SAN JUAN COUNTY COMMISSION FEBRUARY 17, 1987

The San Juan County Commission met in regular session on February 17, 1987 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Bailey, Acting Chairman

Commissioner Maryboy

Minutes of the February 9, 1987 Commission Meeting were approved with the corrections on the motion of Comnissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

COMMISSIONER CALVIN BLACK

Commissioner Black was in Salt Lake today.

COMMISSIONER KENNETH BAILEY'S REPORT

Caterpillar Graders - Commissioner Bailey said that the two Caterpillar graders the county purchased from

Wheeler Machinery are too short for anyone to stand up in. Commissioner Bailey talked to Bob Kaelberer of

Wheeler Machinery on the phone about re-ordering the graders with taller cabs. Comnissioner Maryboy made

the motion to approve the re-ordering of the two new graders. Commissioner Bailey seconded the motion.

UNANIMOUS. The total cost will be $3000 more to get the taller cabs.

Gravel Test Pits at Bluff - Commissioner Bailey said that the test digging of the gravel pits in Bluff

will be finished today. Commissioner Bailey said that Gary Crowley was in the area with his back hoe and

did the digging for the county for a good price. The road department will need quite a few gravel chips

for the Cahone Mesa road.

Commissioner Bailey said he will review the bid specs for gravel crushing with Craig Halls, county

attorney, before advertising for bids.

UDOT Annual Visit - The UDOT Annual visit to the county is Thursday Feb. 19 at the courthouse. Some of

the items that will be discussed are the Federal Aid Secondary Roads, curb and gutter at Montezuma Creek,

the Paiute Farms Marina Road, the Oljato Wash Bridge and the flashing yellow light at Montezuma Creek.

Sprinkling System at the Blanding Golf Course and Monticello Baseball Fields - Commissioner Bailey said

that Doug Pehrson, surveyor, will survey the Blanding Golf Course and Monticello Baseball fields so that

designs can be drawn for installing new sprinkling systems.

Archeological Sites - The following letter was received by the Commission:

COMMISSIONER MARK MARYBOY'S REPORT

Navajo Tribal Police Director - Comnissioner Maryboy reported that the new Navajo Tribal Police Director

is William Kellogg. Comnissioner Maryboy said that Mr. Kellogg will meet with him, Chapter officials from

Aneth and Red Mesa and Sheriff Lacy in Aneth on February 24 to discuss cross-deputization.

Aneth Chapter Meeting - Comnissioner Maryboy said he attended the Aneth Chapter meeting last Sunday. A

request was made to install a flashing yellow light at Montezuma Creek elementary school. Comnissioner

Bailey said this is a state highway and will discuss this matter at the annual UDOT meeting this Thursday.

Comnissioner Maryboy said that two resolutions were presented and passed. The first was a resolution to

clarify the 168 acres of accretion land by the Bluff mission. According to the people, they are not

receiving any services from the Tribe simply because the title of the land is not clear as to whether it

belongs to the Tribe or not. But according to the executive order of 1884 the land was given to the

Navajo Tribe. The people will contact the BIA and the Navajo Tribal Land Administration to look into this

matter. The second resolution was concerning the grazing rights given to some families in the Aneth area

in 1940 allowing them to graze their livestock on private land. The livestock are now being impounded for

trespassing on BLM land and land the permittees feel they have grazing rights on.

At their next meeting the Chapter will propose a resolution approving the county's authority to continue

taxation of oil companies on the reservation.

Fairboard Meeting - Comnissioner Maryboy reported that he attended the Fairboard meeting last Friday.

They plan to have a rodeo on August 13,14, & 15 in connection with the county fair. The rodeo will be

sanctioned by the Rocky Mountain Rodeo Association and they will also try to combine it with the All

Indian Rodeo Cowboy Association. A request was made by the board to the Commission to have the gravel and

stones cleaned up at the rodeo arena. Comnissioner Bailey said he will discuss this at the road meeting

next Monday.

Historical Meeting - Comnissioner Maryboy reported on the Historical Meeting he attended last week. The

board requested that they have an office at the Monticello Library. There is money available in the

budget to renovate the space above the senior citizen center. Comnissioner Bailey said he will get

quotations on cutting a door into this area for next week.

UNDC Board - Road List - Comnissioner Maryboy said the UNDC board approved the road from Red Mesa to

Yellow Point over to White Mesa. UNDC will be submitting a priority road list to the Commission.

Comnissioner Bailey said the materials are ready at the Clyde Pit, west of Montezuma Creek, to armor coat

two miles west of Red Mesa but the county needs written pre-approval from UNDC before they can do this

project.

