MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD
SEPTEMBER 13, 1982
The Board of County Commissioners met in regular session on Monday, the 13th day of September at the hour of 10:00 a.m. in the Courthouse at Monticello, Utah.
On roll call, the following members were present: Commissioner Kenneth R. Bailey, acting chairman
Commissioner Robert Low Commission Chairman Calvin Black was excused to attend the BLM Advisory Board Meeting.
Minutes of the previous week were read and approved upon the motion of Commissioner Low and the second of Commissioner Bailey and it carried unanimously.
WEED CONTROL PROGRAM DISCUSSED:
Mr. Jim Heaton discussed the County's weed control program policies with the Commissioners. He reported that each individual's, request to the program for reimbursement is logged by the Extension Office secretary and Mr. Heaton has reviewed each request to be sure it complies with the weed control policies and that the proper vouchers are attached. The Commission requested that the Weed Board review their policies at their next meeting.

AGING PROGRAM BUDGET APPROVED:
Mr. Al Haskins presented the Area Plan Budget for the San Juan Aging Program for FY 1983 of $109,405.00
Commissioner Low moved to approve $14,321.00 in matching funds from the the County. The motion was
seconded by Commissioner Bailey and it carried unanimously. The County's match will be approximately
the same as for FY 1982. Mr. Haskins will submit the Aging Program Budget to the State Board for
approval.
Mr. Haskins reported that more cheese and butter will be available for distribution for the Aging
Program. He requested permission for a County truck to bring these government subsidized dairy
products from Salt Lake City and the Aging program will reimburse the county for the mileage. The
Commission approved the use of a county vehicle.
FAIR BUILDING ADMITTANCE POLICY;
The Commission confirmed with Mr. Haskins that persons renting the County Fair Building should be
granted admittance to the building either by Mr. Haskins or the Sheriff's Department. Although
the Road Department is located next to the Fair Building, it will not have a key to the Fair Building
and should not be asked to open it for anyone.
VERDURE GRAVEL PIT DISCISSED;
Commissioner Bailey reported that plans are being made to reclaim the Verdure gravel pit located on Sam Hall's property. As soon as the equipment is available, the Road Department will haul gravel from the pit for the nearest roads to the north and south of the pit, and also stockpile gravel for use in the city of Monticello.
LIBRARY EMPLOYEE SALARY INCREASE CLARIFIED:
In order to clarify the salary increase for all library employees approved on July 26, 1982, Commissioner Bailey reported that the 10% increase was to be provided for both the salaried County employees and contract employees who work at the Blanding and Monticello Libraries. He reported that the Library Board met with the contract employees and negotiated a 10% increase in their contract salaries, to be made retroactive to July 1, 1982, for this year only, and the Commission has approved the Library Boards actions in this matter.
CLIFFORD SMITH RECEIVES APPROVAL TO SELL AIRPORT HANGAR;
Comm. Ken Bailey reported that Mr. Clifford "Kip" Smith has requested that the County Commission give written approval for him to sell his airport hangar at the Monticello Airport. The original deed and 99 year lease require that the sale of the hangar be approved by the commission. Commissioner Low moved to give Mr. Clifford Smith written approval to sell his hangar at the Monticello Airport. The motion was seconded by Commissioner Bailey and it carried unanimously.
CONTINENTAL TELEPHONE COMPANY OF THE WEST WILL PAY FOR DAMAGES TO BLUE MOUNTAIN ROAD: Commissioner Bailey reported that the Continental Telephone Company of the West has damaged County Road #102 which leads to the Blue Mountain from Monticello. The damage was caused while the company was installing cables along the road easement. The telephone company has agreed to reimburse the county for the road damage and for any subsequent or unforeseen damage which may occure during the next 5 years.
LISBON VALLEY ROAD:
Commissioner Bailey reported that the telephone company has buried cables, without the county's approval, along the County Engineers stakes which were marking the relocation of the road to remove a dangerous curve. Commissioner Bailey has requested that the County Engineer write to the telephone company concerning the County's encroachment permit requirements and that the County expects the telephone company to be responsible for any expenses connected with possible relocation of their cables at this site.
BLUFF TO MONTEZUMA CREEK ROAD REPORT;
Commissioner Bailey reported that the County Engineer , Doug Pehrson, will be making the last 10 mile
"walk" of the Bluff to Montezuma Creek Road project on September 14th.
Due to the high cost of construction engineering for the project, the County Road Department hopes it
will be able to complete the engineer ing on a cooperative basis with the State. Also, in an effort to
keep costs down, it has been decided to delete guard rails from the project, except at bridge approaches,
and install them at a latter date.
Mr. Pehrson reported that a second billing from Asa Nielson for the archaeology report on the Bluff to
Montezuma Creek Road was to be submitted as the first invoice was mislaid, but has recently been found.
MONTICELLO BOOK MOBILE RELOCATION DISCUSSED:
The Commission discussed the possibility of moving the Monticello Book Mobile to the County Road Shed
to provide space for possible expansion of the Monticello Library.
BLUFF AIRPORT ROAD APPLICATION MADE TO BLM;
Commissioner Bailey reported that, as per last weeks meeting with Gene Foushee, he has made application to the BLM, and they have approved a right-of-way for an access road to the Bluff Airport to be located west of the River Ranches, and an area for tie-downs will be added to the present BLM lease.
AIRPORT HANGAR LEASES SIGNED;
Upon receiving yearly airport hangar rent of $600.00, the Commission approved the yearly hangar lease agreements for Northern Electric for Blanding Hangar #5, and Leonard Hurst for Blanding Hangar #6. Commissioner Bailey signed the lease agreements in behalf of the County Commission.
MEXICAN HAT FIRE DEPARTMENT DISCUSSED:
Fire Warden, John Baker, reported that Mexican Hat has not connected electricity to the meter at the new fire station, and he has observed a lack of proper care for the County's fire equipment located at Mexican Hat. In view of this report and Mr. Baker's recommendations, the Commission authorized Mr. Baker to send a letter to Mexican Hat explaining that the Fire Dept. would be deactivated if & viable Fire Dept. could not be orginized.
DETENTION FACILITY LETTER CONCERNING TRANSFER OF TITLE XX FUNDS SIGNED;
The Commission approved and the acting chairman, Ken Bailey, signed the following letter presented by Mr. Bruce Shumway to the State Department of Social Services: Dear Sirs:
The San Juan County Commission would like to allocate the carryover Title XX Discretionary funding in the amount of $3,681.01 from the last fiscal year for District 7B to the San Juan Social Services detention facility. This is San Juan County's share of operating the facility.

