SAN JUAN COUNTY COMMISSION MEETING MINUTES FEBRUARY 10, 1986
The San Juan County Commissioners met in regular session on February 10, 1986, at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

FREED LEASING COMPANY - SHERIFF'S PICK-UP
Rick Bailey, Administrative Assistant, reported that Freed Leasing Company is willing to grant the Commissioners' request to self-insure the Sheriff's pick-up. Commissioner Bailey made the motion to approve Commissioner Black to sign the following letter. Commissioner Holliday seconded it. UNANIMOUS

SAN JUAN COUNTY'S MINING, OIL AND ASSESSED VALUES
Rick Bailey, Administrative Assistant, gave the Commissioners a book he prepared with the counties mining, oil, and total assessed values. Mr. Bailey said most of the information was from Marian Bayles, Treasurer, and dates back to 1938 on all the assessed values in the county. The Commissioners estimate that the county's assessed valuation will drop approximately $20 million in 1986 due to the mining, oil and utilities. This does not include the loss if production in the Navajo Reservation cannot be taxed by the county. Mr. Bailey will make some more copies of the book for the school district and others.
UTAH ARMY NATIONAL GUARD
Rick Bailey, Administrative Assistant, received the following letter from Captain Wilde, Utah Army National Guard, concerning their earlier visit with the Commissioners.

1. On 21 January 1986, a presentation was made to your county commission by members of the engineer group of the Utah National Guard. Your assistance in granting and scheduling this meeting is appreciated.

3. Our reports and recommendations certainly have been positive to our headquarters. The results of the recruiting efforts to date are likewise positive.
4. We anticipate reaching our projected objectives in the area and will be pleased to be of support and assistance to your communities in the future.

The Commissioners asked Mr. Bailey to write a letter to the Army National Guard expressing the Commissioners appreciation for the visit and hope that the Army will consider establishing a unit in this area.
MONTICELLO AIRPORT WATER TANK
Rick Bailey, Administrative Assistant, reported that the water tank for the Monticello Airport will be delivered this week. Commissioner Bailey said that the road department will install it when it arrives.
LES PRALL - PUBLIC SAFETY BUILDING
Rick Bailey, Administrative Assistant, reported that Les Prall, Association of Governments, will be here tomorrow for the monthly meeting and will help him prepare the Community Impact Application for the public
safety building. Commissioner Bailey suggested that the Commissioners write a letter to both cities stating that the county is going to make the application and ask that they pass a resolution supporting this project; and, also, request that they furnish the County with individual letters from the mayors, city managers, and individual city councilmen. Mr. Rick Bailey will write the letters.
PUBLIC SERVICE COMMISSION - CONTEL TELEPHONE
Rick Bailey, Administrative Assistant, reported on the Public Service Commission hearing that was last Wednesday in which approx. 22 people were present. Mr. Bailey said that representatives from Public Utilities and Contel were there and thought they were very cooperative. Mr. Bailey said that most of people complained about the service in the area and Contel promised to give written replies to the complaints. Commissioner Bailey said that he pointed out that the county has alot of unemployment and are not giving any county raises and feels that other companies should do the same. Contel did agree earlier to lower their proposed increase from 49% to 22%. Mr. Bailey said that the Public Service Commission said they would cooperate with the county any time. Mr. Bailey thanked them for replying to the county's request for hearings.
COUNTY MILEAGE REIMBERSEMEHT RATE
The Commissioners discussed the county's policy on mileage reimbursement rate which is at 20.5 cents per mile. Commissioner Bailey made a motion to raise the mileage rate back to 21 cents per mile. The motion was seconded by Commissioner Black. The voting to raise the county mileage rate to 21 cents was as follows:

DUMP SITES- BLM
Rick Bailey, Administrative Assistant, reported that Annette Jameson, BLM, informed him that the locations for the dump sites are final except at Mexican Hat. Mr. Bailey said that the one at Montezuma Creek has placer claims filed on it and the BLM has not been successful in getting the owners to release the claims. Mr. Bailey said the Ms. Jameson said that the BLM is working on it and asked the county for their cooperation.
HUMAN SERVICES BOARD
Rick Bailey, Administrative Assistant, said that Fern Richey who is on the Human Services Board is out of town temporarily and that Al Haskins expressed an interest in being an alternate for this position. Commissioner Bailey made the motion to approve Al Haskins as alternate to Fern Richey for the Human Services Board. Commissioner Holliday seconded it. UNANIMOUS.
ALCAN ALUMINUM LIMITED
Commissioner Holliday received a letter from M. Dale Slade, a consultant with Alcan Aluminum Limited, concerning a gallium recovery plant. The letter explains that Alcan is planning to construct a gallium recovery plant in the United States and Mr. Slade feels that the Blanding area would be the best feasible location for this plant. Mr. Slade asked for the Commissioners cooperation in writing a letter of interest and support for the Gallium Reclamation facility to be located in the Blanding area. Commissioner Black asked Rick Bailey to write a letter to Alcan supporting this project.
BLANDING CITY ROAD SHED DEED
The Commissioners adopted the following resolution concerning the Blanding city road shed:

MONTICELLO LIBRARY EMPLOYEES
Commissioner Bailey reported that Jim Douglas and Lora Douglas, Monticello Library employees, are going to retire March 1, 1986. Commissioner Bailey said that the county will need to hire a new librarian and applications can be picked up in the clerk's office and need to be submitted to Oleen Hatch or Harold Allen, library board.
WILBUR LAWS AND COUNTY ROAD #207
The Commissioners received the following signed release from Wilbur Laws and Wanda Laws concerning county road #207:
RELEASE
For the sum of $475.00 and other good and sufficient consideration, receipt of which is hereby acknowledged, Wilbur Laws, and Wanda Laws, husband and wife of Blanding, San Juan County, State of Utah, hereinafter LAWS, hereby release San Juan County, a body corporate and politic, whose address is P.O. Box 338, Monticello, Utah, hereafter COUNTY, from any and all liabilities or obligations arising out of, and/or damages to property owned by LAWS for work done by San Juan County, its, employees, and/or agents, in improving and maintaining County Road #207 in the Mustang area of San Juan County during the month of December, 1985, involving COUNTY'S trespass to and removal of top soil and grass from LAWS' land.
LAWS hereby agree to indemnify COUNTY from any claim made against COUNTY by others claiming ownership to the property damaged either by, through, or from LAWS.
This Release shall be binding upon the heirs and assigns of the parties hereto.

OIL FIELDS IN SAN JUAN COUNTY
Commissioner Holliday said it has been rumored that the oil fields in Aneth have not been pumping oil to Houston, Texas, for the last week. Commissioner Black said that there is a surplus of oil in the United States and that the price has dropped. The Commissioners dicussed how this could hurt the county revenue if it is prolonged.
LEGISLATIVE COMMITTEE MEETING
Commissioner Black reported that he attended the Legislative Committee Meeting in Salt Lake last week. Commissioner Black said that a bill by Representative McKeacknie should return 25% of the mineral lease money to the county. This would give San Juan County about $1 million in revenue at present rates.
BLM WILDERNESS PROPOSALS
Commissioner Black reported he attended the BLM meeting in Salt Lake last week in which the BLM released the Utah Wilderness Draft Environmental Impact Study. Commissioner Black said they reviewed the state-wide proposal. The BLM is recommending 1.9 million acres be designated as Wilderness from the original 3.2 million in WSA'S. Commissioner Black said that 359,000 acres is in San Juan County.
DIVISION OF OIL, GAS & MINING
Commissioner Black said that the of Division of Oil, Gas and Mining has been trying to regulate the small miners which have been exempted for the last 12 years. Commissioner Black said that Jimmy Walker, Grand County Conmissioner, and himself went on the Senate floor and Senator Bunnell offered an amendment to keep the exemption of small mines. Commissioner Black said that Senator Finlandson and the Division of Oil, Gas and Mining opposed the amendment. It was put on the calendar the next day for final action along with the amendment and Senator Finlandson got the amendment killed and the bill was passed. Commissioner Black said that the small miners that are left will now be regulated by the State as well as the BLM. This duplicate regulation will hurt the economy of San Juan County and cost the state taxpayers additional unnecessary expenses.
MINERALS WEST - ENERGY FUELS, LTD,
Bill Nielson and Tom Nielson, Minerals West, Inc. met with the Commissioners to ask for approval of Minerals West, Inc. assigning the county's Mi Vida mining to Energy Fuels, Ltd. Commissioner Bailey made the motion to approve the assignment. Commissioner Holliday seconded it.
CONSENT TO ASSIGNMENT
San Juan County, a body corporate and politic of the State of Utah, by and through its duly elected commissioners, hereby gives its written consent for the assignment by Minerals West, Inc., effective the 22nd day of September, 1985 of all of its right, title and interest in and to that certain Lease dated January 13,1975, July 26, 1976, and August 2, 1983 to Energy Fuels, Ltd., a Colorado limited partnership.
San Juan County further certifies that the aforesaid San Juan County Lease is currently in
full force and effect.

