SAN JUAN COUNTY COMMISSION MINUTES AUGUST 15, 1988

The regular meeting of the San Juan County Commission convened at 10:00 A.M. at the San Juan County Courthouse in Monticello, Utah.

A motion to approve the minutes of August 1, 1988 as corrected was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT

Halls Crossing Airport - A phone call from Congressman Howard Nielson, via Sue Cook of his Moab office, stated that the EIS on the Halls Crossing Airport will be out by the 1st of October and there will be money available for the project in fiscal year 1989.

Translator Site Fees - Administrative Administrator Rick Bailey provided information from the Forest Service on the translator site fees. In reviewing over the information Mr. Bailey reported that there is exemptions made for local governments but they have to submit an application and be waived or they will be changed the same rates as anybody else. The Forest Service has also taken into consideration and based their rates on $75 per 1,000 population for rural areas. That makes some adjustment possible in the fees for those serving small population areas even on the private translator owners. Commissioner Black states that San Juan Counties comments should support total waivers for local and state government and public services.

Utah Department of Health/EMS Contract - The contract for emergency medical services in the amount of $6,736.00 with the Utah Department of Health was recommended for approval. It was noted that the amount was a reduction from past years contracts. A motion to approve and authorize Chairman Black to sign the contract was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS

Tax Limitation Proposals - A meeting will be held Tuesday, August 16 at 8:00 a.m. in Blanding to discuss the tax limitation proposals. Administrative Assistant Rick Bailey provided information on the proposals for Commission review. Commissioner Black stated that a fiscal impact analysis update from the Utah State Tax Commission showed that San Juan County would be impacted far more than any other rural county in the State by the tax limitation measures. The impact based on 1987 revenue figures would be $1,500,095 for the County; $1,675,074 for the school district, $44,522 for Blanding City, $18,776 for Monticello City, $5,103 for the Blanding Cemetery District, $3,271 for the Monticello Cemetery District and $101,397 for the San Juan Water Conservancy District.

Public Safety Building/Pay Phone - A proposal has been received from JC Enterprises in Blanding for the purchase, installation and operation of a public pay phone for the Public Safety Building. JC Enterprises would provide all of the maintenance and costs and in turn would collect all the revenues. Administrative Assistant Rick Bailey was asked to obtain other proposals before a final decision will be

made.

CURRENT BUSINESS

Sortore Home - Rowland Francom met with the Commission regarding the purchase of the Sortore home owned by the County through delinquent taxes. Mr. Francom reported that there are holes in some of the walls and water damage as a result of frozen water pipes that broke. Commissioner Bailey will go look at the home then it will be advertised and sealed bids accepted for the purchase of the home.

Hospital Management Plans - David Ferron, employed by a subsidiary of Blue Cross Blue Shield of Pennsylvania, as well as Tom Mitchell and Byron Smith of Brim, Associates, met with the Commission to present proposals for the management of the San Juan County Hospital.

Southwest Community Health Services - A letter from Southwest Health Services/San Juan Regional Medical Center indicated they are not in a position at this time to submit a proposal for the management of the San Juan County Hospital.

Gravel Crushing Contract/Timber Products - The following agreement was signed between San Juan County and Timber Products:

AGREEMENT

This Agreement made and entered into as of the 27th day of July, 1988, by and between San Juan County, a political subdivision of the State of Utah ("COUNTY"), whose mailing address is P. 0. Box 338, Monticello, Utah 84535, and Timber Products, Inc. ("TIMBER PRODUCTS"), a Utah corporation whose mailing address is P. 0. Box 46, LaSal, Utah 84530.

