The San Juan County Commission met in regular session on May 11, 1987 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.
The following member were present: Commissioner Black, Chairman
Commissioner Bailey Commissioner Maryboy
Minutes of the May 4, 1987 Commission Meeting were approved with the corrections on the motion of
Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.
COMMISSIONER CALVIN BLACK'S REPORT
San Juan Water Conservancy District Board - Commissioner Black said that there are three members on the
Water Conservancy District Board whose term expired December 31, 1986 and were never re-appointed.
Commissioner Black recommended that Norman Nielson of Blanding, Emery Hunt of Mexican Hat, and Clemma
Johnson of Bluff be re-appointed to serve on the board. Commissioner Maryboy made the motion approving
these appointments and Commissioner Black seconded the motion. UNANIMOUS. All three members terms will
expire 12-31-89.
Nursing Home Week May 11-16 - The Four Corners Regional Care Center is celebrating Nursing Home Week May
11-16. Many activities are planned for the week.
Land Board Meeting - Commissioner Black said he will be in Salt Lake tomorrow and plans to attend Land
Board Meetings Wednesday and Thursday.
San Juan Marina Dedication - The San Juan Marina Dedication is Friday May 15 at 11 a.m.
Bus Service - Commissioner Black suggested that members from the Development Board, Commission, MITE,
Blanding and Monticello city councils, UNDC, Navajo Tribe meet together with Continental Trailways to see
if they will reinstate the bus service in San Juan County and also consider expanding service through the
reservation.
Utah Hospital Leader's Digest - An article in the Utah Hospital Leader's Digest read "1986 Hospital
Closure High." More hospitals closed in the U.S. in 1986 than in any other year of this decade. A total
of 83 hospitals in 27 states closed their doors and 21 of these were state or local government owned.
Small Miners - A newsletter stated that the House Interior and Insula Affairs committee has passed out a
bill to repeal the two acreage exemption in the surface mining control and reclamation act of 1987.
Commissioner Black said this will have a negative impact on small miners.
COMMISSIONER KENNETH BAILEY'S REPORT
Road School - Commissioner Bailey reported the road school in Moab was very good. Commissioner Bailey
said the school bus routes are not getting into the Needs Study. Commissioner Bailey said he made a
presentation to the Highway Commission Friday morning stating that mineral lease funds should not be used
on state highways, they should be used in the counties the funds came from. Dyke LeFevre, UDOT, said they
have been authorized and allowed to use the mineral lease funds on state highways. Commissioner Bailey
said he stressed that the mineral lease fund is Impact Money and gas tax funds should be used for state
highways.
Dust Guard - Commissioner Bailey said that at the road school they showed a product similar to dust guard.
Commissioner Bailey said they would like to try this on the road to Paiute Farms because it is really
dusty. One gallon will treat 1000 gallons of water and will cost approx. $500 a mile to stabilize the
dirt road. Commissioner Bailey said the road department will proceed on getting prices. The Commission
agreed that this would be worth a try.
Needs Study - The next Needs Study meeting is in Salt Lake on June 17 at 10 a.m. at the UDOT office
building.
City Streets Agreement with County - Commissioner Bailey said it is the responsibility of the cities, per
agreement, to seal the cracks and patch the streets. The employees have not been trained properly so the
road department will hold a seminar to teach the road crews in both Monticello or Blanding how to seal and
patch the streets. Commissioner Bailey said he would like permission to go into both Blanding and
Monticello when the city and county road crews are working on the roads and use the vibrating roller tc
make the patches smoother.
Skelton, Inc. Agreement Contract Gravel - Commissioner Bailey made the motion approving a contract
agreement between San Juan County and Skelton, Inc. for gravel crushing at the Bluff pit and authorized
Commissioner Black to sign the contract. Commissioner Maryboy seconded the motion. UNANIMOUS. The
contract was reviewed and approved by Craig Halls, county attorney and Doug Pehrson, county engineer.
Roads on Reservation - The Tribe is requiring that the county get right-of-ways to do road work on the
reservation. The Commission asked Commissioner Maryboy to help the county get right-of-ways from the
Tribe and also have the Chapters Tribal Councilman and Chairman get involved.
Generator - Keith Ivins - Commissioner Bailey said that Keith Ivins would like to purchase the generator
from the county for $1500 plus he owes $100 in rent. Commissioner Bailey made the motion to approve the
sell of the generator to Mr. Ivins. Commissioner Maryboy seconded the motion. UNANIMOUS.
COMMISSIONER MARK MARYBOY'S REPORT
Goats Killed on Reservation - Commissioner Maryboy said it was reported to him that nine goats were killed
on the reservation on the south of the San Juan River. The Navajo Ranger and the State Ranger were
notified and are investigating this matter. The Navajo families are concerned about this because it has
been an on going problem. Commissioner Maryboy said he reported this to the county sheriff and will talk
to the BLM because some people think it maybe the river runners.
Navajo Land Purchase - West Water - Commissioner Maryboy reported that he talked to the people at the
Navajo Land Administration and they said the Navajo Tribal's Attorney General sent a statement to the BLM
office agreeing to buy the land at West Water as "fee land".
Montezuma Creek Police Department - Commissioner Maryboy said the Navajo Police Department in Window Rock
would like to reschedule a meeting to work on the Navajo Police building at Montezuma Creek.
Proposals - Baseball fields and fire trucks - Commissioner Maryboy said he plans to follow up on the two
proposals the county submitted to the Tribe on the baseball fields and fire trucks. The county also needs
to submit a request to the Tribe on the Senior Citizen program. Rick Bailey said he is working on it.
Land Sale - The people in Monument Valley and Oljato are concerned about the sale of state school
sections of the reservation. Commissioner Black said he talked to the Director of State Lands about this
and they agree that next time there is an exchange of state lands on the reservation the Navajo people!
will be notified and asked for their input and involvement.
FOREST SERVICE - DRY WASH RESERVOIR
Bob Day, District Ranger, and Joe Bistryski met with the Commission to discuss the status of the road construction in the area of the Dry Wash Reservoir. Mr. Day said he attended a meeting in which representatives of the Blanding Irrigation Company, San Juan Water Conservancy District, and the City of Blanding were present. They are all involved in the building of the Dry Wash Reservoir but the permit is in the name of the State Division of Water Resources. Mr. Day said he asked them to clarify who is really responsible for the project. Commissioner Bailey said the road construction was discussed this morning at the road meeting. The following letter explains what the county will do:

Dear Bob:
I am writing in reference to the road construction project on the Johnson Creek Road in the area of Dry Wash Reservoir. This project is located approximately 10 miles north of Blanding, Utah on County Road #285.
At the present time, San Juan County and the Forest Service have a cooperative agreement in which San Juan County will construct segments of this road while the Forest Service will perform the design engineering and supply the culverts for the projects. Two projects were completed under this agreement several years ago. Another project is planned for construction this summer in the area of Dry Wash Reservoir.
1There are presently two roads which are used to get from one side of the reservoir to the other. The plan is to obliterate these two roads and construct 3300 feet of new road to the west. This is due to plans by the Blanding Irrigation Company to raise the Dry Wash Dam which would inundate the existing
roads.
We fee the new route, as designed by the Forest Service is the best route. We feel this new route should be constructed regardless of whether or not the dam is raised. We wish this new Alignment because we want the road constructed away from the reservoir.
The Forest Service has designed a route under the present agreement. We feel that the raising of the dam will have no effect on the construction of the road. The road must be relocated away from the reservior regardless of whether the reservior is increased in size or not. The number of culvert required by the alignment change made the Forest Service are identical to the culverts required if the road remained in its present location west of Dry Wash Reservior.
We feel that the agreement presently in effect has been very beneficial to both San Juan County arid the Forest Service. We would like to continue improving roads on the Forest in the future as outlined in the present agreement.

PERSONNEL POLICY - SHERIFF'S DEPARTMENT
Claude Lacy, Sheriff, met with the Commission to discuss an employee who was injured and is now receiving workman's compensation and also sick leave from the county. Mr. Lacy explained that the employee didn't report the claim at the time of the accident. Eleven days after the accident he called the secretary and said he was injured and the claim was filed with the Industrial Commission 28 days later by the secretary. The Commission asked Rick Bailey, Administrative Assistant, to draft a memo stating that county employees should report an injury immediately after the accident and it should be reported to the supervisor department head and the claim be signed by the supervisor.
WEED BOARD APPOINTMENTS
Jim Heaton, county weed agent, met with the Commission to discuss the weed control board. Mr. Heaton said that two people need to be appointed to the county weed board and recommended Bob Blankenagel of La Sal and Roy Pehrson of Bluff. Commissioner Bailey made the motion appointing Mr. Blankenagel and Mr. Pehrson with terms of four years expiring May 11, 1991. Commissioner Maryboy seconded the motion. UNANIMOUS.
WEED DEPARTMENT - SUMMER HELP
Jim Heaton, county weed agent, met with the Commission for approval of summer part time help. The Commission asked Mr. Heaton if he had contacted Job Service and also check all the applications at the road department. Mr. Heaton said he checked the applications at the road department and will check witin Job Service tomorrow. The Commission stressed that all county departments should contact Job Service when there is a job opening.
BIDS - SPRINKLING SYSTEM - COURTHOUSE
Dell Hunter, janitor, presented the Commission three bids for the sprinkling system at the courthouse. The following bids were received: Monticello Plumbing & Heating $4369.27, Redd Plumbing $3590.00, and Whipple Plumbing $3959.51. Mr. Hunter recommended Redd Plumbing because of low bid. Commissioner Maryboy made the motion approving Redd Plumbing and Commissioner Bailey seconded the motion. UNANIMOUS.
HOSPITAL ADMINISTRATOR - Physicians Recruitment
John Fellineth, hospital administrator, met with the Commission to discuss recruiting of physicians. The Commission believes at least two doctors need to practice in Blanding because Dr. Redd plans to leave in June.
HOSPITAL EQUIPMENT
Mr. Fellmeth said he would like to buy one ultrasonic nebulizer's with stand from Home Medical Equipment for $795. The Commission approved the purchase but it will be put on the hospital board agenda for ratification.
RECREATION - GOLF COURSE
Grant Leavitt, golf course manager, met with the Commission to discuss equipment purchases for the Monticello golf course.
COUNTY AUCTION
Gail Johnson, clerk reported to the Commission that the county brought in approx. $26,000 at the county
auction.
ELK TRANSPLANT ISSUES- FOREST SERVICE
The Commissioner received a letter from the Forest Service and the BLM canceling the meeting that was set for 5-12-87 to discuss the proposed elk transplant. The letter suggested that the appealants organize their own meeting, invite the agencies, as they see fit, and select their own representatives or
spokesman.

