MINUTES OF THE BOARD OF COUNTY COMMISSIONERS' MEETING HELD IN REGULAR SESSION ON MONDAY, THE 17th DAY OF AUGUST, 1970:

PRESENT: Marion H. Hazleton, Chairman

Calvin Black, Member

Harold C. Young, Member

Meeting opened at 10:13 A.M. with Commissioner Hazleton in the Chair.

Minutes of the previous meeting were read and Commissioner Black moved to approve them. Commissioner Young seconded and approval was unanimous.

JEEP POSSE REQUEST OLD RECREATION JEEP:

The Sheriff's Patrol requested that the old Recreation Jeep be given to them, to be fixed up by them and auctioned off during Deer Season. Commissioner Young motioned for approval of their request, Commissioner Black seconded, and approval was unanimous pending confirmation of legality of this transaction by County Attorney.

RENEWAL OF TUBERCULOSIS CONTRACT:

The TB Contract for the fiscal year 1970-71 was presented. Commissioner Black motioned for approval, Commissioner Young seconded, and approval was unanimous.

GEYSER PASS TO BUCKEYE RESERVOIR ROAD:

Richard Auble of Utah Wildlife Federation and Dan Winbourne of Utah Fish & Game met with the Commission to protest the closing of the road from Geyser Pass to Buckeye Reservoir. Hardy Redd had pushed up dirt mounds and passage was impossible at the time Mr. Auble and Mr. Winbourne toured the road over the week-end. These roads are on the B-Road system and will continue to be maintained by the County . If Redd's protest, a public hearing will be held.

A number of protest were received from the citizens of Grand County. These are on file in the Clerk's office.

Representative Alfred Frost met with the Colorado Highway Patrol and Tax Commission and in return they met with the Utah State Highway Patrol and State Tax Commission over weight of vehicles in both states. An agreement will be made making reciprocity available in both States up to 28,000 pounds.

WELFARE BOARD MEMBERS APPOINTED:

The terms of James Crowley (3/31/70), Alma J. Redd (3/31/67), Sam Capitan (3/31/70), having expired,

the Welfare Board appointed Arlow Freestone (3/31/76), Herma C. Johnson (3/31/73), and Mrs. Jennie Benally,

(3/31/76), to replace them. Robert Billy was reappointed for an additional six year period.

P. & I. AID REQUESTED:

The County Attorney met with the Commission to request $25.00 to $50.00 from the P. & I. Fund to aid in moving Allie McQuire to Grand Junction, Colorado. This was approved by the Commission.

ROAD RAISES:

Raises for members of the road crew effective Aug. 25, 1970: Michael Jaramillo - 2.59 hr.; Bill Maloy - 2.59 hr.; and Allan Tracy - 2.59 hr.

LAND APPLICATION:

Ervin Palmer submitted an application for a piece of land believed to belong to San Juan Co., and located in the extreme eastern part of Blanding. Land will be checked out by th Southeastern Utah Title Co. and a decision made later.

ORDINANCE GRANTING FRANCHISE 1970-2

An Ordinance franchising Navajo Communications Company, Inc., Drawer 429, Grand View, Texas, 76050, or its Assigns to acquire and continue present telephone service in that portion of San Juan County within the boundaries of the Navajo Tribe Reservation and defining its rights, powers, and privileges.

Be it ordained by the Board of Commissioners of San Juan County as follows:

Section I. That Navajo Communications Company, Inc., Drawer 429, Grand View, Texas, 76050, be and is hereby granted the non-exclusive right, power, authority, and privilege to acquire and to continue the present telephone service in that portion of San Juan County within the boundary of the Navajo Tribe Reservation, and in particular to the Aneth School and the Navajo Mountain School and Trading Post with future exchange facilities at Aneth, Utah, as particularly described in its application to the Public Service Commission of Utah for a Certificate of Convenience and Necessity, now pending.

Section II. If said Navajo Communications Company, Inc., should obtain a Certificate of Convenience and Necessity from the Utah Public Service Commission it is hereby given the right and power to conduct such a telephone service as may be specified in such Certificate.

Section III. The Navajo Communications Company, Inc., or its Assigns, shall within 60 days after the passage, approval, and publication of this Ordinance, file a written acceptance of this Ordinance with the Clerk of San Juan County, and, in the event that it does not, within one year of the passage of this Ordinance, receive a Certificate of Convenience and Necessity from the Public Service Commission of Utah, as above described, all the rights and privileges hereunder shall cease.

Section IV. This Ordinance and the Franchise hereby granted shall be in force and in effect for such a period of time as the Company shall have a Certificate of Convenience and Necessity from the Public Service Commission of Utah.

This Ordinance is adopted at a regular meeting of the Board of Commission of San Juan County, held July 27, 1970 with all members of the Commission voting in favor thereof.
