SAN JUAN COUNY COMMISSION MINUTES JANUARY 11, 1988

The regular session of the San Juan County Coimiission convened at the hour of 10:00 A.M. at the San Juan County Courthouse, Monticello, Utah.

A motion to approve the minutes of January 4, 1988 as corrected was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

CURRENT BUSINESS

County Roads - Sandy Johnson reported that the County roads in Fry Canyon going up through Horse Flatsf on the Bears Ears especially Maverick Dugway and the Hideout Mine area are in need of repair. Mr. Johnson will stop in Blanding and talk to Bernal Bradford about these roads and Commissioner Bailey will report these conditions to the County Road Department.

Missing Trailer - Road Department - A couple of years ago a trailer belonging to the road department turned up missing after the County auction. The Commission requested the Sheriff's department to follow-up to see if they could determine what happened to the trailer. A similar trailer had been purchased by Rex Anderson. Contact with Mr. Anderson indicated he thought he had purchased both trailers and subsequently had resold them to other individuals. Mr. Anderson said he would pay the Road Department for the second trailer.

Aneth BIA School Roads - A request was received from the Aneth BIA School for improvement of 125 miles of unpaved roads used by school buses. Conmissioner Maryboy will submit the request to the UNDC Board for their consideration and recommendation to the County. Commissioner Bailey will submit the request to the road department and check to make sure all the roads are County roads. Those not on the B Road system need to be taken to the BIA, Navajo Tribe and the DOT to be put on the B Road System.

Beer License - A motion to approve the Beer License for the Mexican Hat Trading Post was made by Conmissioner Bailey and seconded by Conmissioner Maryboy. UNANIMOUS.

UAC Meeting on Assessing & Collecting - A meeting of the Utah Association of Counties to discuss the assessing and collecting issue will be held at noon on Friday, January 15th. - The UAC wants to draft an inter-local governmental agreement and/or have the State Tax Commission take over the assessing and collecting as a uniform levy. If the State Tax Commission would levy the tax like the Uniform School Levy instead of the counties levying the tax then it would be constitutional. However, the state does not want to take it over. The State Attorney General has given the opinion that the present legislation on assessing and collecting is unconstitutional as the counties do not have the power to mandate a uniform tax rate. If the legislature would give the State Tax Commission authorization, the State Tax Commission would be able to do it.

There was not enough budgeted in the 1987 San Juan County assessing and collecting budget to cover the tax litigation case. The County wanted to amend the 1987 budget to include these costs and not have to contribute money to the State because the levy on the initial budget makes San Juan County one of the few contributing counties. The state refused the requested amendment. They did give the County a letter saying that the deficit could be carried over as a cost in the 1988 budget. If the present law is repealed, the County would be required to pay all assessing and collecting costs from the general fund. The County would not be interested in entering into an inter-local governmental agreement unless the other counties were willing to let us get reimbursed for all our 1987 costs. Administrative Assistant Rick Bailey will represent the Commissioners at the meeting as none of then are able to attend. Computers - Hospital/Courthouse - John Fellmeth discussed the need to upgrade the computers at the hospital and the courthouse. The present system is the IBM System 34 which went out of production about five years ago. Mr. Fellmeth presented four options for upgrading the computers.

1. Upgrade the Hospital System 34 to IBM System 36. Purchase new financial software to run on the Hospital's 36 from Professional Medical Systems Inc. Leave the System 34 and the existing software in the courthouse. The total initial expense would be $25,000 with a monthly fee of $800.

2. Upgrade the Hospital and Courthouse System 34's to IBM System 36's. Purchase new license for our existing software from J & K. The total initial expense would be $59,600 with monthly fees of $580.

3. Purchase new Hospital System from HAS. Leave the courthouse hardware and software the way it is. Ongoing monthly fees would be $2,000.

4. Upgrade Hospital system to a System 36. Purchase a new system for the courthouse from Progressive Management Systems (Art Partridge). The total initial expenditure would be $120,983 with ongoing monthly fees of $2,193.

Conmissioner Bailey made a motion to accept option #2 as recommended by Mr. Fellmeth. Coimiissi oner Maryboy seconded the motion. UNANIMOUS.

