The regular session of the San Juan County Commission, convened at 10:00 a.m. at the San Juan County Courthouse in Monticello, Utah.

COMMISSIONER MARK MARYBOY'S REPORT

Recreation Program - Commissioner Maryboy and Recreation Director Edward Allred met with the Navajo

Division of Youth Development. The NDYD will hire a full-time recreation director by this summer or fall

to coordinate recreation on the Reservation with Mr. Allred.

UNDC Board - The UNDC Board would like to have reports on the progress of the roads on the UNDC priority

request at their monthly board meetings.

Task Force Meeting/Orrin Hatch - Commissioner Maryboy will attend the Task Force meeting with Senator

Orrin Hatch tomorrow at 4:00 p.m. in Moab.

Grant Application/historical Society - Commissioner Maryboy made a motion to approve the grant application

of $4,150 for the Historical Society. Commissioner Bailey seconded the motion. UNANIMOUS.

COMMISSIONER KENNETH BAILEY'S REPORT

Public Safety Building Payment - Contnissioner Bailey made a motion to approve the budget request of

$126,985.17 for the Public Safety Building. There are problems with the concrete at the site and the

architect Mark Tressler has made adjustments for that out of the request. Commissioner Maryboy seconded

the motion. UNANIMOUS.

Tannery Operation - Harold Frost, Blue Mountain Meatsf has asked Commissioner Bailey to obtain

information requested by an individual interested in establishing a tannery operation in Monticello that

would hire from 50 to 200 employees. More information is needed on air services into the Monticello area.

Commissioner Bailey will check with Jon Hunt on the information requested. Joe Slade and Bill Howell are

putting together a proposal to submit for the tannery operation.

Schedule A Roads/Forest Service - Commissioner Bailey made a motion to approve and authorize Chairman

Black to sign the revised Schedule A Agreement between San Juan County and the Forest Service.

Commissioner Maryboy seconded the motion. UNANIMOUS.

Contract Hauling/chips - Kenneth Miller has a contract to haul wheat from the area to Kaysville, Utah and

is willing to haul Geneva chips back to Monticello for stockpiling for the County Road Department. He

will haul them for $11.00 a ton. The chips sell for $5.50 a ton. A motion to approve Mr. Miller and

other local trucks request to haul chips back to San Juan County was made by Conmissioner Bailey and

seconded by Commissioner Maryboy. UNANIMOUS.

UDOT Meeting/March 10 - Commissioner Bailey reported on the Utah Department of Transportation meeting held

March 10 with San Juan County Commissioners and Blanding and Monticello officials. Mr. Bailey said there

were twelve people in attendance and it was a very productive meeting. The DOT stated that they need

2,000 to 5,000 yards of material from the pit in Montezuma Creek to use for fill so that guard rails can

be installed east of Montezuma Creek. Commissioner Maryboy will find out what needs to be done to make

application for the material.

Other issues discussed were: The curves at the bottom of Peter's. Hill need to be straightened while the road is being reconstructed. The Blanding intersection signs will be studied and efforts made to make the junction less confusing for travelers. The John Atlantic Ferry should be listed in the phone books under the Lake Powell Ferry so that it will be easier for visitors to contact. Pack Creek Bridge will be engineered by UDOT engineer Frank Ularich and bid at the same time as the Blue Hill Road project. The Copper Canyon Road project may be engineered with only one bridge across the creek. Commissioner Bailey will check with Representative Howard Nielsen on the funding so the project can be engineered. The DOT agreed to paint crosswalks across the highway for student crossing in Montezuma Creek. The Aneth Chapter Resolutions on improvements on State roads was considered as was the administrative jurisdiction of State roads within the County to be placed on the State Road System.

Monticello Road Service Contract - The County does not have a signed service contract with Monticello City for County participation on road maintenance in Monticello City. Commissioner Bailey will get the Mayor to sign a contract for these services.

