SAN JUAN COUNTY COMMISSION MINUTES SEPTEMBER 12, 1988

The regular meeting of the San Juan County Commission convened at 10:00 A.M. in the San Juan County Commission Chambers at Monticello, Utah.

A motion to approve the minutes of August 22, 1988 as corrected was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.

CURRENT BUSINESS

County Computer Equipment - Several months ago the Commission approved the purchase of some computer equipment for John Fellmeth's office, the road office and the surveyor's office. The equipment has not been purchased mainly because Mr. Fellmeth has not had the time to begin work on installing the equipment and developing the programs to utilize the equipment and the surveyor's office felt they would not be able to use the equipment until the fall. With the upcoming tax initiatives, Mr. Fellmeth asked the Commission if he should hold up on ordering the equipment. The Commission stated that, as long as they had already been included in the budget, they should be ordered.

Hospital Administrator - Hospital Administrator John Fellmeth said that Norm Campbell, the interim hospital administrator, will be at the hospital tomorrow to begin administration of the hospital. Mr. Fellmeth asked the Commissioners what the status of John's position and compensation in connection with the hospital would be. His continuing involvement, if any, with the hospital has not been decided. Mr. Fellmeth stated he would be available or work with Mr. Campbell as long as necessary. The Comnission stated that John should cooperate as much as possible with Mr. Campbell and an equitable agreement reached on his compensation at to the next Hospital Board meeting on September 27th.

San Juan County Audit/Waiver - County Clerk Gail Johnson presented a request for a waiver of responsibility for Ted Stagg and Kay Anderson, the independent auditors. It's a request which states that all of the information provided for the audit is in accordance to the required laws. The Commission asked that the document be reviewed by County Attorney Craig Halls before final action is taken.

San Juan County Audit/Billing - Ted Stagg and Kay Anderson had previously met with County Clerk Gail Johnson and Administrative Assistant Rick Bailey to present and discuss the additional fees for the San Juan County audit. Mrs. Johnson reported to the Commission that the original fee of $6,000 has been paid. An additional request of $26,000 has been presented for accounting assistance and securities transactions. The Commission requested that an itemized billing be submitted for consideration before they approve the request.

Alkali Crossing/Hatch's Trading Post - A Navajo lady has refused to allow the County to proceed with upgrading the road at the Alkali Crossing by Hatch's Trading Post because she feels it is located on her grazing rights. County Engineer Doug Pehrson feels that it is not on her permit area. Commissioner Maryboy will be contacted and asked to talk with the lady so the work can proceed.

Weed Board Truck - Extension Agent Jim Keyes reported on the items that had to be done to the weed truck by the County shop. These items were supposed to be done by Steve Reagan Company before the truck was delivered. The Commission authorized Mr. Keyes to deduct the amount of work done by the County shop from the billing from the Steve Reagan Company and pay the remainder of the bill. The check is to have a statement to the effect the bill is paid in full.

COMMISSIONER CALVIN BLACK'S REPORT

Nancy Patterson Park/Proposed - Commissioner Black has received a copy of a letter to Congressman Howard Nielson from Joel Janetske, director of archaeology at Brigham Young University, who has been trying to create a national monument out of the 40 acres belonging to Mark Evans known as the Nancy Patterson ruins. Mr. Janetske had hoped that the National Park Service would complete a study of the area by this fall but due to concerns of the San Juan County Commissioners the request has not been implemented. The Commissioners had previously supported the project with the following conditions. 1. That it would never be allowed to be more than 100 acres. 2. That it would never be allowed to stop anything outside of the boundaries, by noise, dust, etc. so they couldn't stop oil drilling, etc. 3. Not more than $40,000 would be paid for the site. Mr. Janetske stated that protection of the site requires a quick resolution to the current stalemate on the study request. He would like to see the National Park Service carry out the study to determine whether the property is appropriate and acceptable for acquisition by that agency. Those issues that are pertinent to the acquisition such as size, cost, distribution of artifacts, etc. could then be addressed in light of NPS recommendations. Congressman Nielson was asked to resubmit his request without the commissioners provisions to clear the way for the study.

Commissioner Black was authorized to write a letter to Congressman Nielson stating that the County is firmly committed to those provisions being part of any acquisition by the National Park Service.