RE: Request for Proposals (DFCM RFP 3-87) Gentlemen:
It is with pleasure that the San Juan County Commission presents you with the application of the City of Monticello and San Juan County for the proposed 2,000 bed regional prison facility.
We believe that the site offered in the application is very suitable and will provide the State with the best possible location for the prison. The site will be donated to the State by the City o Monticello. All utilities needed by the facility are within a short distance and all have sufficient capacities to serve the prison. Most, if not all the utilities companies have agreed to provide all materials to the site for hookup at no cost to the State. San Juan County has agreed to furnish necessary access roads from US 666 to the site.
As you are aware, the County has been involved in attempting to secure such a facility as this for several years and the Department of Corrections has been in the area reviewing potential sites over the past years.
The addition of such a facility to the City of Monticello and San Juan County would provide economic support and stability to this area of the State. We believe that governmental services such as schools, roads, police and fire can support the facility without additional increase of staff, building or equipment. A substantial number of suitable employees would also available within the County to staff the facility.

PERSONNEL POLICY - HIRING POLICY
Rick Bailey, Administrative Assistant, asked the Commission for permission to draft a memo of new hiring procedures for the county personnel policy. The Commission approved the request and said the memo should clarify that Job Service be contacted for every job opening.
SENIOR CITIZENS DIRECTOR - MONTICELLO
Rick Bailey, Aging Director, said he interviewed applicants last week and selected a person for the senior citizen director of Monticello. Mr. Bailey recommended that Mary Ann Brown be hired at $5.13 per hour part-time at 20 - 25 hour per week with no benefits. Commissioner Bailey made the motion to approve the hiring of Mrs. Brown and Commissioner Maryboy seconded the motion. UNANIMOUS.
STATE DIVISION OF MENTAL HEALTH
Charles Patterson and Don Mueller, State Division of Mental Health, Bruce Shumway, Social Services, Mark Lyman and Garth Skousen, Mental Health, met with the Commission. Mr. Mueller said they are visiting all the county mental health employees around the state and are discussing the new program. The contract this year will be between San Juan County Mental Health and the Utah State Division of Mental Health, the county will have to contract with Social Services. The Commission asked Bruce Shumway to review the contract and will also ask the county attorney to review the contract.
PRIVATE PRACTICE - MENTAL HEALTH STAFF
Bruce Shumway, Social Service Director, Garth Skousen and Mark Lyman, Mental Health Staff met with the Commission to discuss private practice by Mental Health Staff. The Commission said the proposal as outlined is very good and will have the county attorney review it. The Commission said there is a potential for several problems but if they are recognized now and very specific guidelines are set so there is no guessing and it has a good chance of working. Mr. Shumway recommended that if the private practice requests are approved, that they be reviewed again in six months or a year, and the option to reject the approval be retained.

ALCOHOLISM AM) DRUGS - SAN JUAN COMMUNITY SOCIAL SERVICES FY 88
Bruce Shumway, Social Services, presented the Commission the Alcoholism and Drugs Comprehensive plan for FY 88. The Commission will review it and put it ont he agenda next week for approval.
MONTEZUMA CREEK NAVAJO POLICE STATION
The Commission received the following letter concerning the Montezuma Creek Elementary School lease:

This letter is in reference to a facility and site, the former Montezuma Creek Elementary School and your lease with the Navajo Nation for use of the facility. Our department, Industrial Development Department, has been approached by a prospective tenant for the facility concerning lease negotiations for the entire facility to establish a manufacturing plant and create employment for the area.
It would be appreciated if you could inform us if you still wish to develop and utilize the facility. If you do not have any immediate need for it, your relinquishment back to the Navajo Nation in writing, would
be appreciated.