As there will be quite a bit of work involved in the changeover, Mr. Fellmeth would like to start on the Hospital computer and get it into operation before changing the courthouse computer.

Commissioner Bailey asked Mr. Fellmeth if a separate computer at the road

department could be operated independently of the courthouse computer. Mr. Fellmeth indicated there would be no problem. He had ordered the parts necessary to repair the computer but has not had time to install them.

Tax Notices - County Treasurer Marian Bayles and County Assessor Barbara Montella met with the Cormissioners to discuss the present property tax notices. The Commissioners feel that the present tax notice used by the County is confusing to the taxpayers as it does not give the actual market value of their property. The possibility of changing the tax notice to show both market value and the taxable value as well as the taxes for the previous year was discussed. Administrative Assistant Richard Bailey will work on a new notice to present to the Commission.

Public Safety Building - A motion authorizing Chairman Black to sign the change order for the Public Safety Building was made by Coimiissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS. County Purchases - The following bids were received:

1-7 ton End Lift Jack - Monticello Snap-On Tools, $1,810

Gray Automotive Prod. Co., $1,729

Burnisher - Gabriel Service & Supply Co., $ 895.00

Magic Chemical Company, $1,495.00

Conmissioner Bailey made a motion to approve the purchase of the End Lift Jack from Gray Automotive Prod. Co. for $1,729 and the Burnisher from Gabriel Service and Supply Co. for $895.00. Commissioner Maryboy seconded the motion. UNANIMOUS.

ADMINISTRATIVE ASSISTANT RICHARD BAILEY'S REPORT

Mi Vida Ore Cars - Recently Rusty Musselman made a request to use the old ore cars at the Mi Vida mine for scrap iron. Richard Bailey drove down and took pictures to show the condition of the cars. A snow storm prevented close inspection of the cars at the time Mr. Bailey took the pictures. There are approximately 14 to 20 cars visible but there may be more in the portal. The commissioners felt that there may be people who would like to purchase one or more of the cars and should be given that opportunity at the

County auction.

Ccmmunity Nursing Service - The County is not interested in giving any additional funding to the Community Nursing Service for home nursing care if the Southeastern Health District could provide that service. The County has provided and is willing to continue to provide a vehicle for use by the CNS if they want to continue providing those services to the people of the County.

Microwave Repeater System - The present microwave system in the Sheriff's department is obsolete and cannot be relicensed. Administrative Assistant Richard Bailey requested authorization to order a new system before prices increase the first part of February. A new unit will cost approximately $23,000f to be part of the new Public Safety Building. It will replace the County microwave system. A deal has been worked out where the State can use our microwave repeater and in turn they will give the County the dial tones for Moab, Price, Provo and Salt Lake and provide the dial tones for the computer system which is costing us about $65 a month for that alone. Mr. Bailey feels we can recoup our costs by putting that in. Phone signals cannot go through the present system but will be available in the new system. Commissioner Bailey made a motion to authorize the purchase of the microwave repeater system. Commissioner Maryboy seconded the motion. UNANIMOUS.

County Purchasing Policy - Local Preference - The Commission has previously discussed the policy of giving a 2% preference to San Juan County vendors when bidding on items needed by the County. A motion to approve the policy was made by Commissioner Bailey and seconded by Conmissioner Maryboy. UNANIMOUS.

Executive Session - A motion to dismiss the regular session and convene in an executive session to discuss the tax litigation case with Attorney Lyle Anderson was made by Commissioner Bailey and seconded by Conmissioner Maryboy. UNANIMOUS.

The regular session was reconvened by motion of Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

COMMISSIONER MARK MARYBOY'S REPORT

Fire Truck - The Bluff area residents are anxious for the County to go ahead on the purchase of a used

fire truck for the Bluff area. Administrative Assistant Richard Bailey indicated that if the used truck

became available, someone from the County would need to go look at it to make sure it is in good

condition. The Commissioners indicated they would be in favor of Joe Slade, Monticello Fire Chief, going

to look at it.

Aneth Meeting - County Attorney Craig Halls and Conmissioner Maryboy will attend an Aneth Chapter meeting

regarding the organization of a labor union to help the Navajos settle grievances with the oil companies.