TELEPHONE PROPOSALS COURTHOUSE
Gail Johnson, clerk, met with the Commissioners with the telephone proposals for the courthouse. Mrs. Johnson said that she received only one proposal from Chaffee Communications in Colorado. Commissioner Bailey said he would call this company to see the rates and follow up on this.
UAC - MIKE STEWART CAMPAIGN
The Commissioners agreed to make a contribution of $483 to UAC for Mike Stewart's campaign to NACO's 4th vice-president. Comnissioner Bailey made the motion to approve the contribution. Comnissioner Holliday seconded it. UNANIMOUS.
SAN JUAN COUNTY POPULATION ESTIMATE
Comnissioner Black reported that he received a letter from Utah Population Estimate Committee stating that as of July 1, 1985, the county's population was estimated at 12,500. Comnissioner Black said the letter says that if the county doesn't have information to the contrary they will assume it is correct. Comnissioner Black said that the county's population partially determines the county's payment in lieu of taxes and funds for B and C roads, etc.
PIC BOARD
The Commissioners suggested that Comnissioner Holliday be considered to serve on the Private Industry Council Board. Comnissioner Black said that Comnissioner Holliday will need a letter of recommendation from the Development Council Board to submit to the AOG board and the AOG board will have to approve his appointment to the PIC board.
UTAH BLM STATE WILDERNESS DRAFT
Gene Nodine, Ed Scherick, Brent Norton, Alex VanHemert, and Russ Von Koch, BLM, met with Commissioners to present Utah BLM's statewide draft environmental impact statement that was announced last Wednesday. The draft consists of seven volumes based on 3.2 million acres that are included in 82 wilderness study areas. The land is administered by the BLM in Utah until it goes to Congress which could be 1991. Mr. Nodine said that only Congress can designate areas to the National Wilderness Preservation System. Mr. Norton explained that seven alternatives for designating BLM land includes a "proposed action" in which 1.9 million acres in 58 WSAs are suitable. Comnissioner Black pointed out that most of the proposed wilderness is in southeastern Utah which puts restrictions on multiple land use and hurts the cattle men, oil companies and others. Mr. Nodine said that copies of this draft can be obtained at the BLM office in Monticello and the public will have until June 15, 1986, to submit comments. An open house for information will be hosted by the BLM in Moab and Monticello and public hearings will be May 7, 1986, in

Monticello and May 8, 1986, in Moab.
MINING OPERATIONS ON FEDERAL LAND
Commissioner Black asked the BLM what regulations they require on mining operations on federal lands. Mr.
Von Koch said that on five acres or more the BLM requires a plan of operation and under five acres a notice is required fifteen days prior to preceding with the operation. Mr. Nodine said the notice should give the plans of the operation.
SAN JUAN HEALTH CARE SERVICES, INC,
The Commissioners talked with John Fellmethf San Juan Health Care Services,Inc., concerning the local group's proposal to buy the county's health care. The Commissioners told Mr. Fellmeth that the county is not going to turn the accounts receivable over to anyone; but they are willing to sell. Mr. Fellmeth said that his committee discussed this and will offer $450,000 for the accounts receivables and will raise their offer from $800,000 to $1,250,000 and the $150,000 down payment. Commissioner Black said that the
Commissioners have met with the other interested parties and are considering leasing the hospital and are
still accepting offers to sell. Mr. Fellmeth said that he feels that for the county's best interest the
hospital and nursing home should be kept under one owner. Mr. Fellmeth said that San Juan Health Care
Services, Inc. might be interested in making separate proposals.