WITNESSETH:WHEREAS, COUNTY has entered, or is about to enter into an agreement (the "REDD-COUNTY AGREEMENT") with Paul David Redd ("REDD") which provides that REDD will provide certain pit run gravel to the COUNTY for use on the county roads; and,

WHEREAS, TIMBER PRODUCTS has available for its use a crusher (the "CRUSHER") which has the capability to crush pit run gravel into gravel suitable for the surfacing of roads; and,

WHEREAS, TIMBER PRODUCTS has entered into an agreement (the "REDD-TIMBER PRODUCTS AGREEMENT") providing that TIMBER PRODUCTS can set up its crusher on land belonging to REDD; and,

WHEREAS, COUNTY and TIMBER PRODUCTS desire to enter into an agreement with each other providing that TIMBER PRODUCTS will crush for COUNTY the gravel which COUNTY will use under the REDD-COUNTY AGREEMENT.

NOW THEREFORE, in consideration of the acts and covenants hereinafter set forth to be done and performed by each of the parties and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged by each of the parties, the parties hereby do and agree as follows:

1. TIMBER PRODUCTS will crush for COUNTY the crushed gravel which the COUNTY need to perform the REDD-COUNTY AGREEMENT.

2. COUNTY will pay TIMBER PRODUCTS, within 30 days after receipt of an invoice, which TIMBER PRODUCTS will submit to COUNTY upon completion of the crushing operation, the following:

A. TIMBER PRODUCTS1 cost or #2.95 for each cubic yard of gravel crushed, whichever is less.

B. If COUNTY does not remove the gravel from the place where it is stockpiled as it comes out of the crusher so that the stockpile of COUNTY gravel is more than 6,000 cubic yards, TIMBER

PRODUCTS will remove the excess gravel to another location for which it will be paid an additional $0.50 per cubic yard.

3. COUNTY will pay all amounts due REDD for the pit run gravel crushed by TIMBER PRODUCTS under this agreement so that TIMBER PRODUCTS shall have no liability to REDD for the pit run gravel

purchased by the COUNT under its agreement with REDD.

4. Each party will indemnify and save and hold harmless the other party from any and all claims, including, but not limited to, all costs and expenses (including attorney's fees) incurred by

each party in defending against such claims, arising out of the operations of the other party hereunder.

Harts Draw Road/Project Agreement - The following project agreement between San Juan County and the Forest Service, U.S. Department of Agriculture was presented:

PROJECT AGREEMENT

Supplement No. 18 to the Forest Development Road Cooperative Agreement entered into on May 9, 1966 by and

between the Forest Service, U.S. Department of Agriculture and San Juan County, State of Utah.

Whereas, both parties are desirous of improving and applying surfacing on the Harts Draw Road, FDR #50174,

from the Spring Lake Road, $50100 to the Forest Boundary on the northern section line of Section 34, R. 22

E., T 32 S., SLM and thence to State Route 221, and

To that end, it is mutually agreed that:

A project will be constructed from the junction with the Spring Lake Road, survey station 0+00 +_, a distance of approximately 8000 feet. Said construction shall consist of reconstructing the road to a subgrade width of 32 feet plus curve and fill widening, installing drainage culverts where needed, and placing 11 inches of subbase, base, and surfacing to provide a 24-foot finished surface width, and it is further agreed that:

A. The County will:

1. Perform preliminary surveys and roadway design and provide plans and specification for reconstruction of the road.

2. Perform construction engineering and staking for the reconstruction of the roadway.

3. Provide all necessary personnel, equipment, surface course materials, culverts and seeding to properly perform the complete

reconstruction of said road.

4. Perform the said reconstruction in reasonably close conformity to the plans and specifications approved by the Forest Service.

5. Provide a plat and right-of-way description for final easement document preparation at the completion of the entire road reconstruction.

B. The Forest Service will:

1. Review with the County the proposed work on the ground prior to the work and periodically inspect the work as it progresses to insure compliance with the terms of this agreement.

2. The Forest Service will prepare the final easement documents and grant an easement to the County for the road after completion of entire road within the Forest Boundaries.

C. Both parties mutually agree that:

1. The United States, and/or its assignees, will not be liable to the County for any damages incident to the above cooperation.

2. The reconstruction will be performed in an orderly workmanship-like manner and upon beginning the work, it will continue without

disruption, except as required due to inclement weather, until the work is

complete and accepted by both parties.

