NOVEMBER 10, 1986

The San Juan County Commission met in regular session on November 10, 1986 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Black, Chairman

Commissioner Bailey Commissioner Holliday

Minutes of the November 3, 1986 Commission Meeting were approved on the motion of Commissioner Holliday and seconded by Commissioner Bailey. UNANIMOUS.

MI-VIDA MINE ROYALTY DUE

Gail Johnson, clerk, presented the Commission a check for $211.14 of royalty due from the Mi-Vida Mine. The total pounds produced to date is 10,248.

LONG CANYON POINT - ROAD - MAX DALTON

The Commission received a letter from Max Dalton describing the history of the Long Canyon point road. Mr. Dalton requests that this road be a private road. The Commission will give a copy to Bruce Halliday, county attorney, to follow up on this.

HILL-BURTON OBLIGATIONS - NURSING HOME

Rick Bailey, Administrative Assistant, reported that the Hill-Burton obligations on the Nursing Home needs to be worked out to provide a clear title. Mr. Bailey said that Mrs. Maxine Frost, Southeastern Title Company, asked if the county was willing to sign a hold harmless agreement to assure the buyer that the obligations would not affect the nursing home. The Commission said they would sign the agreement.

PUBLIC SAFETY BUILDING - VERNAL

Rick Bailey, Administrative Assistant, reported that he and Sheriff Wright visited the jail facility in Vern&l and then met with the Motorola people in Salt Lake last week.

FIRE WARDEN CONTRACT POSITION

Rick Bailey reported that he received a draft copy of a Contract for a Fire Warden from Mike Grosjean, the Regional Manager of State of Utah Natural Resources. Mr. Bailey said he would review it and invite Mr. Grosjean to meet with the Commission to discuss it.

SAND & GRAVEL APPLICATION

The Commission received a sand and gravel permit application from "A Very Hot Production, Inc." to remove material for use in the production of a movie. The land is located in San Juan County in Section 3: SW4NW4, and Section 4: SE4NE4, NE4SE4, T27S, R21S, SLB&M. The Commission said there is no problem with the approval of the permit.

CANYONLANDS NEEDLES DISTRICT - NATIONAL PARK SERVICE

The Commission received a copy of a letter to Carl Eisemann from Peter L. Perry, Superintendent of the National Park Service of Arches and Canyonlands National Parks. The letter says they appreciate the interest shown by San Juan County in having a cooperation effort in the development planning for the Needles District of Canyonlands National Park. (Congress approved $495,000 for planning in the Needles.) Mr. Perry says they will designate a National Park Service planning team and there will be opportunities for public input. The Commission asked Commissioner Bailey to write a letter to Mr. Perry stating that this committee work with them in the development as a local government partner and not only as a public or interest group.

HOVENWEEP EXPANSION - NATIONAL BLM ADVISORY COUNCIL

Commissioner Black reported that the Moab District BLM Advisory Council will be meeting on November 20 in Moab. The council will be visiting the Hovenweep area to meet with the counterpart in Colorado Thursday evening to discuss the proposal made by Environmental groups and the Park Service to enlarge Hovenweep National Monument in both Utah and Colorado. Then on Thursday night the council will stay in Monticello and meet at the BLM offices Friday morning. (The public is invited to give input.) Commissioner Black suggested that San Juan County submit a statement opposing the expansion.

NACO BOARD MEETING IN MIAMI

Commissioner Black reported that he attended a NACo board meeting in Miami last week. The board adopted a budget, approved some steering committee appointments and set the cities for the 1989, 1990 and 1991 conventions.

EMPLOYEE RAISE - RICK BAILEY

Commissioner Bailey said that after reviewing the information on the employee job evaluations from Jack Tanner, UAC, he would like to make a motion that Rick Bailey, Administrative Assistant, be raised to grade 21 step 4, effective November 1. Commissioner Holliday seconded the motion. UNANIMOUS.

