SAN JUAN COUNTY COMMISSION MINUTES APRIL 18, 1988
The regular session of the San Juan County Commission convened at 10:00 a.m. at the San Juan County Courthouse in Monticello, Utah.

A group of boy scouts met to observe and take notes on the Commission meeting for a requirement for their Citizenship in the Community Merit Badge. The boys were: Jim Harris, Brad Randall, Brian Adams, Brad Bunker, Aaron Bronson, Don Coleman and Chris Bennett.
A motion to approve the minutes of April 11, 1988 as corrected was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.
COMMISSIONER KENNETH BAILEY'S REPORT
Moab Valley Fire District - The Moab Valley Fire District has requested participation by San Juan County in the purchase of fire equipment that would serve the Spanish Valley area which is part of San Juan County but served by Grand County. Commissioner Bailey will check with the Moab Valley Fire District to see if they were saving funds for fire equipment prior to San Juan County's contributing to the mill levy agreement with Grand County. Some of the residents expressed concern because they have been told that if there are simultaneous fires in San Juan and Grand County, the fire crew will respond to the fire in Grand County first. Commissioner Black stated that if San Juan County is paying the same amount to Grand County as their mill levy and if we participate in other funding, there shouldn't be that differentiation. Gibbons Furnace Billing - Gibbons Furnace had submitted a bill for work they claimed to have completed at both the Blanding and Monticello libraries. A letter had been written asking for an itemized billing as the work had not been authorized by the Conmission nor was the work performed satisfactorily. The response to the letter was just a demand for payment. Comnissioner Bailey indicated the bill will not be paid until the itemized information is received.
Paiute Creek Bridge - Commissioner Bailey reported that County Surveyor Doug Pehrson sent a request to Creamer & Noble to submit a proposal for preliminary engineering on the Paiute Creek Bridge. The engineering would include all that is necessary up to and including bidding the project. San Juan County would have the option to do the archaeology and to acquire the right of way.
Sweepers/Courthouse/Public Safety Building - Commissioner Bailey got some information from the school district on hiring sweepers for County Custodian Dell Hunter to work up a system on handling custodial employees at the Courthouse and Public Safety Building.
Dove Creek Medical Clinic - Commissioner Bailey and Hospital Administrator John Fellmeth met with the Dolores County Health Care Board concerning the replacement of the nurse practitioner and funding of the Dove Creek Medical Clinic. Over the years the clinic has been operated on a grant from Rural Health Service. The clinic has been able to hire a part-time doctor and a nurse practitioner. The present nurse practitioner is leaving. In order to sustain the funding, the Health Board indicated that they need to be tied closer to a primary provider. Mr. Fellmeth indicated that San Juan County Hospital would be interested in cooperating as the primary provider for the clinic. Dolores County Health Care Board will check further and let Mr. Fellmeth know what more will be needed on the grant application. Public Safety Building - Commissioner Bailey made a motion to pay $4,882.13 to Delta Geotechnical for the structural distress study on the Public Safety Building. Commissioner Maryboy seconded the motion. UNANIMOUS. This study is being coordinated with County Attorney Craig Halls and additional tests may be required to establish responsibility for problems at the facility.
Oljato Bridge - The County is proceeding with the archaeological study on the Oljato Bridge to clear the right of way. Once the archaeological study is completed the County will work with the Navajo Tribe to get the right of way.
Paiute Farms Road - Commissioner Bailey reported that dust guard materials will be obtained to complete two miles on the Paiute Farms road.
Surveyor - Blazer - A crew-cab pickup to replace the old one in the Surveyor's Department cannot be obtained as this model has been discontinued. County Surveyor Doug Pehrson has decided he would like to purchase a Blazer instead. The Commission authorized Commissioner Bailey to procure the needed bids to purchase the Blazer.
Oljato to Navajo Mountain Road - Fred Polenz of the Navajo Economic Development Council in Window Rock spoke to Commissioner Bailey regarding the road between Oljato and Navajo Mountain. He is well aware of the Paiute Farms Marina and the need for it to be relocated and is concerned about the road. A meeting with a representative of the national BIA indicated concern for infrastructure on the reservation for community and economic development. The County has asked Representative Howard Nielson for help to get a special appropriation for the engineering of the Oljato to Navajo Mountain Road. Commissioner Bailey will send Mr. Polenz a copy of his letter to Representative Nielson and any information that County Surveyor Doug Pehrson has on the road. Mr. Polenz will send the information on to the Washington BIA office to help Representative Nielson obtain the appropriation. Commissioner Black suggested that a letter also be prepared to Senator Garn, with copies to Senator Hatch, Representative Hansen, and Representative Owens asking their support on this issue.