Public Safety Building - There is some settlement in the concrete at the new Public Safety Building. Delta Engineering will come down to make some tests on the compaction. Commissioner Bailey made a motion to approve funds for Delta Engineering to make the required tests. Conmissioner Maryboy seconded the motion. UNANIMOUS.

New Tire Machine - The following bids were received for the purchase of a tire-changing machine for the Blanding Road Shed: The McGee Co. for $1,912.00 and Save-Way Tire Co. for $lf864.00. Conmissioner Bailey made a motion to accept the low bid of $1,864.00 from Save-Way Tire Company. Commissioner Maryboy seconded the motion. UNANIMOUS.

Probationary Raise/Road Employees - Commissioner Bailey made a motion to approve probationary raises for Victor Nebeker to Grade 18 Step 2, $lf776 per month; James Harvey to Grade 10 Step 2 at 7.35 per hour and Max Halls to Grade 10 Step 2 at 7.35 per hour. Commissipner Maryboy seconded the motion. UNANIMOUS. Mail Trail Mesa Mud Bog - Nelson Dishface made a request to have the County haul bentonite for a mud bog at Mail Trail Mesa above Aneth. The Commission approved the request.

Tire Bids - Sealed bids were opened for 85R 16" tires left off the original tire bids. Bids were received from Grand Tire and 4-State Tire Company. A motion to accept the low bid from Grand Tire was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Rio Algom Road - A spring has developed in the Rio Algom road necessitating some drain tile being laid to the bar ditch and emergency repairs made.

Utah Counties Finance Cooperative/Boettcher & Company - Commissioner Bailey made a motion to adopt the resolution to issue bonds in the amount of $500,000 for the purchase of equipment. Commissioner Maryboy seconded the motion. UNANIMOUS.

RESOLUTION 1988-3

A RESOLUTION OF INTENT OF THE GOVERNING BODY OF SAN JUAN COUNTY TO UTILIZE THE FINANCING PROGRAM OF THE UTAH COUNTIES FINANCE COOPERATIVE; AUTHORIZING BOETTCHER & COMPANY, INC., AS REMARKETING AGENT, TO WORK WITH THE GOVERNING BODY IN CONNECTION WITH SUCH FINANCING; AUTHORIZING THE PAYMENT OF LEGAL FEES; AND RELATED MATTERS.

WHEREAS, on April 29, 1987 the Utah Counties Finance Cooperative issued its $114,880,000 Mandatory Tender Revenue Bonds, 1987 Series A (Pooled Capital Improvement Financing Program) for the purpose of

financing the costs of certain projects by acquiring such facilities and improvements and selling or leasing them to the cities, towns and various districts which are members of the Cooperative; and

WHEREAS, the Governing Body of San Juan County, Utah, on March 14, 1988 adopted a resolution approving the Utah Counties Finance Cooperative Agreement thereby becoming a member of the Cooperative; and

WHEREAS, the Governing Body of San Juan County, Utah desires to utilize the financing program of the Cooperative in order to finance the costs of certain road equipment (the "Project"); and

WHEREAS, the Governing Body of San Juan County, Utah desires to authorize Boettcher & Company, Inc., as Remarketing Agent for the Cooperative to proceed with the preparation of all documentation and action which must be taken by the Governing Body to utilize the Cooperative financing:

NOW, THEREFORE, BE IT RESOLVED by the Governing Body of San Juan County, Utah as follows:

Section 1. The Governing Body hereby expresses its intent to finance costs of the Project by entering into a Lease/Purchase Agreement with the Cooperative prior to April 1, 1988.

Section 2. The Governing Body hereby authorizes Boettcher & Company, as Remarketing Agent for the Cooperative, to prepare all necessary documentation and to take such action as shall be necessary for the Governing Body to utilize the financing of the Cooperative.

Section 3. The appropriate officials of San Juan County, Utah are hereby authorized to execute a lease/purchase agreement and such other documents and to take such action as shall be necessary to utilize the Cooperative financing and to consummate such financing transaction.