COMMISSIONER CALVIN BLACK'S REPORT

BLM Mining Recordation Fees - The BLM is proposing to double Mining Recordation fees from $5 to $10 with a $5 per claim charge being assessed on filing the assessments. There has been no previous charge for the assessment filings. These adjustments are open for comments. Southeastern Utah Association of Governments have sent in a comment opposing the proposed raise in fees and has asked for an extension of

time for the comments.

Wilderness Designation - Commissioner Black reported that a decision from the Department of Interior and the Justice Department of the Federal Government stated they have taken the position that creation of wilderness does not reserve any water rights unless specified by Congress. That is an administrative decision and environmental groups have stated they will take the issue before the courts as they feel the decision is wrong.

Moab District BLM Advisory Council - There will be three vacancies on the Moab District BLM Advisory Council at the end of 1988. Nominations for replacements can be made until August 26th. The Commissioners will make a recommendation next week to be submitted.

AOG Meeting - Commissioner Black will attend a meeting of the AOG in Price on Friday, August 18. Representatives of all rural Utah Counties have been invited to a meeting later to discuss the hiring on a part-time or consulting basis some qualified people to respond to the various BLM and Forest Service management plans as they come up.

Anasazi Heritage Center - There will be an Open House and dedication of the Anasazi Heritage Center on August 27th at Dolores, Colorado at 10:30 a.m.

Utah Association of Counties - A letter has been received from the Utah Association of Counties which stated that at the time the County dropped from the Unemployment Compensation Fund and asked for a refund of the County deposit, a refund of $2,039.73 was given. The County had only paid in $1,399.67. The UAC would like to have the $640.06 reimbursed. As the refund was in 1985 the UAC is not asking for additional interest. County Clerk Gail Johnson said that a voucher for the reimbursement is in the bills to be approved by the Commission.

Contel - Commissioner Black met with Emmett Mays and Colleen Johnson of the Contel Telephone Company. They had met with the Commission a year ago and said they would get the phone system in working order. It was their impression that the County would pay them for any time and materials used and they wouldn't go on a monthly maintenance contract until the system was working. They reported that they've replaced $27,859 worth of equipment but because sane of it was rebuilt and could be exchanged so that was reduced to $10,000. Total man hours at the rate they charge would be $6,115. Contel's recommendation is that they bill us $4,585.20 for the equipment replaced and then they would be willing to go on a maintenance contract of $1,420.80 per year. Some exceptions to that would be acts of God, lightning strikes, etc. and would not be covered under the maintenance contract. Mr. Mays and Ms. Johnson indicated that the system is basically doing everything it is designed to do and if the County wants equipment that will do more or different than that then they have it and other companies have it but the present equipment is doing the job it was designed for. There are three problems that still need to be worked out: 1. There is a noise that's coming from the main switching equipment in Monticello and that is scheduled for replacement next year; 2. There is a problem with noise on the supersets and that is from the fact that they are 2-piece units and as they move it creates some noise; and 3. They have not; been able to figure out what's tripping the trunk alarm and those have to be manually reset. They stated that they felt most of the other problems would be alleviated if one person were hired to answer the console as their main job with other secondary jobs. Mr. Mays and Ms. Johnson stated they would be glad to meet with the Commission where a solution can be worked out.

Lake Powell Region Resource Development Council - A meeting of the Lake Powell Region Resource Development Council was held August 4th and 5th at Lake Powell. They looked at the Farley Canyon area, the Red Canyon area, Hansen Creek, Bull Frog and Halls Crossing the first day. The second day they toured the Hole in the Rock and Lewellyn Bench, Wahweap and Lone Rock. The Council passed a motion recommending and requesting the Congressional Delegation sponsor legislation that would facilitate the land trade for the above land on Lake Powell, which is the scattered state sections in Capitol" Reef, Glen Canyon, the Navajo Reservation and the Arches. There are mineral rights under lands the State owned which the Federal Government took in 1965 under threat of condemnation for which they paid only $12.50 per acre for the surface estate. Red Canyon area was also added as it had not been part of the original request. That opens up another area to development where there is a dirt road but it would require improvement in the future. All of the Congressional Delegation was represented by staff members.