Bluff Sr. Citizen Bus Driver - Some Bluff area residents are concerned that the bus driver for the Senior

Citizens is not a local resident. Rick Bailey reported that the position had been advertised and that

there were no Bluff residents that applied for the position.

Navajo Tribe - Health Services - Conmissioner Maryboy reported that the Navajo Tribe is making application

to transfer more Social Service programs to the Tribe. Many of the reservation residents are concerned as

they are not receiving the services they need from the Tribe. Commissioner Black indicated that the

residents needed to write to the Governor and the Navajo Tribal officials to express their concerns.

COMMISSIONER KENNETH BAILEY'S REPORT

Bluff Cemetery - County Surveyor Doug Pehrson has made a survey of the Bluff

Cemetery to indicate property owners in the immediate area. Walt Purcell, Ray, Tim and Corey Perkins and

Robert and Lyle Anderson are the owners of the property in question. The Commission feels that a cemetery

district should be formed and the property deeded to the cemetery district. A letter and the survey will

be mailed to Steven Boos of Bluff who has indicated an interest in forming the cemetery district. A copy

of the proposal will then be sent to the Andersons.

Business Financing - Conmissioner Bailey feels there are no funds available through the local banks for

funding of new businesses. Commissioner Black indicated that with proper collateral funding would be

available to anyone making application. If there are legitimate complaints, the Commissioners are willing

to ask banking officials to explain their policies to the Commission.

Long Canyon Agreement - County Attorney Craig Halls and County Surveyor Doug Pehrson have met and drafted

a letter agreement on the Long Canyon Road changes. The agreements will be mailed to Max Dalton, Neldon

Holt and Richard Lyman for their approval. The Commission will meet with interested parties next week to

work out a final agreement.

Copper Canyon Road - When Congressmen Howard Nielson met with the Commissioners he indicated there would

be a good chance of receiving a federal appropriation to construct the Copper Canyon Road. Conmissioner

Black indicated that Senator Jake Garn, as Chairman of the Appropriation Committee, would be the proper

person with which to make application. The County would need to submit cost estimates, engineering

designs, and maps along with resolutions from all the Utah Chapter officials and letters from the

residents for the application.

BLM Property - Administrative Assistant Richard Bailey was asked to get information on the sale of a

parcel of property which had been sold by the County to Joe Redd probably in the 1930s. The property was

subsequently sold to Jim Blankenagel. Later it was determined the property belonged to the BLM and not to

the County.

COMMISSIONER CALVIN BLACK'S REPORT

San Juan Resource Management Plan - The Commissioners discussed changes that need to be made in the draft statement to the BLM regarding the County's opposition to the ACEC's in the BLM San Juan Resource Management Plan.

Land Board Meeting - Commissioner Black attended the State Land Board meeting last week where several issues were discussed. One major area of concern is the Lake Powell Land Trade. Research and other needed information is being compiled. Navajo Tribe officials have been contacted on the parcels of reservation land to be included as part of the land trade. Mr. Black also met with Bob Weidner from Senator Jake Garn's office, Pat Spurgeon, Director of the State Land Board, Sam Taylor and John Williams, from the five-county AOG, on getting a group together to push the Land Trade proposal.

Mental Health - A special State Mental Health Board meeting will be held Monday, January 18th. The purpose of the meeting is to listen to comments from various organizations and individuals who care to verbally address the board regarding the divisions issue paper on long-term care evaluation costs and pass through funds. Conmissioner Black will formulate a letter for that meeting indicating that people ought to be entitled to the same level of service whether in an urban or rural area. When funding is based on a per capita basis the rural areas receive less than half the services as the urban areas.

PUBLIC HEARING

County Bmployee Cost of Living Increase - A public hearing was convened at 2:00 p.m. for the purpose of public conment regarding the cost of living increase for all County employees including elected officials. There were only five people attending the hearing and their concerns were as to whether all County employees were being considered or if selected individuals would be excluded. The Commissioners explained that funds had been set aside in the budget for all employees to receive a one-step (4.177%) cost of living raise. Action was deferred until the next Conmission meeting.