Lake Powell Ferry Schedule - Commissioner Bailey showed the Commission a copy of the Lake Powell Ferry Schedule and reported that it has been distributed and is available for tourists at various businesses. Road Department Employees - George (Eddie) Barry had previously been approved for employment as a heavy equipment operator with the San Juan County Road Department
on April 4, 1988. His salary will be based on grade 10 step 1 at $7.35 per hour effective April 4, 1988. Commissioner made a motion to approve the hiring of Jay W. Palmer as a light equipment operator for the construction crew at grade 9 step 1, $7.06 per hour and J. Edgar Clayton as a 6-month heavy equipment operator at grade 5 step 1, $6.02 per hour. Commissioner Maryboy seconded the motion. UNANIMOUS.
Commissioner Black commented that the road department needs to take advantage of the rain to grade county roads even if it is on a weekend. The employees can arrange to take time off on other days. Sane of the retired road department employees may be willing to work part-time to help with the grading on weekends.
Road Department Equipment - Bids for 2 1-ton overhead motorized trolley with 20' lift and chain bucket and 1 5-ton overhead motorized trolley with 20' lift and chain bucket were received from Frank's Supply for $10,000 delivered and from H.O.J. Engineering for $10f384 plus freight. A motion to approve the bid from Frank's Supply for $10,000 was made by Commissioner Bailey and seconded by Comnissioner Maryboy. UNANIMOUS.
Surveyor's Calculator and Survey Pac - Bids for a HP-41CX Calculator and Survey Pac were received from Holman's for $217 and Surveyor's Supply for $239.95. A motion to approve the purchase from Holman's for $217 was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.
COMMISSIONER MARK MARYBOY'S REPORT
Bluff Community Meeting - Ralph Horne and Jim Keyes met with the residents of Bluff regarding the mosquito problem. Mr. Horne recommended the purchase of a fogging machine and he will check on the prices and make a recommendation to the Commission.
Red Mesa Chapter Meeting - The residents of the Red Mesa area are concerned about the up-coming elections and registration. They would like to have the Democrat and Republican party chairmen attend a chapter meeting to explain their platforms and tell who the candidates are. Commissioner Black stated that those who voted in the elections since 1984 will still be registered. According to the law, those individuals on the registration books that have not voted in the past four years have been stricken from the record and the individual will need to re-register.
Road Priorities - The Red Mesa Chapter officials are also concerned about the priority roads in the Red Mesa area. Commissioner Black explained that all the roads submitted would not be on the priority list as the UNDC took the Utah
Chapters priority road list and made one priority list to submit to the County. The County is working on the roads as fast as they can get to them. One immediate problem is a turn-around area for a school bus
that needs to be graded.
COMMISSIONER CALVIN BLACK'S REPORT
Utah Department of Transportation Letter - The following letter was received from Samuel J. Taylor, Chairman of the Utah Transportation Commission:
Dear Cal, Ken and Mark,
Relative to the current highway construction project from Monticello north to the Canyonlands turnoff, it is my understanding that an additional $400,000 has been added to the project to eliminate the dangerous "S" curves at the bottom of the Peter's Hill segment.
In reviewing the project, I found that it was originally funded with highway rehabitation funding, which is confined strictly to resurfacing and upgrading existing roadways, and by law cannot be used for any major realignment. That project was in excess of $3 million, and the addition of passing lanes on the hill was done with state funds. The additional money to correct what we all agree is a bad situation, will also be done with state funding.
Thanks to a concerned citizenry from your county, we were able to catch the problem in time. I have received literally dozens of letters on the matter, as has our Director and the Governor's office. Since
I am currently dividing my time equally in thirds---one-third in my office in Moab, one-third in Salt Lake
City, and one-third on the road, I simply don't have the time to answer all those letters personally, even though I would like to do so. I would appreciate it if the sentiments expressed in this letter could be read into the minutes of one of your next commission meetings, so that those who took the time and effort to get in touch with me won't feel slighted that they did not receive a personal reply.
I think that by working together, we have been able to accomplish a whole lot the last few years in the way of roads and highways in Southeastern Utah, and I am pleased to have had a small part in that progress. It is always a pleasure working with you three.

Commissioner Black stated that this is a very good example of how one individual can really make a difference in seeing a problem and contacting the right people to correct it before it's made to where you can't correct it. Darroll Young saw a problem and contacted Commissioner Bailey, who in turn contacted Chairman Taylor. Several letters were written to the Department of Transportation and the Governor about the matter. Commissioner Black commended Commissioner Bailey and Mr. Young and all of the other people who took the time to identify a problem and go about it in the right way to get it corrected. Appreciation was also expressed to Sam Taylor from Moab who has done so much to help our transportation system, not only in southeastern Utah but clear across the State.
