MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD

JANUARY 10, 1983

The Board of County Commissioners met in regular session on Monday the 10th day of January, at the hour of 10:00 a.m. in the Courthouse at Monticello, Utah.

On roll call, the following members were present: Commissioner Calvin Black, Chairman

Commissioner Robert Low Commissioner Kenneth R. Bailey

Minutes of the previous week were read and approved upon the motion of Commissioner Low and the second of Commissioner Bailey and it carried unanimously.

BLUFF TO MONTEZUMA CREEK PROJECT REPORT:

County Engineer, Doug Pehrson, reported that Summit, Inc. will not be able to start on the Bluff to Montezuma Creek road project until a right-of-way is granted by the State Department of Lands for some 50 acres on the project. Since the. archaeological work has been completed, there should be no problem in obtaining the right-of-way within the next two weeks.

MI VIDA LEASE DISCUSSED:

Mr. Merv Lawton, a representative from Rio Algom Corporation Mining, met with the Commission concerning the county's lease to Minerals West for the Mi Vida property. Mr. Lawton reported that he has been discussing the lease agreement with Minerals West and he would like to know if the county would be willing to accept less than a 10% royalty, and if the royalty would be based on the yellow cake or the ore mined. The Commission made no commitment to Mr. Lawton, but recommended that he review the present lease agreement with the lessee and present a proposal to the Commission, at which time the Commission will make a decision on the royalty based on the best interests of the county.

RIO ALGOM ROAD REPAIRS REQUESTED:

Mr. Merv Lawton reported that the roads in the area of the Rio Algom mine, and especially the road to Rio Algom' s main gate, are in need of repair. He requested that these roads be graded and repaired when the weather permits.

MANCOS MESA ROAD:

Commissioner Bailey reported that the BLM does not recognize the Mancos Mesa Road as a Class "D" road,

and he would like to discuss this with the BLM when the Commission meets with them on February 1st.

ARCHAEOLOGICAL CLEARANCES NEEDED ON RESERVATION ROAD PROJECTS;

Commissioner Bailey reported that the Bureau of Indian Affairs has made an appointment to meet with the Road Superintendent, Bernal Bradford, at the Ismay gravel pit in order to work on the problems connected with the archaeological clearance requirements.

NUCLEAR WASTE INFORMATION OFFICE;

A letter was prepared for Mr. Carl Eisemann to take to the Office of Nuclear Waste(DOE),in Columbus, Ohio, stating that the county will agree to provide office space, equipment, furniture and utilities for the county's nuclear waste information office.

PERSONNEL POLICY DISCUSSED;

The Commission discussed the personnel policy regarding employee use of sick leave. It was stressed that department heads are responsible for checking with their employees to minimize abuse of the sick leave policy.

NETTA MCDONALD INQUIRES ABOUT EAGLE SCOUT PROJECT;

Mrs. Netta McDonald met with the Commission to inquire if there was a possibility of her son, Ricky, being able to find an area in the county near Monticello that would be suitable for ice skating. Ricky would like to help develop an ice skating pond as his Eagle Scout project. The Commission advised Mrs. McDonald to contact Bruce Adams and the San Juan Recreation Board for their recommendation and approval of such a project.

U.N.D.C. BOARD APPOINTMENT;

Upon the motion of Commissioner Bailey and the second of Commissioner Low it was unanimously voted to appoint Willie Grayeyes as the San Juan County representative to the Utah Navajo Development Council Board of Directors. Mr. Grayeyes has served on the Board as Vice-Chairman, and the Commission feels he will be able to represent the interests of the county.

NATIONAL PUBLIC LANDS ADVISORY COUNCIL REPORT;

Chairman Black reported on his attendance at the National Public Lands Advisory Council meeting in Phoenix, Arizona. The Council heard public statements on a variety of subjects; was taken on a field trip; and adopted resolutions supporting a flexible asset management program, and acceleration of mineral evaluations. Chairman Black and his fellow Utah council member would like to meet with Governor Matheson to formulate a State policy concerning National Public Lands In Lieu selections in preparation for talks with the BLM.