Scenic Byways - A letter has been received from the State Department of Transportation regarding designation of scenic routes to put on the maps. The Development Board will be asked to respond to this request.

Utah Local Governments Insurance Trust - A Notice of a liability reduction program seminar to be conducted throughout the state was reported by Conmissioner Black. In a one-year period the civil rights

claims at the Trust have risen dramatically. Their reinsurance company, NLC Mutual Insurance Company, requires that a liability reduction (risk management) program be established. The County needs to have a representative attend these special training sessions. The Commission authorized Administrative Assistant Rick Bailey to attend the seminar at Richfield on November 10 from 9-4:30 and suggested that County Attorney Craig Halls and County Clerk Gail Johnson might be interested in attending. Commissioner Black will attend if his schedule allows. The commission has a draft of a cooperative agreement between the counties of Utah with respect to the law that provided a statewide assessment for the assessing and collecting mill levy. Commissioner Black recommended that the agreement be approved as that is what is funding the tax issue litigation. Certain companies have filed law suits claiming that a state-wide levy is unconstitutional. The attorneys believe that if the agreements are signed, under the Intergovernmental Act, it will strengthen the counties position. Commissioner Bailey made a motion to approve the agreement and authorize Chairman Black to sign the same. Commissioner Black seconded the motion. UNANIMOUS.

Mental Health Workshop - There will be a Mental Health Workshop held September 29th and 30th at the Radisson Inn at Park City. The workshop will address public policy and provide an opportunity for input as outlined in Utah law prior to the policies being submitted to rule making this fall.

Social Service Programs - A letter from San Juan Social Service Director Mark Lyman listed what the proposed cuts would be for social service programs statewide if the tax initiatives pass. The projections on cutbacks in Social Services were based on a 13%, $14,000,000 reduction in state funds.

Commissioners Workshop - Commissioner Black reported on the Commissioners Workshop held at Sweetwater this past week. Important items discussed were the special service district, tax initiatives, the role of County Government, assessing and collecting, the highway funding update, the status of the district court transfer, proposed JP court legislation, Utah Association of Counties membership dues and additional amounts paid by counties containing federal lands for a full-time public lands specialist.

Land Exchange - A letter written by Richard Dewsnip, who died shortly after the letter was written and who was considered a leading expert on land exchanges and laws that affect then was received. One paragraph states, "As you know any mining claims validly located is a vested property right that cannot be divested without due process of law. Thus if the state were to acquire federal lands in exchange and the lands so acquired contain valid mining claims, the owners of the claims could proceed to obtain patents under the federal law and the interest acquired by the state in the exchange would be terminated with respect to the land covered by such claims. Therefore, it would be a imprudent course of action for the state to acquire lands in exchange which were covered by valid mining claims." So if the state vacates a scattered section, on that section they have the locatable mineral rights. When they trade it, they give those rights up. So when they acquire a piece of land, if it has mining claims on it, .they not only lose that right in the exchange they have the risk of losing the surface rights and the leasable mineral rights too. When a mining claim is patented, if there is not a lease for oil and gas existing at the time or it has not been declared a known geologic structure, the mining claim patent gets the leasable mineral rights too. So the state, in those events, would lose all rights.

COMMISSIONER KENNETH BAILEY'S REPORT

Road Foreman Position - Commissioner Bailey reported that he had interviewed over half of the applicants for the position of County Road Foreman. The remainder will be interviewed this week and a recommendation made to the Cormiission at the next Commission meeting.

Montezuma Creek Road Shed - The construction of the Montezuma Creek Road Shed is progressing rapidly. As soon as it is completed with the fences, etc., two patrols for road maintenance will be set up. Previously there has only been one man to maintain the roads in that part of the County and it has been too much to cover adequately.

Joint Highway Committee Mtg. - Commissioner Bailey will be attending a meeting of the Joint Highway Committee on Sept. 22-23.

ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT

Enterprise Zone Application - San Juan County is eligible to be designated as an "Enterprise Zone" which provides for corporate franchise tax or personal income tax credits for investment and job creation within designated counties. This action provides for a variety of tax credits which are available to manufacturing companies which locate or expand with the designated counties. A draft copy of the Enterprize Zone application was presented to the Commissioners to review for final action at the next Commission meeting. The Commissioners need to determine what categories will be targeted for the County supplemental job tax credits. Each county may designate up to three employee categories which will receive special focus within the Enterprise Zone.