RETIREMENT EMPLOYEES - NEW NON-CONTRIBUTORY PLAN

Commissioner Bailey reported on the county employee meeting that was held last Wednesday night to discuss the county adopting the new retirement non-contributory system. Bonnie Sweat, Utah State Retirement Board, gave a presentation and all the employees that were present agreed that the county should go with the new non-contributory system. New employees would automatically be on the new system and present employees would have six months to decide whether to stay with the old plan or change to the new non-contributory system. Commissioner Bailey made the motion that the San Juan County Commission adopt the new non-contributory system effective January 1, 1987. Commissioner Holliday seconded the motion. UNANIMOUS. A second motion was made by Commissioner Bailey that the 2.65% amount the county will save on the new system be contributed to the employees 401K retirement plan. Commissioner Holliday seconded the motion. UNANIMOUS. This does not include the Law Enforcement employees and Health Care employees and does not change them. The total contribution rate for the new system is 7% of salary as opposed to 9.65% in the present contributory system, providing a savings of 2.65%. In addition, by converting to the new plan, those employees who retire from the system will have their benefit increased by 4% to 8% because of the use of the three-year final average salary in the benefit calculation.

SAN JUAN HISTORICAL COMMITTEE

Commissioner Bailey made the motion that the Commission appoint Tom Austin to the San Juan County Historical Committee upon their recommendation. Commissioner Holliday seconded the motion. UNANIMOUS.

ROAD YARD IN MONOMENT VALLEY

Commissioner Bailey reported that Doug Pehrson, county engineer, received a letter from State of Utah Natural Resources regarding the proposed land sale to San Juan County in Monument Valley. (The land would be used for a road yard.) Mr. Stan Baker, land specialist, states that the land is not available at the present time but suggests the Commission submit a letter of interest to the state. A letter of interest

would not constitute "first rights" to a sale, it would have to be approved by the Utah State Land Board. Commissioner Bailey said he would follow up on this with the legal description and explain that the county wants to use it public purposes.

EXECUTIVE SESSION - SOCIAL SERVICES

At 2:00 p.m. the Commission went into an executive session with Bruce Shumway, Social Services, to discuss personnel problems.

NANCY PATTERSON ARCHEOLOGICAL SITE

Commissioner Black wrote the following letter to Congressman Nielson responding to his letter:

Dear Howard:

Thank you for your letter of October 24th, with respect to a proposal for designating the Nancy Patterson Archeological site as a National Monument.

In your letter you concur with our conditions 1, 2, and 3; but have concerns with conditions 4 and 5.

Condition 4 is that any artifacts removed be displayed only in San Juan County and that none leave the County. The condition is important because nearly all artifacts excavated by archeologist and government agencies are still being removed from San Juan County and always have been, even though there is a State Museum in Blanding that was specifically built so items from San Juan County could be displayed here.

We would agree that items could be taken out of the County for temporary display in other museums. We believe any studies should be funded and studied in facilities already here than being sent out.

Condition 5 would provide that management of Natural Bridges, Hovenweep and the proposed new National Monument and the Needles section of Canyonlands National Park be from an office located in San Juan County.

As you know, San Juan County has almost 20 percent of its land area set aside for preservation and protection in the form of a National Park, two National Monuments, and most of a National Park.

All of these are presently managed from Park Services offices outside of San Juan County and two of them are from outside the State of Utah. The only Park Service presence in the County is a small information office in Monticello which presently has only two employees.

Hovenweep National Monument is managed from Mesa Verde National Park in Colorado which is 51 miles away compared with Monticello which is 61 and Blanding which is 39 miles. Natural Bridges National Monument is only 40 miles form Blanding and 60 miles from Monticello, but 114 miles from Moab from where it is managed. The Needles section of Canyonlands National Park is only 46 miles from Monticello, 66 miles from Blanding, but is 74 miles from Moab where it is managed.

Because of the foregoing, we believe a management office could be located in San Juan County personnel be transferred from Mesa Verde and Moab for management of these Park Service areas and another National Monument and actually save taxpayers money in addition to better serving the Park visitors.

Commissioner Black received a copy of a letter from Wayne W. Flaherty, U.S. Federal Aviation Administration, to Monte Yeager, Utah Department of Transportation regarding the Halls Crossing Airport Site Selection and Master Plan. Mr. Flaherty said it is FAA's goal to support the best site for development of the airport and asked Mr. Yeager to cooperate with them in this. Mr. Flaherty asked for a copy of inventory, facility requirements, etc. from UDOT.