Section 4. In the event that San Juan County, Utah elects to discontinue efforts to consummate the financing authorized by this resolution, the Governing Body hereby authorized the payment of legal fees and expenses incurred to such time in preparing the documentation authorized in Section hereof.

COMMISSIONER CALVIN BLACK'S REPORT

Washington D.C. Meetings - Commissioner Black attended the Legislative Conference in Washington, specifically a Western Interstate Region Board Meeting where the same public lands issues were discussed. The big one now is the gross to net that the Government keeps coming up with to try to cut some government costs on timber receipts, mineral lease receipts and others. What they do is give the States 50% of the gross revenue (Counties in the case of timber receipts). This year the administration tried to take out all of their costs of bureaucracy before giving back the revenue amount but the measure was killed.

The PILT funds are in the budget for this year also.

They discussed the managements plans which are being implemented all over and seen to have the same basic plan. Wilderness plans were also considered.

Coitinissioner Black also attended a session of the Energy, Environment and Land Use Steering Committee, the NaCo Board Meeting and various seminars.

Hill-Burton Bill - Judy from Representative Howard Nielsen's office is working to draw up a bill that will receive administration approval for passage in the House.

BLM Meeting - Commissioner Black met with Robert Burford, National Director of the BLM; Bob Weidner of Senator Jake Gam's staff and Reed Ivins from Representative Howard Nielsen's office. Mr. Black presented the opposition draft to the San Juan Area Resource Management Plan from the San Juan County Commission and discussed it with them. Mr. Burford ask if the Congressional Delegation and Governor's office supported the County draft. Mr. Black replied in the affirmative but said it had not been discussed with Representative Wayne Owens. When asked by Mr. Burford what he could do, Commissioner Black suggested that he instruct the Utah State BLM and the local districts meet with the representative of the Governor and San Juan County Commission and work out a management plan that will be acceptable to all concerned. Mr. Burford indicated that ACEC's do not need to prohibit multiple use of the land.

News Madia - Commissioner Black responded to an editorial in the Salt Lake Tribune on "Project Bold". Mr. Black also met with Jim Mortimer of the Deseret News and Don Gale of KSL television to discuss the editorial and the Governor's land trade proposal. Coitinissioner Black also responded to a Common Carrier article in the Tribune which will be carried in the paper this coming Sunday.

Commissioner Black met with gubernatorial candidate Ted Wilson to discuss the other side of "Project Bold."

Taxable Sales - Commissioner Black reported that in comparing the 2nd quarter of 1987 to the 2nd quarter of 1986 the taxable sales were up. Other comparisons of previous quarters were down as was the County total for the past year.

Road Department Contract Trucks - Commissioner Black stated that contract trucks used by the Road Department should be used for efficiency and not to prolong the work for individuals. There seems to be differing opinions between the Blanding and Monticello road foremen about the use of the trucks. Commissioner Bailey will set a County policy on this issue.

Road Request - A request was received to put the road from the Dry Wash Road down to the Bayles ranch on the County Road System. It's primarily an access road to the ranch but there is public land south of the ranch that is accessible only through the ranch. If the road only serves one person then it does not qualify for the County Road System but it is a public road as the Forest Service will not allow a gate to be put on it. If the access to public land beyond the ranch and other roads could continue to go through the Bayles place or around it the road would qualify to be put on the County Road System. The request will be put on the agenda for the monthly road meeting.

ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT

Federal Highway Tax/County Exempt - A letter received from Chevron U.S.A., Inc. states: "We previously informed you of the changes in tax laws affecting business due to the Tax Reform Act of 1986. A revised ruling by the Internal Revenue Service allows Chevron to remove the federal excise tax from billing to certain organizations and government agencies as we did in the past. Effective with your March billing, we will remove the federal excise tax from the following organizations: diplomats; foreign embassies; state and local governments; non-profit organizations; private schools; American Red Cross; USP/FO including the National Guard." A request for refunding of the tax for the January and February billings can be made.