San Juan Health Service District - Because of the time element a special commission meeting will be required in order to put the proposal on the November ballot. On Monday, Sept. 5, a resolution on intent to establish the San Juan Health Service District was approved. After a three week publication period a public hearing will be held on Monday, Sept. 26th for public comments on the proposed health service district. The 15 days allowed for public comment will end October 11. The Commission will need to hold a special commission meeting to approve, reject, or postpone the resolution on Wednesday, October 12. If the resolution is adopted, a 21-35 day period with a three-week publication of the intent to put the resolution on the ballot is required.

San Juan Transportation Service District - In connection with the San Juan Health Service District, Administrative Assistant Rick Bailey asked the Conmission to adopt a resolution of intent to create a special service district that would be called the San Juan County Transportation Service District with the intent that the Service District would provide road repairs, Maintenance and construction and would be funded primarily coming from the state payment in lieu of taxes and federal mineral lease revenues which are going to be coming into the County based on new legislation that was passed in the last legislative session. The legislation would return 25% of the mineral lease revenue from the federal government back to the areas of origin. They also passed a bill to start a program of payment in lieu of taxes on state lands similar to the one on federal lands. In order to not have a reduction of federal PILT payments it is necessary to establish the Special Service District. The funding is in addition to already existing programs. The first payment of mineral lease money would amount to $312,800, the second year would be $625,000 and the third year $938,000 based on current estimates of revenues. The state PILt would be: 1989, $17,800; in 1990, $89,162 and from there on would continue to increase at to a maximum of 52 cents per acre.

The money will be allocated from the federal mineral lease revenues on a quarterly basis. They will cut the first check on the 1st of October and hold that money at the State Treasurer's office until the districts are set up. In order to get the money a resolution of intent to establish the San Juan Transportation Service District was approved and authorization given to Chairman Black to sign the document upon motion of Conmissioner Bailey and seconded by Commissioner Black. UNANIMOUS.

After the 21-35 days, three week publication, a public hearing will be held on October 10. The comment period will end on October 25th and a special commission meeting held Wednesday, October 26th at 9:00 a.m. to adopt the following resolution:

RESOLUTION 1988-6

A RESOLUTION DECLARING THAT THE PUBLIC HEALTH, CONVENIENCE AND NECESSITY REQUIRE THE CREATION OF A SPECIAL SERVICE DISTRICT, DEFINING THE BOUNDARIES OF SAID SPECIAL SERVICE DISTRICT AND THE SERVICES TO BE PROVIDED THEREIN, PROVIDING FOR A HEARING ON THE CREATION OF SAID SPECIAL SERVICE DISTRICT,

PROVIDING FOR NOTICE OF SAID HEARING AND RELATED MATTERS.

WHEREAS, the Board of County Commissioners of San Juan County, Utah, believes that the public health, convenience and necessity require the construction, repair, and maintenance of roads within a specified area of the County and therefore it is desireable to incorporate said area into a Special Service District pursuant to the provisions of the Utah Special Service District Act, Chapter 23, Title 11, Utah Code annotated, 1953, as amended, and Article XIV, Section 8 of the Constitution of Utah; and

WHEREAS, all property of the area to be contained within the said proposed Special Service District will be benefited by the creation thereof; and

WHEREAS, none of the area to be contained within the boundaries of said

proposed Special Service District is also within the boundaries of any other special service district established by said County to construct, repair, and maintain roads, nor is the area within any other district presently providing similar services:

NOW THEREFORE, Be it Resolved by the Board of County Commissioners of San Juan County, Utah, as follows:

Section 1. The public health, convenience and necessity requires the creation within San Juan County, Utah, of a Special Service District (the "District") pursuant to the provisions of the Utah Special Service District Act, Chapter 23, Title 11, Utah Code Annotated, 1953, as amended, and Article XIV, Section 8 of the Constitution of Utah.

Section 2. The boundaries of the District to be so established shall be as set forth in the Notice of Hearing in Section 7 hereof.