NACo Board Meeting - Commissioner Black attended the NACo Convention and Board meeting this past week in Anaheim, California. The immediate past president of the National Association of Counties had stacked the Energy, Environment and Land Use Steering Committee. At a previous meeting they adopted a resolution which would put NACo on record as opposing drilling for oil and gas in the Alaskan Wildlife Refuge. The only part of that proposed for oil and gas drilling is about 10% of the 20,000,000 acres. The 1.9 million they have proposed for drilling is right next to Prudoe Bay and that is estimated to contain as much oil as Prudoe Bay. In order to get the development and drilling so that it can be produced by the time Prudoe Bay starts decliping, they need to get started. Prudoe Bay is now producing 20% of all U.S. production. The resolution adopted by the Steering Committee would have put NACo opposing that until the U.S. comes up with an energy policy. The Public Lands Committee came out with a resolution supporting the drilling. The National Board of Directors meets as a resolution committee and the President of NACo, Harvey Rubin, presented the two resolutions to settle the question. Commissioner Black made a motion to amend the Energy, Environment and Land Use resolution to take every reference to the wildlife refuge and drilling out of it so that the resolution would state they NACo supported an energy policy. Then the other resolution could be passed without conflict. After consideration the resolution was passed as recommended by Commissioner Black. The resolutions were also passed in the business portion of the meeting by the NACo membership.

State Land Board Meeting - The State Land Board met last week with Reed Christensen, former Regional Forester from Price, and Rulon Gill, from Celsius Corporation, as new members of the Board. All of the former board members were appointed again with the exception of Chandler St. John, who chose not to be reappointed. One more board member needs to be appointed representing wildlife. Umetco Minerals

Corporation/Radioactive Waste Disposal Site - A letter was received from Umetco Minerals Corporation advising the Commission of a proposal by Umetco Minerals Corporation to the Colorado Department of Health to establish a low-level radioactive waste disposal site at Uravan, Colorado. The Commission stated they have no objections to the proposal. There will be public meetings held in Naturita on August 22, Grand Junction on August 23, and Montrose August 24th to acquaint the public with the proposal.

Conservation Fund Grants -Applications are being received for conservation fund grants from the Land and Water Conservation Fund. They have to be submitted by October 1, 1988. Administrative Assistant will give a copy of the letter to Monticello City for their information.

Mexican Water Chapter Resolution - A memo was received from San Juan County, New Mexico indicating that a resolution from the Mexican Water Chapter requesting the construction of a shale pit to be utilized for road improvements was sent to the wrong San Juan County.

Letter of Appreciation/John Martinez - A letter has been received from John Martinez expressing appreciation to the Commission for taking time to talk with Mr. Martinez and Jean Melton when they were in the area formulating and implementing a workable program for recruiting Native Americans to the University of Utah law school.

State Land Sale - A copy of a letter that was sent to Jimmy Walker with respect to the proposed sale of a piece of land that is in San Juan County was received. The environmentalists are opposed to the sale but the Division of State Lands and Forestry point out that the Trust mandate is such that they feel they should provide the opportunity for this land to be purchased. Unless there is some future form of legal action, the Division will continue to pursue the proposed sale.

LaSal Forest Road Closings - Steve Kosanke has sent the County a copy of a letter to the Forest Service opposing the closing of roads in the LaSal Forest area.

Congressman Howard C, Nielson/Minerals on Public Lands - A letter has been received from Congressman Howard C. Nielson regarding a bill that he sponsored that would be able to deal with the problem of mining

claims and gravel pits. Congressman Nielson wanted comments from the Commissioners as to whether he should reintroduce the bill. The Commissioners felt the bill should be reintroduced in order to resolve the issue.