Human Services Board Member - Rick Bailey said there isn't anyone from Montezuma Creek serving on the

Human Services Board. Comnissioner Maryboy said he would find someone to serve on this board.

GRAVEL CRUSHING - COUNTY POLICY BIDDING

Jerry Holliday and Finley Bayles met with the Commission concerning the gravel crushing that has been done by Skeleton at Lem's Draw. Mr. Holliday said the Commission did not follow the county's bidding policy and advertise for bids. The Commission approved payment to Skeleton 30 cents more than the original contract price to crush an additional 1-inch gravel. Mr. Holliday said the public should have been able to bid on the gravel crushing. Commissioner Bailey said it was in the best interest of the county to go ahead and have the gravel crushed while Skeleton was there. Commissioner Bailey said it was discussed at the road meeting this morning and there will be no more crushing at this pit at the present time. The county is looking at finding another gravel pit. Mr. Holliday stated that he felt that bidding for price on hired trucks would save the county money.

HILL-BURTON OBLIGATIONS - HEALTH CARE

Rick Bailey, Administrative Assistant, reported that he talked to Ted Stagg, CPA developer, about the Hill-Burton Obligations. The Commissioners prefer that the county keep the Hill-Burton obligations and transfer this free-care service to all areas of the county's health services, ambulance, and others.

PUBLIC SAFETY BUILDING

Bonds - Rick Bailey, Administrative Assistant, said he met with the county's bond attorney last week

concerning the closing of the bonds on the public safety building. The closing date for comments on the

bonds is Feb. 21. Mr. Bailey said he received the contract for the $1.9 million grant today and will have

the county attorney review it before the Commission signs it.

Fencing - The Commission reviewed the fencing drawings with Mr. Bailey.

Empire ELectric Poles - Commissioner Bailey asked Mr. Bailey about the electric poles that need to be

installed by Empire Electric. Mr. Bailey said that John Peterson, architect, said they will work with

Empire on this matter.

Cinder Blocks - Commissioner Bailey discussed the cinder blocks that are to be used for the building.

LIABILITY SAFETY MEETING

Rick Bailey, Administrative Assistant, said that the county's liability carrier will hold a safety meeting in Monticello on March 10 at 9 a.m. Mr. Bailey said their presentation will last from two to three hours and he would also like to have someone come and speak on fitness and stress in the work place. A memo will be sent to all department heads announcing this meeting. Commissioner Bailey said that he would like all the employees of the road department and sheriff's office to attend this meeting.

COMMUNICATIONS REPEATER - MONTEZUMA CREEK

Rick Bailey reported that he talked with Fritz Mueller of the UNDC Health Dept. last week. UNDC is interested in installing a repeater on the south side of Montezuma Creek (which is on the Navajo reserva-tion) that would hit off the repeater on Abajo Peak. Mr. Bailey said he discussed this with Bill Bayles, communication engineer, and they both agree that the county should install two repeaters (VHF & UHF). The county has not been able to communicate with the Tribe on the radios because the county is on VHF and the Tribe UHF. If both repeaters were installed this would increase ambulance and police communications with the Tribe. The Commission agreed and instructed Mr. Bailey to work with Mr. Bayles and UNDC on this matter.

RURAL COMMUNITY FIRE PROTECTION GRANT

Rick Bailey presented the Commission the Rural Community Fire Protection Grant program. If approved, the state will match 50% of the county's requested funds for fire equipment.

GRAVEL BIDS OPEN AT 2 P.M.

Bids were open at 2 p.m. for a gravel crushing pit near Blanding. The following bids were received: Calvin Black proposed to sell gravel at 25 cents per yard of produced gravel. Jerry Holliday Construction proposed: Bank run in place - less top soil at 40 cents per yard and/or cleaned gravel measured in stock pile at 75 cents per yard.

Doug Pehrson, surveyor/engineer, said the BLM has agreed to let the county have a permit on 19 acres north of Lem's Draw if the tests show the gravel to be good. There is an archeological site on this land that will have to be medigated before the county can get a permit. Mr. Pehrson said the BLM is willing to let the county dig trenches to test the area with the supervision of an archeologist. The BLM is also checking to see if there are any mining claims on this area. Commissioner Bailey said the county's two options for a gravel pit are; one, acquire the permit from the BLM for the 19 acres near Lem's Draw, and two, buy gravel from Calvin Black who was the lowest bidder. The Commission told Mr. Pehrson to have the trenches dug as soon as possible and if the gravel tests are good then work with the BLM on getting the permit.

BIDS - ROAD DEPARTMENT

The following bids were approved by the Commission: Stan Bonham Co, for model C-36 RS roofers special self propelled 5 hp engine - 36" brush std. etc. for $1575. This was the only source of supply on this item. Other inquires did not respond.