Section 3. The District is to be created for the purpose of constructing, repairing, and maintaining roads within its boundaries through the construction, purchase, gift, condemnation or any combination thereof of the facilities or systems necessary to provide said services, and to finance the same, among other ways, through the receipt of Mineral Lease Payments as provided in the Trust Land Management Act, Chapter 1, Title 65B, Utah Code Annotated, 1953, as amended.

Section 4: The District so created shall be known as "San Juan County Transportation Service District".

Section 5: A public hearing on the question of the creation of the District shall be held by the Board of County Commissioners at 2:00 P.M. on October 10, 1988, at which time and place all interested parties may appear and be heard either in support of or in opposition to the creation of the District as more fully described in the Notice of Intention set forth in Section 7 hereof.

Section 6: A Notice of the Intention to create the District shall be published at least once a week during three consecutive weeks, the first publication to be not less than twenty-one (21) days nor more than thirty-five (35) days before the hearing, in the San Juan Record, a newspaper having general circulation in San Juan County.

Section 7: The Notice of Intention to be published shall be in substantially the following form:

NOTICE OF INTENTION TO ESTABLISH

SAN JUAN COUNTY TRANSPORTATION SERVICE DISTRICT

NOTICE IS HEREBY GIVEN THAT on September 12, 1988, the Board of County Commissioners of San Juan County, Utah, adopted a Resolution declaring that the public health, convenience and necessity require the establishment of a Special Service District, to be called "San Juan County Transportation Service" (the "District") for the purpose of construction, repairing, and maintaining roads within the boundaries of the District. The Resolution also provides for a public hearing on the establishment of the District in the County to be held at the San Juan County Commission Chambers in Monticello, Utah, at 2:00 P.M. on October 10, 1988.

DESCRIPTION OF THE PROPOSED DISTRICT The District shall have the following boundaries:

Beginning on the Eastern Boundary of the State at latitude 38 30' North, thence West to the middle channel of the Green River, thence Southwesterly down the middle of the channels of the Green and Colorado Rivers to the Southern boundary of the State. Thence East to the Eastern boundary of the State thence North to the point of beginning; Less the boundaries of the incorporated areas of City of Monticello and the City of Blanding.

PROPOSED SERVICES

The District will be authorized to construct, repair and maintain roads, to be located within the District, together with acquisition of necessary facilities, appurtenances and equipment therefor.

METHOD OF FINANCING

Pursuant to the provisions of the Utah Special Services District Act, Chapter 23, Title 11, Utah Code Annotated, 1953, as amended and Article XIV, Section 8 of the Constitution of Utah, the District may annually impose fees and charges to pay for all or a part of the services to be provided by the District. It may also annually levy taxes upon all taxable property within the District to provide the proposed services, and may issue bonds for the acquisition and/or construction of facilities or systems to provide said services, provided, however, that said levy to provide said services or to repay said bonds, must be authorized and approved by a majority of the qualified electors of the District at an election for that purpose. In addition, pursuant to the provision of Section 65B-1-2, Utah Code Annotated 1953, as amended the District may receive all or any portion of the monies to be allocated and distributed by the Utah Department of Transportation under said provision for the purposes set forth therein.

PUBLIC HEARING ON PROPOSED ESTABLISHMENT OF SPECIAL SERVICE DISTRICT

The Board of County Commissioners will hold a public hearing on the establishment of the District and the constructing, repairing, and maintaining roads within the District at the San Juan County Commission Chambers at 2:00 P.M., on October 10, 1988. Any interested person may protest the establishment of the District or the furnishing of services therein either orally at the hearing or in writing, at or at any time prior to the hearing. Written protests must be filed with the County Clerk, and may be withdrawn by the protestant at any time before the County establishes or abandons the District.

Any protest signed on behalf of a corporation owning property in the District shall be sufficient if it is signed by the president, vice president, or any duly authorized agent of the corporation. Where title to any property is held in the name of more than one person, all of the persons holding title to the property must join in the signing of the protest.