INITIATIVE PETITION AND NOVEMBER BALLOT DISCUSSED:
To help answer questions raised by the Development Board, Mr. Bruce Shumway asked the Commission if an alternate program to the initiative petition could be placed on the November ballot, and if it would be constitutional to restrict voting on the initiative petition to only the unincorporated areas of the county. The County Attorney, Bruce Halliday, advised Mr. Shumway that there may not be enough time to complete the initiative petition process before the November elections, but the County Commission has the authority to prepare an alternate ordinance. He also reported that he has not found any justification for zoning of the vote. It was felt by the Commission that an alternate ordinance on the ballot might confuse the issues even more.
The following wording for the ballot for the initiative petition was suggested by the County Attorney: Shall the Ordinance submitted by initiative petition which prohibits the Sale of Beer in all unincorporated areas of the County; and which makes other changes in the San Juan County ordinances regarding possession and distribution of beer and alcohol be adopted.

The Commission approved Mr. Carl Eisemann's request to print the proposed wording in the San Juan Record and request public comment on their interpretation of the statement.
FLAGPOLE FOR COURTHOUSE:
Courthouse Custodian, Del Hunter, reported that the present flagpole on top of the courthouse is unsafe to use. The Commission asked Mr. Hunter to see if it would be possible to place a flag pole at an angle on the Building outside the window to the Judge's chambers and above the porch.

WEATHERIZATION APPLICATIONS APPROVED:
Mr. Al Haskins presented applications for the Weatherization program and they were reviewed and approved by the Commission. Commissioner Low signed the applications in behalf of the County Com-mission.
IBM COPY MACHINE SERVICE CONTRACT TO BE CONTINUED:
Mary Lou Mosher reported to the Commission that the County's IBM copy machine is nearing one million copies and will probably break down more frequently in the future. The IBM repair man has already made 11 service calls since February 1982. Without the service contract, the county would be charged $86.00 per hour and 250 per mile from Price for each service call, plus the cost of any replacement parts. Mrs. Mosher recommended maintaining the service contract and the Commission concurred.