Ccmmunity Inpact Board Grant - Administrative Assistant Rick Bailey will follow up on information needed to receive the grant of $205 ,000 awarded San Juan County by the Permanent Community Impact Fund Board for the Montezuma Creek Police Station, Montezuma Creek Road Shed and Fire Truck. Certification that the County has obtained the following funds to complete the project: 1) $20,000 from the Navajo Tribe; 2) $10,000 from the Utah Navajo Development Council; and 3) $20,000 from San Juan County and submission of a certified and approved bid for the project is still needed.

Hovenweep Resource Management Plan - The comment period on the Hovenweep Resource Management Plan will extend until April 19, 1988. Administrative Assistant Rick Bailey recommended that the Commission respond in opposition to the Hovenweep RMP and ask that any further action bu deferred until the BLM San Juan Area

Resource Management Plan is approved so the County will know what the BLM management will be in the area

adjacent to Hovenweep. Commissioner Black felt that specific opposition comments and other letters should

be submitted and say that the plan is premature.

Moab Fire District - The Moab Fire District has purchased new fire fighting equipment for that District

which supplies the Spanish Valley area which is in San Juan County. They are requesting a contribution

from San Juan County to help defray the cost of the equipment. The Commission directed Mr. Bailey to find

out where the money came from to purchase the equipment. If some of the money was raised locally, then

San Juan County should help with the costs.

Ccmmunications Computer - Commissioner Maryboy made a motion to approve the purchase of a computer for

$2,116.30 for the Communications Department. Commissioner Bailey seconded the motion. UNANIMOUS.

COUNTY CLERK GAIL JOHNSON

Election Translator - County Clerk Gail Johnson recommended the hiring of Andy Tso on a part-time basis to

act as translator for the 1988 elections. Mr. Tso is willing to work for $5.00 an hour. Commissioner

Bailey made a motion to approve the hiring of Mr. Tso. Commissioner Maryboy seconded the motion.

UNANIMOUS.

Alcohol Training Seminar - County Clerk Gail Johnson talked to Mr. Leon Povey of the Alcohol Control Board

in Salt Lake City. Mr. Povey feels that the Social Services personnel in Blanding could be trained to do

the certification training of alcohol vendors. Mrs. Johnson reported that she has moved the March 29

scheduled training meeting to Blanding to facilitate the vendors in the southern part of the County.

After discussing the matter with Social Service Director Mark Lyman, he said the Social Service Department

would be willing to find out what is necessary for then to do the training.

Fry Canyon Store Beer License - Commissioner Bailey made a motion to authorize Chairman Black to sign the

request of Fry Canyon Store to change their beer license from a Class A license to a Class B license.

Conmissioner Maryboy seconded the motion. UNANIMOUS.

Assessing and Collecting Budget - County Clerk Gail Johnson reported that she is waiting for approval or

changes of the County Assessing and Collecting Budget from the State Auditor's office before sending the

1986 excess of $127,000 as requested. When the auditor looked at the budget, he would only reconmend

$829.000 instead of the $835,000 requested. Mrs. Johnson does not feel that the 2.5 mills statewide will

be able to raise the Assessing and Collecting budget of $829,000. As soon as word is received from State

Auditor Tom Allen's office Mrs. Johnson will make a recommendation to the Commission to authorize County

Treasurer Marian Bayles to send up the requested $127,000.

CURRENT BUSINESS

Mineral Lease Road Program/Steve Creamer - Steve Creamer met with the Commission to report the successful passage of the Mineral Lease Road bill through the Utah State Legislature. San Juan County will receive $283,200 of Mineral lease funds on or about July 1st for 1988; $566,400 for 1989; $849,600 for 1990 and $1,132,800 in 1991 which represents a proportionate share of 25% of Mineral Lease Money that comes to the State based on San Juan County's production. Mr. Creamer noted that Representative David Adams and the San Juan County Commissioners were very instrumental in the passage of the bill.