Delinquent Sales Tax Account - A letter from G. Elaine Davis of the State Tax Commission indicated that San Juan County was delinquent in filing the sales tax return for the period of January through December of 1987. A penalty and interest amount were automatically imposed on the account. Contact with Gail Johnson indicated that because San Juan County is a governmental entity they were not required to pay the penalty and interest. Mr. Davis informed the Commission and other employees that penalty and interest are, in fact, imposed on governmental entities if they do not comply with the state law. Accordingly, the penalty and interest for that delinquency has been waived but any future delinquency will require the payment of penalties and interest.

BLM Right-of-way/Halls Crossing Dump - A right-of-way has been granted from the Bureau of Land Management for the road to the Halls Crossing Dump site.

COMMISSIONER KENNETH BAILEY'S REPORT

Oljato Bridge - Commissioner Bailey reported that County Engineer Doug Pehrson met with Jim Copeland, Navajo Tribal Archaeologist, on the Oljato Bridge Project. They went over the site and agreed to put a one-wire fence around two of the disputed archaeological sites during the construction of the bridge. This should protect the sites from equipment damage.

Holliday Construction/Gravel Crushing - County Engineer Doug Pehrson negotiated with Holliday Construction regarding the crushing of gravel for the Harts Draw road. Mr. Holliday agreed to crush 15,000 yards of gravel and going up in the 200 mesh from 3 to 12 for $4.50 a yard. County Attorney Craig Halls is drafting an agreement for the project.

Brown's Canyon Gravel Pit - The BLM has indicated that they wanted to keep the Brown's Canyon gravel pit for a community pit for the future but they do not have access to the pit. County Engineer Doug Pehrson told Bob Turri of the BLM that the County needed the gravel and that we have received permission to build a County B road over to the pit which will also make the pit accessible to the BLM. Mr. Pehrson felt that the BLM would cooperate with the County on the gravel. Commissioner Bailey indicated that the Lem's Draw pit will be rehabilitated which should helping get cooperation from the BLM.

Road to Monticello Cemetery - There has been a considerable amount of damage done by the DOE trucks hauling materials from around Monticello down there. Commissioner Bailey indicated that Monticello City is going to talk to the Department of Energy about obtaining funds to repair the road. Commissioner Bailey will contact Congressman Howard Nielson in support of that request.

Probationary Raise/John Alvarez - Conmissioner Bailey made a motion to approve the probationary raise for John Alvarez to grade 10 step 2, $7.70 per hour, effective August 9, 1988. Commissioner Maryboy seconded the recommendation. UNANIMOUS.

Public Safety Building - A payment request has been received for the construction of the Public Safety Building in the amount of $154,834.37, of which $132,725.00 is for Valley Builders Construction, $14,747.00 for retainage to Deseret Architects, and $2,774.45 to AT&T. A motion to approve the payment was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Dark Canyon Road - Mike Grosjean with the Utah Lands and Forestry told County Engineer Doug Pehrson that the Dark Canyon road, No. 153, will be used by Louisiana Pacific to remove some trees. Mr. Pehrson indicated that the County does not have road use permits to guarantee against damage as all county roads are open to public use. However, if any damage is indicated then weight limits would be applied. Mr. Grosjean stated that Utah Lands and Forestry would require a guarantee from Louisiana Pacific against any possible road damage.

Red Mesa Road - The road department will be armour coating the Red Mesa road this week. The equipment is being tested and will be moved to the site.

Monticello Tannery Project - Commissioner Bailey reported on the progress of the Monticello Tannery project. Monticello City is putting a proposal together for a grant from the Community Impact Board for the purchase of the land and the infrastructure. They will request a loan for the building. Monticello Mayor Ernest Sondregger, Councilman Joe Slade, City Manager Rick Terry and Harold Frost met with the Commission to review the plans. The County agreed to build the road and the parking lot needed for the plant. Administrative Rick Bailey will assist the city in putting the application together.

San Juan County Fair - Commissioner Maryboy reported that the San Juan County Fair held August 11-13 was very successful. Many County residents enjoyed the displays and rodeo. The 4-H livestock sale was also successful.