FRANK ROSE MEETS CONCERNING COMPUTER TIME REQUEST;

Mr. Frank Rose met with the Commission to ask if there was a possibility of the Community Social Services and Public Health offices in the county buying time on the county's IBM System 34 computer. The Commission requested that Mr. Rose contact Kermit Blake to find out if the computer would have the capacity, specifications and accessability required by their offices.

AGING PROGRAM EVALUTATION OF DELIVERY OF SERVICES;

Mr. Al Haskins presented the State Social Service's evaluation of the county's service delivery system for the Aging Program. The State reported that the delivery of services is excellent and most of the programs are in compliance with Federal and State Standards, but they requested that more detailed records and documentation be kept on the services delivered. Mr. Haskins will respond to the State's evaluation by January 31, 1983.

BILL REGER MEETS CONCERNING HEALTH SERVICES 1983 BUDGET;

Health Care Services Administrator, Bill Reger, met briefly with the Commission to confirm the 1983

approved budgets for the hospital and nursing home.

AUDIT PROPOSALS REQUESTED;

A proposal for the annual audit of San Juan County and the San Juan Hospital for the year ended December 31, 1982, was received from Smuin, Rich and Company. The Commission requested that the County Clerk also invite R.J. Fellmeth, Francis M. Lyman, and Larry D. Thompson to submit proposals for the annual audit of the County and County Health Care Services.

DELINQUENT TAX ON STATE ASSESSED PROPERTY DISCUSSED;

County Attorney, Bruce Halliday, reported that Bob Cooper, of the State Tax Commission, will make

jeopardy assessments for delinquent taxes on State assessed property upon receipt of copies of the

delinquent taxes from the county. The Attorney reported that he has sent the copies to Mr. Cooper,

and he will also request a list from the State of the equipment filed with the corresponding tax returns.

SANITY HEARINGS; j

The Commission requested that the County Attorney, Bruce Halliday, report back to them on whose respon-sibility it is to pay Utah County for sanity hearings.

LOCAL OPTIONS SALES TAX DISTRIBUTION;

The Commission met with Blanding Mayor Cleal Bradford, Blanding City Manager Bud Nielson, Monticello

Mayor Kieth Redd, and Monticello City Manager Rick Terry, to discuss the most equitable distribution

of Local options sales taxes. The Cities and the County agreed to send in a corrected statement to the

State for the period between December 1, 1979 and November 30, 1982, which should be acceptable under

the three year retroactive limitation for corrections. It was also agreed to extend the limit to six

miles outside the cities' present boundaries for inclusion in their local options sales tax rolls.

The Cooperative Agreement for fire protection should also be amended to include the same six mile limit.

PRISONER MEAL PAYMENT AGREED UPON;

The Commission discussed the matter of payment for meals served to prisoners in the County Jail, with Blanding Mayor Cleal Bradford, City Manager Bud Nielson, Monticello Mayor Kieth Redd, City Manager Rick Terry, and County Sheriff Rigby Wright. Both cities agreed to pay the cost of meals served to prisoners sentenced by their respective courts. The County agreed to provide the meals for county offenders, juveniles, and felons. The current price per day is $4.00 for maintenance of prisoners in the county jail, The matter of who is responsible for paying medical and hospital bills for prisoners was discussed. It was decided that each case would have to be delt with individually.

OIL AND GAS LEASE/PINNACLE ENERGY, INC.;

The Commission received the five year Oil and Gas Lease as approved on December 20, 1982, between San Juan County and Pinnacle Energy, Inc., along with the $366.99 payment for the lease. Chairman Black signed the lease in behalf of the county.

NUTRITIONAL CONTRACTS FOR 1983 APPROVED;

Upon the motion of Commissioner Low and the second of Commissioner Bailey, it was unanimously voted to approve the 1983 Nutritional Contracts for the Aging Program meals with Patsy Howell of Blanding, Hogie's Restaurant of Monticello, Catherine Johnson of Bluff, and the White Mesa Ute Council. Mr. Al Haskins was authorized to sign the four contracts in behalf of the county.

TELEPHONE EXTENSION FOR RECORDER'S OFFICE;

At the request of County Recorder, Mary Lou Mosher, the Commission authorized an additional telephone

extension to be installed in the Recorders office near Mrs. Moshers desk.