San Juan Area Resource Management Plan - Vaun Cox, chairman of the Salt Lake BLM Multiple Use Advisory Council, sent an interoffice communication to Commissioner Black in which another member of the council had expressed concern that the San Juan County Commission, mining, oil and gap, livestock and other interests are taking a short view of things when they oppose the San Juan Resource Management Plan. In his words, "They are not looking at the big picture." He said he feels users should stop viewing BLM as their big danger — while reserving the right to disagree — and either make a new attempt to work things out with the current BLM management or face something far worse. Commissioner Black will contact Mr. Cox and others on the council to express the County's concerns and "the rest of the story."
Utah Division of Indian Affairs - A resolution opposing the BLM Resource Management Plan has been received from the Utah Division of Indian Affairs and will be forwarded to Gene Nodine, District Manager for the Moab BLM office.
County Roads - Commissioner Black reported that residents along the Flour Mill Road are anxious to have improvements made on that road. Mr. Black told them that as soon as the County can get the right of way and the residents move their fences back the improvements will be made.
David Perkins Road - Mr. Perkins said the existing fence is not worth saving and that the County could go ahead and use a dozer to clear the fence out of the way and make the improvements on that road. Commissioner Black expressed a desire to have that road graveled and oiled this year.
Hovenweep Road - Commissioner Bailey reported that the crews are having problems with extremely hard rock in the Hovenweep project. The D8 dozer can't rip the rock and in it's present location dynamite can't be used because of a C02 line. Possible solutions are being looked at so this project can be completed.
ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT
CDBG Workshop - A mandatory workshop for those applying for Community Development Black Grant funds will be held May 6th in Moab or May 13th in Salt Lake City. Commissioner Black and Administrative Assistant Rick Bailey will attend the May 13th workshop in Salt Lake City.
EMT Appreciation - Administrative Assistant Rick Bailey presented a letter of appreciation to the EMT associations in San Juan County to be signed by the Commissioners. Commissioner Black commended the EMT's and stated that without the willingness and service of these volunteer professionals, it would be very difficult, if not impossible, to provide this service, which is one of the most important in the health care field.
Permanent Part-Time Employees - At the time of the cost of living increase, it was the Commission's decision not to give the permanent part-time employees a cost of living increase along with everyone else. That effectively eliminated them being able to be placed on the grade and step chart due to the fact that it had to be revised. Commissioner Black felt because the permanent part-time employees do not get the many other benefits given the full-time employees, the Commission ought to reconsider giving them a raise. BLM San Juan Area Resource Management Plan - A letter from James M. Parker of the National BLM office advised the County that the PMP protest had been reviewed and it was being returned to the Utah State
Director for further review and reconsideration. Mr. Parker stated that the County will have another opportunity to protest before the reconsidered plan is approved, should the County feel it necessary.
The Commission felt that our concerns of protest should now be put into recommendation form for changes and submitted during the comment period. Some of the user groups will be asked to meet with the Commissioners to plan some strategy about preparing their responses and recommendations to the BLM.
Commissioner Black felt each commissioner should write letters on each of the various elements; grazing, mineral leasing, no surface occupancy, highway corridors, VRM classifications, permanent recreation non-motorized classifications, critical habitation, then formalize a Commission letter from all of these letters and have other individuals write letters of recommendation for the plan on the various elements to be given to the BLM.
Hovenweep Resource Management Plan - Information has been received from the Utah Petroleum Association on the Hovenweep Resource Management Plan that will be helpful for the County, in formulating our comments. A letter of appreciation will be sent to Jim Peacock of the Petroleum Association for his excellent comments. Copies of Mr. Peacocks comments will be sent to various individuals and groups as an example of the types of comments that will be needed to be successful in making changes in similar plans. San Juan Water Conservancy District - At an earlier commission meeting Commissioner Maryboy had stated that Albert Mark of the San Juan Water Conservancy Board had not been receiving notification of the meetings. A letter received from Marsha Keele, secretary of the board, indicated that written notification or phone messages have been left at Mr. Marks office of each meeting. Attendance at these meetings is very important as pertinent business cannot be conducted without a quorum of the board members present.
Tax Limitation Initiative Petitions - The Commission discussed the effects on the county budget of the tax limitation proposals if they were passed. This information was requested by the Utah Association of Counties for their spring management convention to be held next week. The figures can only be estimates but the Commission felt they should be as accurate and realistic as possible. The property tax initiative would not allow the total tax to be more than 1%. In order to get accurate figures Administrative Assistant Rick Bailey was asked to get the average assessment on residential property from County Assessor Barbara Montella and the tax would be a percentage of that, which would probably be less than 1%. The Commissioners understand that the ad valorum tax on oil, gas and mining will not be affected. There will be two proposals on the tax limitation. What you'd have in increased property revenue would be only allowed to gain as your population and your income gains from the base period, which would really hurt counties that are poor. When you had an energy growth you wouldn't be able to fund the impact of that growth and then when you had a decline you wouldn't be able to continue some services after the decline. Fire Truck - Bluff Area - L.N. Curtis Company has a used fire truck that is being reconditioned. The cost, with all the equipment that is required under the fire codes plus the truck, would be between $18,000 and $20,000. It is a 1967 truck with approximately 70,000 miles on it. The Commissioners authorized Mr. Bailey to make a $500 deposit on the truck to hold it until a final decision can be made after further information is received.