At said public hearing, the Board of County Commissioners will give full consideration to all protests which shall have been filed and will hear and consider all interested persons desiring to be heard. The Board of County Commissioners may continue the hearing from time to time. After conclusion of the hearing, the Board of County Comnissioners shall adopt a resolution either establishing the San Juan

County Transportation Service District or determining that the establishment of the District should be abandoned, or may, in its discretion, reduce the boundaries of the District and establish the District by resolution, as modified.

If, within fifteen (15) days after the conclusion of the hearing, over fifty percent (50%) of the qualified voters of the territory proposed to be included within the District or the owners of over 50% of the taxable value of the taxable property included within the proposed District file written protests against the specified type of service to be provided within the District with the County Clerk, the Board is required by law, in the former instance, to abandon the proposed establishment of the District and, in the latter instance, to eliminate the type of service objected to from the resolution finally establishing the District.

Any person who shall, at or any time prior to the date and time above-specified for the hearing, file a written protest with the County Clerk against the establishment of the District and whose property has been included within the boundaries of the proposed District notwithstanding such protest, may, within thirty (30) days after the adoption of the Resolution establishing the District, apply to the District Court of the 7th Judicial District for a writ of review of the actions of the County in establishing the District, only upon the grounds, however, that his property will not be benefited by the services authorized to be furnished by the District or that the proceedings taken in the establishment of the District have not been in compliance with law.

A FAILURE TO APPLY FOR SUCH WRIT OF REVIEW WITHIN THE PRESCRIBED TIME SHALL FORECLOSE ALL OWNERS OF PROPERTY WITHIN THE DISTRICT SO ESTABLISHED FROM THE RIGHT TO FURTHER OBJECT THERETO.

Section 8: The officers of the San Juan County, Utah, are hereby authorized and directed to take all action necessary or appropriate to effectuate the provisions of this resolution.

Section 9: If any one or more sections, sentences, clauses, or parts of this resolution shall, for any reason, be questioned or held invalid, such judgement shall not affect, impair, or invalidate the remaining provisions of this resolution, but shall be confined in its operation to the specific sections, sentences, clauses, or parts of this resolution so held unconstitutional and invalid, and the inapplicability and invalidity of any section, sentence, clause or part of this resolution in any one or more instances shall not affect or prejudice in any way the applicability and validity of this resolution in any other instances.

Section 10: All resolutions, by laws and regulations of San Juan County, Utah, in conflict with this resolution, are hereby repealed to the extent only of such inconsistency. This repealer shall not be construed to revive any resolution, by-law, or regulation, or part thereof, heretofore repealed.

Forest Service/Translator Site Fees - Administrative Assistant Rick Bailey has prepared a draft letter from the County to J.S. Tixier, Regional Forester, with comments regarding the 2710-Notice of a Proposed Revised Fee Schedule for Contnunication Uses and Request for Public Review and Comments. " The proposed revision indicates that local and state governments may receive waivers of fees. While this consideration is appreciated, the Forest Service will continue to plague local and state governments with the burdensome and costly application process required as often as yearly for this waiver. All of the services that local and state governments provide are public services in one way or the other. These public services include communication services for public safety agencies, ambulances, emergency rescue operations including fire, and other governmental services such as roads and health services. Many of these areas provide initial backup conmunication for federal governmental agencies, including the Forest Services, which in most cases is provided free of charge. San Juan County urges this exemption and a good faith consideration that we are all serving the public, taxpayers for the same purpose that being to provide services and not bureaucratic red tape."

Commissioner Black reported that at the UAC meeting held last week County Commissioners adopted a resolution opposing any fee assessed to counties, states and governmental entities for public purposes.

Revolving Loan Fund/Application - In order to set a date as to when the applications for funding from the County Revolving Loan Fund should be in, Administrative Assistant Rick Bailey suggested a quarterly cycle of every three months beginning October 1. If there are no funds available in any subsequent quarter a notice would be given stating such. There is approximately $73,000 available for those who meet the qualifications.

Montezuma Creek Police Substation Remodeling - Upon review of the Tri-Hurst bid for the remodeling of the Montezuma Creek Police Substation, it was determined that Mr. Hurst had not received the addendum to the plans. Mr. Hurst will review his bid and submit a new amount based on the reduction of the addendum. As soon as that is received, Administrative Assistant Rick Bailey will contact the CIB board for their approval of the funding.
