED:

Commissioner Low moved to approve the Contract Amendment from the Office of Recovery Services making the incentive payment for the child support enforcement program based on an equal 50/50 split of the total incentives due, and authorize Chairman Black to sign the Contract Agreement. The motion was sec-onded by Commissioner Bailey and it carried unanimously.

LAW ENFORCEMENT TRAINING RESOLUTION REGARDING JEFFERY HUNT APPROVED;

Commissioner Low moved to approve the resolution wherein Jeffery E. Hunt agrees to remain in the employ of the County as a law enforcement officer for a period of at least one year from the date of completion of law enforcement training or pay to the County $1,000 which amount having been expended for his train-ing. The motion was seconded by Commissioner Bailey and it carried unanimously.

SOLAR HEATING APPROVED FOR BLAND1NG POOL SHOWERS;

Commissioner Bailey moved to approve the contract with Chamberlain Construction & Mfg., of Blanding, for three County pool controls at $250ea.;

and a solar collector and hot water shower system for the Blanding Pool at $6,300. The motion was sec-onded by Commissioner Low and it carried unanimously. The Contract was signed by Chairman Black.

SOCIAL SERVICE DETOXIFICATION AGREEMENT APPROVED;

Commissioner Low moved to approve the Department of Social Service Contractual Agreement with the County to use the detoxification center at the San Juan Hospital; and authorize Chairman Black to sign the Agreement. The motion was seconded by Commissioner Bailey and it carried unanimously.

U.N.D.C. REQUESTS WEATHERIZATION FUNDS DIRECTLY FROM THE STATE; Mr. Al Haskins reported that the U.N.D.C. would like to get weatherization funding directly from the State rather than from SEUCAP. The Commission felt that this would not be advantageous as the funds from the State could only be used on the Reservation.

GEORGE BARRY RECOMMENDED FOR MONTICELLO DISTRICT FOREMAN;

Road Superintendent, Bernal Bradford, recommended that Mr. George Barry be hired as the Monticello Dist-rict Foreman at a starting salary of $1,675 per month. Mr. Barry would be on a three month probation, with sick leave and vacation time accumulating from the day he is hired.

RECREATION FUNDS POLICY FOR OUTSIDE FUNDS RECEIVED;

The Commission agreed that any recreation funds generated from outside sources, such as a grant, will go into the Recreation Fund and will not be credited to any of the project participants on a percentage basis. Each participant will still be required to contribute their respective percentage as agreed.

COMMISSIONER BAILEY REPORTS ON ROAD MATTERS;

Commissioner Bailey reported that, in the past, project charges have been made to the Collector Road budget that were not authorized Collector Road projects. Mr. Doug Peherson is working to correct this situation before the Utah State Department of Transportation meeting, January 28, 1982.

Commissioner Bailey also reported that Mr. Ron Dickemore, of the Forest Service, informed him that the County has been given permission to use the rock on the Johnson Creek Road.

PAY RAISE FOR MARY JANE ROSE:

Upon the recommendation of the Clerk's office, Commissioner Low moved to approve a pay raise for Mary Jane Rose from step 1.1 to 1.2. The motion was seconded by Commissioner Bailey and it carried unanimously.

There being no further business for this day, the meeting was adjourned at 1:30 p.m.