A bill for Payment In Lieu of Taxes on State lands was also passed. This year it pays six (6) cents and acre and over a 6-year phase-in period will pay 52 cents an acre.

Anastico Lopez/David Adams - Anastico Lopez and David Adams met with the Commission to discuss the Lopez property located north of Dr. Warren's clinic and east of the new Public Safety Building. The County at one time wanted to purchase the back portion of the lot but Mr. Lopez was not willing to sell at the time. Mr. Lopez would now like to sell the entire lot and house to the County. Commissioner Bailey indicated that the only reason it would improve the Public Safety Building project is to expand the impound enclosure. The property could be made to conform to the present project. The Farm Home Administration has indicated that the property would probably appraise for about $6,000. Commissioner Bailey was authorized to negotiate with FHA and other parties to reach an agreement to purchase the property.

Sheriff's Office - Sheriff Lacy reported that the promotional board met last week and made a recommendation to keep Helen Howell as the Sheriff's Department Office Manager, Lawrence Steve Stovall as the Jail Administrator and William Pierce as County Investigator, subject to a six-month review. Commissioner Maryboy made a motion to approve the salary adjustment for Mr. Stovall and Mr. Pierce to $1,443 per month, grade and step to be determined, effective March 1, 1988. Conmissioner Bailey seconded the motion. UNANIMOUS.

Human Services Board - Social Services Director Mark Lyman and Jed Lyman, chairman of the Human Services Board presented the Human Services Board recommendations for project funding for fiscal year 1989 and additional requests for the current fiscal year. Chairman Lyman indicated they based their reconmendations on $29,047 of unallocated money for the current fiscal year and $84,359 available funding for fiscal year 1989 for a total of $113,406 plus any monies not expended during the current year. Approximately $2,500 was not used in the detoxification program.

Project Good Work requested funding of $15,000 for fiscal year 1989 and an additional $3,000 for the current year. They would like to turn the program into a year-long program instead of a summer program. The board recommended the awarding of the additional $3,000 for the remainder of the current year and just $13,000 for fiscal year 1989.

The Transition Center was funded for $20,000 for fiscal year 1988 and is requesting an additional $5,000. The board recommended awarding the additional $5,000 and funding $13,500 for fiscal year 1989.

CEU Counseling has requested $34,000, the same as the previous year.

Transportation was awarded $32,000 for fiscal year 1988 and is requesting the same for fiscal year 1989.

The UNDC Developmentally Disabled Program is a new proposal and the Human Services Board felt the program is worth some funding as they act as a funnel into the Transition Center. The program identifies and provides services for the developmentally disabled. However, the board could not give the full funding requested as the money was not available. The Board is recommending $10,000 be awarded the program for fiscal year 1989.

One other UNDC proposal called Project TEAM (Team Education for Adolescent Mothers) was considered but the Board felt these services were being duplicated in other Social Service projects and did" not reconmend funding the project.

Commissioner Maryboy had proposed the TEAM proposal and felt the Board did not give adequate consideration to this project as it was to be just a one-year proposal. The Board did not understand this as part of the request. Mr. Maryboy also felt there was some discrimination of Navajo administered programs. Commissioner Black indicated that all of the programs helped minority and Native American people. Commissioner Bailey stated that all of the program will need to be cut next year as there will be less money available and the carry-over funds are being used on the 1989 fiscal year requests.

Commissioner Bailey made a motion to approve the additional monies requested for Project Good Work and the Transition Center for the current fiscal year. Commissioner Maryboy seconded the motion. UNANIMOUS.

Chairman Lyman was requested to poll the other board members as to whether they would agree to meet to reconsider the request for the UNDC TEAM project or to leave the recommendations the same as presented and then report back to the Commission.