Vehicle Bids/Communications - Bids for a vehicle for the County Communications Engineer Bill Bayles were: Mike Young, Inc., $13,331 and Tom Redd, $13,448. Commissioner Maryboy made a motion to approve the bid from Mike Young, Inc. for $13,331. Commissioner Bailey seconded the motion. UNANIMOUS. Utah Local Government Trust Health Insurance - The County belongs to Utah Local Government Trust for health insurance of which they are a member of the State Retirement Board, public employees group health plan. The County has to sign an agreement both for the hospital and the County. The county attorney has reviewed the agreement and recommended that it be signed. A motion to approve and authorize Chairman Black to sign the agreement was made by Commissioner Bailey and seconded by Commissioner Maryboy.

EMT Jackets - Administrative Assistant Rick Bailey presented a jacket designed by a Dolores man that would give the EMT's protection as well as visibility, especially when they are working at night on the highway. The coat would be made of a breathable fabric that is water proof and has some acid resistant qualities at a cost of approximately $100 per coat. Mr. Bailey suggested three proposals for obtaining the coats: (1) the County could purchase the coats and keep them as property of the County, (2) the cost would be shared by the county and the individual with the individual keeping the coat, (3) purchase six or eight coats of various sizes of each ambulance for use when needed. The Commission authorized Mr. Bailey to complete the negotiations and make a more definitive proposal.
CURRENT BUSINESS
County Attorney Craig Halls - County Attorney Craig Halls reported that James Schermerhorn, attorney for the United States Justice Department, will be here on Thursday to review the voter records that were purged.
Vfeed and Rodent Department - Bids were received for weed control chemicals from Intermountain Farmers for $4,944.35 and Steve Regan for $5,191.46. Commissioner Bailey made a motion to approve the low bid of $4,944.35 from Intermountain Farmers. Commissioner Maryboy seconded the motion. UNANIMOUS.
Recreation Department - Bids were received for 400' #6 bare copper wire, 1000' #10 insulated copper wire, 430' 1/2" EMT conduit rain tight and 2 hole straps from Gray Bar Electric for $268.51 and Amfac for $374.29. A motion to approve the bid of $268.51 from Gray Bar Electric was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.
Bids for a 10hp pump and motor for the Bland ing Golf Course was received from House of Pumps for $901.00 and W.W. Granger for $940.00. A motion to approve the bid of $901.00 from House of Pumps was made by Commissioner Maryboy and seconded by Commissioner Bailey.
Road Department/10-wheel Dump Trucks - The original bid was for an autocar truck with engine and power train for $53,999. The truck that was brought down for trial from Great Basin was very similar to the truck that was bid. It had more options on it and therefore cost a little more. It had a 364 hp engine as opposed to the 300 hp bid. It had air conditioning and the bid truck did not. It had a heavier front and rear axel, and some other smaller options that in the judgment of Commissioner Black made a better truck for the Countys' needs at a very competitive price. It also had air to back on the frame so a pup could be pulled. The dump bed was already on it with side boards, a special braced tail gate, 180,000 psi floor, and the dump cylinder mounted in front of the dump bed rather than caged within it. These cost an additional $924 more than the original bid. The bid truck was bid with 10.100.22 tires and would have been changed to 11R24.5 tires. Great Basin also agreed to change the hydraulic system so that it will accommodate snow plow attachments at no additional cost. The total cost will be $68,780 per truck with the dump bed. With the power train on the Volvo engine, they give you a 500,000 pro-rated warranty. If the County had gone with a Cat engine, as originally discussed, it would have cost an additional $3,000 and $500 for a similar warranty. All of the original bids were compared, adding the optional features at market value and Great Basin was still the low bidder. Commissioner Bailey made a motion to accept the truck as agreed with a second truck rigged with identical specifications. Commissioner Black seconded the motion. UNANIMOUS. There will be one truck placed in each district. Commissioner Black stated that there are several old County trucks that will be disposed of and not replaced. Any additional bob-tail body load and belly dump trucks will be contracted as needed.
Montezuma Creek Project - Major Henderson and Captain Atcitty of the Navajo tribal police delivered a letter from Andrew Benallie, Executive Director of the Navajo Division of Community Development, stating
their commitment of $20.000 towards the Montezuma Creek Project. The next step on the project is to have the engineering completed for the remodeling of the police station so the bid can be let.
