MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD

AUGUST 16, 1982

Time: 10:00 a.m. in the Commissioners Room at the Monticello Courthouse.

Members Present: Chairman Calvin Black, Commissioner Robert Low and Commissioner Kenneth R. Bailey.

Minutes of the previous week were read and approved upon the motion of Commissioner Low and the second of Commissioner Bailey and it carried unanimously.

MONTICELLO CHAMBER OF COMMERCE CONCERNING 24TH OF JULY CELEBRATION:

Representatives from the Monticello Chamber of Commerce met with the commission concerning the 24th of July Celebration and possible solutions to working out conflicts in scheduling. The Commission recommended that the Chamber meet with the Recreation Board as they have the responsibility for establishing the policies of the county recreation programs, and facilities.

NUCLEAR REPOSITORY REPORT:

Chairman Black reported that the Friends of the Earth rally scheduled for August 23rd has been changed to an all day tour of Canyonlands guided by Tag-a-long Tours. The Commission received an invitation to participate in the tour, but felt it best to decline at this time as the tour is to be held on a regular commission meeting day.

Commissioner Bailey reported on a recent KSL-TV editorial on nuclear power. The Commission telephoned KSL-TV and requested a video copy of the editorial.

FAIR FIREWORKS;

Chairman of the Fair Board, Everett Johnson, reported to the Commission that the Fair Board would like to have a small fireworks display at the closing of this years County Fair. The Commission authorized a fireworks display, not to exceed $350.00, provided no animals would be present and the Board received clearance for the County Fire Warden and City Fire Department.

MONTICELLQ STREET PROGRAM AND SCOUT HUT DISCUSSED;

Monticello City Manager, Rick Terry, explained why the street by the grade school was not on the road program, and that the City is working with Empire Electric Company to have an electric pole on the street moved so that the road can be improved.

Mr. Terry also discussed the location of the proposed Scout hut, near the Monticello pool and baseball complex. He reported that the City Council will be making an official request for land for the Scout hut in connection with a Circle Park land exchange with the County.

REPRESENTATIVE HARDY REDD MEETS WITH THE COMMISSION:

State Representative Hardy Redd met with the Commission to learn more about the Initiative Petition and proposed beer Ordinance. He was informed that the proposed Ordinance will be on the November ballot for a public vote. The Commission and Representative Redd discussed current issues of concern to the County such as the development of a LaSal Cemetery District, the proposed spent nuclear fuel repository, the county's appeal to the State Tax Commission concerning the .49 additional tax levy, and funding for a ferry at Hall's Crossing.

SAN JUAN FOUNDATION REQUESTS B.L.M. LAND:

Mr. Bruce Shumway reported on the San Juan Foundation's application to the B.L.M. for 120 acres of land adjacent to the west boundary of Blanding for the development of an outdoor educational and cultural complex. The Commission approved and signed a letter to the B.L.M. area director in support of the Foundation's application.

BILL HOWELL MEETS WITH THE COMMISSION:

Mr. Bill Howell, executive director of the Southeastern Utah Association of Governments, met with the

Commission at 11:30 a.m. Mr. Howell presented the Association's projected budget for FY 1983. It had

been proposed that the Association operate with a minimum Administrative staff, but Mr. Howell explained

that a reduced staff could not handle all the proposed programs for the coming year. Mr. Howell explained

that there is adequate funding and no program will be in jeopardy.

Mr. Howell and the Commission discussed the annual SEU-AOG meeting with their State Legislators. It was

agreed that September 20, 1982 would be a good day to schedule the meeting.

FOREST SERVICE MEETS CONCERNING ROAD TO DEVILS CANYON CAMPGROUND ROAD:

Forest Service representatives, Sue Dwight , Ted Fitzgerald, and Mike Smith met with the Commission to solicit the County's participation on the project to restore the pavement on Devil's Canyon Campground Road. Chairman Black requested that the Forest Service contact the County Attorney regarding the legality of the county doing the work. If it is in accordance with the law, the Commission authorized Commissioner Bailey and Bernal Bradford to work with the Forest Service on the project.

Mr. Fitzgerald discussed the deterioration of the LaSal Loop Road. The Commission reconfirmed that it is not a high priority road for the county at this time.

BLANDING STREET DEED SIGNED;

Upon the motion of Commissioner Bailey and the second of Commissioner Low it was unanimously voted to approve and authorize Chairman Black to sign the Deed conveying to the City of Blanding three parcels currently in the name of the County on 2nd West Street. It is required that Blanding City have the title to the property before work can begin on the water line.

HEALTH CARE REPORT:

Commissioner Low reported that the utilization of the Monument Valley Hospital is declining.

The Commission discussed the appointments for the Mental Health Board and Commissioner Low will bring specific recommendations to the meeting next week.

ROAD SHOP ELECTRICAL SERVICE:

It was agreed by the Commission to approve an application for the electric service to be changed to

three phase to the County Road Shop. The application was then signed by Commissioners Bailey and Black.

BLUFF AIRPORT AND BIG INDIAN ROADS: RIGHT-OF-WAYS;

Commissioner Bailey moved to authorize Doug Pehrson to act as the authorized

County agent to respond to the B.L.M's request for the dedicated right-of-ways on the Bluff Airport

and Big Indian Roads. The motion was seconded by Commissioner Low and it carried unanimously.

VAL DALTON'S CULVERT PLACEMENT;

Commissioner Bailey reported that with the approval of Val Dalton, the County installed the culvert above Mr. Dalton1s ditch in a different location than he had previously requested at Commissioners meeting. The County Engineer is to request that Mr. Dalton sign a statement confirming his acceptance of the location of the culvert, that the culvert was installed according to his wishes, and he will accept future responsibility for any silting which may occur.

BLUFF TO MONTEZUMA CREEK ROAD FENCING DEFERRED:

Commissioner Bailey reported that the State Department of Transportation needs to know if the County

would like to fence the Bluff to Monitezuma Creek Road at this time. The Commission agreed it would

defer fencing of the project and reconsider it when it becomes a paved road.

Before releasing the bid specifications on the Bluff to Montezuma Creek Road, the State also needs to

know if the utility pipelines will be encased at the utility companies1 expense. Chairman Black

offered to contact the companies with pipelines that would be affected by the project and report back

for the State.

NURSING HOME STREET REQUEST FOR RIGHT-OF-WAY;

Commissioner Bailey reported that the City of Blanding has requested the right-of-way from the county for the street south of the Nursing Home. The city would like to construct a road there and the Commission was agreeable to this request.

DARROLL AND BENNIQN REDD REQUEST CULVERT MATERIAL;

Commissioner Bailey reported that Darroll and Bennion Redd have asked to buy culvert material from the County Road Department for covering a ditch. The Commission agreed that Darroll and Bennion Redd may purchase the culvert from the County at cost plus 10%.

BEER ORDINANCE DISCUSSED:

The County Attorney, Bruce Halliday, reported to the Commission that Salt Lake County's and Emery

County's beer ordinance would be applicable to San Juan County's situation.

Mr. Halliday reported that prior to the November election, a For and Against statment concerning the Initiative Petion's proposed beer ordinance would have to be published and mailed to each registered voter in the county.

Mr. Halliday also discussed with the Commission the wording to be printed on the ballot for the Initiative Petition. Voters will be asked to vote for or against an ordinance prohibiting the sale of beer in all unincorporated areas of the county.
